This paper sketches a dispositionalist conception of laws and shows how the dispositionalist should respond to certain objections. The view that properties are essentially dispositional is able to provide an account of laws that avoids the problems that face the two views of laws (the regularity and the contingent nomic necessitation views) that regard properties as categorical and laws as contingent. I discuss and reject the objections that (i) this view makes laws necessary whereas they are contingent; (ii) this view (...) cannot account for certain kinds of laws of nature and their properties. Laws of nature take center stage in philosophy of science. Laws are usually believed to stand in a tight conceptual relation to many important key concepts such as causation, explanation, confirmation, determinism, counterfactuals etc. Traditionally, philosophers of science have focused on physical laws, which were taken to be at least true, universal statements that support counterfactual claims. But, although this claim about laws might be true with respect to physics, laws in the special sciences (such as biology, psychology, economics etc.) (...) appear to have—maybe not surprisingly—different features than the laws of physics. Special science laws—for instance, the economic law “Under the condition of perfect competition, an increase of demand of a commodity leads to an increase of price, given that the quantity of the supplied commodity remains constant” and, in biology, Mendel's Laws—are usually taken to “have exceptions”, to be “non-universal” or “to be ceteris paribus laws”. How and whether the laws of physics and the laws of the special sciences differ is one of the crucial questions motivating the debate on ceteris paribus laws. Another major, controversial question concerns the determination of the precise meaning of “ceteris paribus”. Philosophers have attempted to explicate the meaning of ceteris paribus clauses in different ways. The question of meaning is connected to the problem of empirical content, i.e., the question whether ceteris paribus laws have non-trivial and empirically testable content. Since many philosophers have argued that ceteris paribus laws lack empirically testable content, this problem constitutes a major challenge to a theory of ceteris paribus laws. (shrink)

Normic laws have the form "if A, then normally B." They are omnipresent in everyday life and non-physical 'life' sciences such as biology, psychology, social sciences, and humanities. They differ significantly from ceteris-paribus laws in physics. While several authors have doubted that normic laws are genuine laws at all, others have argued that normic laws express a certain kind of prototypical normality which is independent of statistical majority. This paper presents a foundation for normic laws which is based on generalized (...) evolution theory and explains their omnipresence, lawlikeness, and reliability. In this paper I criticize the commonly accepted idea that the generalizations of the special sciences should be construed as ceteris paribus laws. This idea rests on mistaken assumptions about the role of laws in explanation and their relation to causal claims. Moreover, the major proposals in the literature for the analysis of ceteris paribus laws are, on their own terms, complete failures. Laws in the special sciences are usually regarded to be non-universal. A theory of laws in the special sciences faces two challenges. (I) According to Lange's dilemma, laws in the special sciences are either false or trivially true. (II) They have to meet the ?requirement of relevance?, which is a way to require the non-accidentality of special science laws. I argue that both challenges can be met if one distinguishes four dimensions of (non-) universality. The upshot is that I argue (...) for the following explication of special science laws: L is a special science law just if (1) L is a system law, (2) L is quasi-Newtonian, and (3) L is minimally invariant. Moral philosophers are, among other things, in the business of constructing moral theories. And moral theories are, among other things, supposed to explain moral phenomena. Consequently, one’s views about the nature of moral explanation will influence the kinds of moral theories one is willing to countenance. Many moral philosophers are (explicitly or implicitly) committed to a deductive model of explanation. As I see it, this commitment lies at the heart of the current debate between moral particularists and moral generalists. In (...) this paper I argue that we have good reasons to give up this commitment. In fact, I show that an examination of the literature on scientific explanation reveals that we are used to, and comfortable with, non-deductive explanations in almost all areas of inquiry. As a result, I argue that we have reason to believe that moral explanations need not be grounded in exceptionless moral principles. (shrink)

Standard objections to the notion of a hedged, or ceteris paribus, law of nature usually boil down to the claim that such laws would be either 1) irredeemably vague, 2) untestable, 3) vacuous, 4) false, or a combination thereof. Using epidemiological studies in nutrition science as an example, I show that this is not true of the hedged law-like generalizations derived from data models used to interpret large and varied sets of empirical observations. Although it may be ‘in principle impossible’ (...) to construct models that explicitly identify all potential causal interferers with the relevant generalization, the view that our failure to do so is fatal to the very notion of a cp-law is plausible only if one illicitly infers metaphysical impossibility from epistemic impossibility. I close with the suggestion that a model-theoretic approach to cp-laws poses a problem for recent attempts to formulate a Mill-Ramsey-Lewis theory of cp-laws. (shrink)

It has been argued that the fundamental laws of physics do not face a ‘problem of provisos’ equivalent to that found in other scientific disciplines (Earman, Roberts and Smith 2002) and there is only the appearance of exceptions to physical laws if they are confused with differential equations of evolution type (Smith 2002). In this paper I argue that even if this is true, fundamental laws in physics still pose a major challenge to standard Humean approaches to lawhood, as they (...) are not in any obvious sense about regularities in behaviour. A Humean approach to physical laws with exceptions is possible, however, if we adopt a view of laws that takes them to be the algorithms in the algorithmic compressions of empirical data. When this is supplemented with a distinction between lossy and lossless compression, we can explain exceptions in terms of compression artefacts present in the application of the lossy laws. Few have given an extended treatment of the non-statistical sense of normality: a sense captured in sentences like “dogs have four legs,” or “hammers normally have metal heads,” or “it is normal for badgers to take dust baths.” The most direct extant treatment is Bernhard Nickel’s Between Logic and the World, where he claims that the normal or characteristic for a kind is what we can explain by appeal to the right sorts of explanations. Just which explanatory strategies can ground (...) normalities, though, is difficult to determine without inviting circularity into the account. After raising this and other worries for Nickel’s account, I develop my own account according to which normal features are those which are explained by the kind of thing involved. (shrink)

In this paper, I draw a parallel between the stability of physical systems and that of economic ones, such as the US financial system. I argue that the use of equilibrium assumptions is central to the analysis of dynamic behavior for both kinds of systems, and that we ought to interpret such idealizing strategies as footholds for causal exploration and explanation. Our considerations suggest multi-scale modeling as a natural home for such reasoning strategies, which can provide a backdrop for the (...) assessment and prevention of financial crises. Equilibrium assumptions are critical elements of the epistemic scaffolding that make up multi-scale models, which we should understand as a means of constructing explanations of dynamic behavior. An otherwise lawlike generalisation hedged by a ceteris paribus (CP) clause qualifies as a law of nature, if the CP clause can be substituted with a set of conditions derived from the multivariate regression model used to interpret the empirical data in support of the gen- eralisation. Three studies in human biology that use regression analysis are surveyed, showing that standard objections to cashing out CP clauses in this way—based on alleged vagueness, vacuity, or lack of testability—do not apply. CP (...) laws also cannot be said to be simply false due to the indefinitely many conditions not explicitly stated in their associated model: scientific CP clauses imply that these are, given the evidence, not nomically relevant. I analyze here biological regression equations known in the literature as allometries and scaling laws. My focus is on the alleged lawlike status of these equations. In particular I argue against recent views that regard allometries and scaling laws as representing universal, non-continent, and/or strict biological laws. Although allometries and scaling laws appear to be generalizations applying to many taxa, they are neither universal nor exceptionless. In fact there appear to be exceptions to all of them. Nor are the constants (...) in allometries and scaling laws truly constant, stable, or universal in character, but vary in value across different taxa and background conditions. Moreover, these equations represent evolutionary, strongly contingent generalizations, which threatens their lawlike status. Lastly, allometries and scaling laws do not offer stable probabilities to which they hold in different backgrounds. I further suggest that many allometries and scaling laws function to elucidate explananda rather than explanantia or covering laws. (shrink)

It has not been sufficiently considered in philosophical discussions of ceteris paribus (CP) laws that distinct kinds of CP-laws exist in science with rather different meanings. I distinguish between (1.) comparative CP-laws and (2.) exclusive CP-laws. There exist also mixed CP-laws, which contain a comparative and an exclusive CP-clause. Exclusive CP-laws may be either (2.1) definite, (2.2) indefinite or (2.3) normic. While CP-laws of kind (2.1) and (2.2) exhibit deductivistic behaviour, CP-laws of kind (2.3) require a probabilistic or non-monotonic reconstruction. (...) CP-laws of kind (1) may be both deductivistic or probabilistic. All these kinds of CP-laws have empirical content by which they are testable, except CP-laws of kind (2.2) which are almost vacuous. Typically, CP-laws of kind (1) express invariant correlations, CP-laws of kind (2.1) express closed system laws of physical sciences, and CP-laws of kind (2.3) express normic laws of non-physical sciences based on evolution-theoretic stability properties. After a brief survey of the literature on ceteris paribus clauses and ceteris paribus laws (1), the problem of exceptions, which creates the need for cp laws, is discussed (2). It emerges that the so-called skeptical view of laws of nature does not apply to laws of any kind whatever. Only some laws of physics are plagued with exceptions, not THE laws (3). Cp clauses promise a remedy, which has to be located among the further reactions to the skeptical view (...) (4). After inspecting various translations of the Latin term 'ceteris paribus' (5), the paper arrives at the conclusion that, on the most reasonable translation, there are no such things as cp laws, for reasons of logical form. Cp clauses have an indexical content, so that they need singular propositions as their habitat, not general ones. Cp clauses and the universal generalizations they are supposed to modify are not fit for each other (6). (shrink)

Although there is an ongoing controversy in philosophy of science about so called ceteris paribus laws that is, roughly, about laws with exceptionsóa fundamental question about those laws has been neglected (ß2). This is due to the fact that this question becomes apparent only if two different readings of ceteris paribus clauses in laws have been separated. The first reading of ceteris paribus clauses, which I will call the epistemic reading, covers applications of laws: predictions, for example, might go wrong (...) because we do not know all the relevant factors which are causally effective in relevant situation. The second reading, which I will call the metaphysical reading, is concerned with the laws themselves and their possible exceptions (ß3). It is this latter readingóand the funda- mental question associated with itówhich has been neglected due to the confusion of the two readings (ß4): if we leave epistemic issues aside is there at all conceptual space left for a notion of laws of nature which allows the laws themselves to have exceptions? I call a law with exceptions in this sense, if such there is, a real ceteris paribus law. To tackle this question, I distinguish grounded laws from non-grounded laws (ß5). A grounded law is, roughly, a law about structured entities where the properties of the parts of that structure figure themselves in laws of nature (ß6). I will claim that, since the substructure of such an entity can be damaged, grounded laws themselves can face exceptions. Hence, they are candidates to be real (metaphysical) ceteris paribus laws in the sense of my central question. I will discuss grounded laws and their exceptions in detail (ß7, ß8, ß9). For reasons of space, the further question whether we can even have a notion of fun- damental (non-grounded) laws that allows for exceptions cannot be discussed here. I will, however, give a positive answer and also outline how I have argued for that claim elsewhere (ß10). (shrink)

Several philosophers of biology have argued for the claim that the generalizations of biology are historical and contingent.1–5 This claim divides into the following sub-claims, each of which I will contest: first, biological generalizations are restricted to a particular space-time region. I argue that biological generalizations are universal with respect to space and time. Secondly, biological generalizations are restricted to specific kinds of entities, i.e. these generalizations do not quantify over an unrestricted domain. I will challenge this second claim by (...) providing an interpretation of biological generalizations that do quantify over an unrestricted domain of objects. Thirdly, biological generalizations are contingent in the sense that their truth depends on special initial and background conditions. I will argue that the contingent character of biological generalizations does not diminish their explanatory power nor is it the case that this sort of contingency is exclusively characteristic of biological generalizations.
