Contemporary political thought is deeply divided about the role of ontology in political thinking. Famously, political liberal John Rawls has argued that ontological claims are best to be avoided in political thought. In recent years, however, a number of theorists have claimed that ontology is essential to political philosophy. According to the contributors to this ‘ontological turn’, ontological investigations may foster the politicisation of hegemonic political theories and can highlight new possibilities for political life. This essay aims to contribute to (...) the debate about ontology in political philosophy by arguing that a compelling case for ontology can also be made in light of Rawls’ political liberalism itself, in particular, by taking seriously Rawls’ commitment to the politicisation of justice and the task of orientation of political philosophy. To make this case, the paper brings Rawls' perspective in conversation with the critical methodology and the ontology of agonism and reflections on parrhesia or frank truth-telling of Michel Foucault. Despite the persistence of violence inside and around prisons, and the dubious adequacy of criminal law to respond to victim–survivors, international human rights (IHR) discourse increasingly promotes the mobilisation of the state’s penal apparatus to respond to human rights violations, including violence against women (VAW). Using an anticolonial feminist approach, this article scrutinises the ontological and epistemological commitments underlying ‘human rights penality,’ by analysing features of the Western-colonial register vis-a-vis more relational worldviews. Separateness, abstraction, and transcendence broadly underpin the exclusion (...) of embodied experience, context, and material reality from the juridical field. In the second part, through discourse analysis of Inter-American and European case law, the author shows the deployment of human rights penality, the displacement of experience, and the disregard of context in IHR discourse. VAW is construed as a procedural and penal matter: it is the absence of a penal process that courts regard as failure to protect women, rather than the state’s inability/unwillingness to address structural subordination. Moreover, the ‘virtues’ attributed to the penal system justify its expansion, which facilitates the continuity of penal violence and debilitates alternative approaches to justice. This paper stages an encounter between Foucault and Althusser on the question of strategy. By contrasting a few passages in La Volonté de savoir with some of Althusser’s writings on Machiavelli and Lenin, I propose an alternative between the two thinkers according to a schema of strategic thought (Foucault) and a philosophy for strategy (Althusser). This narrow focus enables me to generate a working definition of strategy as the anticipation of an encounter which modifies, abolishes, or otherwise alters the relations (...) constituting its conjuncture. By staging the encounter between the Foucault and Althusser, I propose this definition as a reflection on the phrase “intervention into conjuncture,” and conclude by sketching implications concerning theory, practice, and the discipline of the conjuncture.
