Abstract: The emergence of cross-border communities and transnational associations requires new ways of thinking about the norms involved in democracy in a globalized world. Given the significance of human rights fulfillment, including social and economic rights, I argue here for giving weight to the claims of political communities while also recognizing the need for input by distant others into the decisions of global governance institutions that affect them. I develop two criteria for addressing the scope of democratization in transnational contexts— (...) common activities and impact on basic human rights —and argue for their compatibility. I then consider some practical implications for institutional transformation and design, including new forms of transnational representation. (shrink)

In his 1923 work, Roman Catholicism and Political Form, Carl Schmitt claims that representation is a complexio oppositorum and incarnates a hierarchical form of political authority, which is alternative to liberalism. This article shows that Carl Schmitt’s interpretation of the political theology of representation is based on a misreading. Schmitt selectively overlooks some meanings of the theology of repraesentatio to build his decisionistic political agenda. An investigation of the original conceptual meanings of representation in Tertullian, the first Christian author who (...) theorized representation and established many of its subsequent theological meanings, shows a different picture. At its inception, representation already included mechanisms of plurality and participation, which anticipated, and perhaps motivated, the absorption of the representation vocabulary within democratic discourse and practice. The democratization of science entails the public having greater influence over science and that influence being shared more equally among members of the public. This chapter will present a thumbnail sketch of the arguments for the democratization of science based on the importance of collectively shaping science’s impact on society, the instrumental benefits of public participation in science, and the need to ensure that the use of science in politics does not undermine collective self-government. Calls for new forms of representation to protect the interests of future generations and non-human species have become common among green theorists. Examining these proposals critically, this article finds, first, that ‘ecological representation’ contradicts the virtues traditionally associated with representative government: creating a circuit of legitimacy between voters and political authorities; preventing abuses of power; keeping law neutral with respect to the worth of competing values. It concludes, second, that our environmental predicament is not essentially the fault of inadequate representation. (...) The logic of representation itself is part of the problem. Several authors have recently stressed the constitutive and ubiquitous nature of representation, which, as a result, can no longer be conceived as a relation between pre-existing entities. This has important consequences for democratic representation, traditionally thought in terms of authorization, accountability or representativity. This article argues that Jacques Rancière’s political philosophy makes a fruitful contribution to the necessary rethinking of democratic representation. Although Rancière never systematically developed a theory of representation, this concept is shown to constitute a red thread throughout (...) his political writings. His main contribution consists in shifting the focus from the relation between representative and represented to the relation between the distribution of the sensible as a space of representability and its disruption or contestation. This makes it possible to recast a critique of representative government, and to reconceive of democratic representation, which is about making the contingent equality underlying each order visible. In recent decades, theories of representation have undergone a constructivist turn, as many theorists no longer view the represented subject as prior to but rather as an effect of representation. Whereas some critics have claimed that lacking an ontologically pre-given subject undermines the theory of representation, many democratic theorists have sought to reconceptualize representation and its democratic possibilities by turning away from ontological questions altogether. By focusing instead on how representatives come to know the public interest, many scholars now contend (...) that an epistemological account best explains how political representation can foster democratic participation. Yet, theorists of representation have not assessed whether this turn to epistemology has overcome the ontological problems that initially motivated it. This article tracks epistemological defenses of representation to outline two models of political representation that attempt to tackle the epistemological problem of constituent interest without positing a foundational ontology of the subject. I argue that both theoretical tendencies ultimately remain caught in the problems of ontology, thereby undercutting their normative aspirations to foster political participation. Turning to Hannah Arendt’s comments on public interest and her writings on council democracy, the article retheorizes the concept of political representation to avoid the ontological problems that beset current accounts. This paper argues that, because Science and Technology Studies lost contact with political philosophy, its defense of public participation in policy-making involving technical claims is normatively unsatisfactory. Current penchants for political under-laboring and normative individualism are critiqued, and the connections between STS and theorists of deliberative democracy are explored. A conservative normativity is proposed, and STS positions on public participation are discussed in relation to current questions about individual and group rights in a liberal democracy. This paper intersects the literature on the democratic boundary problem with the literature on the constructivist turn in political representation to show that the boundary problem broadly construed involves a distinction between ‘the problem of inclusion’ (into pre-existing demoi and their decision-making procedures) and ‘the problem of constituting the demos’ (which involves criteria for partaking in constituent power). This distinction is consistently neglected by democratic theorists. However, it has serious implications for representative democracies because the standard answers to the boundary (...) problem – the all-affected-interests principle, the all-subjected principle, and the substantive-demos principle – do not apply to the problem of constituting the demos. A new principle aimed at the latter problem is here proposed: the constructivist-representative principle. In the end, it should be clear that ascertaining who should be entitled to participate in which democratic decision requires the adoption of different principles depending on the specific demos in question and on the type of decision-making procedure involved (e.g., constitution-making-or-changing, lawmaking, policymaking, etc.). The ‘constructivist turn’ in political representation literature has clarified that representation is crucial in forging identities – through the creation of ideological and symbolic representations that mobilize and coalesce otherwise scattered and undefined social forces – and thus also why it is essentially an interpretative and performative activity. In this article I argue that, as a consequence of this emphasis on interpretation and performativity, this approach makes clear why the ethos of representatives is important in representation. To prove this, I (...) employ some insights from rhetoric. Rhetorical persuasion and democratic representation, indeed, call for a similar kind of judgment, as they both need to mediate between opposing exigencies: rhetoric between attentiveness to the specificity of the audience and the creation of new beliefs, and representation between being responsive to specific interests and giving them a new articulation. Mediating this tension requires an exercise of judgment that, being directed toward the future, inevitably introduces uncertainty into the relation. This is why both in rhetoric and representation the ethos is an essential element. However, as I argue in the conclusion, the personal qualities that should be considered relevant here are above political qualities, rather than technical or moral ones. (shrink)

What gives representation its democratic essence? The recent democratic theory literature, particularly spearheaded by Nadia Urbinati, defends representative mediation as a facilitator of ongoing democratic contestation and revision. While I agree with this agonistic defence, I take issue with how Urbinati construes it. For her, representative contestation works in the teleological sense of testing opinions over time and sublimating them into ideological forms as a safeguard against the threat of immediacy. This article locates the traces of such presentism within Urbinati’s (...) own teleological framework, which I see as compromising her commitment to the agonistic vein in representative politics. When our relationship to the future is imagined from such a teleological angle, I argue, the scope of our representative options becomes significantly narrowed down and the possibility of beginning anew looks quite slim. I develop this critique by tapping into Jacques Derrida’s affirmation of untimeliness. (shrink)

Representation is a major and multifaceted concept of modern politics. Through open and regular elections, it shields the democratic character of representative governments, compelling politicians to pursue the interests of their constituencies and become responsive to their demands. But since the concept of representation is so embedded in the day-to-day workings of democratic regimes, it has largely lost significant traces of its history that shed light on its political dawn. There are longstanding calls for international organizations to be more inclusive of the voices and interests of people whose lives they affect. There is nevertheless widespread disagreement among practitioners and political theorists over who ought to be included in IO decision-making and by what means. This paper focuses on the inclusion of IOs’ ‘intended beneficiaries,’ both in principle and practice. It argues that IOs’ intended beneficiaries have particularly strong normative claims for inclusion because IOs can affect their vital interests and (...) their political agency. It then examines how these claims to inclusion might be feasibly addressed. The paper proposes a model of inclusion via representation and communication, or ‘mediated inclusion.’ An examination of existing practices in global governance reveals significant opportunities for the mediated inclusion of IOs’ intended beneficiaries, as well as pervasive obstacles. The paper concludes that the inclusion of intended beneficiaries by IOs is both appropriate and feasible. (shrink)

This paper discusses the myths regarding both the conceptualization and the expected effects that are implicitly or explicitly presented in analyses of the so-called ‘democratic innovations’, that is, the new institutions that aim to increase public participation beyond regular elections. It is argued that these myths, together with the (fictitious) confrontation between direct and indirect politics, have generated false oppositions and reductionisms that mask the debate and limit empirical approximations to democratic innovation. A research agenda based on the concept of (...) ‘participatory ecologies’ is suggested as a way to gain an understanding of the mechanisms of participation in a systematic way.Este artículo analiza los mitos que se han construido, tanto en un plano conceptual como de efectos esperados, en torno a las denominadas innovaciones democráticas, entendidas como instituciones destinadas a incrementar la participación ciudadana más allá de las elecciones. Argumentamos que tanto estos mitos como la (ficticia) confrontación entre política directa e indirecta ha generado falsas oposiciones y reduccionismos que enmascaran el debate y limitan el estudio empírico de la innovación democrática. Una agenda de investigación basada en el concepto de ecologías participativas se sugiere para el entendimiento de los mecanismos de participación en forma sistemática. (shrink)

The paper deals with the paradox of the incommensurability of the demands of responsiveness and performativity in representative democracy. To solve this puzzle, the paper first analyzes Pitkin’s concept of symbolic representation. Pitkin sees symbolic representation as a caricature of democracy because of its performativity, non-rationality and vagueness. The paper argues that these are indeed the key characteristics of every single representative act and that their presence does not make representation undemocratic. Using the work of Claude Lefort, the second part (...) of the paper attempts to set out the conditions that would enable us to differentiate between the performativity of representation appropriate in a democratic society and the sheer falsification of the popular will. The paper claims that such a distinction would demand that we extend our understanding of representation to go beyond the relation between the representative and the represented and focus instead on the contestability of governmental claims to represent. "Transparency" is the constant refrain of democratic politics, a promised aid to accountability and integrity in public life. Secrecy is stigmatized as a work of corruption, tolerable by a compromise of democratic principles. My dissertation challenges both ideas. It argues that secrecy and transparency are best understood as complementary, not contradictory, practices. And it develops a normative account of liberal democratic politics in which duties of transparency coexist with permissions to act behind closed doors. The project begins with some history. (...) I show that the language of transparency gained currency only in the last quarter century, and explain how its proximate sources promote three dubious assumptions—that disclosure should in principle be maximized, that it prevents misrule more or less automatically, and that its value is either instrumental, or rooted in a reductive notion of democracy as the rule of popular opinion. Against these assumptions, I sketch an alternative account of liberal democracy centered on the logics of representation, liberty, and equality. These three "logics of self-government" give rise to duties of transparency binding on public and private actors alike. Such obligations have bite, I argue, but they are not all-encompassing. Indeed, the same ideals of representation, liberty, and equality license concealment in a range of important contexts, including deliberation and dissent. Having made this case, I go on to explain how secrecy and transparency can form a "democratic dyad," deepening rather than undermining the project of self-rule. Lastly, I address the limits of conventional transparency practices. Taken alone, disclosure is subject to a range of pitfalls, often failing to produce the results promised in transparency’s name. While my non-instrumental case for openness is not destabilized by this analysis, it does suggest that mandating disclosure is rarely enough. I therefore propose a series of adversarial practices to facilitate the checking of unjustifiable secrecy, and highlight the critical role of interpretation in efforts to make power intelligible. In the end, my dissertation offers a novel defense of secrecy and transparency that highlights rather than minimizes the hard work of political engagement. (shrink)
