RÉSUMÉ : John Searle, Hubert Dreyfus et Charles Taylor défendent la thèse voulant qu’il y ait des formes de «compréhension» ou de «savoir» qui, contrairement aux formes courantes, ne sont pas de nature représentationnelle ou conceptuelle mais sont plutôt du type des «savoir-faire». Cet article examine l’argument avancé en faveur de cette thèse ainsi que l’affirmation de ces auteurs suivant laquelle les Recherches philosophiques de Wittgenstein démontrent que celui-ci, au moins implicitement, l’acceptait. Les conclusions qui découlent de cet examen sont, (...) d’une part, que l’argument n’est pas concluant et, de l’autre, qu’il aurait été récusé par l’auteur des Recherches. ABSTRACT : A thesis held by John Searle, Hubert Dreyfus and Charles Taylor is that there is a kind of “understanding” or “knowledge” that differs from ordinary knowledge in being by nature non-representational or non-conceptual and rather a kind of “know-how.” The aim of this article is to examine the argument in support of their common thesis and their claim that it was endorsed, at least implicitly, by Wittgenstein in the Philosophical Investigations. Jeffrey Stout claims that John Rawls's idea of public reason (IPR) has contributed to a Christian backlash against liberalism. This essay argues that those whom Stout calls “antiliberal traditionalists” have misunderstood Rawls in important ways, and goes on to consider Stout's own critiques of the IPR. While Rawls's idea is often interpreted as a blanket prohibition on religious reasoning outside church and home, the essay will show that the very viability of the IPR depends upon a rich culture of deliberation (...) in which all forms of reasoning can be put forth for consideration. This clarification addresses the perception that the IPR imposes an “asymmetrical burden” upon believers. In fact, the essay suggests that there are good reasons why believers, qua believers, might endorse the IPR. (shrink)

The capability approach assigns a central role to the contexts within which social interactions take place, which make individual liberty achievable. However, an auxiliary concept is necessary to explain the contexts of collective action more accurately. In this paper I shall present Taylor’s concept of irreducibly social goods as a supplement to the capability approach. I shall also introduce the concept of hermeneutics as a strategy suitable for evaluating which capabilities are to be considered valid, as an alternative to aggregative (...) methodologies. This conceptual development at the core of the capability approach demands to be framed by a normative criterion that enables us to distinguish between emancipatory and conservative contexts of social action; for that purpose I make use of the subject idealization that Honneth and Anderson present. Although the residues of official segregation are widespread, affirmative action continues to meet resistance in both official and everyday life, even in such recent Supreme Court decisions as Grutter v Bollinger (539 U.S. 306). This is due in part to a governing ontology that draws the line between individual and collective. But there are other possibilities for conceiving the social, and I offer one here in a theory of affirmative action that is developed through close examination of sharing and promising (...) as elemental qualities of equitable communal life. The nature and value of these actions are demonstrated in narrative formulations of fairness as exemplified in triage and the situation at the end of slavery; of the difference between equality and equity and how justice depends on their conjunction; and finally of theorizing how these may come together in the permutable, opaque, yet resilient interdependence of person and community that represents most deeply the Greek idea of two in one, that is, of one two, not two ones. In these respects the paper is successful insofar as it discloses the kinds of reasoning that underlie both resistance and commitment to affirmative action. (shrink)

In this dissertation I examine the topics of ethics, religion, and their relationship in the work of Charles Taylor. I take Taylor's attempt to confront modern disenchantment by seeking a kind of re-enchantment as my guiding thread. Seeking re-enchantment means, first of all, defending an `engaged realist' account of strong evaluation, i.e., qualitative distinctions of value that are seen as normative for our desires. Secondly, it means overcoming self-enclosure and achieving self-transcendence, which I argue should be understood in terms of (...) transcending a `lower' mode of selfhood for a `higher' one in concern for `strong goods'. One of the main issues that Taylor raises is whether re-enchantment requires theism for its full adequacy. He advances - often as `hunches' - controversial claims regarding the significance of theism (1) for defending strong evaluative realism and (2) for motivating an ethic of universal human concern. I seek to fill out his hunches in terms of a theistic teleological perspective that is centered on the `telos of communion'. I argue that such a view is important for overcoming the problem of what Bernard Williams calls the `radical contingency' of ethical beliefs, which seems to undermine their normative authority. However, I argue that if a non-theistic view of cosmic purpose (e.g., Thomas Nagel's view) can be regarded as a viable option, then it could also help to address this problem and support a kind of re-enchantment. Taylor also advances the controversial view that (3) there is an ineradicable draw to `transcendence' in human life in connection to the quest for the meaning of life. Here he opposes certain mainstream theories of secularization that see it as a process involving the ineluctable fading away of the relevance of religion. I seek to fill out and defend Taylor's view in this matter. Besides providing a reading of Taylor's work as a whole and advancing further some of the issues he raises, I also examine his general evaluative framework based on his account of strong evaluation. In doing so I show how he provides a distinct and important perspective among contemporary moral philosophers. (shrink)

Taking as a starting point Taylor's concept about man as a being of meanings, this article examines, in particular, the way that Taylor elaborates his conception of the practical use of reason, recovering some fundamental notions of the phenomenological tradition and hermeneutics, relating to language, such as, the idea of the background, and the incarnated situation of man. Considering that, ultimately, the background is a horizon of previous reference, from the ontological point of view, to the subjective domain of reason (...) in the human agent, the analysis of Taylor ends up favoring certain approaches of contemporary philosophy such as, Heidegger’s existential analytic that aims at leaving aside, paradoxically, the premise of the subject. If we consider this indication, a challenge that remains, then, to the future development of the ways of understanding moral philosophy and philosophical anthropology, is how to link the analysis of the moral problem, in a subject of senses, with the ontological theory of the background that is, however, a-subjective. Tomando como punto de partida el concepto que tiene Taylor acerca del ser humano como un ser de significados, este artículo estudia el modo como Taylor elabora su concepción del uso práctico de la razón, recuperando ciertas nociones fundamentales de la tradición fenomenológica y hermenéutica relativas al lenguaje, como lo son la idea del trasfondo y la situación encarnada del hombre. Puesto que, en definitiva, el trasfondo constituye un horizonte de referencia anterior, desde el punto de vista ontológico, al dominio subjetivo de la razón en el agente humano, el análisis de Taylor termina por favorecer ciertos enfoques de la filosofía contemporánea como, por ejemplo, la analítica existenciaria de Heidegger, que buscan prescindir, paradójicamente, de la premisa del sujeto. Si atendemos a esta indicación, un desafío que resta, pues, al desarrollo futuro de los modos de comprensión de la filosofía moral, y de la antropología filosófica, es el de cómo vincular el análisis del problema moral, de un sujeto de sentidos, con una teoría ontológica del trasfondo que es, en cambio, a-subjetiva. Theories of cognition and theories of social practices and institutions have often each separately acknowledged the relevance of the other; but seldom have there been consistent and sustained attempts to synthesize these two areas within one explanatory framework. This is precisely what my dissertation aims to remedy. I propose that certain recent developments and themes in philosophy of mind and cognitive science, when understood in the right way, can explain the emergence and dynamics of social practices and institutions. Likewise, the (...) view I construct explains how social practices and institutions shape the character of cognition of their constituent agents. Moreover, I explain both cognitive and social agency under the single explanatory framework provided by Dynamic Systems Theory. Drawing upon the phenomenological tradition, "embodied, "extended", "embedded", "enactive", and "ecological" approaches to cognition, as well as the conceptual resources of Dynamic Systems Theory, I construct a theory of agency that sees cognitive and social agents as far-from-equilibrium, open, recursively self-maintenant dynamic systems. Depending on the specifics of concrete circumstances, such systems, which I call "Dynamic Embodied Agents", may develop and possess emergent capacities for error-detection, flexible learning, normative behavior, representation, self-reflection, various modes of pattern-recognition, a temporal sense of self, and even moral responsibility. Some such systems are also sensitive to perceived social influences ; while reciprocally constituting and causally affecting them. (shrink)

While the last several decades have seen a renaissance of scholarship on J. G. Herder (1744?1804), his moral philosophy has not been carefully examined. The aim of this paper is to fill this gap, and to point the way for further research, by reconstructing his original and systematically articulated views on morality. Three interrelated elements of his position are explored in detail: (1) his perfectionism, or theory of the human good; (2) his sentimentalism, which includes moral epistemology and a theory (...) of moral education; and (3) his theism, which deepens and justifies these other elements. According to Charles Taylor, practical reasoning helps us overcome cultural conflicts of val-ue when we are able to show that the passage from one value to another represents an epistemic gain. This paper argues that practical reasoning can be effective in pathological cases of cultural convergence but only if it is understood as a species of the creative social imagination.

The paper examines one possible argument against restricting the display of religious icons in Romanian public schools. Opponents of this decision claim that cult objects affirm something essential about our cultural identity and therefore that using legal instruments to protect this identity is justified. Using a differential analysis of two models of identity recognition, Charles Taylor’s and Axel Honneth’s, this paper argues that the legal protection of cultural identity is compatible with value pluralism but only if its defense is justified (...) in the terms provided by Honneth’s theory of identity recognition. However, the argument in favor of displaying icons in Romanian public schools, unlike the argument against wearing the Islamic veil in French public schools, cannot be justified in these terms. In the debate on conscientious objection in healthcare, proponents of conscience rights often point to the imperative to protect the health professional’s moral integrity. Their opponents hold that the moral integrity argument alone can at most justify accommodation of conscientious objectors as a “moral courtesy”, as the argument is insufficient to establish a general moral right to accommodation, let alone a legal right. This text draws on political philosophy in order to argue for a legal right to accommodation. The moral (...) integrity arguments should be supplemented by the requirement to protect minority rights in liberal democracies. Citizens have a right to live in accordance with their fundamental moral convictions, and a right to equal access to employment. However, this right should not be unconditional, as that would unduly infringe on the rights of other citizens. The right must be limited to cases where the moral basis is more fundamental in a sense that all reasonable citizens in a liberal democracy should accept, such as the constitutive role of the inviolability of human life in liberal democracies. There should be a legal, yet circumscribed, right to accommodation for conscientious objectors refusing to provide healthcare services that they reasonably consider to involve the intentional killing of a human being. This paper reconstructs the political–theoretical triangle between liberalism, communitarianism and conservatism. It shows how these three positions are related to each other and to what extent they are actually incompatible. The substantive outcome is the following thesis: the conservative position poses a challenge to liberalism that communitarianism is unable to offer and that liberalism cannot incorporate as it could with communitarianism. This challenge lies in the conservative’s ideal of a traditionally evolved, purposeless form of civil association, and its associated view (...) on the justification of authority within such forms of association. This ideal cannot be incorporated into liberalism’s overall concern with individual autonomy, in contrast to the communitarian’s ideal of community. This will be shown through an investigation of two key elements of the conservative ideal of civil association: its ‘purposelessness’ and its justification of authority. (shrink)

Je considère toutefois que Gauchet sous-estime également la mesure dans laquelle la religion a conservé ce pouvoir au sein de la société post-séculière. Although Gauchet starts from a vision of religion in which this dimension is central, I contend that he too underestimates the extent in which religion has retained this power within postsecular society. This paper critically discusses Charles Taylor’s ethical views in his little known paper “Ethics and Ontology” : 305–320, 2003) by confronting it with the moral phenomenology of Maurice Mandelbaum, as laid out in his The Phenomenology of Moral Experience. The aim of the paper is to explore the significance of Taylor’s views for the dispute between naturalists, non-naturalists, and quietists in contemporary metaethics. It is divided in six sections. In the first section, I examine Taylor’s critique of naturalism. I continue (...) to discuss his moral phenomenology in more detail in the second and third sections, arguing that Taylor’s move from phenomenology to ontology is problematic. In the fourth section, I evaluate Taylor’s strategy by comparing it with Mandelbaum’s understanding of moral phenomenology, while also extending this comparison to the issue of how to locate the source of moral experience in the fifth section. Based on these discussions, I finally conclude in the sixth section that Taylor’s hermeneutical position, although ontologically incomplete and underdemonstrated, draws attention to a question to which current moral theory does not adequately respond. This paper challenges a pervasive curricular justification for educationally acquainting young people with stories of genocide and other moral horrors from history. According to this justification, doing so favours the development of psycho-social soft skills connected with interpersonal awareness and the establishment and maintenance of positive relationships. It is argued that this justification not only renders the specific historical content incidental to the development of these skills. The educational intention of promoting such psycho-social soft skills by way of studying moral (...) horrors in history constitutes an ethically problematic instrumentalisation of the historical material itself. RÉSUMÉ: Cet article présente une critique de la position dite de l’ «ironie morale», une position philosophique passablement répandue dans la culture intellectuelle con temporaine et dont la caractéristique centrale est de mettre en question de façon radicale le concept de vérité morale. En m’appuyant sur la lecture de Foucault pro posée par Robert Réal Fillion, je dégage les présuppositions qui sont au cœur de la position en question. Je souligne ensuite ses implications pragmatiques; en acceptant le gambit épistémologique, crucial (...) en l’occurrence, selon lequel toutes les affirmations d’ordre moral sont en dernière analyse des descriptions fausses, nous renonçons en fait à notre capacité de juger d’une manière signifiante qu’un état de choses, une ligne de conduite, etc., est qualitivement supérieur à un autre. La question ici posée est donc la suivante: étant admis que la conception ironique de la moralité implique cette perte considérable, les raisons fournies en sa faveur sont-elles suffisamment bonnes pour étayer une attitude aussi forte et aussi radicale à l’endroit de la moralité et de la vérité? Ma thèse est qu’elles ne le sont pas et qu’en réalité on s’abuse en acceptant pour nécessaire et inévitable cette conception débilitante de la moralité. Les raisons sur la foi desquelles cette conclusion est admise semblent inattaquables à première vue, mais il se révèle à y regarder de plus près qu’elles sont non concluantes et inadéquates, ou qu’elles requièrent à tout le moins une révision sérieuse. People discussing science and religion usually frame their conversations in terms of essentialist assumptions about science, assumptions requiring the existence (but not the specification) of criteria according to which science can be distinguished from other forms of inquiry. However, criteria functioning at a level of generality appropriate to such discussions may not exist at all. Essentialist assumptions may be avoided if science is understood within a broader context of human practices. In a philosophy of practices, to label a practice as (...) “scientific” is to make a practically motivated provision for a way of speaking. Charles Taylor and Joseph Rouse have produced complementary philosophies of practice that promote this kind of understanding. In this essay I review the work of Taylor and Rouse, identify apparent residues of essentialism that each seems to harbor, and offer a resolution to some of their disagreements. I also criticize a form of essentialism commonly employed in Christian circles and outline an anti-essentialist view of science that may be helpful in science-and-religion discussions. (shrink)

A central feature of complexity is that it is based on non-linear, recursive relations. However, in most current accounts of complexity such relations, while non-linear, are based on the reductive relations of a Newtonian onto-epistemological framework. This means that the systems that are emergent from the workings of such relations are a narrowly reduced spectrum of complex systems. It is argued that John Dewey’s trans-actional relations, relations that are characterized by an irreducible internal distinction, can function as an exemplar of (...) the less reductive relations seen in living complex systems. Conceptualizing complex relations and complex systems in a less reductive way allows indeterminate concepts such as epistemological limits and the generative production of meaning, which are inextricably linked, to be considered. Methodologically, such lessened reduction highlights functional systems, revealing aspects of the biopsychosocial human ‘complex system of complex systems’ that are hidden from view in a Newtonian framework. This paper identifies the duty to care for the public interest in the commonly valued ecological goods of the Gulf as one of the basic essential features of the moral significance of the federal policies that govern the Deepwater Horizon Oil Spill. I argue that the Clean Water Act and the Oil Protection Act implicitly provide for a communitarian interpretation of the public and ecological goods of this event that warrants a virtue ethical account of normativity that is ultimately expressed (...) in the duty to care, a duty that is one of the central moral principles that underlies the punitive damages doctrine. Liberalism believes that individuals are endowed a priori with reason or at least agency and it is up to that reason and agency to make choices, commitments and so on. Communitarianism criticizes liberalism’s explicit and deliberate neglect of the self and insists that we attain a self and identity only through the effective recognition of significant others. However, personal autonomy does not seem to be a default position, neither reason nor community is going to provide it inevitably. Therefore, it is (...) so important to go beyond the liberal–communitarian divide. This article is analysing various proposals in this direction, asks about the place of communities and the individual in times of populism and the pandemic and provides a global perspective on the liberal–communitarian debate. The Law of Peoples and Global Justice: Beyond the Liberal Nationalism of John Rawls The paper deals with the relation of a theory of international justice, specifically John Rawls's philosophy of the law of peoples, and a theory of global justice. In the first part, the paper outlines Rawls's main theses on the international conception of the law of peoples. The second part concerns a problem found in segments of Rawls's theory, specifically his concept of a social contract—contractualism. This problem (...) inadequately approaches the relationship between the individual and the community. The third part deals with the inconsistent points in Rawls's theory contained in part two, i.e. his principles of justice selected with the aid of social contract. In the fourth part, the paper concentrates on the consequences of these limitations for a socially distributive dimension of justice or as an approach for dealing with disproportionate global inequalities. The last part formulates the causes of the limitations of Rawls's theory of international justice and points out the need for a global justice which is socially and inter-culturally considerate. ABSTRACTThis article explores how Charles Taylor’s account of moral personhood and Luc Boltanski and Laurent Thévenot’s account of justificatory regimes can add breadth, depth, and specificity to discussions of ethical dilemmas in public relations. These frameworks are analyzed for their potential to make the following contributions to public relations ethics. First, they convey that there is more to ethics than choosing the right duties and actions. Second, they reveal the diversity of goods that people consider to be ethically worthy and (...) admirable, as well as the complex personal issues involved in ranking these goods. Third, they emphasize that these different goods often need to be articulated and evaluated in different ways. Last, they can either point toward new ways of resolving ethical dilemmas or show why such resolutions are not possible. (shrink)

Growing concern about a shrinking cultural consensus on values, coupled with religious pluralisation and the realisation that schooling is not, and cannot be, value-neutral,have led to proposals to teach ethics in schools, interpreted as a contribution of the discipline of philosophy to the common curriculum. To the extent that this approach is seen to hinge on the alleged autonomy of ethics, it has the potential to indoctrinate the contestable view that rationality is the prime motivator of moral commitment. A case (...) is made for regarding philosophical ethics and religious studies not as alternative avenues to values education but each as a core curriculum priority, different but complementary to the other in its content. This article outlines and discusses some plausible examples of group learning. Drawing on these examples, various principles and issues that surround the notion of group learning are identified and discussed. I argue that Aristotelians who are sympathetic to the critique of liberal moral categories put forward by Alasdair MacIntyre ought to avail themselves of Marx's analysis of capitalism in Capital, Volume 1. Broadly speaking, there are two reasons for such a recommendation. First, Marx's account shows capitalism to be the sociological substrate for the evisceration of particularity that so concerns MacIntyre and other Aristotelians. I offer an explanation for why MacIntyre seems not to appreciate this. Second, Marx's own thinking is (...) markedly Aristotelian, in ways that I specify. (shrink)

The author studies Leibniz’s views of vindicating God for the existence of evil in the world, as well as the idea of the best of all possible worlds, including the past and present criticism. Following Leibniz, he opted for the presentation of Herder’s philosophy of history as one of the most significant forms of philosophical optimism that influenced the first half of the 19th century, including contemporary debates on and critiques of the topic. He defines Herder’s concept as the philosophy (...) of historical progress, which also significantly influenced Slovak philosophy of the given period. The main goal of the article is to present Leibniz’s and Herder’s views as a starting point for the Slovak philosophy of optimism and historical progress of the 18th century and the first half of the 19th century. In social and political philosophy, linguistic differences are usually seen as one item in the long and indefinite list of Cultural Differences; consequently, language rights are discussed and criticized together with other cultural rights. In this essay, it is argued that a right to use one's own language can be justified by appeal to the practical role of language in human life. The ability to communicate effectively is essential for human autonomy and well-being; thus there is no need to argue (...) that linguistic groups, as groups, are entitled to special treatment, or that language rights are group rights. Because learning a new language is invariably a costly matter, by recognizing some languages as official languages the state (re)distributes burdens and benefits among its citizens. The task of language rights is to guarantee that these burdens are not distributed in a too unequal way. (shrink)

A cross‐national study of differences in the identities of nursing in England and Australia and how this has affected nurses’ capacity to respond to hospital reform This paper examines similarities and differences in the identity of nursing in England and Australia. In doing this we examine how in each country nursing has developed different ideologies and strategies. Our analysis draws on data derived from a cross‐national study of hospital staff in England and Australia. We demonstrate how differences in the occupational (...) identity of nursing in each country are registered in their values, attitudes and beliefs. We suggest that these differences reflect the interplay of factors such as the strategic stances of nursing professional and industrial organisations and how nurses in each country have positioned themselves in responding to recent changes in health policy. Abstract.The United Kingdom Department of Health initiative on “The Expert Patient” (2001) reflects recent trends in political philosophy, ethics and health services research. The overall objective of the initiative is to encourage patients, particularly those suffering from chronic conditions to become more actively involved in decisions concerning their treatment. In doing so there would be (perhaps) an expectation of better patient compliance and (arguably) a resultant improvement in quality of life. Despite these anticipated beneficial influences on health outcomes, there may (...) be a danger that such initiatives are being carried along by the general swell of enthusiasm for recognising and facilitating the claims of disadvantaged or discriminated against groups. What more attractive than that patients should be “liberated” from what might be seen as the oppression of medical paternalism? To a great extent the potential for success of the Expert Patient venture turns on:(a) whether and to what extent a patient can be considered truly to be an expert and (b) full acceptance by the medical and heath care professions of allowing patients a more equitable and positive role.Whilst clearly the patient is an expert in the hermeneutic sense – it is they and they alone who experience their illness – there is nevertheless a risk of confusing experience with expertise. Experience limited to an individual does not of itself give rise to the generalisations that underlie reliable clinical treatment. Neither do the vast majority of patients possess the physiological and pharmacological knowledge to fully appreciate the biological nature of their illness nor the basis, risks or limitations of therapeutic measures. Might the notion of “The Expert Patient” as informed co-decision maker become a well-meaning but rather vacuous aspiration similar to that of informed consent? Even worse, could patient “empowerment” have a deleterious effect? The paper reviews some of the major issues and concludes that the expert patient initiative could have benefits for both patients and health professionals if operated on the basis of concordance: an informed collaborative alliance that optimises the potential benefits of medical care. In my paper, by drawing on the writings Heidegger developed in the late 1920s, I wish to display what we may refer to as the thorough educational nature of Heideggerian reflection. It is my argument that the analysis of Dasein we find in the early Heidegger displays an extraordinary deep and dense reflection on selfhood and subjectivity, a reflection that is rooted in subject’s freedom and transcending. By paying attention to the interplay between these two features, I argue that in (...) the late 1920s, while challenging the notion of an all-encompassing consciousness as the place where everything should be understood and managed, Heidegger built a conception of selfhood and subjectivity in terms of freedom, responsibility, and ongoing transformation. The positioning of theory in relation to educational practice has provoked much recent debate, with some arguing that educational theory constrains thinking in education, while others dismiss ‘theory’ out of hand as belonging to the world of the ‘academic’, abstracted from the ‘realities’ of the classroom. This paper views theory as necessarily implicated in all practices, but argues that depending on the theories embraced, and the understanding of theory itself, education can be understood in very different ways. Resisting the separation (...) of theory from practice, the paper takes up the call to consider the entanglement of theory with practice, or how theory matters. It takes formative assessment as a particularly fertile case for this discussion. Formative assessment has been considerably developed in schooling across different national education systems. Its aspiration is for assessment to support learning, rather than only to credentialise learning. Having first emerged as a concept when behaviourism held sway, it has been considered through different theoretical lenses. Drawing upon empirical studies of classroom assessment practices, the paper draws out the different ‘mattering’ implicated in the different languages of assessment used by practitioners, raising questions about the practices this produced. The paper concludes by asking if formative assessment could become ‘educational’ in a more radical sense, if opportunities to focus on the contingencies and politics of our meaning-making were sometimes taken up more openly and dialogically with students, as opposed to formative assessment sitting in a instrumental relationship to a given curriculum. This article explores the differences between Marcel Gauchet and Charles Taylor with respect to their theories of secularization. It starts by looking at their resemblances; it continues by distinguishing a two-fold difference in their approach. The variation within their similar methodologies is examined, and then the consequences of these divergent definitions of religion are investigated. We focus on four themes: the role of the Axial religions, the significance of Incarnation and Reformation, the significance of Christianity as the ‘religion of the (...) departure from religion’, and the possibility of religious ‘conversion’. Taylor's and Gauchet's views on the future of religion diverge as a function of their different interpretations of ‘fulfilment’ and ‘hunger for meaning’. (shrink)

Charles Taylor’s conception of the relationship between democracy and social creativity developed through a critical synthesis of various traditions, including the Romantic Movement and liberal political philosophy. However, it is argued that Taylor’s understanding of the implications of religion and revolution significantly differentiates his standpoint from that of pragmatism and theories of democratic creativity. Taylor’s defence of religious transcendence is shown to give rise to tensions with the latter perspective. The theorists of democratic creativity suggest that democracy originates in the (...) rupturing of religious significations and their closure of meaning. Taylor essentially inverts these arguments and perceives that the loss of transcendence may lead to a closed world structure. Taylor claims that the dilemmas of the modern immanent frame were prefigured in the French Revolution’s inability to generate an institutional form consistent with its understanding of democracy and that social creativity should be qualified in light of this historical experience. Authority figures permeate our daily lives, particularly, our political lives. What makes authority legitimate? The current debates about the legitimacy of authority are characterised by two opposing strategies. The first establish the legitimacy of authority on the basis of the content of the authority’s command. That is, if the content of the commands meet some independent normative standard then they are legitimate. However, there have been many recent criticisms of this strategy which focus on a particular shortcoming – namely, its (...) seeming inability to account for who can legitimately command whom. This is the basis of the second strategy, which attempts to characterize the normative relationship that underlies and makes possible authoritative commands. The central point of Part I is that these two strategies are, in fact, not opposed and both raise questions which a theory of legitimacy must answer. If this is the case, then we need to ask: how ought we to determine the legitimacy both of the content of commands as well as who can command whom? Part II will answer this question. Starting with the question of standing, I argue that we ought not to look for normative principles outside of the institutions in which authority is embedded. Rather, one ought to start by elaborating the ontology of institutions in which a sui generis form of normativity arises. A joint commitment account of social ontology provides the tools necessary to see how the direction obligations emerge concurrently with the formation of institutions. Similarly, the question of content can be answered by paying close attention to the social ontology of institutions. We need not look beyond the internal constitutive standards of the institution itself. The constitutive standards provide an internal criterion by which the legitimacy of commands can be established.
