The relevance of different concepts of computer software (henceforth SW) rights is analysed from the viewpoint of divergent sociopolitical doctrines. The question of software rights is considered from the ontological assumptions, on one extreme, to the relevance of current practical applications of SW rights (such as copyright and patent), on the other extreme. It will be argued (from a non-descriptive/non-cognitive account) that the current expression of SW rights in Western societies (namely copyright, excluding patent) can be seen to be fair (...) from the viewpoint of the theses of agreed rights and universalisability. Finally, given that such practice is neither immoral, nor irrelevant-but fair (based on the ad ignorantiam argument)-we have good reason to respect it rather than violate or demolish it. (shrink)

This investigation provides an in-depth exploration of the dialectics of action and technology in the works of French philosopher Jean-Paul Sartre, both in terms of the concrete use contexts of technological artifacts and the entanglement between individual agents and their sociotechnical surroundings. Furthermore, it briefly outlines some potentials of Sartre’s thoughts for debates in contemporary philosophy of technology. Throughout his works, Sartre approaches human action from different yet dialectically interrelated perspectives that are always accompanied by and developed in relation to (...) reflections about technology. Against the background of a complementary conception of human action that is derived from Sartre’s major works, the implementation of matter in the course of action primarily represents an instrumentalization. Things are thus always disclosed as implement things due to the practical character of human existence. Although things do not prescribe action, the material characteristics and properties of these things render them more useful for attaining some and more adverse for attaining other ends. Despite the ontological freedom of human beings, their position in societal forms of organization, to which Sartre refers to as practical ensembles, delimits their choice of means and necessitates them to satisfy their needs and desires with the limited means available. In this way, la force des choses arises, not as a result of the characteristics of technology but as an outcome of sociality and politics. (shrink)

Gleichzeitig zu der in den letzten Jahren geringer werdenden Akzeptanz des globalen Kapitalismus ist eine kritische Philosophie der Arbeit wieder erstarkt, die nach den normativen Anforderungen fragt, denen moderne Arbeitsformen Rechnung zu tragen haben. Diese Philosophie der Arbeit soll hier in begrifflicher Hinsicht durch eine Anbindung an empirische Untersuchungen zu den Erfahrungen der Arbeiter weitergeführt werden. Der Blick auf diese empirischen Untersuchungen macht eine neue Art von Entfremdung evident – hier genannt: Entfremdung von sozialen Kontakten. Auf dieser empirischen Erkenntnis und (...) auch auf deren wissenschaftstheoretischen Implikationen basierend argumentiert der Aufsatz für eine Erweiterung von Axel Honneths Theorie der Arbeit. This contribution investigates whether Hegel’s critique of social contract theory is still applicable to contemporary contract theory proposed by, e. g., Rawls and Nozick. At first sight, they seem to have overcome the problems identified by Hegel because Rawls and Nozick appropriate the social contract as something essentially rational and normative. I argue, however, that for Hegel, their appeal to rational argumentation is not compatible with the concreteness of human individuals. A revised reading of the master/ bondsman-relation, emphasizing the role (...) of the “fear of death”, shows the limited scope of contemporary contract theory. (shrink)

The aim of this paper is to point out significant similarities and productive dissonances between Marx and Nietzsche. My thesis is that these two thinkers have much more in common as is usually acknowledged. After a prove that Nietzsche most certainly know Marx, I develop several aspects of commonality. Both pursue philosophical projects of critical transformation, employ a hermeneutics of suspicion beyond good and evil, propose a naturalized anthropology and historical reconstructions. The final passages discuss their respective views on capitalism (...) and socialism. The similarities as well as the differences between Marx and Nietzsche could serve as a productive resource and inspiration in our contemporary attempts to understand the world we live in. (shrink)

Gesellschaftskritik, or social philosophy that aims to provide firm criticism of pathological social practices, requires normatively grounded evaluative principles. In this article, we assess different possibilities for such principles with focus on a model that takes specific patterns of intersubjective interaction as its point of reference. We argue that in order to understand the full significance of this ‘intersubjective turn’ for social philosophy, and to strengthen the normative foundation of social philosophy, we need to distinguish several levels of intersubjectivity and, (...) in particular, focus on the somewhat neglected level of primary intersubjectivity. The article will discuss the account of primary intersubjectivity in Honneth’s work. We show that Honneth’s account runs into difficulties, and drawing on recent findings in developmental psychology, we suggest a rethinking of elementary recognition in terms of ‘affective proximity’. This both renders the account less susceptible to criticism and provides a normative perspective that can effortlessly enter into interdisciplinary collaboration. (shrink)

Carl Schmitt’s radio broadcast ‘Hegel and Marx’, aired on 13 November 1931, and newly translated here, recapitulates the account of Marxism that Schmitt started to develop in the 1920s. Beginning from Schmitt’s early theory of adjudication inLaw and Judgement, the concepts of decision, representation and the friend/enemy distinction are analysed, connected, and shown to structure Schmitt’s critique of Marxism, both in the broadcast, and in his other writings during this period. Since ancient times philosophy has dealt with the relation between technology and man. Nowadays this is especially true in the context of the philosophy of technology. Technology is interpreted as an anthropological constant to construct an environment in which man can survive. Acting in the field of technology is to act rationally with a purpose, i.e., in the framework of a means-end relation, and it is employed for coping with experiences (Widerfahrnisse) by means of using tools. Like technology, language can (...) be reconstructed as a symbolic form and thus as a technological means, as a tool so that the employment of metaphors can also be described as an employment of tools. Using technology has effects on man as well as on his self-image. Thus, philosophy of technology creates different ideas of man, which have to become subject to ethical discourses. (shrink)

One can work for another person, probably for all the others in an ethical way, and not for money. This is the main idea pursued in this article. When it comes to labour, we are inclined to deal with Marx. But even Marx apparently did not notice this ethical side of labour, because his focus was mainly on the creation of value, which was common among thinkers at that time, such as Locke and Smith. In contrast, Hegel consistently tackled the (...) same issue from another angle: ethics. In terms of this, he went so far as to say the dignity of humans should be located in labour. We shed light on this very aspect of Hegel’s philosophy by reference to Alexandre Kojève’s famous commentary, Introduction à la lecture de Hegel. (shrink)

For decades, the question of whether dialectics applies to nature has been a hotly debated topic in the Marxian literature. A number of authors have claimed that the Marxist outlook on nature and natural sciences has been for-mulated by Engels alone. According to this view, Marx, unlike Engels, was concerned not with trans-historical laws governing the universe but with some particular laws of society. This anti-Engels camp, so to speak, mainly tended to draw bold lines between Marx and Engels, and (...) charged Engels with dis-torting Marxʼs original ideas of dialectics by some kind of reductionism, sci-entism and positivism that might also end up in an obsolete idealism. Engels was „following Hegelʼs mistaken lead“ by extending „the method to apply also to nature“. However, dialectics was „limited ... to the realms of history and society“.2 Some others objected to this view, and characterized any at-tempt to sharply contrast Engels with Marx as concealed mysticism and idealism. For the pro-Engels camp, Engelsʼs conception of nature was „in full conformity“ with Marxʼs materialist philosophy.4 Dialectics of nature was „no invention of Engels“. Eine der frühesten Schriften des jungen Karl Marx — die Dissertationsschrift „Differenz der demokritischen und epikureischen Naturphilosophie“ — legt wichtige Fundamente für das gesamte Marx’sche Denken. In der Dissertationsschrift versucht Marx anhand des Vergleichs der antiken Naturphilosophien Demokrits und Epikurs grundlegende Erkenntnisse der theoretischen und praktischen Philosophie in einem komplexen, von Hegel inspirierten ontologischen System zu verbinden. Aus dieser kritischen Synthese antiker Naturphilosophien entsteht so eine auf Hegelschen Begriffen basierende, aber gleichzeitig reformierte Idee der Praxis. Auf diesen Grundlagen sowie mit (...) Hilfe des über die Kritik an Epikur und Hegel gewonnenen Begriffs der Entfremdung entwickelt Marx den dialektischen Materialismus der Naturphilosophie. Dem inhaltlichen Aufbau der Dissertationsschrift folgend wird in dem Aufsatz die Marx’sche Naturphilosophie diskutiert. Dabei werden die wichtigsten Begriffe des Marx‘schen Denkens, wie etwa Materialismus, Dialektik, Entfremdung oder Einheit von Theorie und Praxis in der Dissertationsschrift von Karl Marx ausgearbeitet. Axel Honneth makes initial and promising steps towards what could be called a two-level account of recognition, according to which the normatively substantial forms of recognition represent various manners in which the primordial acquaintedness with others is expressed. It will be argued that Honneth's promising approach must be revised in regard to the issue of intentionality, which may be achieved by reference to earlier critical theorists such as Adorno and Arendt.
