This paper reviews a publication entitled ‘Ethics Matters. Managing Ethical Issues in Higher Education’, which was distributed to all UK universities and equivalent in October 2005. The publication proposed that HEIs should put in place an institution‐wide ethical policy framework, well beyond the customary focus on research ethics, together with the mechanisms necessary to ensure its implementation. Having summarised the processes that led to the publication and the publication itself, the paper then considers whether following the now commonplace corporate practice (...) of implementing a code of ethics is appropriate for such institutions. Drawing on both the empirical evidence in relation to codes in the business ethics literature and a consideration of the nature of the university as an institution, the paper offers an alternative suggestion for how ethical issues in higher education might be managed. This paper extends previous discussions of corporate character and corporate virtues. By drawing particularly on the work of Alasdair MacIntyre, it offers a perspective on context-dependent categories of the virtues. It then provides a philosophically grounded framework which enables a discussion of which virtues are required for business organizations to qualify as virtuous. It offers a preliminary taxonomy of such corporate virtues and provides a revised definition of corporate character.

From folk tales to movies, stories possess features which naturally suit them to contribute to the growth of virtue. In this article I show that the fictional exemplars help the learner to grasp the moral importance of internal states and resolves a tension between existing kinds of exemplars discussed by virtue ethicists. Stories also increase the information conveyed by virtue terms and aid the growth of prudence. Stories can provide virtuous exemplars, inform learners as to the nature of the virtues (...) and offer practice in developing situational judgement. As such they are a significant resource for virtue ethics and moral education. (shrink)

The article provides a focused overview of the recent debates in political philosophy on the role of religious arguments (as reasons for action) in liberal democracy, as well as a preliminary defence of a particular approach to the issue. Drawing on Christopher Eberle’s typology, we distinguish three main camps – Justificatory Liberalism, basing its advocacy of a “doctrine of religious restraint” on Rawls’s account of public justification; its Liberal Critics, embracing a wholly permissive position vis-à-vis religious arguments in the public (...) sphere; and New Traditionalism, which assigns priority to the religious rationale. The article deals in more detail with the exchange between the first two camps. Upon considering their strengths and weaknesses, we argue for a more robust “third way” between exclusion from and unqualified inclusion of religious arguments in public debates in liberal democracy. Inspired by the work of Gerald Gaus and Kevin Vallier, we the outline in the closing sections a framework of such “minimal justificatory liberalism” that steers clear of several errors shared by both the defenders and the critics of justificatory liberalism. This paper formulates the categories of "ethics," "self," and "subject" for an analysis of classical rabbinic ethics centered on the text, "The Fathers According to Rabbi Nathan." Early rabbis were concerned with the realms of life that today's scholars describe as ethics and self-cultivation, yet they had no overarching concepts for either the self/person or for ethics. This analysis, then, cannot rely only upon native rabbinic terminology, but also requires a careful use of contemporary categories. This paper first sets out (...) basic features of "Rabbi Nathan" and presents appropriate formulations of the relevant scholarly terms. The latter sections address possibilities for employing and revising these categories in descriptive and comparative studies more broadly, first surveying relevant scholarship on Christian, Muslim, and Manichaean sources, and then turning to ancient East Asian sources with a particular focus upon passages in the "Zhuangzi". Modern medicine faces fundamental challenges that various approaches to the philosophy of medicine have tried to address. One of these approaches is based on the ancient concept of phronesis. This paper investigates whether this concept can be used as a moral basis for the challenges facing modern medicine and, in particular, analyses phronesis as it is applied in the works of Pellegrino and Thomasma. It scrutinises some difficulties with a phronesis-based theory, specifically, how it presupposes a moral community of professionals. (...) It is argued that Pellegrino and Thomasma's concept of phronesis corresponds to a Hippocratic concept of t�chn�, and that this latter concept seems to address many of the challenging issues Pellegrino and Thomasma also address. Thus, if modern medicine is to find its philosophical model in ancient concepts, it appears that the Hippocratic t�chn� is closer to the ancient concept of medicine than the Aristotelian phronesis, and that it might avoid many of the pitfalls of a phronesis-based approach. This paper starts from the presupposition that moral codes often do not suffice to make agents understand their moral responsibility. We will illustrate this statement with a concrete example of engineers who design a truck’s trailer and who do not think traffic safety is part of their responsibility. This opinion clashes with a common supposition that designers in fact should do all that is in their power to ensure safety in traffic. In our opinion this shows the need for a (...) moral philosophy that helps engineers to interpret their responsibility and think more critically about it. For this purpose we will explore the moral philosophy of Alasdair MacIntyre, which is particularly interesting because he locates the beginning of moral thinking in the daily practice of a profession. This is consistent with the history of moral codes, for codes are also the product of moral reflection by professionals. We will use MacIntyre’s philosophy to (1) explain what is wrong with the designers’ understanding of their responsibility and (2) show a possible way to bring their reflection to a more self-critical level. Building on influential work in virtue ethics, this collection of essays examines the categories of self, person, and anthropology as foci for comparative analysis. The papers unite reflections on theory and method with descriptive work that addresses thinkers from the modern West, Christian and Jewish Late Antiquity, early China, and other settings. The introduction sets out central methodological issues that are subsequently taken up in each essay, including the origin of the categories through which comparison proceeds, the status of these (...) categories in the process of comparison, and the goals of comparison. In considering the question of goals, the introduction draws connections between comparative study and historical study within one tradition. Both types of analysis can bridge the gap between historical and normative work by attending to the ways in which the questions a scholar asks - not just the answers found - vary from one context to another. The most interesting and perilous issue at present in comparative religious ethics is comparative ethical judgment—when and how to judge others, if at all. There are understandable historical and conceptual reasons for the current tendency to prefer descriptive over normative work in comparative religious ethics. However, judging those we study is inescapable—it can be suppressed or marginalized but not eliminated. Therefore, the real question is how to judge others (and ourselves) well, not whether to judge. Instead of bringing supposedly universal (...) moral scoring systems to bear on reified "traditions" and "cultures," it would be better to focus on the precise details of particular practices, motifs, and theories in various settings, and compare them with an eye to substantive issues of current ethical concern. In South Africa there is widespread recognition amongst university educators that the new outcomes‐based education system can prevent instrumental thinking, particularly in view of OBE's agenda to encourage critical learning. However, what these educators do not necessarily take into account is that many students are not always ready to deal with critical learning because of the apparent persistence of instrumental thinking at some universities in South Africa. Simply put, many students seem to be quite willing to be taught about some (...) of the ends of education, rather than the reasons behind these ends. With this idea of desired student learning in mind, in this article, I argue that it has become necessary to fulfil the promise of democratic justice on the African continent through educating for friendship, rather than perpetuating uncritical modes of learning which could further extend the violation of human dignity on the African continent. Reflecting on several moments in my classroom pedagogy and conversations with colleagues at different universities, I firstly argue that critical learning cannot be blind to prescriptiveness, since students have to be made attentive in some way to the public realm of a democratic post‐apartheid South Africa and post‐colonial Africa. In short, they have to be taught what it means to be democratically just. Thereafter, I argue that teaching students about democratic justice can entail critical learning and, hence, be non‐instrumental, provided that university educators become more responsible educators. Finally, I examine how actions can potentially fulfil the democratic justice project, the success of which is so desperately needed on the African content. (shrink)

ABSTRACTIn this paper, I trace out Alasdair MacIntyre’s assessment of managerial capitalism as a uniquely positioned critique occupying an intersection between the sociology of knowledge, ideology critique, and social science metatheory. The first part of this paper outlines MacIntyre’s historical claim that social science principles diffused into an ‘industrial social science’ in the first half of the twentieth century. Tracing out this history allows us to identify four major categories of critique levelled against managerialism, spanning managerialism’s practices to its social (...) location as a discourse of scientific, objective knowledge. That four category typology provides a framework to understand MacIntyre’s specific critique of managerialism as concerned primarily with metatheoretical flaws. MacIntyre's argument provides a valuable sociological account of how flawed presuppositions lend to the creation of flawed descriptions of social reality. These descriptions come to serve as the ‘ideology of bureaucratic control’ when taken up as authoritative knowledge of organizational dynamics. (shrink)

Debates about preserving, modifying and applying sharia through principles of taqlid or ijtihad are immensely useful in thinking through a sharper definition of tradition for political theorists and historians of political thought more generally. Political theorists and historians of political thought have tended to use tradition in a range of ways without specifying key elements of the concept. Building on debates in Islamic thought related to taqlid and its relationship to ijtihad, and through a focus on the ideas of a (...) contemporary thinker, Javed Ahmed Ghamidi, this paper proposes that tradition in political thought can be defined as a framework for knowledge production and consumption constituted of two key elements: method and sensibility. Further, the paper suggests that this definition allows us a better understanding of vibrancy in a tradition: vehement debate, contradictions and internal contestation are not signs of decay but of vitality within a tradition. It is the severe delinking of the two elements of a tradition, method and sensibility, which has greater potential to reduce its vibrancy. (shrink)

Religious considerations in medical decision-making have enjoyed newfound attention in recent years, challenging the assumption that the domains of biological and spiritual flourishing can be cleanly separated in clinical practice. A surprising majority of patients desire their physicians to engage their religious and spiritual concerns, yet most never receive such attention, particularly in cases near the end of life where such attention seems most warranted.1–3 As physicians Aparna Sajja and Christina Puchalski recently wrote in the AMA Journal of Ethics theme (...) issue on ‘Religion and Spirituality in Healthcare Practice’, modern medical training is ‘falling short of preparing physicians to help patients with the metaphysical needs of their illness’.4 It would seem then that both patients and physicians might challenge the conclusions proffered by philosophers Jake Greenblum and Ryan Hubbard in ‘Responding to Religious Patients: Why Physicians Have No Business Doing Theology’, in which they claim that physicians ought not to engage religious reasoning for medical decisions. Their conclusion relies on two core arguments: a ‘public reason’ argument and a ‘fiduciary argument’, both of which contend that theology and religious considerations have no place in medical reasoning. We find that two central errors undergird these arguments. First is the fraught notion of an epistemically and ethically normative public reason, and second is a fundamental mischaracterisation of the fiduciary nature of the patient–physician relationship and the nature of medicine itself. In response, we argue that all physicians essentially ‘do theology’ and that, rather than divorcing theology from medical practice, clinicians should make it their business to do theology well. To support the exclusion of religious reasoning from medical decision-making, the authors open with a ‘public reason argument’, suggesting that physicians serve in roles closely resembling those of public officials. Alasdair MacIntyre has developed a theory of the rationality of traditions that is designed to show how we can maintain both the tradition-bound nature of rationality, on the one hand, and non-relativism, on the other. However, his theory has been widely criticized. A number of recent commentators have argued that the theory is either inconsistent with his own conception of rationality or else is dependent on the standards of his particular tradition and therefore fails to defuse the threat of relativism. James Turner Johnson is the foremost scholar of the just war tradition working today. His treatment of the historical development of the just war tradition has been hugely important, influencing a generation of theorists. Despite this, Johnson's work has not generated much in the way of critical commentary or analysis. This paper aims to rectify this oversight. Engaging in a close and critical reading of Johnson's work, it claims that his historical reconstruction of the just war tradition is bounded by (...) two key thematic lines — the imperative of vindicative justice and the ideal of Christian love — and occasionally betrays an excessive deference to the authority of past practice. By way of conclusion, this paper sums up the promise and limits of Johnson's approach, and reflects upon its contribution to contemporary just war scholarship. (shrink)

Atheists are rarely associated with holiness, yet they can have deeply spiritual experiences. Once such experience of the author exemplified ‘the holy’ as defined by Otto. However, the subjectivism of Otto’s Kantianism undermines Otto’s otherwise fruitful approach. While the work of Hegel overcomes this, it is too rationalistic to account for mortal life. Seeking to avoid these shortcomings, this paper places ‘holiness’ within a self-differentiating ontological unity, the Heideggerian ‘fourfold’. This unity can only be experienced by confronting groundless finite mortality, (...) and the resulting existential disposition is characterized as ‘reverence’. Reverence is gratitude for mortal existence, and existence itself. Moreover, it is as much political as it is ontological, atheistic as it is theistic. (shrink)

This paper aims to show that by confronting the ethical alternatives proposed by Nietzsche and MacIntyre as resulting of their critical analyses of the modern moral condition respectively done in Genealogy of the Morals and After Virtue , we can find shared theoretical presumptions that point to those alternatives as convergent in many cases and not simply as excluding each other, even in a opposed direction to the MacIntyre’s point of view concerning that issue.

In recent years, organisational theorists have been interested in the tensions faced by healthcare organisations. In this paper, these tensions are examined using the virtue approach to ethics of Alasdair MacIntyre. It is argued that although MacIntyre's framework shares many concerns with organisational studies, it supplements the analysis with a focus on moral content and evaluation. By providing moral evaluation of the stories told in organisations, an ethical analysis compels action on a basis that organisational studies does not. Nevertheless, it (...) is the analysis of stories in organisation studies that provides the tools for taking action. The analysis presented here provides an example of how ethics and organisational studies can be brought together to provide a stronger analysis of organisational phenomena. Indeed, it provides support for Nielsen's position that organisational theory and ethics are co‐dependent and suggests that greater attention should be paid to ethical concepts in the study of organisational phenomena. Virtue and deontological ethics are now commonly contrasted as rival approaches to moral inquiry. However, I argue that neither metaethical party should seek complete, solitary domination of the ethical domain. Reductive treatments of the right or the virtuous, as well as projects that abandon the former or latter, are bound to leave us with a sadly diminished map of the moral territories crucial to our lives. Thus, it is better for the two parties to seek a more cordial and equal (...) relationship, one that permits metaethical pluralism, and acknowledges mutual dependence. I do not seek to prescribe how that relationship should look: this essay offers less a positive metaethical position than a prolegomenon to such a position, one that attempts to head off harmful attempts to reduce the territory of the aretaic to that of the deontic, or that of the deontic to the aretaic. Los enfoques educativos del problema de la incivilidad tienden a concentrarse bien sea en inculcar hábitos cívicos, o en promover el desarrollo de competencias sociomorales. Sin embargo, en “Tras la virtud”, Alasdair MacIntyre identificó a la estructura misma del discurso moral moderno como una fuente de incivilidad. MacIntyre sostiene que la naturaleza incivil del discurso moral moderno es en parte el resultado de la inconmensurabilidad conceptual y de las bases no racionales de las premisas fundamentales de cada bando. A causa (...) de tal estructura, los debates eventualmente se reducen a una simple seguidilla de afirmaciones y contra-afirmaciones que pronto frustra a ambas partes, dando paso a intercambios estridentes e inciviles. MacIntyre recomienda al discurso dialéctico como un medio para lograr que tales debates resulten más productivos y cívicos. En el presente artículo me centro en la extensión que Daniel Vokey hace de la concepción dialéctico-discursiva de MacIntyre, para explorar sus implicaciones en el terreno de las prácticas educativas que se proponen mitigar la incivilidad. After tracing the rise in interest in the phenomenon of interpretation to events in the early post-Kantian period, I argue that this development is highly relevant to understanding contemporary philosophy's methodological status and its relation to fields such as science and literature. I argue that much of recent philosophy is best understood in terms of an "interpretive turn" that has now provided philosophy with a modest but valuable and distinctive role. I illustrate the procedure of philosophy in this key by (...) critically appropriating ideas about interpretation advanced by Harold Bloom and Richard Rorty, and by using hints about the role of history that arise from discussions of Kant's notion of genius. El presente trabajo quiere analizar la encíclica Caritas in veritate desde la idea de globalización como clave hermenéutica de todo el documento. Nos parece que este noción -comprendida en sus múltiples dimensiones sociales, éticas, políticas, culturales y espirituales- puede contribuir no sólo a una comprensión más profunda de este texto, sino que también puede ayudar a desentrañar muchas de las críticas que ha recibido esta carta, su excesiva extensión y complejidad temática, así como su silencio sobre el capitalismo y el (...) liberalismo. En una segunda etapa, pretendemos comparar la propuesta de esta encíclica social con el proyecto político de las pequeñas comunidades de Alasdair MacIntyre. La intención es mostrar que lejos de una oposición entre ambas posturas -como de alguna forma lo señaló Jeffrey Nicholas- ellas pueden comprenderse como posturas complementarias, en la medida que realicemos una nueva significación del concepto mismo de globalización, entendida ahora como un proceso dialéctico típicamente postmoderno, siguiendo para ello los análisis de autores como Roland Robertson, Zygmunt Bauman o Ulrich Beck. In this paper we seek to analyze the eneyelieal Caritas in veritate based on the idea of globalization as a hermeneutical key to the whole document. We think that this notion -understood in its multiple social, ethical, political, cultural and spiritual dimensions- can contribute not only to a deeper understanding of this text, but also help unravel many of the criticisms directed against the letter, its excessive length and thematic complexity, as well as its silence regarding capitalism and liberalism. In a second stage, we set out to compare the proposal of this social enyelieal with Alasdair Maclntyre’s political project of local communities. Our purpose lies in demonstrating that far from an opposition between the two positions -as Jeffrey Nicholas has in a way pointed out- that they can be understood as complementary, to the extent that we make a new meaning of the very concept of globalization, now understood as a typically postmodern dialectical process based on to the analyses of authors such as Roland Robertson, Zygmunt Bauman or Ulrich Beck. The banking sector has been under public scrutiny since the credit crisis of 2007/8, and a range of diagnoses and cures have been offered, particularly in terms of regulatory and financial structures. In the public media, much comment has been made about ethics in the sector, but this has provoked surprisingly little response from academic researchers. This thesis explores the crisis in banking as a moral one, taking Alasdair MacIntyre’s account of virtue ethics as a framework for understanding the careers (...) of Scottish banking leaders. The method used for the study is narrative, and depends both on MacIntyre’s philosophy of tradition-constituted enquiry, and on Hans-Georg Gadamer’s hermeneutics. Conversations were held with ten leaders of Scottish banking whose careers typically span between 25 and 40 years, and the record of those conversations forms the primary data set for the research. The resulting narratives are frank, rich descriptions of deeply felt changes in a particular mode of working life. This was a way of life characterised up until the 1980s by a well-defined status within local communities, professional expertise and a well-ordered tradition. The deregulation of banking and subsequent structural and technological changes to retail banking services eroded that professional tradition, and replaced it with new modes of work dominated by institutional priorities of sales, profit and growth, rather than by an ethic of professional expertise and customer service. The thesis finds that there are structural barriers to the recovery of a professional ethic in banking. It offers new perspectives on the work of Alasdair MacIntyre, particularly in the application of his idea of traditions to mainstream economic activity. It also explores common ground between Gadamer and MacIntyre, proposing ways in which both philosophers can enhance our pursuit of qualitative empirical research. (shrink)

The browser wars case is a useful springboard for considering the principle of positive competition and the proper regulation of platform technologies. There are lessons to be culled about policy, the application of antitrust law, and the parameters of fair competition. We argue that despite Microsofts opportunistic exploitation of its proprietary code, policy makers should resist the temptation to mandate an open source code model. Vigilant anti-trust enforcement is a preferable alternative. But courts must refrain from using antitrust law to (...) favor small innovators or to constrain the economic protections inherent in intellectual property rights, since those rights are still needed to encourage innovation. On the other hand, despite the exigencies of competition, platform leaders should respect the norm of fair competition and refrain from the impulse to tilt the platform in their favor. Preservation of robust intellectual property rights, deft application of antitrust statutes, and principled competition represent the best prescription for social wealth in the New Economy. (shrink)

This article offers a post-pedagogical image of universities. We explore two main purposes of university education: creating an educated public and preparing learners for their future careers. This exploration draws on philosophers Barnett, MacIntyre and Nussbaum. We then utilise a series of reports from The Foundation for Young Australians to offer insights into the changing nature of society, technology, and worklife. The evolution of models or theories of learning sets the scene for the framework for how to structure the future (...) university—a post-pedagogical learning institution in which educators are learning specialists, learners are engaged in meaningful and critical thinking, learning and acting.
