I criticize two ways of interpreting Kant's claim that property rights are merely ‘provisional’ in the state of nature.Weak provisionalityholds that in the state of nature agents can make rightful claims to property. Most opponents of somatic cell nuclear transfer and embryonic stem cell technologies base their arguments on the twin assertions that the embryo is either a human being or a potential human being, and that it is wrong to destroy a human being or potential human being in order to produce stem cell lines. Proponents’ justifications of stem cell research are more varied, but not enough to escape the charge of obsession with the status of the embryo. What unites the two (...) warring sides in ‘the stem cell wars’ is that women are equally invisible to both: ‘the lady vanishes.’ Yet the most legitimate property in the body is that which women possess in their reproductive tissue and the products of their reproductive labour. By drawing on the accepted characterisation in the common law of property as a bundle of rights, and on a Hegelian model of contract as mutual recognition, we can lessen the impact of the tendency to regard women and their ova as merely receptacles and women’s reproductive labour as unimportant. Although John Locke’s theory of appropriation is undoubtedly influential, no one seems to agree about exactly what he was trying to say. It is unlikely that someone will write the interpretation that effectively ends the controversy. Instead of trying to find the one definitive interpretation of Locke’s property theory, this article attempts to identify the range of reasonable interpretations and extensions of Lockean property theory that exist in the contemporary literature with an emphasis on his argument for unilateral appropriation. It (...) goes through Locke’s argument point-by-point discussing the controversy over what he said and over what he perhaps should have said to make the most valuable and coherent argument. The result is an outline of Lockean theories of property: a menu of options by which one might use appropriation to justify property rights. Supporters only need to pick the version they find most plausible, but opponents should be aware of the entire menu. Anyone claiming to refute appropriation-based property rights must address not only one but all potentially valid versions of it. (shrink)

John Locke is generally seen as an unequivocal defender of private property. However, taken normatively, certain aspects of his argument leave room for interesting loopholes with relevance to some of today’s social and political crises. This paper focuses largely on the spoilage proviso—in which Locke warns against appropriating more than one can make use of—and its possible application to abandoned buildings and the potential for legitimate productive use to be made of them by people other than the legal owner. Using (...) two case studies in which squatters have actively reversed the dereliction of abandoned buildings, this article aims to build a defence of certain types of squatting based on the limitations Locke has placed on the appropriation and the retention of property. Since the establishment of the Human Genome Project and the identification of genes in human DNA that play a role in human diseases and disorders, a long, moral and political, battle has began over the extension of IPRs to information contained in human genetic material. According to the Nuffield Council on Bioethics, over the past 20 years, large numbers of human genes have been the subject of thousands of patent applications. This paper examines whether human gene patents can be justified (...) in terms of liberal theories of morality such as natural law, personality development, just reward and social utility. It is argued that human gene patents are in conflict with fundamental principles of liberal morality and justice because they result in "genetic information feudalism". (shrink)

The Kantian moral foundations of Nozickian libertarianism suggest that the claim that self‐ownership grounds only negative rights to property should be rejected. The moral foundations of Nozick's libertarianism better support basing property rights on moral desert. It is neither incoherent nor implausible to say that need can be a basis for desert. By implication, the libertarian contention that persons ought to be respected as persons living self‐shaping lives is inconsistent with the libertarian refusal to accept that claims of need can (...) sometimes outweigh claims to property. Surge en nuestras sociedades la propiedad intelectual para resolver problemas generados por la evolución técnica. Unos la entienden como una noción sui generis, otros la recusan. Nuestro enfoque reductivo recalca sus semejanzas con la propiedad de otros bienes. Se aborda el problema de sus fundamentos, inclinándonos por una justificación relativa al actual marco institucional. Tales propuestas están ligadas a la dilucidación metafísica de los objetos sobre los que recae, brindándose una concepción de los mismos como cúmulos de possibilia. Así defendida, (...) la propiedad intelectual tiene que desempeñar un papel social, recurriendo a la noción de servidumbres, voluntarias o legales, todo lo cual se aplica singularmente a los productos de la investigación científica en el ámbito académico, denunciándose la privatización de sus beneficios. La relación entre patrimonio y derechos políticos en la obra de John Locke ha sido ampliamente discutida. Por un lado, se encuentran posiciones como las de Kendall y Tully que atribuyen un carácter democrático a la concepción lockeana sobre la sociedad civil. Por otro, interpretaciones como las de Ashcraft que le asignan un sesgo revolucionario e igualitario, próximo a la concepción de los Levellers. Sin embargo, a la luz de una serie de documentos, es posible discutir estas interpretaciones, como ya (...) lo han hecho diversos intérpretes parcialmente. Se mostrará aquí que Locke supone que la discusión parlamentaria compete a quienes, representando a los diferentes sectores productivos, discuten la promoción de sus actividades y que los trabajadores, al no disponer de la formación necesaria para la discusión sobre los asuntos públicos, no son considerados para participar del ejercicio parlamentario sino sólo de una resistencia excepcional. Many countries encourage immigration, yet almost without exception they impose medical conditions on the admissibility of prospective immigrants. This paper examines the ethical defensibility of this practice. It argues that the neighbourhood principle, which states that we owe a greater duty to neighbours than to strangers, when properly understood, extends to all human beings, that economic and safety considerations play only a limited role in ethically underwriting an exclusionary policy, and that medical immigration criteria should be harmonized with treatment eligibility (...) criteria for citizens of the relevant countries themselves.
