Theories of free will are often measured against how well they capture everyday intuitions about free will. But what are these everyday intuitions, and what theoretical commitments do they express? Empirical methods have delivered mixed messages. In response, some free will theorists have developed error theories to undermine the credentials of countervailing intuitions. These efforts are predicated on the idea that people might misunderstand determinism in any of several ways. This paper sheds light on the comprehension problem. We first discuss (...) recent efforts to explain systematic errors in how people interpret determinism. Then, we present the alarming results of two new preregistered studies exploring three types of comprehension failure: (a) epiphenomenal bypassing, (b) fatalistic bypassing, and (c) indeterministic intrusion. Our findings suggest that misunderstanding runs deeper than others have supposed. This casts doubt on existing models of commonsense thinking about free will. Unless and until researchers properly control for the kinds of misunderstandings we identify, research on free will intuitions cannot shed light on whether ordinary thinking reflects commitments to compatibilism or incompatibilism. The claim that common sense regards free will and moral responsibility as compatible with determinism has played a central role in both analytic and experimental philosophy. In this paper, we show that evidence in favor of this “natural compatibilism” is undermined by the role that indeterministic metaphysical views play in how people construe deterministic scenarios. To demonstrate this, we re-examine two classic studies that have been used to support natural compatibilism. We find that although people give apparently compatibilist responses, this (...) is largely explained by the fact that people import an indeterministic metaphysics into deterministic scenarios when making judgments about freedom and responsibility. Shaun Nichols has recently argued that while the folk notion of free will is associated with error, a question still remains whether the concept of free will should be eliminated or preserved. He maintains that like other eliminativist arguments in philosophy, arguments that free will is an illusion seem to depend on substantive assumptions about reference. According to free will eliminativists, people have deeply mistaken beliefs about free will and this entails that free will does not exist. However, an alternative (...) reaction is that free will does exist, we just have some deeply mistaken beliefs about it. According to Nichols, all such debates boil down to whether or not the erroneous folk term in question successfully refers or not. Since Nichols adopts the view that reference is systematically ambiguous, he maintains that in some contexts it’s appropriate to take a restrictivist view about whether a term embedded in a false theory refers, while in other contexts it’s appropriate to take a liberal view about whether a token of the very same term refers. This, according to Nichols, affords the possibility of saying that the sentence “free will exists” is false in some contexts and true in others. In this paper I argue that even if we grant Nichols his pluralistic approach to reference, there is still good reason to prefer eliminativism to preservationism with regard to free will. My argument focuses on one important difference between the concept of “free will” and other theoretical terms embedded in false theories—i.e., the role that the phenomenology of free agency plays in reference fixing. Contrary to intuitions that human beings are free to think and act with “buck-stopping” freedom, philosophers since Holbach and Hume have argued that universal causation makes free will nonsensical. Contemporary neuroscience has strengthened their case and begun to reveal subtle and counterintuitive mechanisms in the processes of conscious agency. Although some fear that determinism undermines moral responsibility, the opposite is true: free will, if it existed, would undermine coherent systems of justice. Moreover, deterministic views of human choice clarify the conditions (...) in which we ought to protect people from themselves, for example when they cannot give informed consent to medical procedures. Some of the most unresolved questions in this domain are just now emerging; they include robot ethics and the responsibilities of groups. We propose a philosophical and scientific research program to apply complex systems science to these problems. (shrink)

Many philosophers think not only that we are free to act otherwise than we do, but also that we experience being free in this way. Terry Horgan argues that such experience is compatibilist: it is accurate even if determinism is true. According to Horgan, when people judge their experience as incompatibilist, they misinterpret it. While Horgan's position is attractive, it incurs significant theoretical costs. I sketch an alternative way to be a compatibilist about experiences of free agency that avoids these (...) costs. In brief, I assume that experiences of freedom have a sort of phenomenal content that is inaccurate if determinism is true, just as many incompatibilists claim. Still, I argue that these experiences also have another sort of phenomenal content that is normally accurate, even assuming determinism. (shrink)

We ordinarily think that we human beings have agency: we have control over our choices and make a difference to our environments. Yet it is not obvious how agency can fit into a physical world that is governed by exceptionless laws of nature. In particular, it is unclear how agency is possible if those laws are deterministic and the universe functions like a mechanical clockwork. In this short paper, I first explain the apparent conflict between agency and physical determinism (referring (...) to recent work by Helen Steward on "agency incompatibilism"), then review some salient responses one might give to this conflict, and finally sketch a response that rests on a distinction between “physical” and “agential possibilities.” Agency, I suggest, is a higher-level phenomenon, which comes with its own level-specific notion of possibility, and it cannot be adequately analyzed in physical terms alone or just through the lens of physical possibility. Recent research suggests that, regardless of the truth of libertarianism about free will, there appears to be a widespread belief among nonphilosopher laypersons that the choices of free agents are not causally necessitated by prior states of affairs. In this paper, I propose a new class of debunking explanation for this belief which I call ‘reasons-based accounts’. I start the paper by briefly recounting the failures of extant approaches to debunking explanations, and then use this as a jumping off point (...) to articulate several alternatives, highlighting the strengths and weaknesses of each. Given the available evidence, I argue that we face considerable uncertainty about free will. In particular, I argue that the available philosophical evidence does not support being highly confident in our theories about the nature of free will, though this does not necessarily mean that we should suspend judgment about either incompatibilism or compatibilism. For those who accept incompatibilism, however, I argue that there is enough uncertainty about libertarian free will that they should suspend judgment about whether we are ever (...) free, if not reject free will entirely. While I do not claim that compatibilists should be similarly agnostic about the existence of free will, I argue that most compatibilist theories are subject to considerable uncertainty as well, so that most compatibilists should be agnostic about how often we act freely. I conclude with a brief discussion of how we might address these issues going forward. (shrink)

This article clarifies what a neuroscience challenge to criminal justice must look like by sketching the basic structure of the argument, gradually filling out the details and illustrating the conditions that must be met for the challenge to work. In the process of doing so it explores influential work by Joshua Greene and Jonathan Cohen, and Stephen Morse respectively, arguing that the former should not be understood to present a version of the challenge, and that the latter's argument against the (...) challenge is unpersuasive. This analysis allows the article to flesh out the challenge, and demonstrate why it is currently non-completeable. However, the paper argues that contrary to what is often assumed the burden of proof falls on the defenders of criminal justice, and that they will find meeting it a monumental task. (shrink)

Recent empirical evidence indicates that people tend to believe that they possess indeterminist free will, and people’s experience of choosing and deciding is that they possess such freedom. Some also maintain that people’s belief in indeterminist free will has its source in their experience of choosing and deciding. Yet there seem to be good reasons to resist endorsing. Despite this, I maintain that belief in indeterminist free will really does have its source in experience. I explain how this is so (...) by appeal to the phenomenon of prospection, which is the mental simulation of future possibilities for the purpose of guiding action. Crucially, prospection can be experienced. And because of the way in which prospection models choice, it is easy for agents to experience and to believe that their choice is indeterministic. Yet this belief is not justified; the experience of prospection, and hence of free will as being indeterminist, is actually consistent with determinism. (shrink)
