Successful formulation and implementation of end-of-life care requires ongoing communication with the patient. When patients, for reasons of general medical or psychiatric illness, fail to verbally communicate, providers must be receptive to messages conveyed through alternate avenues of communication. We present the narrative of a man with schizophrenia who wished to forgo hemodialysis as a study in the ethical importance of attention to nonverbal communication. A multilayered understanding of the patient, as may be provided by both behavioral and motivational models, (...) can inform the provider’s ability to receive, process, and represent communicated content to the patient or his or her surrogate decision-maker. In this article we will be arguing in favour of legislating to protect doctors who bring about the deaths of PVS patients, regardless of whether the death is through passive means or active means. We will first discuss the ethical dilemmas doctors and lawmakers faced in the more famous PVS cases arising in the US and UK, before exploring what the law should be regarding such patients, particularly in Australia. We will continue by arguing in favour of allowing euthanasia in (...) the interests of PVS patients, their families, and finally the wider community, before concluding with some suggestions for how these ethical arguments could be transformed into a set of guidelines for medical practice in this area. Emphasizing the importance of language is a key characteristic of philosophical reflection in general and of bioethics in particular. Rather than trying to eliminate the historicity and ambiguity of language, a continental approach to bioethics will make conscious use of it, for instance by closely studying the history of the key terms we employ in bioethical debates. Continental bioethics entails a focus on the historical vicissitudes of the key signifiers of the bioethical vocabulary, urging us to study the history of (...) terms such as “bioethics,” “autonomy,” “privacy,” and “consensus.” Instead of trying to define such terms as clearly and unequivocally as possible, a continental approach rather requires us to take a step backwards, tracing the historical backdrop of the words currently in vogue. By comparing the original meanings of terms with their current meanings, and by considering important moments of transition in their history, obfuscated dimensions of meaning can be retrieved. Thus, notwithstanding a number of methodological challenges involved in etymological exercises, they may foster moral articulacy and enhance our ability to come to terms with moral dilemmas we are facing. This essay seeks to characterise the essential features of an equitable health care system in terms of the classical Aristotelian concepts of horizontal and vertical equity, the common language of “need” and the economic notion of cost-effectiveness as a prelude to identifying some of the more important issues of value that policy-makers will have to decide for themselves; the characteristics of health that can cause policy to be ineffective ; the information base that is required to support a policy directed (...) at securing greater equity, and the kinds of research that are needed to underpin such a policy. Autor rozpatruje - w kontekście dyskusji na temat eutanazji - argumenty przemawiające za stosowaniem silnych środków pozwalających uśmierzać ból i cierpienie w fazie terminalnej, jak też przemawiające przeciwko takiemu postępowaniu. W efekcie zestawienia ze sobą jednych i drugich argumentów dojść można do wniosku, że stosowanie środków uśmierzających jest zachowaniem o wiele bardziej wskazanym, aniżeli wspomaganie przy samobójstwie. Nie należy z tego jednak wyprowadzać wniosku, że jest to jedyna moralnie akceptowana opcja. Wniosek, do jakiego dochodzi autor, brzmi mniej więcej następująco: oba (...) sposoby postępowania są moralnie akceptowalne, atoli jeden z nich jest bardziej wskazany czy korzystny. Poza tym trzeba jeszcze wspomnieć o jednym: podczas gdy można wskazać racje przemawiające przeciwko temu, by obowiązkiem lekarza uczynić asystowanie przy samobójczym akcie cierpiącego pacjenta, to tak samo można wskazać racje przemawiające za tym, by zobowiązać lekarza do tego by w tych samych okolicznościach - przy założeniu, że jest to jedyny sposób uśmierzenia bólu - uczynić obowiązkiem lekarza to, by w danych okolicznościach podał pacjentowi silne środki uśmierzające ból. Autor skłonny jest nawet pójść dalej i przyznać pacjentowi prawo żądania w określonych okolicznościach podania środków uśmierzających ból w stanach terminalnych. Jedną z racji przemawiających za tym jest, według autora, żywotne zainteresowanie pacjenta tym, by w ostatnich chwilach swego życia być uwolnionym od cierpienia. (shrink)

Objectives To explore attitudes and reasoning among Swedish physicians and the general public regarding the withdrawal of life-sustaining treatment at a competent patient's request. Design A vignette-based postal questionnaire including 1202 randomly selected individuals in the county of Stockholm and 1200 randomly selected Swedish physicians with various specialities. The vignettes described patients requesting withdrawal of their life-sustaining treatment: (1) a 77-year-old woman on dialysis; (2) a 36-year-old man on dialysis; (3) a 34-year-old ventilator-dependent tetraplegic man. Responders were asked to classify (...) the act of terminating treatment and to prioritise arguments for/against. Results A majority in both groups prioritised arguments in favour of terminating treatment and classified the act as defensible in all vignettes. However, among the general public, 16% classified the act as euthanasia in all vignettes; among physicians this view was most expressed regarding ventilator treatment (26%). Some who classified the act as euthanasia prioritised arguments in favour of terminating treatment: among physicians 18% in vignette 1, 19% in vignette 2 and 34% in vignette 3; among the general public 35% in vignette 1, 20% in vignette 2 and 48% in vignette 3. Conclusion There is a widespread consensus regarding competent patients' right to abstain from life-sustaining treatment. An association between the hastening of death, caused by the withdrawal of life-sustaining treatment and the concept of euthanasia is proposed. The results also suggest that classifying the withdrawal of life-sustaining treatment as ‘euthanasia’ does not necessarily mean that the act is interpreted as ethically unacceptable. (shrink)

ZusammenfassungWährend die terminale Sedierung neueren niederländischen Erhebungen zufolge bereits in mehr als 5% aller Sterbefälle zur Leidensminderung am Lebensende angewandt wird, sind viele der durch dieses Verfahren aufgeworfenen begrifflichen und ethischen Fragen weiterhin offen. Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Ethical issues relating to the withdrawal of dialysis are discussed, comparing dialysis with other life-support systems, particularly artificial ventilation. It is argued that there is no ethical difference between discontinuing treatment in each case. One practical difference between the two is that patients with chronic renal failure are less likely to have reduced autonomy, and so can engage in discussions with their doctors regarding the situations in which their life-supporting treatment might be discontinued. It is argued that doctors caring for (...) patients on dialysis have an ethical duty to discuss with these patients the circumstances in which they may wish to discontinue dialysis. (shrink)

To what extent are people able to make predictions about other people’s preferences and values? We report two experiments that present a novel method assessing some of the basic processes in surrogate decision-making, namely surrogate-utility estimation. In each experiment participants formed dyads who were asked to assign utilities to health related items and commodity items, and to predict their partner’s utility judgments for the same items. In experiment one we showed that older adults in long-term relationships were able to accurately (...) predict their partner’s wishes. In experiment two we showed that younger adults who were relatively unfamiliar with one another were also able to predict other people’s wishes. Crucially we demonstrated that these judgments were accurate even after partialling out each participant’s own preferences indicating that in order to make surrogate utility estimations people engage in perspective-taking rather than simple anchoring and adjustment, suggesting that utility estimation is not the cause of inaccuracy in surrogate decision-making.
