La atención en la obra rortiana a la retórica como tal es mínima, por no decir nula. No hay en Rorty una Filosofía de la Retórica en el sentido objetivo del genitivo. The purpose of this paper is to defend and justify the hypothesis that Perelman’s New Rhetoric can enable the French school of Discourse Analysis to readjust its theoretical positions concerning the ethics of discourse. If you want to challenge or at least weaken the adhesion to a system of values, you can basically adopt two radically opposed rhetorical strategies. Either you will attack the system in a frontal way: for instance, fundamentalists or fascists deny any validity to democratic values and human rights. The author holds that the old theory according to which philosophy is the matrix of argumentation studies must be entirely reviewed currently. He argues that argumentation theory, as an interdisciplinary domain, may start playing, in new terms, the role which ― in the Cartesian tree ― was that of philosophy as the trunk of the different branches of human knowledge, as long as a set of requirements, which he lists, were met. |

We intend to examine ways that emotions may be intertwined within argumentative legal discourses. From the transcript of a brief trial in a Court of Appeal in Brazil we have the opportunity to observe how the emotional and rational reasoning live together in a deliberation among magistrates. “The leg broken case” allow us to examine how judges define the value of compensation to be paid in cases of moral damage.
