Animal ethicists have been debating the morality of speciesism for over forty years. Despite rather persuasive arguments against this form of discrimination, many philosophers continue to assign humans a higher moral status than nonhuman animals. The primary source of evidence for this position is our intuition that humans’ interests matter more than the similar interests of other animals. And it must be acknowledged that this intuition is both powerful and widespread. But should we trust it for all that? The present (...) paper defends a negative answer to that question, based on a debunking argument. The intuitive belief that humans matter more than other animals is unjustified because it results from an epistemically defective process. It is largely shaped by tribalism, our tendency to favor ingroup members as opposed to outgroup members. And this influence is distortive for two reasons. First, tribalism evolved for reasons unrelated to moral truths; hence, it would at best produce true moral beliefs accidentally. Second, tribalism generates a vast quantity of false moral beliefs, starting with racist beliefs. Once this intuition is discarded, little evidence remains that speciesism is morally acceptable. A central question in contemporary ethics and political philosophy concerns which entities have moral status. In this article, I provide a detailed analysis of the view that moral status comes in degrees. I argue that degrees of moral status can be specified along two dimensions: (i) the weight of the reason to protect an entity’s morally significant rights and interests; and/or (ii) the rights and interests that are considered morally significant. And I explore some of the complexities that arise when (...) we link degrees of moral status to the weight of reasons to protect bundles and/or the content and size of these bundles, in particular regarding the attribution of moral status to nonparadigmatic entities (e.g. people with severe cognitive disabilities, children, embryos and foetuses, robots, non-human animals, ecosystems, and rivers). A central puzzle of contemporary moral and political philosophy is that while most of us believe that all or almost all human beings enjoy the same moral status, human beings possess the capacities that supposedly ground moral status to very unequal levels. This paper aims to develop a novel strategy to vindicate the idea of moral equality against this challenge. Its central argument is that the puzzle emerges only if one accepts a usually unstated theoretical premise about value and the (...) proper response to value. The premise holds that if the presence of a valuable property warrants a certain kind of response towards its bearers, then every variation in the degree to which the property is present necessarily constitutes a reason for a corresponding variation in the response that is warranted towards its bearers. It argues that despite its intuitive appeal, the premise is not plausible as a general view about the proper way of responding to value, and as a view about responding to the value of rational beings in particular. It proposes an account of the proper manner of valuing rational beings that supports a distinctive version of the so-called threshold approach to justifying equal moral status. (shrink)

It is fairly commonplace to think that the capacity for sentience need not be the only basis of moral status. Pluralists contend that moral status is grounded in several other valuable capacities as well as, or instead of, sentience, such as agency, empathy, or sociality. However, this contention contrasts with a standard assumption in animal ethics: that sentience should be the only basis of moral status. This article vindicates that assumption. Whilst classical utilitarians have defended a similar claim about sentience (...) in relation to ultimate value, the merits of this view have gone relatively unnoticed in contemporary debates about moral status and animal ethics. An account based on sentience alone avoids conceptual redundancy and has greater explanatory power than pluralist alternatives. An account of moral status based exclusively on sentience also yields two significant and revisionary implications that have not been recognised. First, the distinction between persons and nonpersons cannot hold, so all moral patients, including nonhuman animals, should feature as primary subjects in ethical theories, public policies, and research agendas. Second, we ought to favour nonhuman interests far more often than we tend to suppose. (shrink)

This paper offers several criticisms of the account of rightholding laid out in S. Matthew Liao’s recent paper “The Basis of Human Moral Status.” I argue that Liao’s account both does too much and too little: it grants rightholder status to those who may not deserve it, and it does not provide grounds for offering such status to those who arguably do deserve it. Given these troubling aspects of his approach, I encourage Liao to abandon his “physical basis of moral (...) agency” account of moral status and instead adopt a position closer to a traditional “speciesist” view. As artificial intelligence (AI) continues to proliferate into every area of modern life, there is no doubt that society has to think deeply about the potential impact, whether negative or positive, that it will have. Whilst scholars recognise that AI can usher in a new era of personal, social and economic prosperity, they also warn of the potential for it to be misused towards the detriment of society. Deliberate strategies are therefore required to ensure that AI can be safely integrated (...) into society in a manner that would maximise the good for as many people as possible, whilst minimising the bad. One of the most urgent societal expectations of artificial agents is the need for them to behave in a manner that is morally relevant, i.e. to become artificial moral agents (AMAs). In this article, I will argue that exemplarism, an ethical theory based on virtue ethics, can be employed in the building of computationally rational AMAs with weak machine ethics. I further argue that three features of exemplarism, namely grounding in moral exemplars, meeting community expectations and practical simplicity, are crucial to its uniqueness and suitability for application in building AMAs that fit the ethos of AI4SG. In his article ‘In Defense of Eating Meat’, Timothy Hsiao argued that sentience is not sufficient for moral status, that the pain experienced by an animal is bad but not morally bad, that the nutritional interests of humans trump the interests of animals and that eating meat is permissible. In this article I explore the strengths and weaknesses of Hsiao’s argument, clarify some issues and argue that eating meat is likely in conflict with some of our strongest moral intuitions.

Many approaches to dignity endorse the Human Scope Thesis (HST), according to which almost all humans and almost only humans have dignity. I argue that justifications for this thesis are doomed to fail. Proponents of the HST can be broadly divided into two camps, according to how they defend this thesis against the Scope Challenge. This challenge states that there is no non-arbitrary way of restricting the scope of dignity that includes almost all and almost only humans. Naturalistic Accounts attempt (...) to find a property which roughly matches the HST, while Conventionalist Accounts attempt to explain why endorsing the HST is necessary to achieve coherence with the human rights project. I argue that neither strategy overcomes the Scope Challenge. I then draw out the important implications of this. Even as dignity retains relevance to all humans, it must move beyond the mere human, so as to include nonhuman animals. (shrink)

The substance view is an account of personhood that regards all human beings as possessing instrinsic value and moral status equivalent to that of an adult human being. Consequently, substance view proponents typically regard abortion as impermissible in most circumstances. The substance view, however, has difficulty accounting for certain intuitions regarding the badness of death for embryos and fetuses, and the wrongness of killing them. Jeff McMahan’s time-relative interest account is designed to cater for such intuitions, and so I present (...) a proposal for strengthening the substance view by incorporating McMahan’s account – the Dual-Aspect Account of the morality of killing. I show that it resolves some important issues for the substance view while preserving its central premise of moral equality for all human beings. I then compare the Dual-Aspect Account with McMahan’s Two-Tiered Account of the morality of killing, which he derives from his time-relative interest account. (shrink)

Many theorists think that discrimination is wrongful because it involves treating discriminatees as if they have a lower moral status than others when in fact all people are moral equals. However, there are strong reasons, expounded by Peter Singer and others, to doubt that all people are indeed moral equals. While it may turn out that, ultimately, these reasons can be shown to be unsound, we cannot rule out the possibility that we are not all moral equals. If we are (...) not, discrimination cannot be wrong because it involves failure to treat people as moral equals. With this in mind, I propose two anti-inegalitarian accounts of the wrongness of discrimination – “anti-inegalitarian” rather than “egalitarian” because, strictly speaking, they do not posit equality of status, and “anti-inegalitarian” rather than “inegalitarian” because they reject almost all (and in the case of one of them, all) inequalities in status. These two accounts have many of the attractions of the moral equality account. Being immune to Singerian doubts about moral equality is also a strength of the accounts because it means that they are not hostage to the outcome of the intricate debate over moral equality. Lastly, the anti-inegalitarian accounts I propose are in some ways preferable to the moral equality account because they have certain implications for the wrongness of discrimination that an account given in terms of moral equality does not have, and which egalitarians so far have not theorized. Moral equality—the idea that ‘we’ all have equal moral worth, our interests ought to count for the same, and we possess the same bundle of basic rights—is one of the most central principles of liberal thought, being regularly drawn on as a presupposition of moral and political inquiry. Perhaps because it is so often relied on as a presupposition, however, moral equality is more often assumed than argued for. When moral equality is argued for, the most common tactic is to (...) appeal to some inherent property. As is well established, however, such property-based defenses of moral equality face two significant challenges: the problem of exclusion and the problem of inequality. In light of these challenges, in this article I put forward a new, revisionist account of moral equality. Taking inspiration from recent work in the social metaphysics of human kinds, I argue that moral equality ought to be seen as a component of a status that we confer on one another, rather than (grounded in) a property inherent in certain individuals. Conceiving of moral equality this way, I argue, side-steps both the problem of exclusion and the problem of natural equality. (shrink)

Secular arguments for equal and exclusively human worth generally tend to follow one of two strategies. One, which has recently gained renewed attention because of a novel argument by S. Matthew Liao, aims to directly ground worth in an intrinsic property that all humans have in common, whereas the other concedes that there is no morally relevant intrinsic difference between all humans and all other animals, and instead appeals to the membership of all humans in a special kind. In this (...) article, I argue that both strategies necessitate drawing a line that is both arbitrary and implausibly opens a moral gulf between individuals whose difference from one another in terms of empirical reality is entirely unremarkable, providing reasons to reject them that go beyond the standard objections in the literature. I conclude that, if all humans are to be included in the community of equals, we must lay to rest the idea that we can do so without also including a wide range of non-human animals. (shrink)

This article presents an argument for veganism, using a formal-axiomatic approach: a list of twenty axioms are explicitly stated. These axioms are all necessary conditions to derive the conclusion that veganism is a moral duty. The presented argument is a minimalist or core argument for veganism, because it is as parsimonious as possible, using the weakest conditions, the narrowest definitions, the most reliable empirical facts and the minimal assumptions necessary to reach the conclusion. If someone does not accept the conclusion, (...) logical consistency requires that s/he should be able to point at axiom on which s/he disagrees. Philosophers struggle to explain why human beings with deep cognitive impairments have a higher moral status than certain non-human animals. Modal personism promises to solve this problem. It claims that humans who lack the capacities of “personhood” and the potential to develop them nonetheless could have been persons. I argue that modal personism has poor prospects because it's hard to see how we could offer a plausible account of modal personhood. I search for an adequate understanding of modal personhood by (...) considering existing accounts and sketching new ones. But each account fails, either because it objectionably excludes some deeply cognitively impaired humans from the class of modal persons or because it makes modal personhood doubtfully relevant to moral status. And the modal personist cannot solve this problem by appealing to the misfortune suffered by modal persons. (shrink)

This is a big-picture discussion of an important implication of Darwinism for ethics. I argue that there is a misfit between our scientific view of the natural world and the view, still dominant in academic philosophy and wider society alike, that there is a discrete hierarchy of moral status among conscious beings. I will suggest that the clear line of traditional morality – between human beings and other animals – is a remnant of an obsolete moral outlook, not least because (...) it has no counterpart in empirical reality, and I will invite the reader to think, with me, about tenable alternatives. Agnieszka Jaworska and Julie Tannenbaum recently developed the ingenious and novel person‐rearing account of moral status, which preserves the commonsense judgment that humans have a higher moral status than nonhuman animals. It aims to vindicate speciesist judgments while avoiding the problems typically associated with speciesist views. We argue, however, that there is good reason to reject person‐rearing views. Person‐rearing views have to be coupled with an account of flourishing, which will (according to Jaworska and Tannenbaum) be either a species norm (...) or an intrinsic potential account of flourishing. As we show, however, person‐rearing accounts generate extremely implausible consequences when combined with the accounts of flourishing Jaworska and Tannenbaum need for the purposes of their view. In this article, a concise argument for computational rationality as a basis for artificial moral agency is advanced. Some ethicists have long argued that rational agents can become artificial moral agents. However, most of their views have come from purely philosophical perspectives, thus making it difficult to transfer their arguments to a scientific and analytical frame of reference. The result has been a disintegrated approach to the conceptualisation and design of artificial moral agents. In this article, I make the argument (...) for computational rationality as an integrative element that effectively combines the philosophical and computational aspects of artificial moral agency. This logically leads to a philosophically coherent and scientifically consistent model for building artificial moral agents. Besides providing a possible answer to the question of how to build artificial moral agents, this model also invites sound debate from multiple disciplines, which should help to advance the field of machine ethics forward. While most theorists agree with the claim that human beings have high and equal moral standing, there are strong disagreements about how to justify this claim. These disagreements arise because there are different ways of managing the difficulty of finding a basis for this claim, which is sufficiently substantial to do this justifying work, but not vary in degree in order to not give rise to inequality of moral considerability. The aim of this paper is to review previous attempts to (...) address this difficulty and to demonstrate why they fail and then to defend another way of dealing with this challenge by applying two views: the substance view on the human person and the natural-law account of morality. My claim is that this approach has comparative advantages because it provides a binary and a normatively significant basis of justification for equality without being implausibly inclusive. (shrink)

Christopher Grau argues that the genetic basis for moral agency account of rightholding is problematic because it fails to grant all human beings the moral status of rightholding; it grants the status of rightholding to entities that do not intuitively deserve such status; and it assumes that the genetic basis for moral agency has intrinsic/final value, but the genetic basis for moral agency only has instrumental value. Grau also argues that those who are inclined to hold that all human beings (...) are rightholders should reconsider speciesism. In this paper, I argue that Grau's objections do not undermine the genetic basis for moral agency account of rightholding, and I also offer criticisms of Grau's defense of speciesism. (shrink)

In the last decade, the study of moral heuristics has gained in importance. I argue that we can consider speciesism as a moral heuristic: an intuitive rule of thumb that substitutes a target attribute (that is difficult to detect, e.g. “having rationality”) for a heuristic attribute (that is easier to detect, e.g. “looking like a human being”). This speciesism heuristic misfires when applied to some atypical humans such as the mentally disabled, giving them rights although they lack rationality. But I (...) argue that it is not necessarily irrational or inconsistent to hold on to this heuristic rule, because we have to take time and knowledge constraints, uncertainty aversion and emotional costs into account. However, this “heuristic defense” of speciesism uses a target attribute (rationality) that has implications of disrespect towards some atypical humans. Therefore, based on notions of impartiality and compassion, I argue for a morally better target attribute: sentience (“having a sense of well-being”). “Being a vertebrate” is suitable as a corresponding heuristic attribute because it is easy to detect and has a strong correlation with the target attribute of sentience. Peter Singer famously argues that speciesism, like racism and sexism, is based on a preju-dice. As Singer argues, since we reject racism and sexism, we must also reject speciesism. Since Singer articulated this line of reasoning, it has become a widespread argument against speciesism. Shelly Kagan has recently critiqued this argument, claiming that one can endorse speciesism with-out doing so on the basis of a prejudice. In this paper, I defend Kagan’s conclusion (that one can endorse speciesism without being prejudiced). (...) However, many philosophers have found Kagan’s argument deeply unsatisfactory; so, I advance an alternative argument, different from Kagan’s, in support of his conclusion. My argument runs as follows: I argue that, if there is epistemic peer dis-agreement about a view, then the parties to this disagreement cannot reasonably label each other as prejudiced in their beliefs about this view. Then, I argue that there is epistemic peer disagreement about the truth of speciesism, from which it follows that the parties to this disagreement cannot rea-sonably label each other as prejudiced. Thus, one can affirm speciesism without being prejudiced. If I am correct that one can affirm speciesism without being prejudiced, then Singer’s argument (that if one rejects racism, one must reject speciesism) is unsound. (shrink)

Paternalism is widely viewed as presumptively justifiable for children but morally problematic for adults. The standard explanation for this distinction is that children lack capacities relevant to the justifiability of paternalism. I argue that this explanation is more difficult to defend than typically assumed. If paternalism is often justified when needed to keep children safe from the negative consequences of their poor choices, then when adults make choices leading to the same negative consequences, what makes paternalism less justified? It seems (...) true that ordinary adults have capacities enabling them to promote their interests in ways most children lack. This can explain why paternalism is more often justified towards children than adults. What is not explained, however, is why paternalism would be justifiable for children, but not adults, when neither possess the relevant interest-promoting capacities—exactly the cases when paternalism towards adults might be considered. I argue that this dilemma undercuts capacities-based explanations for the belief that childhood is distinctively relevant for the permissibility of paternalism. I then address defenses of both consequentialist and deontological versions of the capacities-based explanation. Absent this capacities-based explanation, I argue that the intuition that less demanding justificatory standards apply to paternalism when directed at children than when directed towards adults presents unresolved problems for egalitarians. A number of philosophers have found inspiration in the writings of Alfred Whitehead to develop their ideas on environmental and animal ethics. I explore the writings of Charles Hartshorne and Daniel Dombrowski to address the question of whether Whiteheadians should be vegetarians. I conclude that there is a morally relevant distinction between plants and animals, based on the Whiteheadian view that animals have higher grades of experience, and that this distinction grounds a moral duty to adopt minimal moral veganism.

Non-human animal models of human diseases advance our knowledge of the genetic underpinnings of disease and lead to the development of novel therapies for humans. While mice are the most common model organisms, their usefulness is limited. Larger animals may provide more accurate and valuable disease models, but it has, until recently, been challenging to create large animal disease models. Genome editors, such as Clustered Randomised Interspersed Palindromic Repeat, meet some of these challenges and bring routine genome engineering of larger (...) animals and non-human primates well within reach. There is growing interest in creating NHP models of brain disorders such as autism, depression and Alzheimer’s, which are very difficult to model or study in other organisms, including humans. New treatments are desperately needed for this set of disorders. This paper is novel in asking: Insofar as NHPs are being considered for use as model organisms for brain disorders, can this be done ethically? The paper concludes that it cannot. Notwithstanding ongoing debate about NHPs’ moral status, animal welfare concerns, the availability of alternative methods of studying brain disorders and unmet expectations of benefit justify a stop on the creation of NHP model organisms to study brain disorders. The lure of using new genetic technologies combined with the promise of novel therapeutics presents a formidable challenge to those who call for slow, careful, and only necessary research involving NHPs. But researchers should not create macaques with social deficits or capuchin monkeys with memory deficits just because they can. (shrink)

Mitochondrial replacement techniques are designed to allow couples to have children without passing on mitochondrial diseases. Recently, Giulia Cavaliere and César Palacios-González argued that prospective parents have the right to use MRTs to pursue genetic relatedness, such that some same-sex couples and/or polygamous triads could use the process to impart genetic relatedness between a child and more of its caregivers. Although MRTs carry medical risks, Cavaliere and Palacios-González contend that because MRTs are identity-affecting, they do not cause harm to an (...) existing human being, and our intuitions otherwise arise from the non-identity problem. Here, I review several attempts to address the non-identity problem, and propose a solution to the problem. Furthermore, I argue that regardless of one’s stance on whether MRTs are identity-affecting, the use of MRTs to pursue genetic relatedness alone falls outside the scope of the medical profession, as they involve substantive medical risk for no medical benefit. Concern with ethical anthropocentrism has largely been confined to debates in animal and environmental ethics. Philosophers generally have shown little interest in it. Ethical egoism, by contrast, though usually rejected, has sparked wide philosophical interest. This is surprising, for the two are akin; anthropo-centrism is egoism writ large – the egoism of the human species. This paper explains the kinship by articulating this analogy, shows that the analogy provides for each argument for or against ethical egoism an analogous argument for (...) or against ethical anthropocentrism, and demonstrates the analogy's fruit-fulness by using it to extrapolate from an existing argument against ethical egoism a novel argument against ethical anthropocentrism. Advances in reproductive genetic engineering have the potential to transform human lives. Not only do they promise to allow us to select children free of diseases, they can also enable us to select children with desirable traits. In this paper, I consider two clusters of arguments for the moral permissibility of reproductive genetic engineering, what I call the Perfectionist View and the Libertarian View; and two clusters of arguments against reproductive genetic engineering, what I call the Human Nature View and (...) the Motivation View. I argue that an adequate theory of the ethics of reproductive genetic engineering should take into account insights gained from these views. (shrink)

This article engages with debates concerning the moral worth of human beings with profound intellectual and multiple disabilities (PIMDs). Some argue that those with such disabilities are morally less valuable than so-called normal human beings, whereas others argue that all human beings have equal moral value and so each group of humans ought to be treated with equal concern. We will argue in favor of a reconciliatory view that takes points from opposing camps in the debates about the moral worth (...) of humans with PIMDs. The view in question, roughly, is this: most humans with PIMDs are persons in the morally significant sense and so deserve equal moral consideration to so-called normal human beings. Some humans with PIMD may not, however, be persons, but nevertheless deserve equal moral consideration to persons because they stand in a special relation to persons. (shrink)

This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

To provide a theoretical basis for the common view that moral status comes in degrees, many philosophers endorse ‘two-factor’ accounts of the foundations of moral status. These accounts postulate one or more properties which endow individuals with moral status, and one or more other properties which increase the moral status of those who possess them. Critical assessment of two-factor accounts has focused on their implications, especially for humans who lack the properties thought to increase individuals’ moral status. Unfortunately, this approach (...) has led to an impasse. To try to break it, the present manuscript instead assesses the assumption on which two-factor accounts are based, namely, possession of one or more properties, what I call ‘moral status enhancing’ properties, increases their possessors’ moral status. I argue that two challenges, the problem of relevance and the need for a threshold, reveal that there are no moral status enhancing properties, hence, no degrees of moral status among those who matter morally. According to a diverse and widely popular family of moral theories, there is a class of individuals – typically humans or persons – who have the very same, full moral status. Individuals not falling into that class count for less, or not at all, morally speaking. In this article, I identify two problems for such theories, the mapping problem and the problem of misgrounded value, and argue that they are serious enough to be decisive. I will then propose an alternative (...) account of full and equal moral status that avoids those problems. In grounding full moral status in phenomenal consciousness, it preserves the idea that you and I are equal, but at the same time radically expands the community of moral equals. I conclude by discussing some practical implications of my proposal. (shrink)

Creating simulations of the world can be a valuable way to test new ideas, predict the future, and broaden our understanding of a given topic. Presumably, the more similar the simulation is to the real world, the more transferable the knowledge generated in the simulation will be and, therefore, the more useful. As such, there is an incentive to create more advanced and representative simulations of the real world. Simultaneously, there are ethical and practical limitation to what can be done (...) in human and animal research, so creating simulated beings to stand in their place could be a way of advancing research while avoiding some of these issues. However, the value of representativeness implies that there will be an incentive to create simulated beings as similar to real-world humans as possible to better transfer the knowledge gained from that research. This raises important ethical questions related to how we ought to treat advanced simulated beings and consider if they might have autonomy and wellbeing concerns that ought to be respected. As such, the uncertainty and potential of this line of research should be carefully considered before the simulation begins. (shrink)

I show that an overlooked feature of our moral life—moral status—provides a route to vindicating naturalist moral realism in much the same way that the Humean theory of motivation and judgment internalism are used to undermine it. Moral status presents two explanatory burdens for metaethical views. First, a given view must provide an ecumenical explanation of moral status, which does not depend on the truth of its metaethical claims (say, that there are mind-independent facts about moral status). Second, its explanation (...) must be consistent with persistent normative ethical disagreement about what constitutes moral status. I conclude that naturalist moral realism succeeds, while quasi-realism fails because it cannot meet the latter requirement. This argument has three results: we have a new route for metaethical vindication more generally and for naturalist moral realism in particular; quasi-realism's plausibility is undermined by an inability to explain disagreement, but not for the familiar reasons. Abstract In a recent issue of Neuroethics , I considered whether the notion of human dignity could help us in solving the moral problems the advent of the diagnostic category of minimally conscious state (MCS) has brought forth. I argued that there is no adequate account of what justifies bestowing all MCS patients with the special worth referred to as human dignity. Therefore, I concluded, unless that difficulty can be solved we should resort to other values than human dignity in (...) addressing the moral problems MCS poses. In his new book Christopher Kaczor criticizes the argument I put forward. Below, I respond to Kaczor’s criticism. I maintain that the considerations he presents do not undermine my argument nor succeed in providing adequate justification for the view that all MCS patients possess the worth referred to as human dignity. Just as one line appears to be longer than another in an optical illusion, we can have a spontaneous moral judgment that one individual is more important than another. Sometimes such judgments can lead to moral illusions like speciesism and other kinds of discrimination. Moral illusions are persistent spontaneous judgments that violate our deepest moral values and distract us away from a rational, authentic ethic. They generate pseudo-ethics, similar to pseudoscience. The antidote against moral illusions is the ethical principle to (...) avoid unwanted arbitrariness. Speciesism involves unwanted arbitrariness, and psychological research as well as the problem of wild animal suffering demonstrate that moral illusions such as speciesism can be very persistent. This thesis takes up a rights-based perspective to discuss a number of issues related to the problem of permissible harm. It appeals to a person’s capacity to shape her life in accordance with her own ideas of the good to explain why her death can be bad for her, and why each of us should have primary say over what may be done to her. The thesis begins with an investigation of the badness of death for the person who dies. (...) If death is bad for us, this helps explain the wrongness of killing. The thesis defends the deprivation account—i.e. the idea that death is bad for us when and because it deprives us of good life—against two Epicurean challenges. It adds that death is also bad when and because it thwarts our agency. Next, the thesis deals with the logic of our moral rights to non-interference. It proposes a conception of rights according to which the stringency of our rights derives from and is justified by the rational aspect of our human nature. It argues that this conception of moral rights solves the paradox of deontology. While our rights to non-interference are stringent, they are not absolute. The thesis considers two possible exceptions to the general rule that it is impermissible to harm an innocent person against her consent. First, using an actual case from WWII, it investigates the circumstances under which a government may expose some parts of its population to an increased risk of harm in order to decrease the risk to others. Second, it considers the permissibility of self-defence against an innocent threat. It argues that the potential victim of an innocent threat has a justice-based reason to treat her own interests as on a par with those of the threat. (shrink)

ABSTRACTIt has become a commonplace that human beings possess human rights ‘simply in virtue of being human’. Exactly what this formula entails and whether it is cogent remains largely obscure, however. To remedy this situation, the article distinguishes between an interpretation of the formula according to which ‘being human’ is a practical condition for holding human rights and a reading which takes ‘being human’ to be a moral reason for holding human rights. It argues that only under the second reading (...) is there a limited sense in which it is correct that human beings possess human rights ‘simply in virtue of being human’. The article also considers if the concept of human dignity can provide a more convincing approach to the formula, and argues that it cannot. (shrink)

According to the social ontology proposed by John Searle, there are ontologically objective facts or “brute facts”, independent from human attitudes, and ontologically subjective facts. Among the latter, the most notable are institutional facts, such as money or borders, which existence is explained through a collective attribution of status function within a certain social context. Could “moral truths” exist according to an ontology like this? Assuming the truth as correspondence, the notion of “moral truth” remits to the notion of “moral (...) fact”. As we will see, these moral facts, contrary to what authors such as Markus Gabriel suggest, are similar to institutional facts. For this reason, the truth or falsity of moral statements will be, as indicated by authors such as Gilbert Harman, relative to a social context; without that being an obstacle for acknowledging their expressive and directive function. Dignity is traditionally thought to apply to almost all and almost only humans. However, I argue that an account of a distinctly human dignity cannot achieve a coherent and non-arbitrary justification; either it must exclude some humans or include some nonhumans. This conclusion is not as worrying as might be first thought. Rather than attempting to vindicate human dignity, dignity should extend beyond the human, to include a range of nonhuman animals. Not only can we develop a widely inclusive account (...) of dignity by pursuing this route, but we can still defend the three core principles that lie at the heart of contemporary thinking about dignity: that bearers of dignity possess dignity to an equal degree, in virtue of possessing the same intrinsic worth, and that this generates direct and claimable rights. I thus develop an account of dignity that includes nonhuman animals. I argue that the capacity to value most plausibly grounds dignity. This capacity arises from valenced sentience: a being values insofar as they have experiences that matter to them. I then characterise what follows from this. First, I contend that it is only the capacity to value grounds dignity because this produces the most plausible, simplest, and most explanatorily powerful account of dignity. We ought to reject pluralist accounts which assert a sharp distinction between bearers and non-bearers of rational agency, and biocentric accounts which include non-sentient organic entities. Second, I argue this property grounds an account of dignity that is non-hierarchical. There are no degrees of dignity. Instead, all possessors of the capacity to value have the same kind of intrinsic value, and the same equal fundamental right: to consideration of their interest in leading a life of value. Finally, I argue that since the fundamental right is to consideration, moral agents have claimable duties to engage in a deliberative procedure with actionable requirements. Specific rights are instantiations of this general procedure. Certain revisionist conclusions follow on my view, for instance, that nonhumans should be given greater weight and inclusion in a far wider range of cases, but my account is sensitive to the range of different things different beings value, so it does not generate counterintuitive implications. Health care insurance schemes, whether private or public, are notoriously unaccommodating to individuals with disabilities. While most nonelderly nondisabled persons in the U.S. are insured through private sources, coverage sources for nonelderly persons with disabilities have traditionally been a mix of private and public coverage. For all age groups, the employment-to-population ratio is much lower for persons with a disability than for those with no disability. Moreover, employed persons with a disability were more likely to be self-employed than those with (...) no disability. As a group, therefore, nonelderly people with disabilities have not been as well positioned as others to obtain private health care insurance because in the U.S., acquiring such coverage usually is employer based.
