This introduction does three things. We first give an overview of the linguistic justice debate in normative political philosophy. We then situate Philippe Van Parijs’s position within it, by zooming in on Van Parijs’s two major normative claims: the support of the rise of English as the global lingua franca and the defence of linguistic territoriality. Finally, we clarify how each of the essays that follow this introduction relates to those two claims.

Is the project of liberal democracy dissociable from nationality? In this paper I outline and defend the main components of a recent and emerging answer to this question, which I term the "national pluralism" approach. I distinguish national pluralism from both national neutrality and liberal nationalism. In contrast to national neutrality, national pluralism holds that there is an important link between liberal democracy and nationality. In contrast to liberal nationalism, it pleads for pluralistic ways of accommodating multiple national identities within (...) the same political community. Moreover, national pluralism accords no special standing to existing nations. If new national identities emerge, such as an overarching national identity in multinational states or a European national identity, then these should be accordingly recognized. In addition, it can be argued from within this approach that there are also non-identity reasons for pursuing nation-building practices at supranational levels. (shrink)

To respond to globalization-related challenges, many contemporary political theorists have argued for forms of democracy beyond the level of the nation-state. Since the early 1990s, however, political theory has also witnessed a renewed normative defense of nationhood. Liberal nationalists have been influential in claiming that the state should protect and promote national identities, and that it is desirable that the boundaries of national and political units coincide. At first glance, both positions - global democracy and nationalism -seem to contradict each (...) other. We do not share this oppositional picture. The word ‘cosmopolitan’, which derives from the Greek word kosmopolitês (‘citizen of the world’), has been used to describe a wide variety of important views in moral and socio political philosophy. The nebulous core shared by all cosmopolitan views is the idea that all human beings, regardless of their political affiliation, do (or at least can) belong to a single community, and that this community should be cultivated. Different versions of cosmopolitanism envision this community in different ways, some focusing on (...) political institutions, others on moral norms or relationships, and still others focusing on shared markets or forms of cultural expression. The philosophical interest in cosmopolitanism lies in its challenge to commonly recognized attachments to fellow citizens, the local state, parochially shared cultures, and the like. (shrink)

According to ‘global institutionalism,’ individuals who do not share a state have duties of justice to one another, and this is explained, in part, by the institutional connections that obtain between them. In this chapter, I defend this view against two challenges. First, I consider challenges raised by ‘non-institutionalists,’ who deny that facts about global institutional interaction bear on the nature of duties of justice that arise between particular individuals. Second, I address challenges posed by ‘domestic institutionalists,’ who accept the (...) claim that facts about institutional interaction bear upon the scope of justice but deny that the right sort of interaction necessary to ground duties of justice is found in the global domain. The debate about justice in immigration seems somehow stagnated given that it seems justice requires both further exclusion and more porous borders. In the face of this, I propose to take a step back and to realize that the general problem of borders—to determine what kind of borders liberal democracies ought to have—gives rise to two particular problems: first, to justify exclusive control over the administration of borders (the problem of legitimacy of borders) and, second, to specify how this control (...) ought to be exercised (the problem of justice of borders). The literature has explored the second but ignored the first. Therefore, I propose a different approach to the ethics of immigration by focusing on concerns of legitimacy in a three-step framework: first, identifying the kind of authority or power that immigration controls exercise; second, redefining borders as international and domestic institutions that issue that kind of power; and finally, considering supranational institutions that redistribute the right to exclude among legitimate borders. The main objective of this essay is to offer an answer to the following question: Is there a scientific ground for the theory of the historical opposition between liberalism and the nation? In order to answer this question, this essay is organised in three parts. The first part identifies the position of the nation within the classical liberal discourse; the second identifies the crucial moment of the 1950’s as the precise period in which a major change in the relation between (...) liberalism and the nation took place; the third one identifies the moment of the nation’s restoration within the contemporary liberal discourse. The main conclusion of this essay is that, except for a brief though noteworthy period (which explains the actual apparent consensus concerning the opposition between the liberal and the national theories), the nation was a fundamental component of the liberal discourse and of the liberal political practices rather than a result of an opposing political vision. Québec’s model of cultural diversity, Interculturalism, has been the object of considerable debate since Bouchard and Taylor released in 2008 their now famous report, Building the Future: A Time for Reconciliation. Among other things, the authors recommended that schools take more seriously Québec’s Intercultural model as a means of bringing diverse cultures into a single society. In this dissertation I consider the uptake and implication of Intercultural ideals in Québec’s History and Citizenship education course. This study involved three secondary school (...) history teachers in Montreal Anglophone schools. Using Thacher’s “normative case study” as the methodological framework, I combine curriculum documents, classroom observations, open-ended interviews, and photo-voice methods to illuminate the Intercultural model’s shortcomings with regard to issues of power and identity. The guiding question for this dissertation is: how do the historicized power dynamics embedded within Québec’s Intercultural policy shape history education in Québec? Two sets of tensions are found to be at the crux of the issue of history teaching in Québec: first the theoretical debates on history education do not take Québec’s specific brand of cultural negotiation into account, resulting in a lack of research on the civic implications of history education particular to the Québec context. Second, the Intercultural model itself does not adequately deal with entrenched issues of power relating to marginalized identities, which raises many questions for how civic education is being carried out in the province. New biotechnologies have the potential to both dramatically improve human well-being and dramatically widen inequalities in well-being. This paper addresses a question that lies squarely on the fault line of these two claims: When as a matter of justice are societies obligated to include a new biotechnology in a national healthcare system? This question is approached from the standpoint of a twin aim theory of justice, in which social structures, including nation-states, have double-barreled theoretical objectives with regard to human well-being. (...) The first aim is to achieve a sufficient level of well-being in each of six core dimensions. In the special case of healthcare systems, this aim is focally but not exclusively attentive to achieving health sufficiency as one of the core dimensions. The second aim is to combat the emergence and persistence of densely woven patterns of systematic disadvantage that tend to undermine the achievement of a sufficient level of health and the other core elements of well-being of some persons and groups. Judgments about entitlements to health related resources, including new biotechnologies, are made in light of a threshold notion of health sufficiency. What is enough or sufficient health? The answer that is defended here is that sufficient health is enough health for a decent human life, understood as enough health to live a full life course without preventable, significant functional disability or decrement in health, or treatable pain or suffering. When a state must include a new biotechnology in its national healthcare system is also influenced by ancillary concerns about the connection between health and other core dimensions of well-being. What counts as a significant functional impairment or health decrement is thus explicated, in part, in relation to the theory’s sufficiency aim for the other essential dimensions of well-being, and thus for a decent life, overall. Those elements of health that play a critical role in the experience of sufficient reasoning, affiliation, security, respect and self determination are especially important; any loss of health function or capacity that threatens the individual’s prospects for sufficiency in these other dimensions, including the relational egalitiarian concerns they entail, constitutes a significant functional impairment. Within national borders, individuals are thus entitled to those health-related goods and services that are essential for a sufficiency of each of the dimensions of well-being; with regard to self determination and respect, what is sufficient by way of guaranteed access to specific goods and services is going to depend on the implications of such access for where an individual stands in relation to her co-nationals. The content of any entitlement to health-related goods and services is also necessarily dynamic. What can be done for health and the other core dimensions of well-being as a function of technological innovation and diffusion is in constant flux. The paper concludes by considering the implications of this analysis for the conditions under which states are obligated to include access in their healthcare systems to one biotechnology, deep brain stimulation. Multiculturalism has become a hot topic in political philosophy. This thesis investigates the philosophical foundations of multicultural theories through examining the key concepts commonly relied upon. A careful examination of each concept and the way in which they are interconnected, reveals an interesting strategy that the multiculturalist employs. It is my contention that the multiculturalist relies on a complex web of nebulous concepts which fools the reader into thinking that their theory rests on strong foundations. However, when we clear away (...) the fog of confusion, we can see that the multiculturalist has presented us with an illusion, and none of the concepts remain strong enough to hold any of the normative weight they need them to. Multiculturalism relies on grandiloquent rhetoric and muddled thinking, and will ultimately fail to achieve the liberal goals it purports to. (shrink)

Este trabajo intenta analizar las tensiones e interrelaciones entre el paradigma del reconocimiento y el paradigma de la redistribución. En concreto se analiza críticamente la obra de Nancy Frazer. En este sentido, se propone el paradigma de la inclusión, para un tercer ámbito, el de la política. Este paradigma se basaría en el ideal de la igual dignidad y la tricotomía inclusión/exclusión/participación. También se plantean reservas a la noción de paridad participativa, que según Fraser, hace conmensurables todas las demandas de (...) justicia. La conclusión es que redistribución y reconocimiento son irreductibles, están interrelacionados y en tensión. Para los casos de soluciones contrapuestas, se propone la noción de inconmensurabilidad que sostienen los defensores del pluralismo de valores -Berlin,Gray-. En casos de conflicto, redistribución y reconocimiento abocarían a una respuesta similar a cómo se debería resolver un dilema. (shrink)

Must liberalism, in dealing with issues of basic rights and primary goods, take into account national belonging as a particularly important form of cultural belonging? The paper first discusses liberalism which is frequently defined as difference-blind and which considers citizens solely on the basis of some of their abstract and common features. The alternative position is liberal nationalism, according to which individuals and their primary goods stand at the center of considerations of justice, but which also finds it impossible to (...) ignore cultural belonging when discussing primary goods and basic rights of individuals. In discussing the strategy which affirms national cultural belonging as a precondition for autonomy, an attempt is made to show that this is not a sufficient basis for the role of a special national cultural belonging in the definition of primary goods, because even if a national cultural belonging is needed for practicing autonomy, specific national cultural belonging isn’t. This contribution examines some normative assumptions and fundamentals of the multinational states, specifically those containing minorities coexisting with a national majority that has historically been the backbone of the state. The crisis in tradiditionally unitary states and post-communist ones that pursue compulsory policies of national homogenization and assimilation have forced a re-examination of the normative and institutional conditions conducive to the coexistence of several nationalities within the same state, against the classic maxim that every state should become a nation and (...) every nation should become a state. The present study contains a constructiviste critique of the ethnic, prepolitic concept of nation an suggest a cooperative and competitive reformulation of federalism as a democratic and processual device to institutionalize multinationalism by means of accomodation.
