The conciliationist and steadfast approaches have dominated the conversation in the epistemology of disagreement. In this paper, drawing on Jennifer Lackey’s justificationist approach and the casuistry paradigm in medical ethics, I will develop a more contextual epistemology of political disagreement. On this account, a given political disagreement’s scope, domain, genealogy, and consequence can be helpful for determining whether we should respond to that disagreement at the level of our confidence, beliefs, or with policy. Though some may argue that responding with (...) policy is a practical consideration instead of an epistemic matter, I argue that even policy responses to disagreements have an epistemic dimension to them that we should not ignore. In the last two decades, an ever-increasing number of scholars have challenged the conceptual borders of political philosophy and the supposed universalism of its normative pre-commitments. Surprisingly enough, the normative underpinnings of this debate have had very little impact on contemporary disputes about pluralism. This article asks how contemporary disputes about the conceptual borders of political theory can help in constructing a more plural theory of pluralism. It shows that such contributions inspire three ways of constructing a more plural political (...) theory of pluralism: a self-transformative approach, a dialogical approach and a pre-relational approach. While all three approaches progress towards less exclusionary theories of pluralism, I argue that a pre-relational approach can lead to a normative theory that is more plural than the alternatives. This paper defends an account of forgiveness that is sensitive to recent work on anger. Like others, we claim anger involves an appraisal, namely that someone has done something wrong. But, we add, anger has two further functions. First, anger communicates to the wrongdoer that her act has been appraised as wrong and demands she feel guilty. This function enables us to explain why apologies make it reasonable to forgo anger and forgive. Second, anger sanctions the wrongdoer for what she (...) has done. This function allows us to explore the moral status of forgiveness, including why forgiveness is typically elective. (shrink)

The prevailing view is that democratic procedures are unable to confer democratic legitimacy to decisions about democratic procedures. This paper examines this claim in detail and uses referendums on the inclusion of previously disenfranchised groups in the demos as a running example. The paper distinguishes between pure, imperfect and quasi-pure models of procedural democratic legitimacy and sub-versions of them. To various extents, each model does have the capacity to confer legitimacy to demos decisions under well-defined circumstances. The paper argues that (...) quasi-pure procedural legitimacy represents the most promising account of democratic legitimacy in cases where democratic procedures are the subject of collective decision-making. According to this model, the decision to revise the rules for membership in the demos is permissible by democratic standards if and only if the revision is not forbidden by democratic principles for inclusion. The point is that the range of alternatives that are not forbidden by democratic principles of inclusion are likely to be considerable due to vagueness of the principles themselves and/or them being subject to reasonable disagreement. The paper concludes with a discussion about the possibility of democratic legitimacy for democratic institutions not introduced as a result of democratic decision-making. (shrink)

A tension between acting morally and acting rationally is apparent in analyses of moral emotions that ascribe an inherent subjectivity to ethical thinking, leading thence to irresolvable differences between rational agents. This paper offers an account of emotional worthiness that shows how, even if moral reasons fall short of philosophical criteria of rationality, we can still accord reasonableness to them and recognize that the deliberative weight of social norms is sufficient to address the moral limitations of strategic rationality.

Scholars have long recognized the existence of myriad widespread deep disagreements on values, justice, morality, and ethics. In order to come to terms with such deep disagreements, resistant to rational solution, this article asserts the need for developing an ethics of disagreement. The reality that theoretical disagreements often turn into practical conflicts is a major justification for why such an ethics is necessary. This paper outlines an ethics of deep disagreement that is primarily conceived of as a form of virtue (...) ethics. Such an ethics asks opposing parties in moral and intellectual conflicts to acknowledge that (a) deep disagreements exist, (b) opposing positions should be recognized as worthy of respect, and that (c) one should seek dialogue and mutual understanding. This ethical approach conceives of toleration as a moral and political virtue and presents an argument for toleration based on deep disagreements. (shrink)

Courts play a key role in deciding on public health controversies, but the legitimacy of judicial intervention remains highly controversial. In this article I suggest that we need to carefully distinguish between different reasons for persistent disagreement in the domain of public health. Adjudicating between public health controversies rooted in factual disagreements allows us to investigate more closely the epistemic capacities of the judicial process. While the critics typically point out the lack of appropriate expertise of judges—in particular with respect (...) to health and public health—we should not move too fast in inferring from this a generalized competence problem. This article offers four reasons for vindicating the importance of judicial intervention in factual disagreements: the relative independence of judges from the political establishment, the judicial commitment to evidence, the specific nature of judicial reasoning and an additional voice for the people in the policy-making process. This paper defends a particular view of explaining reasonable disagreement: the Conceptual View. The Conceptual View is the idea that reasonable disagreements are caused by differences in the way reasonable people use concepts in a cognitive process to make moral and political judgements. But, that type of explanation is caught between either an explanatory weakness or an unparsimonious and potentially self-undermining theory of concepts. When faced with deep disagreements, theories on the Conceptual View either do not have the resources to (...) explain them, or can only explain them by committing to a completely new theory of concepts where all moral and political concepts are a unique type of concept. This paper shows how the Conceptual View can avoid this dilemma by adopting what I dub the ‘Metalinguistic Strategy’ for explaining reasonable disagreement. The Metalinguistic Strategy uses recent innovations in the philosophy of language on metalinguistic negotiation to explain reasonable disagreements whether they be ordinary or deep disagreements as genuine disagreements whilst maintaining our ordinary ideas about concepts.
