In this paper I seek to defend libertarianism about free will and moral responsibility against two well-known arguments: the luck argument and the Mind argument. Both of these arguments purport to show that indeterminism is incompatible with the degree of control necessary for free will and moral responsibility. I begin the discussion by elaborating these arguments, clarifying important features of my preferred version of libertarianism—features that will be central to an adequate response to the arguments—and showing why a strategy of (...) reconciliation (often referred to as “deliberative libertarianism”) will not work. I then consider four formulations of the luck argument and find them all wanting. This discussion will place us in a favorable position to understand why the Mind argument also fails. (shrink)

In this paper, we do three things. First, we put forth a novel hypothesis about judgments of moral responsibility according to which such judgments are a species of explanatory judgments. Second, we argue that this hypothesis explains both some general features of everyday thinking about responsibility and the appeal of skeptical arguments against moral responsibility. Finally, we argue that, if correct, the hypothesis provides a defense against these skeptical arguments.

In the paper, I defend the skeptical view that no one is ever morally responsible in the basic desert sense since luck universally undermines responsibility-level control. I begin in Section 1 by defining a number of different varieties of luck and examining their relevance to moral responsibility. I then turn, in Section 2, to outlining and defending what I consider to be the best argument for the skeptical view--the luck pincer (Levy 2011). I conclude in Section 3 by addressing Robert (...) Hartman's (2017) numerous objections to the luck pincer. I argue that the luck pincer emerges unscathed and the pervasiveness of luck (still) undermines moral responsibility. (shrink)

Compatibilists about free will maintain that free will is compatible with determinism, and incompatibilists disagree. Incompatibilist believers in free will have been challenged to solve a problem that luck poses for them—the problem of present luck. This article articulates that challenge and then explores a novel compatibilist view recently proposed by Christian List. It is argued that List’s view, unlike standard compatibilist views, faces a very similar problem about luck.

We ordinarily think that we human beings have agency: we have control over our choices and make a difference to our environments. Yet it is not obvious how agency can fit into a physical world that is governed by exceptionless laws of nature. In particular, it is unclear how agency is possible if those laws are deterministic and the universe functions like a mechanical clockwork. In this short paper, I first explain the apparent conflict between agency and physical determinism (referring (...) to recent work by Helen Steward on "agency incompatibilism"), then review some salient responses one might give to this conflict, and finally sketch a response that rests on a distinction between “physical” and “agential possibilities.” Agency, I suggest, is a higher-level phenomenon, which comes with its own level-specific notion of possibility, and it cannot be adequately analyzed in physical terms alone or just through the lens of physical possibility. According to classical theism, the universe depends on God in a way that goes beyond mere (efficient) causation. I have previously argued that this ‘deep dependence’ of the universe on God is best understood as a type of grounding. In a recent paper in this journal, Aaron Segal argues that this doctrine of deep dependence causes problems for creaturely free will: if our choices are grounded in facts about God, and we have no control over these facts, then we do (...) not control our choices and are therefore not free. This amounts to a grounding analogue of the Consequence Argument for the incompatibility of free will and determinism. If successful, it would have application beyond classical theism: similar concerns would apply to any view that takes our choices to be grounded in a deeper reality which is beyond our control. However, I show that the argument is not successful. Segal’s Grounding Consequence Argument is so closely analogous to the Causal Consequence Argument that any response to the one provides a response to the other. As a result, if you don’t think that prior causes (whether deterministic or indeterministic) undermine free will, you shouldn’t think that prior grounds undermine free will. (shrink)

This essay sketches a problem about luck for typical incompatibilist views of free will posed in Alfred Mele, Free Will and Luck , and examines recent reactions to that problem. Reactions featuring appeals to agent causation receive special attention. Because the problem is focused on decision making, the control that agents have over what they decide is a central topic. Other topics discussed include the nature of lucky action and differences between directly and indirectly free actions.

The “problem of present luck” targets a standard libertarian thesis about free will. It has been argued that there is an analogous problem about luck for compatibilists. This article explores similarities and differences between the alleged problems.

Robert Kane’s libertarian theory is often attacked on the grounds that undetermined self-forming actions are not amenable to contrastive explanation. I propose that we should understand contrastive explanations in terms of an appeal to structuring causes. Doing so reveals that Kane’s claim that there can be no contrastive explanation for self-forming actions is not an unwanted implication of his appeal to indeterminism, but is actually an implication of the fact that the agent’s will is not yet appropriately structured. A “contrastive explanation” explains not only why some event A occurred, but why A occurred as opposed to some alternative event B. Some philosophers argue that agents could only be morally responsible for their choices if those choices have contrastive explanations, since they would otherwise be “luck infested”. Assuming that contrastive explanations cannot be offered for causally undetermined events, this requirement entails that no one could be held responsible for a causally undetermined choice. Such arguments challenge incompatibilism, since they entail (...) that causal determinism is a prerequisite for moral responsibility. However, I argue that for a significant class of choices, even if we stipulate that they are determined, we will be unable to provide a relevant contrastive explanation. Hence causal determinism is no remedy for luck infestation, and compatibilists do not fare much better than incompatibilists in the face of this requirement. I present a historical solution to the so-called Arbitrariness Objection (AO). The AO has been leveled against contemporary libertarian conceptions of free will and says that freedom of the will, conceived as freedom of indifference, implies that choices can be made for no reason. If successful, the AO would undermine the rationality of libertarian views, which is why a rebuttal of it is of systematic interest. I discuss the attempt of Christian August Crusius (1715–75) in order to explain that Crusius (...) rejects the AO by showing that there is no choice without a reason. (shrink)

The Direct Argument for the incompatibility of determinism and moral responsibility is so christened because this argument allegedly circumvents any appeal to the principle of alternate possibilities – a person is morally responsible for doing something only if he could have avoided doing it – to secure incompatibilism. In this paper, I first summarize Peter van Inwagen’s version of the Direct Argument. I then comment on David Widerker’s recent responses to the argument. Finally, I cast doubt on the argument by (...) constructing counterexamples to a rule of inference it invokes. (shrink)

This is the introduction to a volume of new essays in the metaphysics of moral responsibility by John Martin Fischer, Carl Ginet, Ishtiyaque Haji, Alfred R. Mele, Derk Pereboom, Paul Russell, and Peter van Inwagen. I provide some background for the essays, cover the main debates in the metaphysics of moral responsibility, and emphasize some of the authors' contributions to this area of philosophy.

If indeterminism is to be necessary for moral responsibility, we must show that it doesn’t preclude responsibility (the Luck Problem) and that it might enhance it (the Enhancement Problem). A ‘strong luck claim’ motivates the Luck Problem: if an agent’s choice is undetermined, then her mental life will be causally irrelevant to her choice, whichever way she decides. A ‘weak luck claim’ motivates the Enhancement Problem: if an agent’s choice is undetermined, then even if her mental life is causally relevant (...) to her choice, whichever way she decides, we cannot explain how she _settles_ her choice. Only the weak luck claim is plausible. However, its plausibility depends on our accepting that we could only settle our choices if they are settled by additional exercises of agency. If we instead understand the process of settling decisions in procedural terms, we can begin to sketch a solution to the Enhancement Problem. (shrink)

Neil Levy mounts two arguments against Robert Kane’s influential libertarian theory. According to the first, because Kanean self-forming actions are undetermined, there can be no contrastive explanation for why agents choose as they do rather than otherwise, in which case how they choose appears to be a matter of luck. According to the second, if one grants Kane the claim that agents are responsible for their undetermined choices in virtue of the fact that they made efforts of will to choose (...) them, the fact that agents engage in dual efforts of will leads to an implausible doubling of the agent’s responsibility. We defend Kane from both objections. We argue against the first by clarifying the nature of contrastive explanation in the context of Kane’s theory and we argue against the second by showing that the kind of doubling of responsibility implied by an agent’s dual efforts of will is, in fact, innocuous. Central to Robert Kane’s libertarian free will is the distinction between two kinds of action: undetermined self-forming actions by means of which we shape our characters, and actions that are determined by our freely formed characters. Daniel Dennett challenges the coherence of this distinction, but I argue that his arguments rely on highly controversial assumptions. In an effort to improve on Dennett’s criticism, I argue that some considerations about non-self-forming actions, when coupled with Kane’s naturalistic framework, imply that all choices (...) are undetermined, which undercuts the distinction between his two categories of action. I then show that this conclusion threatens to undermine the very idea of self-formation Kane seeks to develop. (shrink)

Many contemporary compatibilists about free will and determinism are agnostic about whether determinism is true, yet do not doubt that we have free will. They are thus committed to the thesis that free will is compatible with both determinism and indeterminism. This paper explores the prospects for this version of compatibilism, including its response to the argument that indeterminism would introduce an element of randomness or chance or luck that is inimical to free will and moral responsibility.

In this paper, I argue that trying is the locus of freedom and moral responsibility. Thus, any plausible view of free and responsible action must accommodate and account for free tryings. I then consider a version of agent causation whereby the agent directly causes her tryings. On this view, the agent is afforded direct control over her efforts and there is no need to posit—as other agent-causal theorists do—an uncaused event.
