You may not know me well enough to evaluate me in terms of my moral character, but I take it you believe I can be evaluated: it sounds strange to say that I am indeterminate, neither good nor bad nor intermediate. Yet I argue that the claim that most people are indeterminate is the conclusion of a sound argument—the indeterminacy paradox—with two premises: (1) most people are fragmented (they would behave deplorably in many and admirably in many other situations); (2) (...) fragmentation entails indeterminacy. I support (1) by examining psychological experiments in which most participants behave deplorably (e.g., by maltreating “prisoners” in a simulated prison) or admirably (e.g., by intervening in a simulated theft). I support (2) by arguing that, according to certain plausible conceptions, character evaluations presuppose behavioral consistency (lack of fragmentation). Possible reactions to the paradox include: (a) denying that the experiments are relevant to character; (b) upholding conceptions according to which character evaluations do not presuppose consistency; (c) granting that most people are indeterminate and explaining why it appears otherwise. In his 1958 seminal paper “Saints and Heroes”, J. O. Urmson argued that the then dominant tripartite deontic scheme of classifying actions as being exclusively either obligatory, or optional in the sense of being morally indifferent, or wrong, ought to be expanded to include the category of the supererogatory. Colloquially, this category includes actions that are “beyond the call of duty” (beyond what is obligatory) and hence actions that one has no duty or obligation to perform. But it is a (...) controversial category. Some have argued that the concept of supererogation is paradoxical because on one hand, supererogatory actions are (by definition) supposed to be morally good, indeed morally best, actions. But then if they are morally best, why aren't they morally required, contrary to the assumption that they are morally optional? In short: how can an action that is morally best to perform fail to be what one is morally required to do? The source of this alleged paradox has been dubbed the ‘good-ought tie-up’. In our article, we address this alleged paradox by first making a phenomenological case for the reality of instances of genuine supererogatory actions, and then, by reflecting on the relevant phenomenology, explaining why there is no genuine paradox. Our explanation appeals to the idea that moral reasons can play what we call amerit conferring role. The basic idea is that moral reasons that favor supererogatory actions function to confer merit on the actions they favor—they play a merit conferring role—and can do without also requiring the actions in question. Hence, supererogatory actions can be both good and morally meritorious to perform yet still be morally optional. Recognition of a merit conferring role unties the good-ought tie up, and (as we further argue) there are good reasons, independent of helping to resolve the alleged paradox, for recognizing this sort of role that moral reasons may play. Disputes about what is phenomenologically manifest in conscious experience have a way of leading to deadlocks with remarkable immediacy. Disputants reach the foot-stomping stage of the dialectic more or less right after declaring their discordant views. It is this fact, I believe, that leads some to heterophenomenology and the like attempts to found Consciousness Studies on purely third-person grounds. In this paper, I explore the other possible reaction to this fact, namely, the articulation of methods for addressing phenomenological disputes. In recent years there has been renewed philosophical interest in the thesis that perceptual experience is cognitively penetrable, i.e., roughly, the view that the contents and/or character of a subject's perceptual experience can be modified by what a subject believes and desires. As has been widely noted, it is plausible that cognitive penetration has implications for perception's epistemic role. On the one hand, penetration could make agents insensitive to the world in a way which epistemically 'downgrades' their experience. On the (...) other hand, cognitive penetration may sometimes be epistemically beneficial by making agents more sensitive to the way the world is, i.e., by enabling them to see things that others cannot. For example, penetration could ground a 'high-level' view of perceptual content, according to which agents can have experiences as of 'complex' properties, e.g., natural kind and aesthetic properties. Relatedly, it could elucidate the view that agents can gain perceptual expertise by learning. A type of sophisticated perception which has hitherto received little attention in relation to cognitive penetration is ethical perception. In this paper I examine the significance of cognitive penetration for 'Perceptualist' views in ethics which appeal to a notion of 'ethical perception'. Although cognitive penetration could ground a literalist model of Ethical Perception according to which agents can have perceptual experiences of the instantiation of ethical properties, the results are otherwise somewhat mixed: cognitive penetrability does not support Perceptual Intuitionism, although it may provide some limited support for Virtue Ethics and Cornell Realism. However, as I stress, the significance of cognitive penetration for Perceptualism should not be overstated. (shrink)

Many philosophers argue that the face-value of moral practice provides presumptive support to moral realism. This paper analyses such arguments into three steps. (1) Moral practice has a certain face-value, (2) only realism can vindicate this face value, and (3) the face-value needs vindicating. Two potential problems with such arguments are discussed. The first is taking the relevant face-value to involve explicitly realist commitments; the second is underestimating the power of non-realist strategies to vindicate that face-value. Case studies of each (...) of these errors are presented, drawn from the writings of Shafer-Landau, Brink and McNaughton, and from recent work in experimental metaethics. The paper then considers weak presumptive arguments, according to which both realist and non-realist vindications of moral practice are possible, but the realist vindications are more natural. It is argued that there is no sense of ‘natural’ available that can make these arguments work. The conclusion is that all extant presumptive arguments for moral realism fail. (shrink)

In a series of publications, Tamar Gendler has argued for a distinction between belief and what she calls ?alief?. Gendler's argument for the distinction is a serviceability argument: the distinction is indispensable for explaining a whole slew of phenomena, typically involving ?belief-behaviour mismatch?. After embedding Gendler's distinction in a dual-process model of moral cognition, I argue here that the distinction also suggests a possible (dis)solution of what is perhaps the organizing problem of contemporary moral psychology: the apparent tension between the (...) inherently motivational role of moral judgments and their manifestly objectivistic phenomenology. I argue that moral judgments come in two varieties, moral aliefs and moral beliefs, and it is only the former that are inherently motivating and only the latter that have an objectivistic phenomenology. This serves to both bolster the case for the alief/belief distinction and shed new light on otherwise well-trodden territory in metaethics. I start with an exposition of the moral-psychological problem (?1) and a discussion of Gendler's alief/belief distinction (?2). I then apply the latter to moral judgments in an attempt to dissolve the former (?3). I close with discussion of the upshot for our understanding of moral thought, moral motivation, and moral phenomenology (?4). (shrink)

A vast range of our everyday experiences seem to involve an immediate consciousness of value. We hear the rudeness of someone making offensive comments. In seeing someone risking her life to save another, we recognize her bravery. When we witness a person shouting at an innocent child, we feel the unfairness of this action. If, in learning of a close friend’s success, envy arises in us, we experience our own emotional response as wrong. How are these values apprehended? The three (...) most common answers provided by contemporary philosophy explain the consciousness of value in terms of judgment, emotion, or perception. An alternative view endorsed mainly by authors inspired by the phenomenological tradition argues that values are apprehended by an intentional feeling. In this model, it is by virtue of a feeling that objects are presented as being in different degrees and nuances fair or unfair, boring or funny, good or bad. This paper offers an account of this model of feeling and its basic features, and defends it over alternative models. To this end, the paper discusses different versions of the model circulating in current research which until now have developed in parallel rather than in mutual exchange. The paper also applies the proposed account to the moral domain and examines how a feeling of values is presupposed by several moral experiences. (shrink)

The manifest dissociation between our capacity to make moral judgments and our ability to provide justifications for them, a phenomenon labeled Moral Dumbfounding, has important implications for the theory and practice of moral psychology. I articulate and develop the Linguistic Analogy as a robust alternative to existing sentimentalist models of moral judgment inspired by this phenomenon. The Linguistic Analogy motivates a crucial distinction between moral acceptability and moral permissibility judgments, and thereby calls into question prevailing methods used in the study (...) of moral judgment. Indeed, the judgments that are the focus of most current empirical work in moral psychology are not proper targets of scientific study. (shrink)

In this paper, I address the what, the how, and the why of moral phenomenology. I consider first the question What is moral phenomenology?, secondly the question How to pursue moral phenomenology?, and thirdly the question Why pursue moral phenomenology? My treatment of these questions is preliminary and tentative, and is meant not so much to settle them as to point in their answers’ direction.

Abstract We propose a metaethical view that combines the cognitivist idea that moral judgments are genuine beliefs and moral utterances express genuine assertions with the idea that such beliefs and utterances are nondescriptive in their overall content. This sort of view has not been recognized among the standard metaethical options because it is generally assumed that all genuine beliefs and assertions must have descriptive content. We challenge this assumption and thereby open up conceptual space for a new kind of metaethical (...) view. In developing our brand of nondescriptivist cognitivism we do the following: (1) articulate a conception of belief (and assertion) that does not require the overall declarative content of beliefs (and assertions) to be descriptive content; (2) make a case for the independent plausibility of this conception of belief and assertion; and (3) argue that our view, formulated in a way that draws upon the proposed conception of belief, has significant comparative advantages over descriptivist forms of cognitivism. The claim that (OIC) “ought” implies “can” (i.e., you have an obligation only at times at which you can obey it) entails that (1) obligations that become infeasible are lost (i.e., you stop having an obligation when you become unable to obey it). Moreover, the claim that (2) obligations that become overridden are not always lost (i.e., sometimes you keep having an obligation when you acquire a stronger incompatible obligation) entails that (ONIM) “ought” does not imply “must” (i.e., some obligations (...) are not all-things-considered). It is standard to infer ONIM—via (2)—from the premise that becoming overridden can result in “moral residue” (e.g., in the appropriateness of feeling regret). But then, I note, one could similarly infer not-OIC—via not-(1)—from the premise that becoming infeasible can result in moral residue. So there is an argument against OIC which parallels the standard argument for ONIM. I respond by rejecting both arguments: it is a mistake to always infer from the presence of moral residue that an obligation is not lost. Then I propose new arguments both for ONIM and for OIC. Moral phenomenology is (roughly) the study of those features of occurrent mental states with moral significance which are accessible through direct introspection, whether or not such states possess phenomenal character – a what-it-is-likeness. In this paper, as the title indicates, we introduce and make prefatory remarks about moral phenomenology and its significance for ethics. After providing a brief taxonomy of types of moral experience, we proceed to consider questions about the commonality within and distinctiveness of such experiences, with an eye (...) on some of the main philosophical issues in ethics and how moral phenomenology might be brought to bear on them. In discussing such matters, we consider some of the doubts about moral phenomenology and its value to ethics that are brought up by Walter Sinnott-Armstrong and Michael Gill in their contributions to this issue. Imagine coming across an alternative community such that, while they have normative terms like 'ought' with the same action-guiding roles and relationships to each other, their normative terms come to pick out different properties. When we come across such a community, or even just imagine it, those of us who strive to be moral and rational want to ask something like the following: Further Question: Which set of concepts ought we use—theirs or ours? The problem, first raised by Eklund, is (...) that on almost any metasemantic theory, Further Question cannot be stated in a way that captures the spirit of what we want to ask. This is because any way of asking the question makes use of our own normative concepts, and thus their reference is already fixed on the properties that our current normative concepts refer to. Any purported solution to this problem must meet two conditions. First, it must capture the spirit of what Further Question is intuitively attempting to ask. Second, it must reframe the inquiry in a way that makes the answer neither trivial nor ineffable. In this paper, I propose a solution to this problem by appeal to edenic representation, inspired by, but not identical to, Chalmers’ notion of edenic content. The rough idea here is that representation is edenic to the extent that the representational vehicle mirrors, in quality and structure, the represented property. I argue that a reframing of Further Question in terms of edenic representation can capture the spirit of the question, without collapsing it into a question with a trivial or ineffable answer. Thus, the realist about normative properties can face the problem of the alternative normative community head on, without collapsing into incoherence or triviality. If correct, this solution is of further interest to any metanormative realist concerned with metasemantic questions, because it can tell us more about how the proper representation of the robustly normative would look. I defend the epistemic thesis that evaluations of people in terms of their moral character as good, bad, or intermediate are almost always epistemically unjustified. (1) Because most people are fragmented (they would behave deplorably in many and admirably in many other situations), one's prior probability that any given person is fragmented should be high. (2) Because one's information about specific people does not reliably distinguish those who are fragmented from those who are not, one's posterior probability that any given (...) person is fragmented should be close to one's prior—and thus should also be high. (3) Because being fragmented entails being indeterminate (neither good nor bad nor intermediate), one's posterior probability that any given person is indeterminate should also be high—and the epistemic thesis follows. (1) and (3) rely on previous work; here I support (2) by using a mathematical result together with empirical evidence from personality psychology. (shrink)

Recent decades have witnessed a flurry of interest in Nietzsche's metaethics — his views, if any, on metaphysical, epistemological, semantic, and psychological issues about normativity and normative language and judgment. Various authors have highlighted a tension between Nietzsche's metaethical views about value and his ardent endorsement of a particular evaluative perspective: Although Nietzsche makes apparently "antirealist" claims to the effect that there are no evaluative facts, he vehemently engages in evaluative discourse and enjoins the "free spirits" to create values. Nearly (...) every major type of metaethical "-ism" has been ascribed to Nietzsche in response. This chapter provides a critical introduction to Nietzsche's metaethics, focusing on matters concerning the nature and grounds of normativity. I begin by examining and raising challenges for Nadeem Hussain's prominent interpretation of Nietzsche as a revolutionary fictionalist. I argue that a constructivist interpretation (developed elsewhere) provides an improved account of the connections, for Nietzsche, between evaluative attitudes and the nature of value, and among practical nihilism, art, and value creation. Values, on this view, are treated as grounded purely in facts about creatures’ evaluative attitudes. The chapter concludes by considering several alternative subjectivist, constitutivist, and non-cognitivist interpretations. A nuanced understanding of the space of metaethical theories brings into relief a plausible normative and metanormative view that we can attribute to Nietzsche. (shrink)

Do the introspectively ascertainable aspects of our moral experiences carry ontological objective purport—portraying reality as containing worldly moral properties and facts, thus supporting moral realism? Horgan and Timmons answer this question in the negative, arguing that their non-realist view, cognitivist expressivism, can accommodate the introspectively ascertainable moral phenomenology just as well as realism can—where accommodating the phenomenology means accounting for it without construing it as misleading or erroneous. If sound, this constitutes an important defense of cognitivist expressivism, undermining a central (...) attraction of realism. They thus pose a challenge to realists to identify any aspects of moral phenomenology that cannot be accommodated by expressivism and instead favor realism. I here take up that challenge, in two stages. First, I argue that cognitivist expressivism does not after all capture certain important aspects of the phenomenology of the sort of moral experience on which they focus, while realism does. This argument does not depend on claiming that the phenomenology has ontological objective purport. The claim so far is just that there is more to categorical authoritativeness than the expressivist account captures, though this leaves the door open to Kantian rationalism as well as realism. Second, I will go on to argue that although some aspects of moral phenomenology may only point to this broader range of views, others do specifically carry ontological objective purport and thus directly support realism insofar as we take the phenomenology seriously. This paper explores the relation between metaethical reflection and value experience, and does so by focusing on robust realism. Robust realism is typically criticized for its ontological and epistemological commitments. In this paper, however, we hope to shed new critical light on the plausibility of the theory by using two concepts – ‘reification’ and ‘alienation’ – that have their origin in critical social theory. We use the concept of ‘reification’ as an interpretative lens to look at robust realism and show (...) that it is reifying in two respects: it turns values into things, and, correspondingly, turns human agents into disengaged observers of those things. This analysis is then used to argue that robust realism is alienating in the sense that it distances us from the world that presents itself to us in value experience, and that it separates us from what we call our engaged responsiveness. We also argue that its alienating effects give us good reason to reject the theory. (shrink)

Moral phenomenology has enjoyed a resurgence lately, and within the field, a trend has emerged: uniform rejection of the idea that the experience of making ‘direct’ moral judgments has any phenomenal essence, that is, any phenomenal property or properties that are always present and that distinguish these experiences from experiences of making non-direct- moral judgments. This article examines existing arguments for this anti-essentialism and finds them wanting. While acknowledging that phenomenological reflection is an unstable pursuit, it is maintained here that (...) phenomenological essentialism about a certain domain of direct moral judgment, namely direct judgment of obligation and prohibition, is more credible than has been recognized. The positive proposal is to rehabilitate something close to Maurice Mandelbaum’s essentialism, specifically to maintain that direct moral judgment ’s phenomenal essence is arguably its felt categorical demand. The key to making this argument is to assume a ‘rich view’ of moral consciousness, the view that phenomenal features of moral judgment might be present even when they are not attended to. This assumption is controversial, but it is warranted by two considerations. First, though controversial, the rich view is intuitively plausible. Second, it reveals that the existing arguments against the kind of essentialism defended here appear to tacitly presuppose an equally controversial – and arguably less intuitive – rejection of the rich view. Different notions of objectivity support different notions of what is required for a moral value or obligation to be experienced as objective. If the objectivity of a property requires that it can exist even when we fail to notice its existence, then experiencing a property as objective will require that we imagine it appearing in some way that is not presently available to us. Perceiving things to be a certain way may in some cases lead directly to action that is intelligent. This phenomenon has not often been discussed, though it is of broad philosophical interest. It also raises a difficult question: how can perception produce intelligent action? After clarifying the question—which I call the question of “practical perception”—and explaining what is required for an adequate answer, I critically examine two candidate answers drawn from work on related topics: the first, inspired by Hubert Dreyfus's (...) phenomenological analysis of absorbed coping, focuses on awareness of situational features; the other, suggested by Gilbert Ryle's classic treatment of knowledge-how, focuses on possession of behavioral dispositions. I argue that neither approach is adequate. Subsequently, I develop and defend an alternative answer that emphasizes the agent's conceptual understanding. (shrink)

One of the newest research areas in moral philosophy is moral phenomenology: the dedicated study of the experiential dimension of moral mental life. The idea has been to bring phenomenological evidence to bear on some central issues in metaethics and moral psychology, such as cognitivism and noncognitivism about moral judgment, motivational internalism and externalism, and so on. However, moral phenomenology faces certain foundational challenges, pertaining especially to the existence, describability, and importance of its subject matter. This paper addresses these foundational (...) challenges, arguing that moral experiences – in the phenomenal, what-is-like sense of the term – exist, are informatively describable, and are central for the concerns of moral philosophy at large. Moral judgment commonly depends on intuition. It is also true, though less widely agreed, that ethical theory depends on it. The nature and epistemic status of intuition have long been concerns of philosophy, and, with the increasing importance of ethical intuitionism as a major position in ethics, they are receiving much philosophical attention. There is growing agreement that intuition conceived as a kind of seeming is essential for both the justification of moral judgment and the confirmation of ethical theories. This (...) paper describes several importantly different kinds of intuition, particularly the episodic kinds often called seemings. This is done partly by sketching numerous examples of intuition. Intuitive seemings and moral judgments based on them differ in content, basis, epistemic authority, and phenomenology. The paper explores these four dimensions of intuition and, in doing so, compares moral intuition with moral perception. The overall aim is to clarify moral phenomenology both descriptively and epistemologically and to support the view that intuitions are often discriminative responses to experience and have justificatory power analogous to the power of sense-perceptions. According to contentful moral perception (CMP), moral properties can be perceived in the same sense as tables, tigers, and tomatoes. Recently, Heather Logue (2012) has distinguished between two potential ways of perceiving a property. A Kantian Property (KP) in perception is one in which a perceiver’s access involves a detection of the property via a representational vehicle. A Berkeleyan Property (BP) in perception is one in which a perceiver’s access to the property involves that property as partly constitutive of the (...) experience itself. In this paper, I set aside generalized arguments in favor of one view or another, and instead ask whether proponents of CMP have reasons to understand moral perception as Kantian or Berkeleyan. I explore three possible explanatory differences—(a) explaining the intrinsic motivating force of moral perceptions, (b) providing a metasemantics for moral properties, and (c) providing an epistemology of the normative authority of moral properties. We argue, primarily by appeal to phenomenological considerations related to the experiential aspects of agency, that belief fixation is broadly agentive; although it is rarely voluntary, nonetheless, it is phenomenologically agentive because of its significant phenomenological similarities to voluntary-agency experience. An important consequence is that epistemic rationality, as a central feature of belief fixation, is an agentive notion. This enables us to introduce and develop a distinction between core and ancillary epistemic virtues. Core epistemic virtues involve several inter-related kinds of (...) epistemic rationality in belief fixation. Other “habits of mind” pertinent to belief fixation constitute ancillary epistemic virtues. Finally, we discuss the relationship between both kinds of virtues, offering a unified account of epistemic virtuousness. (shrink)

The question “What is the nature of experience?” is of perennial philosophical concern. It deals not only with the nature of experience qua experience, but additionally with related questions about the experiencing subject and that which is experienced. In other words, to speak of the philosophical problem of experience, one must also address questions about mind, world, and the various relations that link them together. Both William James and Kitarō Nishida were deeply concerned with these issues. Their shared notion of (...) “pure experience” is the conceptual cornerstone of their attempt to deal with the philosophical problem of experience. This dissertation is an analysis of “pure experience” and its relevance to several issues in contemporary hilosophy of mind. Drawing upon James’s and Nishida’s “pure experience”, I argue both for a sensorimotor-based, “extended” conception of consciousness and a bodily skills-based account of moral psychology. (shrink)

While the current discussion on embodied cognition provides valuable accounts of an agent’s bodily sensitivity to instrumental possibilities, in this paper I investigate felt demands as the bodily-affective dimension of the agent’s recognition of deontic powers such as obligations. I argue that there is a close kinship between felt demands and affordances in the stricter sense. I will suggest that what is unique about felt demands on an experiential level is that they involve an evaluative perspective arising from acute or (...) anticipated shame-like feelings. The conclusion is that the recognition of deontic power is also a matter of bodily sensitivity. (shrink)

Most self-reports of heroic action in both reactive and social (proactive) cases describe the experience as involving a kind of necessity. This seems intuitively sound, but it makes it unclear why heroism is accorded strong approbation. To resolve this, I show that the necessity involved in heroism is a nonselfsacrificial practical necessity. (1) Approaching the intentional structure of human action from the perspective of embodiment, focusing especially on the predispositionality of pre-reflective skill, I develop a phenomenological interpretation of Bernard Williams’ (...) notion of “practical necessity” as an endogenous existential necessity. (2) I then offer a view of reactive heroism as instantiating this kind of necessity by literally embodying certain socially affirmed values in a way that is not self-sacrificial. This evinces a deep social bond, and it is this bond, rather than the action itself, is the ground of approbation. (3) I then discuss how this construal of reactive heroism can be extended to cases of social heroism by way of a necessity that is internal to the agent’s individual character. Similarly to reactive cases, a social hero literally embodies a certain ethical commitment such that her actions are likewise instances of nonselfsacrificial practical necessity. (4) I then discuss how the commitment perceived in cases of social heroism pertains to the actualization of “surplus validity,” such that whereas the reactive hero is praised for embodying shared value, the social hero is praised for embodying a commitment to actualizing the concrete potential of such value more fully The approbation accorded to social heroism is therefore tied inextricably to a normative judgment concerning such immanent progressive transformation. Summary In this article the ethical systems of Risieri Frondizi and Maurice Mandelbaum, both decisively influenced by Wolfgang Köhler, are investigated for the first time. Each writer took different things from Köhler, Frondizi the idea of value as a Gestalt quality and Mandelbaum the idea of value as a felt demand. Their positions are highly complementary and Frondizi’s axiological approach enlightens the ontology of value whereas Mandelbaum’s phenomenological approach clarifies the nature of “requiredness” (Köhler) or “fittingness.”.

“S ought (not) to see to it that p at t” is true iff an intention on the part of S to see to it that p at t is (in) correct. From this truth condition follows an understanding of the conceptual role of ought-claims in practical inference: ought-claims are interchangeable with intentions having the same content. From this conceptual role, it is quite clear why first-person, present-tense ought-judgments, and just those, motivate: failure to be motivated is a failure of (...) rationality. The point and purpose of 'ought' is mainly to express the results of practical reasoning performed on premises held hypothetically, an exercise of which there are many varieties. Our capacity for normative thought and language is a consequence of, and intimately related to, our capacity for practical thought. (shrink)

The analysis is based on some moral experiences taking place during a terrorist attack on the Norwegian Labor Party’s youth camp on the island of Utøya July 22, 2011, where 69 young people were killed and several seriously injured. After the attack many of the survivors told stories of how strangers spontaneous had helped and cared for each other. In the midst of the horror there occurred sudden “moments of goodness” or “points of light” that revealed hope for the persons (...) involved, as well as for the society. The article examines these spontaneous moral practices in light of moral educational theory, as well as discusses the terrorists own way of thinking and acting. The spontaneous practices point toward another basis for a moral approach then a cognitive development tradition. The importance of community is underlined, as well as an interpersonal dimension. In the last section the fostering of moral and ethical thinking and acting is discussed in light of general education and the three functions of education proposed by Biesta. It is suggested that moral education could contribute something to all of the three dimensions but based on the experiences from Utøya, there will be a particular emphasis on the subjectification function of education.
