Creeping minimalism threatens to cloud the distinction between realist and anti-realist metaethical views. When anti-realist views equip themselves with minimalist theories of truth and other semantic notions, they are able to take on more and more of the doctrines of realism (such as the existence of moral truths, facts, and beliefs). But then they start to look suspiciously like realist views. I suggest that creeping minimalism is a problem only if moral realism is understood primarily as a semantic doctrine. I (...) argue that moral realism is better understood instead as a metaphysical doctrine. As a result, we can usefully regiment the metaethical debate into one about moral truthmakers: in virtue of what are moral judgments true? I show how the notion of truthmaking has been simmering just below the surface of the metaethical debate, and how it reveals one metaethical view (quasi-realism) to be a stronger contender than the others. The proposed theoretical motivation for legal fictionalism begins by focusing upon the seemingly supernatural powers of creation and control that mere mortals exercise over legal things, as a subclass of socially constructed things. This focus brings to the fore a dilemma of uncharitableness concerning the ontological commitments expressed in the discourse of whole societies about such things. Either, there is widespread equivocation as to the fundamental concept expressed by terms such as ‘existence’ or our claims about legal and other institutional (...) things are never really true. When stated as a dilemma, rather than assuming either horn from the outset, our broader social practice of fiction-telling yields a reason to prefer the fictionalist horn. -/- I differentiate three grades of legal fictionalism and contrast strong legal fictionalism with Horacio Spector’s weak form. Only the stronger form has it that engagement in a fictional discourse of law can provide reasons for legal decision-making independent of moral opinions or policy considerations. This stance relies on the claim that maintaining a fictional discourse with respect for its integrity justifies inferences to conclusions about a fictional domain beyond what is described in existing expressions of the discourse. Focusing on ontology allows an analogy between a fictional discourse of law and literary or popular fiction, in which context such inferences are more obviously persuasive. I argue that this notion of respect for the integrity of such a discourse saves legal formalist jurisprudence from the indeterminacy objections of legal realists. (shrink)

The paper develops an account of semantic notions which occupies a middle ground between antirealism and traditional forms of realism, using some ideas from the work of John McDowell. The position is based on a contrast between two points of view from which we might attempt to characterize our linguistic practices from the cosmic exile s point of view and from the midst of language as a going concern. The contrast is drawn in terms of whether our characterization of our (...) linguistic practices is taken to result from engagement in the very same practices that we are trying to characterize. The position takes realism to be correct when understood as an account from the internal perspective, but incorrect when taken as an account from the external perspective. However, the intelligibility of the question as to what our practices would look like from the cosmic exile s point of view is presented as problematic. (shrink)

A novel motivation for a Humean projectivist construal of our concept of scientific law is provided. The analysis is partially developed and used to explain intuitions that are problematic for a Humean reductionist construal of lawhood. A possible non-Humean rejoinder is discussed and rejected. In an appendix, further intuitions that are problematic for Humean reductionists are explained projectively.

Acceptance of Humean Supervenience and thereductive Humean analyses that entail it leadsto a litany of inadequately explained conflictswith our intuitions regarding laws andpossibilities. However, the non-reductiveHumeanism developed here, on which law claimsare understood as normative rather than factstating, can accommodate those intuitions. Rational constraints on such norms provide aset of consistency relations that ground asemantics formulated in terms offactual-normative worlds, solving theFrege-Geach problem of construing unassertedcontexts. This set of factual-normative worldsincludes exactly the intuitive sets ofnomologically possible worlds associated witheach possible (...) set of laws. In this paper I argue that the explanationist argument in favour of moral realism fails. According to this argument, the ability of putative moral properties to feature in good explanations provides strong evidence for, or entails, the metaphysical claims of moral realism. Some have rejected this argument by denying that moral explanations are ever good explanations. My criticism is different. In this paper, I hope to provide an account of the conditions of moral realism whereby there are still significant metaphysical commitments made by the realist which set the view apart as a distinct position in the contemporary meta-ethical landscape. In order to do so, I will be appealing to a general account of what it is for realism to be true in any domain of experience, whether it be realism about universals, realism about unobservable scientific entities, realism about artifacts, (...) and so forth. Moral discourse is propositionally clothed, that is, it exhibits those features – such as the ability of its sentences to intelligibly embed in conditionals and other unasserted contexts – that have been taken by some philosophers to be constitutive of discourses that express propositions. If there is nothing more to a mental state being a belief than it being characteristically expressed by sentences that are propositionally clothed then the version of expressivism which accepts that moral discourse is propositionally clothed (‘quasi-realism’) (...) is self-refuting. Fortunately for quasi-realists, this view of belief, which I label ‘minimalism’, is false. I present three arguments against it and dismiss two possible defences (the first drawn from the work of Wright, the second given by Harcourt). The conclusion is that the issue between expressivists and their opponents cannot be settled by the mere fact that moral discourse wears propositional clothing. (shrink)

This paper elaborates and defends an expressivist account of the claims of mind-independence embedded in ordinary moral thought. In response to objections from Zangwill and Jenkins it is argued that the expressivist 'internal reading' of such claims is compatible with their conceptual status and that the only 'external reading' available doesn't commit expressivisists to any sort of subjectivism. In the process a 'commitment-theoretic' account of the semantics of conditionals and negations is defended.

The realist programme has degenerated by now to the point where it is quite beyond salvage. A token of this degeneration is that there are altogether too many realisms. It is as though by splitting into a confusing array of types and kinds, realism has hoped that some one variety might yet escape extinct. I shall survey the debate, and some of these realisms, below. Here I would just point out the obvious; that in so far as the successes of (...) science mount while realism continues to decline we must conclude that scientific success lends no support to realism. Since it is unlikely to support anti-realism, we have some reason to suspect that the philosophical debate over realism does not concern issues that can be settled by developments in the sciences, no matter how successful science may be. Further, since that success grounds a culture of acceptance for science and its entities, we have reason to believe that the existence of those entities is also not actually the issue that concerns realism. Afortiori, it is not the issue that concerns anti-realism either; nor, I might add, is anti-realism the winner in the philosophical debate that realism has lost. (shrink)

Scientific naturalism is a metaphysical doctrine, a view about what there is, or what we ought to believe that there is. It maintains that natural science should be our guide in matters metaphysical: the ontology we should accept is the ontology that turns out to be required by science. Quine is often regarded as the doyen of scientific naturalists, though the supporting cast includes such giants as David Lewis and J. J. C. Smart.

This article explores the possibility of naturalized theory of action. It distinguishes ontological naturalism from conceptual naturalism, and asks whether a defensible theory of action can be either ontologically or conceptually naturalistic. The distinction between conditions for an ontology and conditions for a concept receives support from Donald Davidson's identification of two modes of explanation for action: rational and physical causal explanation. Davidson's action theory provides a naturalized ontology for action theory, but not a naturalized concept of intentional action. This (...) article raises doubts about Davidson's basis for such one-sided naturalism. It examines some conditions for a mode of explanation, in order to clarify whether an intentional mode of explanation might have ontological significance and thus raise problems for ontological naturalism. The article argues for the central role of certain instrumental factors in explanatory strategies, whether naturalistic or intentional; and it casts doubt on Jaegwon Kim's recent argument that intentional psychology and neuroscience are mutually exclusive as explanatory strategies. A key lesson is that variable end-dependent reasons are our only wherewithal in the evaluation of explanatory strategies. In this sense, our explanatory strategies are ultimately instrumental and perspectival. The article draws out the implications of this lesson for naturalized action theory and for psychological explanation. It opposes any suggested monopoly on explanation from the physical sciences. The concern of this paper is not with the truth of any particular realist or anti-realist view, but rather with determining what it is to be a realist or anti-realist in the first place. While much skepticism has been voiced in recent years about the viability of such a project, my goal is to articulate interesting and informative conditions whereby any view in any domain of experience can count as either a realist or an anti-realist position.

In the theoretical philosophy of Immanuel Kant, the term object has an extensive and far-reaching significance, and it can therefore be understood as a theory of objects. This becomes particularly clear when it is observed that all of his guidelines can be traced to different concepts of objects and their combination. With his concept of the object of experience, he attempts to mediate incompatible aspects in this: in relation to the object of experience, we have apodictic claims but at the (...) same time our knowledge of the object develops and contains the possibility of historical progress. This theory of objects was elaborated by Kant with regard to natural science and the claim of its metaphysical foundation. For this reason, Kant’s concept of object is inherently linked with his concept of science. Astronomy is at the core of his investigation, because it represents a perfect example of a so-called proper and rational natural science. (shrink)

James Dreier (Philos Perspect 18: 23-44, 2004) states what he calls the "Problem of Creeping Minimalism": that metaethical Expressivists can accept a series of claims about meaning, under which all of the sentences that Realists can accept are consistent with Expressivism. This would allow Expressivists to accept all of the Realist's sentences, and as Dreier points out, make it difficult to say what the difference between the two views is. That Expressivists can accept these claims about meaning has been suggested (...) by Simon Blackburn on behalf of his "quasirealist". I argue against the assumption that there is a way to interpret the Realist's sentences in a way that renders them consistent with Expressivism. (shrink)

The issue of realism about the physical world is distinct from the semantic issue of correspondence truth. So it is an aberration to identify the two issues (Dummett), to dismiss the realism issue out of hostility to correspondence truth (Rorty, Fine), to think that that issue is one of interpretation, or to argue against realism by criticizing various claims about truth and reference (Putnam, Laudan). It is also an aberration to identify realism with nonskepticism, truth-as-the-aim-of-science, or scientific convergence. Realism is (...) an overarching metaphysical issue which should be settled before any of these epistemic and semantic issues. (shrink)

Blackburn’s “quasi-realism” aims to show that expressivism can accommodate the sorts of claims about moral truth, facts, objectivity, and the like that are found in ordinary moral thought and discourse. Egan argues that expressivists cannot accommodate certain claims about the possibility that one’s own fundamental moral commitments are mistaken. He criticizes what I call the approved change strategy, which explains that judgment in terms of the belief that one might change one’s mind as a result of favored processes such as (...) getting more information. Egan targets a simple version of that strategy; I raise objections to a more sophisticated expressivist alternative. I argue against Horgan and Timmons’ claim that quasi-realists need not accommodate certain thoughts about moral fallibility on the grounds that they are metaethical rather than first-order moral claims, and that the implied orientation toward others that results is not objectionably smug. I also argue that the sophisticated strategy problematically commits the expressivist to an ideal observer or advisor theory in first-order ethics. (shrink)

In this journal Andy Egan argued that, contrary to what I have claimed, quasi-realism is committed to a damaging asymmetry between the way a subject regards himself and the way he regards others. In particular, a subject must believe it to be a priori that if something is one of his stable or fundamental beliefs, then it is true. Whereas he will not hold that this is a priori true of other people. In this paper I rebut Egan's argument, and (...) give further consideration to the correct way to think about our own fallibility. In “The Evolutionary Debunking of Quasi-Realism,” Neil Sinclair and James Chamberlain present a novel answer that quasi-realists can pro-vide to a version of the reliability challenge in ethics—which asks for an explanation of why our moral beliefs are generally true—and in so doing, they examine whether evolutionary arguments can debunk quasi-realism. Although reliability challenges differ from EDAs in several respects, there may well be a connection between them. For the explanatory premise of an EDA may state that a particular theory (...) of beliefs of a certain kind does not, or cannot, provide a plausible account of why those beliefs might be generally true, and its epistemic premise may state that, if that is the case, then the beliefs in question have a negative epistemic status or the theory is false inasmuch as, if it were true, it would lead to those beliefs having such a negative epistemic status. The quasi-realist can answer the reli-ability challenge by claiming that, when we form our moral beliefs through a process of well-informed impartial reflection, we form them in response to the non-moral features of things on which depend the moral features they have. Hence, when we form beliefs by means of such a process, we are most likely forming true moral beliefs. (shrink)

Moore's Open Question Arguments are among the most influential arguments in 20th Century metaethical thought. But, surprisingly, there is a fair amount of confusion concerning what the Open Question Arguments actually are, how the Moorean passages should be interpreted, and what they are intended to show. Thus, the early chapters are devoted to clarificatory matters, including the exposing of a variety of contemporary attacks upon Moore's arguments as misguided by indicating where they rest upon faulty interpretations of Moorean passages. Providing (...) what I take to be accurate formulations of Moore's famous arguments, responding to historically important preliminary objections, and, finally, presenting various shortcomings of these arguments constitute the remaining themes of the early chapters. ;Next, I pursue an explanation of what I call the 'Open Question phenomenon': the inclination that many have to endorse Moore's "open question" premises. I survey a variety of popular noncognitivist explanations, arguing that each of them is unsatisfactory. I then present a novel semantic explanation of the phenomenon and use it to construct an augmented Moorean Open Question Argument, one capable of overcoming the shortcomings of Moore's originals. ;The latter chapters are dedicated to an investigation of Moore's preferred normative theory---a version of objective consequentialism. I argue that the standard semantic account of subjunctive conditionals fails to capture the nature of certain subjunctive conditionals relevant to the normative evaluation of alternatives from an objective consequentialist perspective. I then present a modified version of the standard account in an effort to remedy the problem. ;Next, I present a novel objection against all extant versions of objective consequentialism. I then introduce and utilize the concept of an "objective" subjunctive probability in the transformation of a subjective version of consequentialism into an objective version, one capable of dealing with the difficulties posed by the objection. ;I conclude the dissertation with a final chapter in which I defend possibilist versions of consequentialism from a contemporary objection. In doing so, I elucidate a theoretical advantage that possibilist theories have over their subjunctive counterparts. (shrink)
