    Utilitarianism could still be a viable moral and political theory, although an emphasis on justice as distributing burdens and benefits has hidden this from current conversations. The traditional counterexamples prove that we have good grounds for rejecting classical, aggregative forms of consequentialism. A nonaggregative, liberal form of utilitarianism is immune to this rejection. The cost is that it cannot adjudicate when the basic needs of individuals or groups are in conflict.     To the extent that Geary's theory concerning biologically primary and secondary behaviors depends on factor analytic methods and findings, it is woefully weak. Factors have been mistakenly called primary mental abilities, but the adjective “primary” represents reification of a mathematical dimension defined by correlations. Fleshing out a factor beyond its mathematical properties requires much additional quantitative experimental and correlational research that goes far beyond mere factoring.

    This paper reflects on the experience of presenting a limit test case based on passion/provocation cases against a proposed ‘right to passions’ suggested by proponents of a sentimental jurisprudence. The limit case, presented at the 2010 CLC held in Utrecht, invited the audience to reflect on the human right to a provocation defence, a right enshrined in the criminal law as a concession to ‘human frailty’ in ‘crimes of passion’ for centuries.

    A group of economists has recently begun addressing questions at the intersection of ethics and economics. This article surveys that work, and suggests areas where conceptual inputs from business ethicists are clearly needed, and where multiple opportunities for interactive research are obviously present.

    Adam Smith (1723–90) provided a novel and subtle account of the new social physics that emerged to accommodate the economic changes taking place in his time. This article explores Smith’s views on the effect of commercialization on friendship, and then questions one prominent interpretation of his approach, that of Allan Silver.
