Dignity is often invoked as the basis of human rights. The precise relation between dignity and human rights remains objectionably obscure, however, and many appeals to dignity seem little more than hand-waving, as critics have pointed out. This vagueness is potentially damning for contemporary human rights accounts, as it calls into question whether dignity can truly serve as the foundation of human rights. In order to defend the view that human rights are grounded in human dignity, this paper presents a (...) novel analysis of dignity that elucidates how human rights can be derived from dignity. Arguing that neither contingent nor inherent conceptions of dignity can, on their own, account for human rights, it develops a conceptualisation of dignity that combines inherent and contingent features in a coherent fashion. This, in turn, is shown to provide us with the means to explain how human rights are both grounded in and protective of dignity. Showing that the inherent features of dignity always generate a claim to the contingent features of dignity, the paper demonstrates that human rights derive directly from the inherent features of dignity, whilst what they protect are the contingent features of dignity. The paper closes with a discussion of the advantages of conceptualising dignity in the manner proposed, explicating the connection between dignity and nobility. (shrink)

Es wurde für die These argumentiert, dass der Begriff der Würde in der Medizinethik nutzlos sei und in den Fällen, in denen er verständlich verwendet wird, nichts anderes meint als den Respekt vor der Autonomie von Personen. In diesem Aufsatz soll gezeigt werden, dass diese These falsch ist. Es wird ein Begriff von Würde vorgestellt, der sich nicht auf den Begriff des Respekts vor der Autonomie von Personen reduzieren lässt. Anhand der Diskussion um ein Sterben in Würde soll auch deutlich (...) werden, dass auf den Begriff der Würde auch in der Medizinethik nicht verzichtet werden kann. (shrink)

Nicht erst seit Ruth Macklins einflussreichem Aufsatz „Dignity is a useless concept“ ist eine breite Debatte um Sinn und Unsinn des Begriffs der Menschenwürde in der Medizinethik entbrannt. In diesem Beitrag möchte ich mein Augenmerk auf die von Macklin prominent gemachte Substitutionsthese richten. In ihrer einflussreich gewordenen Fassung propagiert diese eine Ersetzung des Menschenwürdebegriffs durch denjenigen der Autonomie. Doch was ist damit genau gemeint? – Ausgehend von einer Analyse von Macklins Argumenten möchte ich zeigen, unter welchen Bedingungen die Substitutionsthese die (...) von ihren Vertretern häufig in den Vordergrund gestellten eleminativen Ergebnisse zeitigt – die Rede von einem eigenständigen begrifflichen Gehalt von „Würde“ sollte aufgegeben werden. Im Verlauf der Untersuchung werden auch die Vorzüge einer solchen Position gegenüber stärker eliminativ auftretenden Standpunkten und Positionen deutlich, die den Ausdruck als berechtigt, aber unanalysierbar betrachten. The central role of human dignity in ethics and law stands in striking contrast to the disagreement regarding the meaning and normative content of this concept. Each competing theory of human dignity also has serious problems. Against the background of this situation, the meaning-oriented theory of human dignity suggests a new understanding that can integrate a number of conceptions of human dignity and resolve their theoretical problems. According to this new theory, respect for human dignity consists in respect for human (...) beings as beings that confer meaning and need meaning. The integrative and problem-solving power of this new approach is demonstrated here by examining two lines of theory: on the one hand, the Kantian tradition of an autonomy-oriented understanding of human dignity, and on the other hand, a theory that focuses on individual identity and protection against humiliation. The purpose of this article is to discuss the criminalization of conduct based on human dignity arguments. It proposes a modest version of integrating human dignity into discussions about criminalization. After a critical examination of both the notion of “human dignity as an objective value” and the assumption that the meaning of human dignity can be explained by referring to Kant’s moral philosophy, human dignity violations are characterized as severe humiliations.

Die künstliche Zeugung und Selektion von Nachwuchs als Spender von Gewebe für Dritte ist ethisch umstritten. Kritiker des Verfahrens berufen sich oft auf Kants Forderung, Personen seien jederzeit auch als Zwecke an sich selbst zu behandeln. Diese Kritik wird aber oft vorgebracht, ohne dass erläutert würde, was es heißt, Personen als Zwecke an sich selbst zu behandeln. Befürworter des Verfahrens weisen die Kritik daher als dunkel zurück oder deuten sie so, dass sie das Verfahren zulässt. Dieser Artikel erläutert den Kern (...) der Zweckformel (im Zusammenhang mit anderen Formulierungen des kategorischen Imperativs). Dieser Deutung zufolge ist die Zeugung von Retterkindern in der Tat eine Form der Instrumentalisierung, die ich präemptive Instrumentalisierung nenne. Der Unterschied zwischen dieser Form der Instrumentalisierung und anderen Formen instrumentell motivierter Nachwuchsplanung wird dargestellt. (shrink)

Definition of the problem The creation and selection of children as tissue donors is ethically controversial. Critics often appeal to Kant’s Formula of Humanity, i.e. the requirement that people be treated not merely as means but as ends in themselves. As many defenders of the procedure point out, these appeals usually do not explain the sense of the requirement and hence remain obscure. Arguments This article proposes an interpretation of Kant’s principle, and it proposes that two different instrumental stances be (...) distinguished. I argue that the creation of “saviour children” is a form of instrumentalization that I dub “preemptive instrumentalization” and that it is categorically different from earlier forms of instrumental attitudes concerning human reproduction. Conclusion Critics are wrong to claim that Kant’s principle is either compatible with the selection of saviour siblings or too vague to serve as an ethical principle. (shrink)
