In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

A key distinction in ethics is between members and nonmembers of the moral community. Over time, our notion of this community has expanded as we have moved from a rationality criterion to a sentience criterion for membership. I argue that a sentience criterion is insufficient to accommodate all members of the moral community; the true underlying criterion can be understood in terms of whether a being has interests. This may be extended to conscious, self-aware machines, as well as to any (...) autonomous intelligent machines. Such machines exhibit an ability to formulate desires for the course of their own existence; this gives them basic moral standing. While not all machines display autonomy, those which do must be treated as moral patients; to ignore their claims to moral recognition is to repeat past errors. I thus urge moral generosity with respect to the ethical claims of intelligent machines. (shrink)

At least since Foster (2002), scholars interested in Aristotle’s views about environmental ethics have focused primarily upon his teleological account of non-human animals as the basis for an Aristotelian environmental virtue ethics. But although Aristotle’s scientific account of non-human animals can serve as the basis for a form of environmental ethics akin to “nature preservation,” one finds in his account of “household management” (or oikonomikē) a very different sort of environmental ethic, one that looks much more like a form of (...) “nature conservation.” My paper argues that for Aristotle, oikonomikē is indeed both “environmental” and an “ethic.” The first part of my chapter shows that oikonomikē is fundamentally environmental insofar as it concerns what Aristotle in Politics 1.8 calls “property acquisition in accord with nature” or “true wealth” (Pol. 1.8.1256b26–27, 30–31), namely the prudential use of natural resources in a way that recognizes the dependence of ways of life upon different habitats or environments. The second part of my chapter shows that oikonomikē is also an “ethic” insofar as it embeds three different kinds of limit on the use of animate and inanimate natural resources, namely that natural resource use is subordinate to expertise about the happiness of the political community (or what Aristotle calls “politics” [πολιτική]); that natural resource use, as an instrumental good, is limited and governed by the craft or expertise of oikonomikē; and that notions of unlimited commercial “wealth acquisition” (χρηματιστική) are based on ethically problematic ways of life. After showing that Aristotle’s account of oikonomikē is indeed an environmental ethic, the third part of my chapter considers the objection that oikonomikē is a weak environmental ethic insofar as it is exploitatively or axiological anthropocentric. I respond that Aristotle’s account of non-human animal domestication provides conceptual resources for thinking about non-human animals as subordinate members in one’s ecological-political community, especially with respect to his invocation of the craft analogy (in the example of shepherds) and inter-species utility friendships. Although Aristotle has multiple sources relevant for understanding environmental ethics, his account of oikonomikē is both a neglected source and a potentially fruitful one. (shrink)

Alice Crary claims that “the standard view of the bearing of Wittgenstein's philosophy on ethics” is dominated by “inviolability interpretations”, which often underlie conservative readings of Wittgenstein. Crary says that such interpretations are “especially marked in connection with On Certainty”, where Wittgenstein is represented as holding that “our linguistic practices are immune to rational criticism, or inviolable”. Crary's own conception of the bearing of Wittgenstein's philosophy on ethics, which I call the “intrinsically-ethical reading”, derives from the influential New Wittgenstein school (...) of exegesis, and is also espoused by James Edwards, Cora Diamond, and Stephen Mulhall. To my eyes, intrinsically-ethical readings present a peculiar picture of ethics, which I endeavour to expose in Part I of the paper. In Part II I present a reading of On Certainty that Crary would call an “inviolability interpretation”, defend it against New Wittgensteinian critiques, and show that this kind of reading has nothing to do with ethical or political conservatism. I go on to show how Wittgenstein's observations on the manner in which we can neither question nor affirm certain states of affairs that are fundamental to our epistemic practices can be fruitfully extended to ethics. Doing so sheds light on the phenomenon that I call “basic moral certainty”, which constitutes the foundation of our ethical practices, and the scaffolding or framework of moral perception, inquiry, and judgement. The nature and significance of basic moral certainty will be illustrated through consideration of the strangeness of philosophers' attempts at explaining the wrongness of killing. (shrink)

The argument from relevance expresses an intuition that, although shared by many applied ethicists, has not been analyzed and systematized in the form of a clear argument thus far. This paper does this by introducing the concept of value relevance, which has been used before in economy but not in the philosophical literature. The paper explains how value relevance is different from moral relevance, and distinguishes between direct and indirect ways in which the latter can depend on the former. These (...) clarifications allow the argument to explain in detail how we can make two claims. The first one is that being a recipient of value should be the only criterion for full moral considerability. This follows if we accept that value relevance should determine, directly or indirectly, moral relevance. The second claim is that, given what the main theories of wellbeing imply regarding what entities can be recipients of value, sentience is both a sufficient and a necessary criterion for full moral considerability. The paper argues that this conclusion stands even if we hold views that consider other values different from sentience. (shrink)

Do non-human animals have rights? The answer to this question depends on whether animals have morally relevant mental properties. Mindreading is the human activity of ascribing mental states to other organisms. Current knowledge about the evolution and cognitive structure of mindreading indicates that human ascriptions of mental states to non-human animals are very inaccurate. The accuracy of human mindreading can be improved with the help of scientific studies of animal minds. But the scientific studies by themselves do not by themselves (...) solve the problem of how to map psychological similarities (and differences) between humans and animals onto a distinction between morally relevant and morally irrelevant mental properties. The current limitations of human mindreading – whether scientifically aided or not – have practical consequences for the rational justification of claims about which rights (if any) non-human animals should be accorded. Since the middle of the 20th century, philosophers and legal scholars have debated the precise definition of punishment. This chapter surveys the debate, identifies six potential conditions of punishment, and critically reviews each of them: 1) the response condition, which holds that punishment must be in response to wrongdoing, 2) the culpability condition, which holds that punishment must be of a person morally responsible for wrongdoing, 3) the authority condition, which holds that punishment must be imposed by a relevant authority, (...) 4) the hard treatment condition, which holds that punishment must impose hard consequences on the punishee, 5) the intentionality condition, which holds that punishment must be intentional, and 6) the censure condition, which holds that punishment must communicate disapproval. The article argues that it is often unclear that there is a version of the condition that provides optimal lexical fit. It discusses the implications of this analysis, and concludes that there may be less reason to worry about the lack of an authoritative definition than has sometimes been assumed, but that definitional clarity remains an objective worth pursuing. In an earlier paper, I defended the moral permissibility of eating meat against sentience-based arguments for moral vegetarianism. The crux of my argument was that sentience is not an intrinsically morally salient property, and that animals lack moral status because they lack a root capacity for rational agency. Accordingly, it is morally permissible to consume meat even if doing so is not strictly necessary for our nutrition. This paper responds to critiques of my argument by Bruers :705–717, 2015) and Erdös. (...) This article presents an argument for veganism, using a formal-axiomatic approach: a list of twenty axioms are explicitly stated. These axioms are all necessary conditions to derive the conclusion that veganism is a moral duty. The presented argument is a minimalist or core argument for veganism, because it is as parsimonious as possible, using the weakest conditions, the narrowest definitions, the most reliable empirical facts and the minimal assumptions necessary to reach the conclusion. If someone does not accept the conclusion, (...) logical consistency requires that s/he should be able to point at axiom on which s/he disagrees. In the last decade, the study of moral heuristics has gained in importance. I argue that we can consider speciesism as a moral heuristic: an intuitive rule of thumb that substitutes a target attribute (that is difficult to detect, e.g. “having rationality”) for a heuristic attribute (that is easier to detect, e.g. “looking like a human being”). This speciesism heuristic misfires when applied to some atypical humans such as the mentally disabled, giving them rights although they lack rationality. But I (...) argue that it is not necessarily irrational or inconsistent to hold on to this heuristic rule, because we have to take time and knowledge constraints, uncertainty aversion and emotional costs into account. However, this “heuristic defense” of speciesism uses a target attribute (rationality) that has implications of disrespect towards some atypical humans. Therefore, based on notions of impartiality and compassion, I argue for a morally better target attribute: sentience (“having a sense of well-being”). “Being a vertebrate” is suitable as a corresponding heuristic attribute because it is easy to detect and has a strong correlation with the target attribute of sentience. In this paper, we present and defend the theoretical framework of an empirical model to describe people’s fundamental moral attitudes (FMAs) to animals, the stratification of FMAs in society and the role of FMAs in judgment on the culling of healthy animals in an animal disease epidemic. We used philosophical animal ethics theories to understand the moral basis of FMA convictions. Moreover, these theories provide us with a moral language for communication between animal ethics, FMAs, and public debates. We defend (...) that FMA is a two-layered concept. The first layer consists of deeply felt convictions about animals. The second layer consists of convictions derived from the first layer to serve as arguments in a debate on animal issues. In a debate, the latter convictions are variable, depending on the animal issue in a specific context, time, and place. This variability facilitates finding common ground in an animal issue between actors with opposing convictions. (shrink)

I characterize the main approaches to the moral consideration of children developed in the light of the argument from 'marginal' cases, and develop a more adequate strategy that provides guidance about the moral responsibilities adults have towards children. The first approach discounts the significance of children's potential and makes obligations to all children indirect, dependent upon interests others may have in children being treated well. The next approaches agree that the potential of children is morally considerable, but disagree as to (...) whether and why children with intellectual disabilities are morally considerable. These approaches explore the moral significance of intellectual capacities, species membership, the capacity for welfare, and the interests of others. I argue that relationships characterized by reciprocity of care are morally valuable, that both the potential to be in such relationships and the actuality of being in them are morally valuable, and that many children with significant intellectual disabilities have this potential. The topic of cruelty features regularly in discussions concerning animals’ moral status. Further, condemnation of cruelty to animals is virtually unanimous. As Regan points out, ‘[i]t would be difficult to find anyone who is in favour of cruelty.’ What is to count as cruelty is therefore important. My aim here is to gain a clearer understanding of one aspect of our moral landscape: cruelty to animals. I will start by analyzing the concept of cruelty in section II. In section III (...) I will examine some implications of this analysis. I will present two arguments for why we should reassess whether modern farming practices are cruel. First, farming practices have changed and our understanding of the concept of cruelty needs to change with them. Second, our application of the concept of cruelty is inconsistent: we would consider many routine practices involving farm animals to be cruel if they involved pets. This inconsistency presents a dilemma: either extending farming practices to pets would not be cruel, or continuing our current farming practices is cruel. In section IV I consider some objections. In this paper I will examine two responses to the argument from marginal cases; the argument from kinds and the similarity argument. I will argue that these arguments are insufficient to show that all humans have moral status but no animals do. This does not prove that animals have moral status but it does shift the burden of proof onto those who want to maintain that all humans are morally considerable, but no animals are.

Timothy Hsiao asks a good question: Why believe animals deserve moral consideration? His answer is that we should not. He considers various other answers and finds them wanting. In this paper I consider an answer Hsiao has not yet discussed: We should accept a conservative view about how to form beliefs. And such a view will instruct us to believe that animals deserve moral consideration. I think conservatives like Hsiao do best to answer his question in a way that upholds (...) the moral status of animals. Since my answer is one Hsiao has not yet addressed, it is compatible with the main points he makes against various other motivations in his many papers on this topic. So my paper should be understood as an invitation to Hsiao to consider another answer. (shrink)

In this paper I defend a theory of welfare rights for nonhuman animals. I do this by demonstrating that a well-established framework for protecting the interests of farm animals, the ‘Five Freedoms of Animal Welfare’, is already functioning just as a set of rights. To support this claim I adopt a common approach to detecting evidence for deontological reasoning and look at the structural features of rights. I first consider Hohfeld’s system of legal rights and consider whether the Five Freedoms (...) may be understood as liberties or claim rights, before making a more successful comparison with side constraints and an interest theory of rights as understood by Nozick and Raz. I also respond to a likely objection that it is not possible to have some welfare rights without a right to freedom from exploitation. The argument therefore contributes to breaking down the stubborn division between ‘animal welfare’ and ‘animal rights’. (shrink)

: Animal ethics has presented convincing arguments for the individual value of animals. Animals are not only valuable instrumentally or indirectly, but in themselves. Less has been written about interest conflicts between humans and other animals, and the use of animals in practice. The motive of this paper is to analyze different approaches to interest conflicts. It concentrates on six models, which are the rights model, the interest model, the mental complexity model, the special relations model, the multi-criteria model, and (...) the contextual model. It is commonly thought that neo-Hobbesian contractarianism cannot yield direct moral standing for marginal humans and animals. However, it has been argued that marginal humans and animals can have a form of direct moral standing under neo-Hobbesian contractarianism: secondary moral standing. I will argue that, even if such standing is direct, this account is unsatisfactory because it is counterintuitive and fragile.

Love does not necessarily benefit its object, and cost-free love may damage both object and subject. Our love of animals mobilises several distinct human concerns and should not be considered always as a virtue or always as a benefit to the animals themselves. We need to place this love in its full psychological, cultural, and moral context in order to assess what form it ought to take if animals are to benefit from it.

Zangwill (“Our Moral Duty to Eat Meat”, “If you care about animals, you should eat them”) has argued that we have a duty to eat meat. In this paper I first show that Zangwill’s essays contain two distinct conclusions: (1) a rather weak thesis that his argument is officially supposed to establish, and (2) a much stronger, advertised thesis that his argument is not officially supposed to establish, but on whose basis he gives concrete recommendations for action and launches polemic (...) attacks on vegans, animal rights activists, and others. Consequently, I argue that Zangwill is likely culpable of some combination of epistemic failure, objectionable carnist activism, and trolling. In the second part of this paper I rebut Zangwill’s argument proper. I conclude by identifying some important issues in the vicinity concerning the suffering of wildlife and population ethics generalized to both human and non-human animals. (shrink)

We distinguish two conceptions of confinement – the agential conception and the comparative conception – and show that the former is intimately related to use in a way that the latter is not. Specifically, in certain conditions, agential confinement constitutes use and creates a special relationship that makes neglect or abuse especially egregious. This allows us to develop and defend an account of one important way in which agential confinement can be morally wrong. We then discuss some of the account’s (...) practical implications, including its usefulness for decision-making in real-world contexts in which animals are confined. (shrink)

This article examines and rejects the view that nonhuman animals cannot be recipients of justice, and argues that the main reasons in favor of universal human rights and global justice also apply in the case of the international protection of the interests of nonhuman animals. In any plausible theory of wellbeing, sentience matters; mere species membership or the place where an animal is born does not. This does not merely entail that regulations of the use of animals aimed at reducing (...) their suffering should be implemented. It actually supports the end of such use, as well as other positive steps to provide help and to promote what is good not only for domesticated animals, but also for those living in the wild. Another reason to bring the protection of animals' interests into the international arena is that it is at this level that numerous animal exploitation industries enjoy the protection of different agreements and institutions. It does not follow from this that changing international law should be animal advocates' first priority, but it does follow that they should conduct their work internationally and not limit it to their own countries. This article addresses a countermovement to the animal liberation movement and its campaigns against vivisection, factory farming, and recreational hunting in the United States, the United Kingdom, and Australia. As moderate welfarists, pragmatic animal liberationists , and radical abolitionists who advocate animal rights, animal protectionists campaign for animals. The countermovement defends acts that animal protectionists decry. Meanwhile, sociologists accord little study to interplay between the movements . In Buechler's and Cylke's collection of 34 papers on social movements , only one (...) paper focused on countermovements, describing the connection between social movement and countermovement as "a continuous dialect of social change" . Although extensive writings exist on the main campaigns of the animal liberation movement, little scholarly material exists on the defenses mounted by the countermovement. This article examines key elements of a values war, a struggle over moral capital waged by animal protectionists and their countermovement opponents. (shrink)

David DeGrazia (2009) and Stuart Rachels (2011), among others, offer moral arguments in favor of adopting a vegetarian diet that have, they claim, broad appeal. Rather than relying on an account of animal rights or a particular ethical theory, these arguments rely on the moral principle that an extensive amount of pain requires moral justification. Since people do not need to eat meat in order to survive, the arguments conclude that the pain that animals experience in factory farming is unjustified. (...) I argue that these very same arguments support a more radical conclusion, namely, vegetarians morally should avoid eating vegetables from industrialized farming. Thus, if vegetarians are convinced by the moral arguments for vegetarianism offered by DeGrazia and Rachels, then they should be convinced, by analogous reasoning, that they should not eat vegetables from industrialized farming. This article examines the relations between methods used in both animal work and study and concepts of animal mind. By "animal work" the authors mean humans and animals working together, and by "animal study" they mean the discipline of ethology, especially the emerging area of cognitive ethology. Within these areas the wide range of conceptions of animal mind includes varying emphases on intelligence, forms of rationality and language, cognition, consciousness, and intentionality. The authors' central concern is to elucidate the vocabulary (...) and the concepts which seem necessary to establishing successful working relationships with sheepdogs and gundogs. Their argument moves toward an emphasis on the appreciation of particular intentional states and recognizes that they invariably deploy elements of a moral vocabulary in achieving creative teamwork performances with dogs and other animals. The article concludes by consid enng the relevance of accounts of work with animals for associated considerations of intentionality. (shrink)

In this paper I will argue that Regan’s subjects-of-a-life account is epistemically irresponsible. Firstly, in making so many epistemic claims. Secondly in making the claims themselves.

External descriptions, which approach animals via external mechanisms rather than internal mental states, have gained a prominent position. However, according to strong objectivism, attention needs to be placed on the presumptions that lay behind given beliefs. When applied to the topic of animal minds, it reveals that perhaps inter-nal rather than external descriptions would offer a fruitful option. This claim is sup-ported by the Wittgensteinian criticism of skepticism, which seeks to avoid “deflection” and brings forward an “affective stance”. Still, in (...) order to avoid relativ-ism and conservatism, internal descriptions and the affective stance need to place em-phasis on the epistemological ramifications behind beliefs concerning animal minds, and centralise the animal as the reference point of inquiry.
