Do non-human animals have moral standing? Work on this question has focused on choosing the right grounding property (for example, personhood or sentience) while little attention has been paid to the various ways that the connection between grounding properties and moral standing has been explained. In this paper, I address that gap by offering a fresh way to approach the debate over the grounds of moral standing, including a novel taxonomy of positions, and argue that one kind of position, which (...) takes a ‘value-first’ approach, is preferable to the other, which takes an ‘interests-first’ approach. According to value-first accounts, some individuals have moral standing because they have properties that make them valuable. According to interests-first accounts, some individuals have moral standing because they have interests, and any interest must always be taken into account. I argue that we should prefer value-first accounts because they engage directly with the problem the concept of moral standing is employed to solve, and because interests-first accounts cannot meet their explanatory burdens without begging the question against value-first accounts. Dignity is traditionally thought to apply to almost all and almost only humans. However, I argue that an account of a distinctly human dignity cannot achieve a coherent and non-arbitrary justification; either it must exclude some humans or include some nonhumans. This conclusion is not as worrying as might be first thought. Rather than attempting to vindicate human dignity, dignity should extend beyond the human, to include a range of nonhuman animals. Not only can we develop a widely inclusive account (...) of dignity by pursuing this route, but we can still defend the three core principles that lie at the heart of contemporary thinking about dignity: that bearers of dignity possess dignity to an equal degree, in virtue of possessing the same intrinsic worth, and that this generates direct and claimable rights. I thus develop an account of dignity that includes nonhuman animals. I argue that the capacity to value most plausibly grounds dignity. This capacity arises from valenced sentience: a being values insofar as they have experiences that matter to them. I then characterise what follows from this. First, I contend that it is only the capacity to value grounds dignity because this produces the most plausible, simplest, and most explanatorily powerful account of dignity. We ought to reject pluralist accounts which assert a sharp distinction between bearers and non-bearers of rational agency, and biocentric accounts which include non-sentient organic entities. Second, I argue this property grounds an account of dignity that is non-hierarchical. There are no degrees of dignity. Instead, all possessors of the capacity to value have the same kind of intrinsic value, and the same equal fundamental right: to consideration of their interest in leading a life of value. Finally, I argue that since the fundamental right is to consideration, moral agents have claimable duties to engage in a deliberative procedure with actionable requirements. Specific rights are instantiations of this general procedure. Certain revisionist conclusions follow on my view, for instance, that nonhumans should be given greater weight and inclusion in a far wider range of cases, but my account is sensitive to the range of different things different beings value, so it does not generate counterintuitive implications. A central question in contemporary ethics and political philosophy concerns which entities have moral status. In this article, I provide a detailed analysis of the view that moral status comes in degrees. I argue that degrees of moral status can be specified along two dimensions: (i) the weight of the reason to protect an entity’s morally significant rights and interests; and/or (ii) the rights and interests that are considered morally significant. And I explore some of the complexities that arise when (...) we link degrees of moral status to the weight of reasons to protect bundles and/or the content and size of these bundles, in particular regarding the attribution of moral status to nonparadigmatic entities (e.g. people with severe cognitive disabilities, children, embryos and foetuses, robots, non-human animals, ecosystems, and rivers). There is an apparent connection between reinforcement learning and agency. Artificial entities controlled by reinforcement learning algorithms are standardly referred to as agents, and the mainstream view in the psychology and neuroscience of agency is that humans and other animals are reinforcement learners. This article examines this connection, focusing on artificial reinforcement learning systems and assuming that there are various forms of agency. Artificial reinforcement learning systems satisfy plausible conditions for minimal agency, and those which use models of the environment (...) to perform forward search are capable of a form of agency which may reasonably be called action for reasons. Many nonhuman animals have the emotional capacities to form caring relationships that matter to them, and for their immediate welfare. Drawing from care ethics, we argue that these relationships also matter as objectively valuable states of affairs. They are part of what is good in this world. However, the value of care is precarious in human-animal interactions. Be it in farming, research, wildlife ‘management’, zoos, or pet-keeping, the prevention, disruption, manipulation, and instrumentalization of care in animals by humans is ubiquitous. (...) We criticize a narrow conception of welfare that, in practice, tends to overlook non-experiential forms of harm that occur when we interfere with caring animals. Additionally, we point out wrongs against caring animals that are not just unaccounted for but denied by even an expansive welfare perspective: The instrumentalization of care and caring animals in systems of use can occur as a harmless wrong that an approach purely focused on welfare may, in fact, condone. We should therefore adopt an ethical perspective that goes beyond welfare in our dealings with caring animals. (shrink)

On expectation, most wild animals have lives of net suffering due to naturogenic causes. Some have claimed that concern for their well-being gives us reasons to intervene in nature on their behalf. Against this, it has been said that many interventions to assist wild animals would be wrong, even if successful, because they would violate their freedom. According to the Freedom-based Approach I defend in this paper, this view is misguided. Concern for wild animal freedom does indeed gives us reasons (...) to secure these animals against control-undermining interferences, but also to intervene in nature in order to enrich their choices. Relational egalitarianism says that moral equals should relate as equals. We explore how moral unequals should relate.

It is seemingly bad for animals to have their desires modified in at least some cases, for instance where brainwashing or neurological manipulation takes place. In humans, many argue that such modification interferes with our positive liberty or undermines our autonomy but this explanation is inapplicable in the case of animals as they lack the capacity for autonomy in the relevant sense. As such, the standard view has been that, despite any intuitions to the contrary, the modification of animals’ desires (...) is not harmful (at least not in itself). In this article, I offer a different perspective on this issue, laying the foundations of a novel argument in defence of the view that animals _can_ be harmed by desire modification directly. I suggest that the modification of an animal’s desires (under certain circumstances) is harmful for that animal because it undermines their agency. (shrink)

Most nonhuman animals live on the terms imposed on them by human beings. This condition of being under the mastery of another, or domination, is what republicanism identifies as political unfreedom. Yet there are several problems that must be solved in order to successfully extend republicanism to animals. Here I focus on the question of whether freedom can be a benefit for individuals without a free will. I argue that once we understand the grounds that make freedom a desirable property (...) of choices, we can see how it is appropriate to predicate it of those made by any sentient agent. (shrink)

If moral status depends on the capacity for consciousness, what kind of consciousness matters exactly? Two popular answers are that any kind of consciousness matters (Broad Sentientism), and that what matters is the capacity for pleasure and suffering (Narrow Sentientism). I argue that the broad answer is too broad, while the narrow answer is likely too narrow, as Chalmers has recently argued by appeal to ‘philosophical Vulcans’. I defend a middle position, Motivational Sentientism, on which what matters is motivating consciousness: (...) any kind of consciousness which presents its subject with reasons for action. (shrink)

Commentary on Kyle Johannsen, Wild Animal Ethics (Routledge, 2020). I want to unpack what we should understand by wild animal well-being, and how different interpretations of what matters about it shape the sorts of interventions we endorse. I will not offer a theory of wild animal well-being or even take a stance on the best approach to theories of well-being as they pertain to wild animals. My aim is to bring into view a concern that WAE has largely overlooked: agency (...) and freedom. To Johannsen’s credit, the issue of liberties does feature in his Wild Animal Ethics (2020) (36–39, 41, 47). The interventions that he favors are those that, for a given amount of harm prevention, involve fewer liberty infringements. Liberties can act, to an extent, as constraints on permissible interventions. For all that, Johannsen’s primary focus remains welfare in a sense that does not appear to give much consideration to agency. Fortunately, his approach is open-ended enough to accommodate some of my concerns. My hope is that he sees them as possible ways of specifying the duties of beneficence, if not justice, that he rightly argues we have to wild animals. (shrink)

Animals who live in cities must coexist with us. They are, as a result, entitled to the conditions of their flourishing. This article argues that, as the boundaries of cities and urban areas expand, the boundaries of our conception of captivity should expand too. Urbanization can undermine animals’ freedoms, hence their ability to live good lives. I draw the implications of an account of “pervasive captivity” against the background of the Capabilities Approach. I construe captivity, including that of urban animals, (...) as affecting a range of animal capabilities, understood as freedoms, and I address some tensions within Nussbaum’s treatment of human-animal conflicts. Using the Capabilities Approach as a guide, I will attempt to motivate a convergence between habitat preservation in urbanized environments, urban design guided by justice, and the individual freedoms of animals. —Commentary on Mikhalevich and Powell on invertebrate minds.— Whether or not arthropods are sentient, they can have moral standing. Appeals to sentience are not necessary and retard progress in human treatment of other species, including invertebrates. Other increasingly well-documented aspects of invertebrate minds are pertinent to their welfare. Even if arthropods are not sentient, they can be agents whose goals—and therefore interests—can be frustrated. This kind of agency is sufficient for moral status and requires that we consider their welfare.

In this article, we develop and defend an account of the normative significance of nonhuman animal agency. In particular, we examine how animals’ agency interests impact upon the moral permissibility of our interactions with them. First, we defend the claim that nonhuman animals sometimes have rights to self-determination. However, unlike typical adult humans, nonhuman animals cannot exercise this right through the giving or withholding of consent. This combination of claims generates a puzzle about the permissibility of our interactions with nonhuman (...) animals. If animals sometimes have rights to self-determination, but lack the capacity to consent, then when, if ever, is it permissible for us to touch them, hold them, bathe them, or confine them? In the second half of the article, we develop a solution to this puzzle. We argue that while we cannot obtain animals’ consent, they can engage in authoritative communications of will through acts of “assent” and “dissent.”. (shrink)

In the philosophy of action, agency manifests the capacity of the agent to act. An agent is one who acts voluntarily, consciously and intentionally. This article studies the relationship between virtues and agency to learn to what extent agency is conceptually and metaphysically dependent on moral or epistemic virtues; whether virtue is a necessary condition for action and agency, besides the belief, desire and intention? Or are virtues necessary merely for the moral or epistemic character of the agent and not (...) his agency? If virtues are constructive elements of personal identity, can we say that virtues are necessary for action and agency? If we accept that virtues play a role in agency, the principle of “Ought Implies Can” makes us face a new challenge; which we will discuss. After explaining the concept of action and agency, I will study the relationship between agency and virtues in the field of ethics and epistemology. Ultimately, I conclude that not only in theories of virtue but also in other ethical theories, virtue is independently necessary for the actualization of agency; even if, conceptually, there might not be any relation between the two. Urban animals can benefit from living in cities, but this also makes them vulnerable as they increasingly depend on the advantages of urban life. This article has two aims. First, I provide a detailed analysis of the concept of captivity and explain why it matters to nonhuman animals—because and insofar as many of them have a (non-substitutable) interest in freedom. Second, I defend a surprising implication of the account—pushing the boundaries of the concept while the boundaries of cities and human (...) activities expand. I argue for the existence of the neglected problem of pervasive captivity, of which urban wildlife is an illustration. Many urban animals are confined, controlled and dependent, therefore often captive of expanding urban areas. While I argue that captivity per se is value-neutral, I draw the ethical and policy implications of harmful pervasive captivity. (shrink)

In this paper, I aim to show that agency-based accounts of moral status are more plausible than many have previously thought. I do this by developing a novel account of moral status that takes agency, understood as the capacity for intentional action, to be the necessary and sufficient condition for the possession of moral status. This account also suggests that the capacities required for sentience entail the possession of agency, and the capacities required for agency, entail the possession of sentience. (...) Thus on this account sentient beings possess agency and agents possess sentience. If this is correct, it will show that an Agency Account of moral status can offer a plausible defence of the moral status of all sentient beings, something that previous Agency Accounts have not succeeded in doing. What is more, this account could establish that all sentient animals are not just moral status holders per se, but that they are owed pro tanto obligations regarding continued existence and liberty, similar in kind, though not always in strength, to those owed to humans. This paper argues that contemporary philosophical literature on meaning in life has important implications for the debate about our obligations to non-human animals. If animal lives can be meaningful, then practices including factory farming and animal research might be morally worse than ethicists have thought. We argue for two theses about meaning in life: that the best account of meaningful lives must take intentional action to be necessary for meaning—an individual’s life has meaning if and only if the individual acts (...) intentionally in ways that contribute to finally valuable states of affairs; and that this first thesis does not entail that only human lives are meaningful. Because non-human animals can be intentional agents of a certain sort, our account yields the verdict that many animals’ lives can be meaningful. It seems obvious that phenomenally conscious experience is something of great value, and that this value maps onto a range of important ethical issues. For example, claims about the value of life for those in a permanent vegetative state, debates about treatment and study of disorders of consciousness, controversies about end-of-life care for those with advanced dementia, and arguments about the moral status of embryos, fetuses, and non-human animals arguably turn on the moral significance of various facts about consciousness. However, (...) though work has been done on the moral significance of elements of consciousness, such as pain and pleasure, little explicit attention has been devoted to the ethical significance of consciousness. In this book Joshua Shepherd presents a systematic account of the value present within conscious experience. This account emphasizes not only the nature of consciousness, but the importance of items within experience such as affect, valence, and the complex overall shape of particular valuable experiences. Shepherd also relates this account to difficult cases involving non-humans and those with disorders of consciousness, arguing that the value of consciousness influences and partially explains the degree of moral status a being possesses, without fully determining it. The upshot is a deeper understanding of both the moral importance of phenomenal consciousness and its relations to moral status. This book will be of great interest to philosophers and students of ethics, bioethics, philosophy of psychology, philosophy of mind and cognitive science. (shrink)

Is there something distinctive about humanity that justifies the idea that humans have moral status while non-humans do not? Providing an answer to this question has become increasingly important among philosophers as well as those outside of philosophy who are interested in our treatment of non-human animals. For some, answering this question will enable us to better understand the nature of human beings and the proper scope of our moral obligations. Some argue that there is an answer that can distinguish (...) humans from the rest of the natural world. Many of those who accept this answer are interested in justifying certain human practices towards non-humans—practices that cause pain, discomfort, suffering, and death. This latter group expects that in answering the question in a particular way, humans will be justified in granting moral consideration to other humans that is neither required nor justified when considering non-human animals. In contrast to this view, an increasing number of philosophers have argued that while humans are different in a variety of ways from each other and other animals, these differences do not provide a philosophical defense for denying non-human animals moral consideration. Brain Organoids in their current state of development are patentable. Future brain organoids may face some challenges in this regard, which I address in this contribution. Brain organoids unproblematically fulfil the general prerequisites of patentability set forth in Art. 3 (1) EU-Directive 98/44/ec (invention, novelty, inventive step and susceptibility of industrial application). Patentability is excluded if an invention makes use of human embryos or constitutes a stage of the human body in the individual phases of its formation and development. Both (...) do not apply to brain organoids, unless ES-cells are used. Art. 6 (1) EU-Directive 98/44/ec excludes patentability for inventions “the commercial exploitation of which would be contrary to ordre public or morality”. While there is no conceivable scenario, in which the commercial application of current brain organoids violates the ordre public, the same is not necessarily true for future brain organoids. Keeping in mind that a development of consciousness-like abilities in future brain organoids cannot be excluded and that an ability for both physical and psychological suffering has been theorized, both of which are aspects of the ordre public, certain applications of future brain organoids may constitute a violation of the ordre public and therefore lead to an exclusion of patentability. Every day, wild animals suffer and die from myriad natural causes. For those committed to non-speciesism, what wild animal suffering entails for us morally is a question of the utmost importance, and yet there remains significant disagreement at the level of normative theory. In this paper I argue that in situations of moral urgency environmental managers and policy makers should refer to widely-agreeable moral principles for guidance. I claim that the principles of beneficence, non-maleficence, autonomy and justice do well to (...) capture our widely-held values, and that the first three principles all support large-scale interventions in nature. I then argue that balancing these against non-maleficence will still allow for the careful consideration of interventions, although is unlikely to support lethal methods. This argument is intended to provide a reasonable starting point for theory-agnostic decision makers, and places the burden of proof on those who oppose intervention. -/- . (shrink)

Should we accept that different moral norms govern our treatment of human and nonhuman animals? In this paper I suggest that the answer is both yes and no. At the theoretical level of morality, a single, unified set of norms governs our treatment of all sentient beings. But at the practical level of morality, different sets of norms can govern our treatment of different groups in different contexts. And whether we accept that we should, say, respect rights or maximize utility (...) at the theoretical level, we might also accept that we should apply a relatively Kantian set of norms to our treatment of humans and a relatively utilitarian set of norms to our treatment of nonhumans in practice, with many caveats. I argue that this moderate “monist in theory, hybrid in practice” view has many advantages over fully monist or hybrid alternatives. (shrink)

In virtue of their capacity for political agency, political agents can possess special rights, powers, and responsibilities, such as rights to political participation and freedom of speech. Traditionally, political theorists have assumed that only cognitively unimpaired adult humans are political agents, and thus that only those humans can be the bearers of these rights, powers, and responsibilities. However, recent work in animal rights theory has extended the concept of political agency to nonhuman animals. In this article, I develop an account (...) of political agency that identifies the capacities that one must possess to be a political agent and captures the fact that political action is a distinctive type of action. Crucially, this account makes sense of the standard assumption that only some humans count as political agents, and explains why few nonhuman animals, human infants, and severely cognitively impaired humans are likely to possess the capacity for political agency. I go on to reject the view, recently advanced by Sue Donaldson and Will Kymlicka, that nonhuman animals can be ‘nonintentional political agents’. I conclude by suggesting that most nonhuman animals, as well as human infants and humans with severe cognitive impairments, cannot straightforwardly be assigned rights to political participation. I show that an overlooked feature of our moral life—moral status—provides a route to vindicating naturalist moral realism in much the same way that the Humean theory of motivation and judgment internalism are used to undermine it. Moral status presents two explanatory burdens for metaethical views. First, a given view must provide an ecumenical explanation of moral status, which does not depend on the truth of its metaethical claims (say, that there are mind-independent facts about moral status). Second, its explanation (...) must be consistent with persistent normative ethical disagreement about what constitutes moral status. I conclude that naturalist moral realism succeeds, while quasi-realism fails because it cannot meet the latter requirement. This argument has three results: we have a new route for metaethical vindication more generally and for naturalist moral realism in particular; quasi-realism's plausibility is undermined by an inability to explain disagreement, but not for the familiar reasons. If a person's head moves, she may or may not have moved her head, and, if she did move it, she may have actively performed the movement of her head or merely, by doing something else, caused a passive movement. And, if she performed the movement, she might have done so intentionally or not. This short array of contrasts (and others like them) has motivated questions about the nature, variety, and identity of action. Beyond the matter of her moving, when (...) the person moves her head, she may be indicating agreement or shaking an insect off her ear. Should we think of the consequences, conventional or causal, of physical behavior as constituents of an action distinct from but ‘generated by’ the movement? Or should we think that there is a single action describable in a host of ways? Also, actions, in even the most minimal sense, seem to be essentially ‘active’. But, how can we explain what this property amounts to and defend our wavering intuitions about which events fall in the category of the ‘active’ and which do not? (shrink)

It is fairly commonplace to think that the capacity for sentience need not be the only basis of moral status. Pluralists contend that moral status is grounded in several other valuable capacities as well as, or instead of, sentience, such as agency, empathy, or sociality. However, this contention contrasts with a standard assumption in animal ethics: that sentience should be the only basis of moral status. This article vindicates that assumption. Whilst classical utilitarians have defended a similar claim about sentience (...) in relation to ultimate value, the merits of this view have gone relatively unnoticed in contemporary debates about moral status and animal ethics. An account based on sentience alone avoids conceptual redundancy and has greater explanatory power than pluralist alternatives. An account of moral status based exclusively on sentience also yields two significant and revisionary implications that have not been recognised. First, the distinction between persons and nonpersons cannot hold, so all moral patients, including nonhuman animals, should feature as primary subjects in ethical theories, public policies, and research agendas. Second, we ought to favour nonhuman interests far more often than we tend to suppose. (shrink)

In this essay I distinguish categories of animals by their mental capacities. I then discuss whether punishment can be appropriate for animals of each category, and if so what form punishment may appropriately take for animals of each category. The aim is to illuminate each type of punishment through comparison and contrast with the others. This both forestalls the overintellectualization of punishment which arises from viewing humans as the only paradigm case and forestalls the underintellectualization of human punishment which results (...) from making no essential reference, in an account of human punishment, to the human capacity for specifically critical reasoning. Most views of agency take acting for reasons (whether explanatory or justifying) to be an important hallmark of the capacity for agency. The problem, however, is that the standard analysis of what it is to act in light of reasons is not sufficiently fine grained to accommodate what we will argue are the myriad types of ways that agents can do so. We suggest that a full account of acting for reasons must also recognize the relationship that agents have with (...) their reasons. We focus on two types of relationships. The first is the traditional case, where agents act in light of reasons that they take to be their own and that they endorse. We describe this as possessing an Endorsement Relationship with one's reasons. A second way of relating to reasons is what we will describe as possessing a Directed Relationship with one's reasons. This includes cases in which agents' actions are the product of reasons but toward which agents do not have an Endorsement Relationship. The Endorsement Relationship is uncontroversial. In this paper, we defend the existence and importance of the Directed Relationship. We show that it is a genuine but overlooked way of relating to, and thereby acting for, reasons. (shrink)

Are there nonhuman animals who behave morally? In this paper I answer this question in the affirmative by applying the framework of care ethics to the animal morality debate. According to care ethics, empathic care is the wellspring of morality in humans. While there have been several suggestive analyses of nonhuman animals as empathic, much of the literature within the animal morality debate has marginalized analyses from the perspective of care ethics. In this paper I examine care ethics to extract (...) its core commitments to what is required for moral care: emotional motivation that enables the intentional meeting of another’s needs, and forward-looking responsibility in particular relationships. What is not required, I argue, are metarepresentational capacities or the ability to scrutinize one’s reasons for action, and thus being retrospectively accountable. This minimal account of moral care is illustrated by moral practices of parental care seen in many nonhuman animal species. In response to the worry that parental care in nonhuman animals lacks all evaluation and is therefore nonmoral I point to cultural differences in human parenting and to normativity in nonhuman animals. We argue that extreme endurance sport can be valuable for some nonhuman animals. To make the case, we focus specifically on dogsled racing. We argue that, given certain views about the nature of self-affirmation, perceptual agency, and affordances, sled dogs are capable of realizing significant value through extreme endurance running. Because our focus is on the axiological question of the nature of the value of the sport for its participants, we do not claim that extreme dogsledding is ethical; indeed, we (...) acknowledge the morally objectionable aspects of the practice in its current form. Still, we offer our argument as a critical step in providing an adequate moral justification for a reformed model of dogsled racing. If it is permissible, that is likely because it offers some significant benefits to sled dogs. Given some assumptions about sled dogs’ capacity to be guided by both internal and external affordances, those benefits include self-affirmation. (shrink)

Recent years have seen an explosion of interest in nonhuman animal agency in different fields. In biology and ethology new studies about animal languages, cultures, cognition and emotion are published weekly, affirming Darwin’s thesis that differences between humans and other animals are of degree and not kind. In the broad field of animal studies the symbolic and ontological human-animal distinction is challenged and other animals are presented as actors. These studies challenge existing approaches to animal ethics. Animals are no longer (...) creatures to simply think about: they have their own perspectives on life, and humans can in some instances communicate with them about that. Animal ethics long determined individual moral rights and duties on the basis of nonhuman animal capacities, but this often measures them to human standards and does not take into account that nonhuman animals are a heterogeneous group in terms of capabilities as well as social relations to humans, which influences their scope for agency and possibilities for leading a good life. In our presentation we defend a relational approach to animal ethics, viewing other animals as subjects capable of co-shaping relations. (shrink)
