When a person performs or fails to perform a morally significant action, we sometimes think that a particular kind of response is warranted. Praise and blame are perhaps the most obvious forms this reaction might take. For example, one who encounters a car accident may be regarded as worthy of praise for having saved a child from inside the burning car, or alternatively, one may be regarded as worthy of blame for not having used one's mobile phone to call for (...) help. To regard such agents as worthy of one of these reactions is to ascribe moral responsibility to them on the basis of what they have done or left undone. (These are examples of other-directed ascriptions of responsibility. The reaction might also be self-directed, e.g., one can recognize oneself to be blameworthy). Thus, to be morally responsible for something, say an action, is to be worthy of a particular kind of reaction —praise, blame, or something akin to these—for having performed it.[1.. (shrink)

According to the most popular versions of the flicker defense, Frankfurt-style cases fail to undermine the Principle of Alternative Possibilities (PAP) because agents in these cases are (directly) morally responsible not for making the decisions they make but for making these decisions on their own, which is something they could have avoided doing. Frankfurt defenders have primarily focused on trying to show that the alternative possibility of refraining from making the relevant decisions on their own is not a robust alternative, (...) while generally granting that this alternative cannot easily be eliminated from successful cases of this sort. In a recent issue of this journal, Stockdale (2022) attempts to sidestep the debate concerning robustness and develops a novel kind of Frankfurt-style case in which agents are unable to avoid making the relevant decisions on their own. The fundamental problem with Stockdale’s argument is that it hinges on an implausible conception of acting on one’s own. I help clarify the pertinent sense of what it means to do a thing on one’s own in this context and show that these new cases are unable to overcome the targeted versions of the flicker defense of PAP. Frankfurt cases are purported counterexamples to the Principle of Alternative Possibilities, which implies that we are not morally responsible for unavoidable actions. A major permutation of the counterexample strategy features buffered alternatives; this permutation is designed to overcome an influential defense of the Principle of Alternative Possibilities. Here we defend the buffering strategy against two recent objections, both of which stress the timing of an agent’s decision. We argue that attributions of moral responsibility aren’t time-sensitive in the way the objectors (...) suppose. We then turn to the crucial question of when an action is relevantly avoidable—when, in the parlance of the literature, an alternative possibility is robust. We call attention to two plausible tests for robustness that merit further consideration, showing that the agents in buffered Frankfurt cases don’t pass these tests, despite being morally responsible for their actions. I have presented a Frankfurt-style argument (Pereboom 2000, 2001, 2003) against the requirement of robust alternative possibilities for moral responsibility that features an example, Tax Evasion , in which an agent is intuitively morally responsible for a decision, has no robust alternative possibilities, and is clearly not causally determined to make the decision. Here I revise the criterion for robustness in response to suggestions by Dana Nelkin, Jonathan Vance, and Kevin Timpe, and I respond to objections to the argument by (...) A great deal of attention has been paid recently to the claim that traditional Frankfurt-type counterexamples to the Principle of Alternative Possibilities (PAP), which depend for their success on the presence of a perfectly reliable indicator (or prior sign ) of what an agent will freely do if left to act on his own, are guilty of begging the question against incompatibilists, since such indicators seem to presuppose a deterministic relation between an agent’s free action and its causal antecedents. Objections (...) of this sort have given rise to considerable efforts to construct alternative Frankfurt-type counterexamples that do not rely on prior signs of this kind and so do not presuppose determinism in a way that incompatibilists should find objectionable. One consequence of this shift in the way Frankfurt-type counterexamples are formulated is that it provides an opportunity for the forceful resurgence of certain versions of the so-called flicker defense of PAP. In this paper I develop two versions of the flicker defense, indicate their advantages over other versions of this strategy, and defend them against objections. Insofar as either of these is successful, it will show not only that PAP has yet to be falsified by any of the modified Frankfurt-type counterexamples currently on offer but that cases of this sort are in principle incapable of falsifying PAP. In this article I develop several responses to my co-authors of Four Views on Free Will. In reply to Manuel Vargas, I suggest a way to clarify his claim that our concepts of free will and moral responsibility should be revised, and I question whether he really proposes to revise the notion of basic desert at stake in the debate. In response to Robert Kane, I examine the role the rejection of Frankfurt-style arguments has in his position, and whether his (...) criticism of my version of this argument is sound. In reply to John Fischer, I argue that the reasons-responsiveness central to his account of moral responsibility is not best characterized counterfactually, and I provide a suggestion for revision. Proponents of modern Frankfurt-Style Counterexamples generally accept that we cannot construct successful FSCs in which there are no alternative possibilities present. But they maintain that we can construct successful FSCs in which there are no morally significant alternatives present and that such examples succeed in breaking any conceptual link between alternative possibilities and free will. I argue that it is not possible to construct an FSC that succeeds even in this weaker sense. In cases where any alternatives are clearly insignificant, (...) it does not appear at all obvious that the agent can be held responsible. Present popular FSCs include alternatives that are ambiguous in their significance, and when the examples are sharpened to remove this ambiguity, they lose their force. Moreover, the proponent of such examples faces a problem: We can easily construct scenarios in which any alternatives are obviously insignificant, and in such scenarios, we are not intuitively inclined to suppose the agent is responsible. The proponent of new FSCs must therefore distinguish any alternatives she includes from the sorts included in these scenarios. The difference must now be such that this helps to make it seem intuitively likely that the agent is responsible where the agent otherwise would not appear responsible, and these alternatives are irrelevant to any judgment about whether the agent is responsible. I maintain that it is impossible to achieve both of these goals at once. (shrink)

Philosophers employing Frankfurt-style cases to challenge the principle of alternative possibilities have mostly sought to construct scenarios that eliminate as many of an agent’s alternatives as possible—and all alternatives at the moment of action, within the agent’s control—without causally determining the agent’s actions. One of the chief difficulties for this traditional approach is that the closer one gets to ruling out absolutely all alternative possibilities the more it appears that agents’ actions in these cases are causally determined. “Limited-blockage” versions of (...) these cases are meant to sidestep this worry by blocking all and only those alternatives that are intrinsically relevant to moral responsibility (“robust alternatives”) while leaving open all other alternatives, including a significant range of alternatives that are within the agent’s voluntary control at the moment of action. I argue that, owing to the fact that omissions (and not just actions) are capable of constituting robust alternative possibilities, limited-blockage cases cannot avoid collapsing into the more traditional sort of Frankfurt-style case to which they are meant to be an alternative and so are vulnerable to the very same concerns they are meant to avoid. The aim of this paper is to present a version of the principle of alternate possibilities which is not susceptible to the Frankfurt-style counter-example. I argue that PAP does not need to be endorsed as a necessary condition for moral responsibility and, in fact, presenting PAP as a sufficient condition maintains its usefulness as a maxim for moral accountability whilst avoiding Frankfurt-style counter-examples. In addition, I provide a further sufficient condition for moral responsibility – the twin world condition – and (...) argue that this provides a means of justifying why the protagonist in Frankfurt-style scenarios is still felt to be morally responsible. I conclude with the claim that neither the amended PAP nor the twin world condition is necessary for the ascription of moral responsibility; rather, what is necessary is simply that one of these conditions is satisfied. I defend the principle of alternative possibilities against what are sometimes known as buffer cases, which are supposed by some to be counterexamples to the principle. I develop an existing problem with the claim that standard buffer cases are counterexamples to PAP, before responding to a recent attempt by Michael McKenna to modify the cases in a way that circumvents this problem. While McKenna’s strategy does avoid the problem, I argue that it faces a different difficulty. I conclude that buffer (...) cases pose no threat to PAP. (shrink)

Pereboom has formulated a Frankfurt-style counterexample in which an agent is alleged to be responsible despite the fact that there are only non-robust alternatives present (Pereboom, Moral responsibility and alternative possibilities: essays on the importance of alternative possibilities, 2003; Phil Explor 12(2):109–118, 2009). I support Widerker’s objection to Pereboom’s Tax Evasion 2 example (Widerker, J Phil 103(4):163–187, 2006) (which rests on the worry that the agent in this example is derivatively culpable as opposed to directly responsible) against Pereboom’s recent counterarguments (...) to this objection (Pereboom 2009). Building on work by Moya (J Phil 104:475–486, 2007; Critica 43(128):3–26, 2011) and Widerker (Widerker 2006), I argue that there is good reason to measure the robustness of alternatives in terms of comparative, rather than non-comparative likelihood of exemption, where the important factor for blame is whether the agent is “doing her reasonable best” to avoid blameworthy behaviour. I maintain that an agent only ever appears responsible when alternatives are robust in this sense. In Pereboom’s examples, both Tax Evasion 2, and his more recent version, Tax Evasion 3 (Pereboom 2009), I maintain the robustness of the alternatives, so understood, is unclear. We can clear up any ambiguity by sharpening the examples, and the result is that the agent appears responsible when the alternatives are made clearly robust, and does not appear responsible when alternatives appear clearly non-robust. The comparative nature of our judgements about blame, I maintain helps to explain the continuing appeal of the “leeway-incompatibilist” viewpoint. (shrink)

Three recent ‘state of the art’ Frankfurt cases are responded to: Widerker’s Brain-Malfunction-W case and Pereboom’s Tax Evasion cases (2 & 3). These cases are intended by their authors to resurrect the neo-Frankfurt project of overturning the Principle of Alternative Possibilities (PAP) in the teeth of the widespread acceptance of some combination of the WKG (Widerker-Kane-Ginet) dilemma, the Flicker of Freedom strategy and the revised PAP response (‘Principle of Alternative Blame’, ‘Principle of Alternative Expectations’). The three neo-Frankfurt cases of Pereboom (...) and Widerker shown to be insufficient for their intended purpose. Of central importance to any account of responsibility is that this applies at the level of the Right and not the Good. Arguments of Carlos Moya are expanded and augmented by considerations from Chisholm, Lucas, Dummett and Lockie (2003) to show that a number of severe problems remain for anyone attempting to resurrect the Frankfurt project. Harry Frankfurt's well-known counterexample to the principle of alternate possibilities (PAP) has recently come under attack by those who argue that the success of that sort of counterexample depends on the falsity of incompatibilism. In response, I argue that, given one controversial assumption, there are Frankfurt-style counterexamples to PAP that don't take the falsity of incompatibilism for granted. The controversial assumption is the Molinist one that something like middle knowledge is possible. I then show how the falsity of PAP causes (...) some trouble for the Free Will Defense standardly offered in response to atheistic arguments from evil. (shrink)

In recent years, many incompatibilists have come to reject the traditional association of moral responsibility with alternative possibilities. Kevin Timpe argues that one such incompatibilist, Eleonore Stump, ultimately fails in her bid to sever this link. While she may have succeeded in dissociating responsibility from the freedom to perform a different action, he argues, she ends up reinforcing a related link, between responsibility and the freedom to act under a different mode. In this paper, I argue that Timpe’s response to (...) Stump exploits concessions she need not have made. The upshot is that, contrary to what Timpe maintains, there is no reason to doubt that Stump's brand of incompatibilism is a genuine alternative to the traditional variety. (shrink)

Traditional theorists about free will and moral responsibility endorse the principle of alternative possibilities (PAP): an agent is morally responsible for an action that she performs only if she can do or could have done otherwise. According to source theorists, PAP is false and an agent is morally responsible for her action only if she is the source of that action. Source incompatibilists accept the source theory but also endorse INC: if determinism is true, then no one is morally responsible (...) for any action. This paper is a critique of a kind of source incompatibilism, namely, direct source incompatibilism. Direct source incompatibilists reject PAP on the basis of Frankfurt-style examples. Since PAP is one of two premises in the traditional argument for INC, direct source incompatibilists opt for a version of the direct argument, which argues for INC with the aid of some non-responsibility transfer principle. I demonstrate that this option is not available, for there is a tension between the following two claims. (shrink)

While philosophers have worried about mental causation for centuries, worries about the causal relevance of conscious phenomena are also increasingly featuring in neuroscientific literature. Neuroscientists have regarded the threat of epiphenomenalism as interesting primarily because they have supposed that it entails free will scepticism. However, the steps that get us from a premise about the causal irrelevance of conscious phenomena to a conclusion about free will are not entirely clear. In fact, if we examine popular philosophical accounts of free will, (...) we find, for the most part, nothing to suggest that free will is inconsistent with the presence of unconscious neural precursors to choices. It is only if we adopt highly non-naturalistic assumptions about the mind (e.g. if we embrace Cartesian dualism and locate free choice in the non-physical realm) that it seems plausible to suppose that the neuroscientific data generates a threat to free will. Frankfurt cases are designed to be counterexamples to the principle of alternative possibilities, a version of which states that an agent is blameworthy for what she did only if there was an alternative course of action available to her at the time, the availability of which is relevant per se to an explanation of why the agent is blameworthy for her action. In this article, I argue that the buffer cases, which are among the most promising and influential Frankfurt cases (...) produced in recent years, are not counterexamples to PAP. While the agent in these examples may be blameworthy for what she did, I contend that there was an alternative course of action available to her at the time, the availability of which is relevant per se to an explanation of why the agent is blameworthy for her action. I then compare my objection to the buffer cases with a similar, though importantly different objection to them. Whatever merits this other objection may have, I contend that the one on offer here has important advantages over it. (shrink)

In his seminal paper ‘Alternate Possibilities and Moral Responsibility’, Harry Frankfurt argues against the principle of alternate possibilities (PAP)—the principle that persons are morally responsible for what they have done only if they could have done otherwise—by presenting a case in which, apparently, a person is morally responsible for what he has done even though, due to the presence of a counterfactual intervener, he could not have done otherwise. According to a compelling (yet relatively under-discussed) response to Frankfurt’s attack on (...) PAP, Frankfurt has not succeeded in showing that the principle is false, since in the scenario he asks us to imagine the agent has an alternate possibility: he can (unwittingly) force the intervener’s hand by revising his decision to perform the action in question and thereby avoid performing the action himself. This response to Frankfurt has been objected to, however, on the grounds that the agent does not avoid performing the action since the intervener acts upon an involuntary prior sign. The goal of this article is to show that this objection fails. While it is true that the prior sign upon which the intervener acts is involuntary, it is a consequence of a change of mind that is voluntary. It follows that the agent does what is needed to avoid performing the action in question (in the counterfactual sequence). (shrink)

Derk Perebooms Free Will, Agency, and Meaning in Life (2014) provides the most lively and comprehensive defense of free will skepticism in the literature. It contains a reworked and expanded version of the view he first developed in Living without Free Will (2001). Important objections to the early book are answered, some slight modifications are introduced, and the overall account is significantly embellished—for example, Pereboom proposes a new account of rational deliberation consistent with the belief that one’s actions are causally (...) determined (ch.5) and develops a forward-looking theory of moral responsibility consistent with free will skepticism (ch.6). A significant contribution to the field, Free Will, Agency, and Meaning in Life is destined to become a classic and is essential reading for anyone interested in free will and moral responsibility. I argue that the simple foreknowledge view, according to which God knows at some time t 1 what an agent S will do at t 2 , is incompatible with human free will. I criticize two arguments in favor of the thesis that the simple foreknowledge view is consistent with human freedom, and conclude that, even if divine foreknowledge does not causally compel human action, foreknowledge is nevertheless relevantly similar to other cases in which human freedom is undermined. Recently, Trenton Merricks has defended a libertarian view of human freedom. He claims that human persons have downward causal control of their constituent parts, and that downward causal control of this sort is sufficient for free will. In this paper I examine Merricks’s defense of free will, and argue that it is unsuccessful. I show that having downward causal control is not sufficient for for free will. In an Appendix I also argue that Merricks’s defense of free will, together with (...) assumptions implicit in his broader ontology, commit him to the implausible conclusion that determinism is incompatible with the existence of human persons. Free will and determinism have recently attracted the attention of Buddhist scholars who have defended conflicting views on this issue. I argue that there is no reason to think that this problem cannot arise in Buddhist philosophy, since there are two senses of ‘free will’ that are compatible with the doctrine of non-self. I propose a reconstruction of a problem of free will and determinism in Early Buddhism, given a) the assumption that Buddhist causation entails universal causal determinism, and b) (...) a crucial passage suggesting that Early Buddhism is committed to the principle of alternative possibilities which is arguably incompatible with a determinist interpretation of causation. This passage suggests that Early Buddhism must leave room for a robust, incompatibilist form of free will, and that a conception of indeterminist free will in the spirit of Robert Kane’s theory allows us to make sense of that notion. The Luck Argument is among the most influential objections to the main brand of libertarianism about metaphysical freedom and moral responsibility. In his work, Alfred Mele [2006. Free will and luck . Oxford: Oxford University Press] develops - and then attempts to defeat - the literature's most promising version of the Luck Argument. After explaining Mele's version of the Luck Argument, I present two objections to his novel reply to the argument. I argue for the following two claims: (1) Mele's (...) reply is either otiose or undermined by his own defense of the Luck Argument from a different objection and (2) Mele's reply turns out to lack the form required to engage the step of the Luck Argument it targets. Having shown that the failure of Mele's novel attack is overdetermined, I close by defending a different (and, I believe, decisive) objection to the Luck Argument - which, as it happens, lurks right under Mele's nose. Sometimes you make a choice. Whether or not you made it was up to you. The choice was free. But how can this be? A scientific view of the world may leave no room for free choice. Free will literature continually explodes. Yet experts still focus on control or on a power to do otherwise. Sadly, they neglect another intuitive feature of free will: being an underived source or ultimate originator. When acting freely, one is a self-determined, self-directed, sole author (...) of change. Surprisingly, though the literature is replete with this pre-theoretic feature of free will, virtually no one makes rigorous use of it when constructing arguments. Equipped with fresh research, this book contends that agent-causation—currently an unpopular theory—deserves serious reconsideration. Only agent-causation accounts for ultimate origination, and popular objections fail under rigorous scrutiny. This book is tightly argued. It challenges and deepens recent advances in free will scholarship made by Peter van Inwagen, Robert Kane, Carl Ginet, Randy Clarke, Stewart Goetz, Tim O’Connor, and others. (shrink)

This is the introduction to a volume of new essays in the metaphysics of moral responsibility by John Martin Fischer, Carl Ginet, Ishtiyaque Haji, Alfred R. Mele, Derk Pereboom, Paul Russell, and Peter van Inwagen. I provide some background for the essays, cover the main debates in the metaphysics of moral responsibility, and emphasize some of the authors' contributions to this area of philosophy.

This paper aims to challenge the view that the sign present in many Frankfurt-style scenarios is insufficiently robust to constitute evidence for the possibility of an alternate decision, and therefore inadequate as a means of determining moral responsibility. I have amended Frankfurt’s original scenario, so as to allow Jones, as well as Black, the opportunity to monitor his (Jones’s) own inclination towards a particular decision (the sign). Different outcome possibilities are presented, to the effect that Jones’s awareness of his own (...) inclinations leads to the conclusion that the sign must be either (a) a prior determinate of the decision about to be made, (b) prior and indeterminate (therefore allowing for a contra-inclination decision to be made), or (c) constitutive of a decision that Jones has made but is not yet aware of. In effect, this means that, prior to the intervention of Black, Jones must have decided to do otherwise or could have so decided. Either way, although Frankfurt’s conclusion, that Jones could not have done other than he did, is upheld, the idea that he could not have decided otherwise must be rejected, and with it the view that the sign is nothing more than a flicker of freedom insufficient for assigning morally responsibility. Famed so-called 'Frankfurt-type examples' have been invoked to cast doubt on the principle that a person is morally responsible for what she has done only if she could have done otherwise. Many who disagree that the examples are successful in this respect argue that these examples succumb to a deadly dilemma. I uncover and assess libertarian assumptions upon which the 'dilemma objection' is based. On exposing these assumptions, it becomes clear that various sorts of libertarian are no longer entitled to (...) one or the other horns of the dilemma. (shrink)

In this paper, we motivate, propose and defend the following two conditions as individually sufficient and disjunctively necessary for moral responsibility: PODMA —originally proposed by Coren, Acta Analytica, 33, 145–159,, now cast as sufficient rather than necessary—and the TWC*, which amends versions presented by Young, 961–969, 2016; Philosophia, 45, 1365–1380, 2017). We explain why there is a need for new necessary and sufficient conditions, how these build on and improve existing ideas, particularly in relation to Frankfurt-style counterexamples and the continuing (...) discussion on their effectiveness, and why PODMA and the TWC* are good candidates. Finally, we defend the proposal against anticipated objections in order to clarify why we think these individually sufficient and disjunctively necessary conditions are plausible and able to inform the ongoing debate on the role of alternate possibilities in the ascription of moral responsibility. Plausibly, agents act freely iff their actions are responses to reasons. But what sort of relationship between reason and action is required for the action to count as a response? The overwhelmingly dominant answer to this question is modalist. It holds that responses are actions that share a modally robust or secure relationship with the relevant reasons. This thesis offers a new alternative answer. It argues that responses are actions that can be explained by reasons in the right way. This (...) explanationist answer comes apart from the modalist answer. For it holds that actions are responses to reasons if they are explained by those reasons even if they don’t share a modally robust relationship. Explanationism thus offers a novel way of vindicating the intuition that alternative possibilities don’t matter to responding to reasons and (consequently) free agency. The key dialectical position the thesis develops is that both modalism and explanationism constitute attempts to capture he core type of relationship encoded by the notion of a response. Responses to reasons, at core, involve a non-accidental relationship between reason and action. We can either understand non-accidentality as a modal phenomenon – as a modally robust tracking between two facts. Or we can understand non-accidentality as an explanatory phenomenon – as a special explanatory relationship between two facts. According to my rival explanationist proposal, two facts share a non-accidental relationship iff we can give a unified explanation of why both obtain. Unified explanations are explanations of why [p&q] that cannot be decomposed into two (or more) separate independent explanations of p and of q. Consequently, according to explanationism about responding to reasons, actions are responses to reasons iff those reasons offer a rational explanation of the action that cannot be decomposed into separate independent components. One of the main challenges faced by Frankfurt-style Cases has been elaborated by Carlos Moya. According to this argument, seemingly insignificant alternatives can become significant and exempting due to the context in which agents find themselves. Given that Frankfurt-style Cases involve extreme situations, seemingly insignificant alternatives become robust, rendering Frankfurt Cases ineffective against the Principle of Alternative Possibilities. This paper provides an overview of the contextual alternatives and Frankfurt Cases debate, presents Moya’s strategy, and ultimately advances an argument to cast (...) doubt on the effectiveness of Moya’s attack on Frankfurt Cases.
