Philosophy and Literature is an internationally renowned refereed journal founded by Denis Dutton at the University of Canterbury, Christchurch. It is now published by the Johns Hopkins University Press. Since its inception in 1976, Philosophy and Literature has been concerned with the relation between literary and philosophical studies, publishing articles on the philosophical interpretation of literature as well as the literary treatment of philosophy. Philosophy and Literature has sometimes been regarded as iconoclastic, in the sense that it repudiates academic pretensions, (...) insidious jargon and institutional vogue. Dutton, who remains the editor, still writes a regular column. A distinctive feature of Philosophy and Literature was the annual Bad Writing Contest, held from 1995–98, which sought to identify (and publish) the ‘most stylistically lamentable passages’ of academic prose, often to great amusement. Céticos do início da Modernidade utilizaram argumentos in utramque partem visando demonstrar que não se pode fundamentar a moralidade em um terreno sólido, já que os argumentos apresentados em favor da ideia de Justiça poderiam ser neutralizados por argumentos igualmente convincentes contra a ideia de Justiça. Nesse artigo, eu argumento que Hugo Grotius tentou refutar esse tipo (...) de ceticismo moral em seus principais escritos filosóficos, De jure bellic ac pacis e De jure praedae commentarius. Contra os céticos, Grotius procura estabelecer que as razões apresentadas a favor e contra a ideia de Justiça não são incompatíveis entre si. (shrink)

For thirty years now there has been considerable debate concerning the foundations of modern natural law theory, with Richard Tuck emphasising the role self-preservation plays in anchoring Grotius's system and his critics pointing to the contribution of a principle of sociability. With reference to recent contributions in the literature on Stoicism from Julia Annas, A. A. Long and Tad Brennan, I argue that Grotius's use of the outline of Stoic ethics from Book III of Cicero's De finibus is crucial for (...) understanding the nature of his argument. Drawing on Cicero's presentation of the Stoics' oikeiosis helps Grotius to generate an argument which issues not in any demand for altruism, charity or mutual aid, but rather for organising justice around very strong protections for private property. The argument remains one about human sociability, however, and ought not to be mistaken for an account of self-interest, nor for a doctrine with substantially Epicurean roots. (shrink)

SummaryThis article studies the impact of the debate about human sociability on the crisis of natural law in the later eighteenth century examining the Untersuchungen über den Stand der Natur of 1780 by the Göttingen scholar Michael Hissmann. It makes the case that this crisis ensued from Rousseau's Discours sur l‘inégalité and a revival of neo-Epicurean trends in moral philosophy more generally. The sociability debate revolved around the question to what extent society was natural or artificial to man. This had (...) important implications for the problem of whether distinctions between right and wrong or just and unjust were natural and inborn, or had developed at a much later stage of mankind's history, reflecting merely the respective needs and utility of different societies and cultures. Hissmann's essay summarises this European debate concisely. His point of departure is Rousseauian premises, yet his political conclusions turn Rousseau upside down. Here, Hissmann's essay opens up several questions regarding the allegedly radical political character of one-substance theories in philosophy. (shrink)
