In this paper I advance a constitutive argument for the authority of rational norms. Because accountability to reasons is constitutive of rational agency and rational norms are implicit in reasons for action and belief, the justification of rational norms is of a piece with the practice of reasoning. Peter Railton has objected that the constitutive view fails to defend the categorical authority of reason over agents. I respond to his objections, arguing that they presuppose a foundationalist conception of justification that (...) demands a ground for reason's authority outside of the practice of reasoning. Criticizing Gallagher’s view on direct perception, I develop a basic model of social perception. According to the Cartesians another person’s intentions are not directly accessible to an observer. According to the cognitivist Cartesians conscious processes are necessary for social understanding. According to the Anti-Cartesians social perception is direct. Since both of these latter approaches face serious problems, I will argue in favor of an alternative: anti-cognitivist Cartesianism. Distinguishing between an active- and a passive part of the perceptual system we can (...) describe the situation as follows: Some functionally individuated parts of our nervous system generate percepts that correspond to the properties that causally trigger the system, whilst others form percepts of properties that do not causally trigger the system. The model is basic in that it merely helps clarifying some of the fundamental concepts we need in order to describe empirical findings. (shrink)

'May one be pardon’ d and retain the offence?’ asks King Claudius in his tormented monologue in Hamlet. Forgiveness appears incompatible with the retention of the offence, both in the sense of enjoying its consequences and in the sense of the subsistence of the attitude which underlay the offensive act. There are, however, views which allow for, even admire, an attitude of forgiveness towards people who have ‘retained’ their offense in some way. This idea of forgiveness is harder to justify, (...) since no change has taken place in the agent. We suggest that the concept of toleration can serve as an illuminating clue in such an analysis. The tolerant attitude involves a certain kind of reconciliation with people who not only have done something wrong in the past, but insist on sticking to their objectionable conduct in the present and the future. Tolerance, in other words, is not conditioned by repentance or by commitment to behavioral transformation; it is a kind of unconditional ‘forgiveness’ in advance. (shrink)

Associamos questões de responsabilidade ao que julgamos deveres ou obrigações que cada um tem para com os demais. Dentre essas obrigações há as que expressam deveres estritos. Mas como nem todos “deveres morais” expressam deveres em sentido estrito, é comum atribuirmos responsabilidade moral para além daquilo a que estamos estritamente obrigados. Não é incomum afi rmar que alguém deveria ter feito ou deixado de fazer algo, mesmo se ele não tinha a obrigação estrita de fazê-lo ou deixar de fazê-lo. Mas (...) como poderíamos “culpar” ou “condenar” moralmente alguém se ele não tinha a obrigação estrita de fazê-lo? É que o escopo de nossas avaliações “morais”, sendo amplo, comporta tipos diversos de “demandas”, o mesmo devendo valer para nossas “atitudes reativas”, tais como o ressentimento e seus análogos vicários, como a indignação. Porém, reações como o ressentimento e a indignação não podem ser reações genéricas à má vontade, à indiferença ou à falta de consideração, mas reações “apropriadas”a injustiças. Se alguém devia fazer algo, porém não estava efetivamente submetido ao dever estrito de fazê-lo, indignar-se é reagir exageradamente, muito além do que é contextualmente apropriado. Afinal, o modo como reagimos moralmente de forma apropriada não pode estar completamente dissociado do modo como interpretamos certos fatos. Neste ensaio, pretendo examinar o conceito de “responsabilidade moral”. Tratarei do problema das atribuições de responsabilidades e dos juízos de responsabilidade que Thomas Scanlon chamou apropriadamente de juízos de “responsabilidade substantiva.” Defenderei que há ações moralmente razoáveis, e até mesmo, em algum sentido, moralmente “requeridas”, porém sob circunstâncias que não pressupõem qualquer submissão do agente a algum dever em sentido estrito . Para tanto, revisarei o conhecido problema do trólei desgovernado e os problemas concernentes ao princípio do duplo-efeito. Veremos que é possível avaliar as ações de alguém sem atribuir-lhe responsabilidade substantiva por suas decisões corretas ou incorretas. Se eu estiver correto, conclusões práticas sobre a razoabilidade de certas ações não pressupõem necessariamente que seus agentes estejam submetidos previamente a quaisquer responsabilidades em termos substantivos. Sendo assim, as teorias tradicionais sobre a responsabilidade moral deveriam ser revisadas, assim como certas noções em psicologia moral acerca de que atitudes reativas são moralmente apropriadas.Questions of responsibility are associated to what we judge we owe to each other. Among these “duties” there are obligations that express strict duties . But since not all “moral oughts” express duties in the strict sense, it is also common to attribute responsibilities beyond what we consider a duty or an obligation in the strict sense. It is not unusual to assert that one should have to do or not to do something even if they didn’t have a strict obligation of doing or not doing that. But how could we morally “blame” or “condemn” someone if they didn’t have a strict obligation of doing something? As a matter of fact, the scope of our “moral” evaluations, being large, comprehends several types of “demands”, and the same should be applied to our “reactive attitudes”, like resentment, and their vicarious analogous, like indignation. But reactions like resentment and indignation cannot be generic reactions to unwillingness, to indifference, or want of consideration, but appropriated reactions to injustices. If a person should do something, but he was not actually submitted to the strict duty of doing so, then indignation is an exaggerated reaction beyond of what is contextually appropriated. After all the way we appropriately morally react cannot be completely disassociated with the way we interpret some facts. In this paper I will investigate the concept of “moral responsibility”. I will deal with problems of attributions of responsibilities and judgments of responsibility that Thomas Scanlon appropriately called judgments of substantive responsibility. My thesis will be that there are morally reasonable actions, and, at least in some sense, morally “required” actions, that don’t presuppose under some circumstances any submission of the agent to some duty in a strict sense . In this connection, I will reexamine the famous trolley problem and correlated problems on the principle of the double-effect. We will see that it is possible to evaluate someone actions without attributing substantive responsibility for his right or wrong decisions. If I am right, practical conclusions on the reasonability of certain actions don’t necessarily presuppose that their agents are previously submitted to whatever responsibilities in substantive terms. In such case, traditional theories on moral responsibilities have to be revised, as well as certain notions in moral psychology about what reactive attitudes are morally appropriated. (shrink)

I’ve been told that in the good old days of the 1970s, when Quine’s desert landscapes were regarded as ideal real estate and David Lewis and John Rawls had not yet left a legion of influential students rewriting the terrain of metaphysics and ethics respectively, compatibilism was still compatibilism about free will. And, of course, incompatibilism was still incompatibilism about free will. That is, compatibilism was the view that free will was compatible with determinism. Incompatibilism was the view that free (...) will was incompatible with determinism.1 What philosophers argued about was whether free will was compatible with determinism. Mostly, this was an argument about how to understand claims that one could do otherwise. You needn’t have bothered to talk about moral responsibility, because it was just obvious that you couldn’t have moral responsibility without free will. The literature was a temple of clarity. Then, somehow, things began to go horribly wrong. To be sure, there had been some activity in the 1960s that would have struck some observers as ominous. Still, it was not until the 1980s that those initial warning signs gave way to real trouble. The meanings of terms twisted. (shrink)

In the last decades increasing attention is paid to the topic of responsibility in technology development and engineering. The discussion of this topic is often guided by questions related to liability and blameworthiness. Recent discussions in engineering ethics call for a reconsideration of the traditional quest for responsibility. Rather than on alleged wrongdoing and blaming, the focus should shift to more socially responsible engineering, some authors argue. The present paper aims at exploring the different approaches to responsibility in order to (...) see which one is most appropriate to apply to engineering and technology development. Using the example of the development of a new sewage water treatment technology, the paper shows how different approaches for ascribing responsibilities have different implications for engineering practice in general, and R&D or technological design in particular. It was found that there was a tension between the demands that follow from these different approaches, most notably between efficacy and fairness. Although the consequentialist approach with its efficacy criterion turned out to be most powerful, it was also shown that the fairness of responsibility ascriptions should somehow be taken into account. It is proposed to look for alternative, more procedural ways to approach the fairness of responsibility ascriptions. (shrink)

Bodily awareness is a kind of perceptual awareness of the body that we do not usually count as a sense. I argue that that there is an overlooked agential difference between bodily awareness and perception in the five familiar senses: a difference in what is involved in perceptual activity in sight, hearing, touch taste and smell on the one hand, and bodily awareness on the other.

In this paper, we investigate the effect described in the literature as the Group Knobe Effect, which is an asymmetry in ascription of intentionality of negative and positive side-effects of an action performed by a group agent. We successfully replicate two studies originally conducted by Michael and Szigeti, who observed this effect and provide empirical evidence of the existence of two related effects—Group Epistemic and Doxastic Knobe Effects—which show analogous asymmetry with respect to knowledge and belief ascriptions. We explain how (...) the existence of the Group Knobe Effect and its epistemic and doxastic counterparts affects the philosophical debate on collective agency and intentionality and supports the intuitiveness of realism about collective agency among laypeople. We also critically assess the reasoning presented by Michael and Szigeti in favor of the realist-collectivist interpretation of their results. We argue that a thorough analysis of both their data and our new findings shows a rather wide range of differing intuitions among laypeople regarding the status of groups as agents. These results show that while some laypeople may have realist-collectivist intuitions, the contrary realist-distrubutivist intuitions are also widespread and the claim that the majority of laypeople hold collectivist intuitions regarding group agency is unjustified. As a neurodevelopmental condition that affects cognitive functioning, autism has been used as a test case for theories of moral responsibility. Most of the relevant literature focuses on autism’s impact on theory of mind and empathy. Here I examine aspects of autism related to executive function. I apply an account of how we might fail to be reasons responsive to argue that autism can increase the frequency of excuses for transgressive behavior, but will rarely make anyone completely exempt from moral (...) responsibility in general. On this account, although excuses may apply more often to autists than to others, the excuses that apply to autists are just the same excuses that can apply to anyone. (shrink)

I examine Manuel Vargas's revisionist justification for continuing with our responsibility-characteristic practices in the absence of basic desert. I query his claim that this justification need not depend on how we settle questions about the content of morality, arguing that it requires us to reject the Kantian principle that prohibits treating anyone merely as a means. I maintain that any convincing argument against this principle would have to be driven by concerns that arise within the sphere of moral theory itself, (...) whereas Vargas's argument draws solely on concerns about the expensive metaphysics involved in a libertarian conception of freedom. I argue that this amounts not just to changing the concept of free will by stipulation, but also (more problematically) to changing our moral principles by stipulation. (shrink)

Perception purports to help you gain knowledge of the world even if the world is not the way you expected it to be. Perception also purports to be an independent tribunal against which you can test your beliefs. It is natural to think that in order to serve these and other central functions, perceptual representations must not causally depend on your prior beliefs and expectations. In this paper, I clarify and then argue against the natural thought above. All perceptual systems (...) must solve an under-determination problem: the sensory data they receive could be caused by indefinitely many arrangements of distal objects and properties. Using a Bayesian approach to perceptual processing, I argue that in order to solve the under-determination problem, perceptual capacities must rely on prior beliefs or expectations of some kind. I then argue that perceptual states or processes can help ground knowledge of the world whether the ‘beliefs’ necessary for perceptual processing are encoded as sub-personal states within a perceptual system or cognitive states, such as person-level beliefs. My argument has two main parts. First, I give a preliminary argument that cognitive influence on perception can be appropriate, and I respond to three lines of objection. Second, I argue that cognitively influenced perceptual states can be instances of seeing that p, which makes the relevant states well suited to help ground knowledge that p. I conclude that a cognitively penetrated perceptual state or process can help ground knowledge under some circumstances. (shrink)

The paper offers an account of justified resentment and its importance in preserving human dignity. I situate the argument in the context of Martha Nussbaum's recent work against anger and resentment. Drawing on Enlightenment thinkers, I show the importance of resentment in deterring injury, in creating greater solidarity and humanity, and in preserving human dignity. The paper also offers a preliminary analysis of the norms that help to ensure appropriately expressed resentment.

Mi problema es como reconciliar una fundamentación racional de instituciones democráticas, que en nuestras sociedades tienden a ser de índole liberal, con la creciente complejidad demográfica de las sociedades contemporáneas. Mi punto de vista es que esta fundamentación debería ser deliberativa y discursiva, es decir, debería garantizar una participación reflexiva de todos los ciudadanos en el diseño y sostenimiento de sus instituciones públicas. Ahora bien, ¿cómo alcanzar este ideal en sociedades cuyas complejidades dificultan la coordinación de intereses y la participación (...) discursiva, lo que vuelve a sus ciudadanos dispuestos a sacrificar sus libertades para rendirlas a un poder político despótico y totalitario? However, how could this ideal be achieved within societies with such complexities that make coordination of interests and discursive participation difficult, thus making their citizens willing to sacrifice their liberties, in order to surrender them to a despotic or totalitarian political power?
