In contemporary democracies, global capitalism exerts a significant influence over how state power is exercised, raising questions about where political power resides in global politics. This question is important, since our specific considerations about justifiability of political power, i.e. political legitimacy, depend on how we characterize political power at the global level. As a partial answer to this question, I argue that our notion of global political legitimacy should be reoriented to include the structural power of the Transnational Capitalist Class (...) as its subject matter. Structural power is a social relation in which the institutional context makes some agents comply with others’ preferences regardless of actors’ intentional efforts to bring about such outcomes. Even when global business elites do not intentionally exercise power to obtain political control of global governance, their structural power has recognizable effects that partly enforce the world order. To advance my claim, I utilize the radical realists’ argument that the notion of legitimacy is applicable to a broader range of social practices that are beyond dyadic power relations, i.e. rulers intentionally exercising power over subjects. Should our factual understanding of the world influence our normative theorising about it? G.A. Cohen has argued that our ultimate normative principles should not be constrained by facts. Many others have defended or are committed to various versions or subsets of that claim. In this paper I dispute those positions by arguing that, in order to resist the conclusion that ultimate normative principles rest on facts about possibility or conceivability, one has to embrace an unsatisfactory account of how principles generate (...) normative political judgments. So political theorists have to choose between principles ostensibly unbiased by our current understanding of human motivation and political reality, or principles capable of reliably generating political judgments. I conclude with wider methodological observations in defence of the latter option, and so of a return to political philosophy’s traditional blend of normative and descriptive elements. (shrink)

Despite the rapidly growing literature on realism, there’s little discussion of the ideology critique of John Rawls offered by one of its leading lights, Raymond Geuss. There is little understanding of what (most of) this critique consists in and few discussions of how Rawls’ approach to political theorising may be defended against it. To remedy this situation, this article reconstructs the realist ideology critique of Rawls advanced by Raymond Geuss, which has three prongs: (1) Rawls’ political theory offers insufficient tools (...) to uncover and address distortions of our political values, beliefs, and intuitions; (2) it unacceptably reinforces these distortions by unduly legitimating them; and (3) it diverts attention from important features of real politics. With this done, I finish by considering how Rawlsians can respond, chiefly by employing a kind of reflective equilibrium, or reflective endorsement, broad enough to encompass different forms of genealogy and ideology critique. In this article I defend a new argument against moralist theories of legitimacy and in favour of realist theories. Moralist theories, I argue, are vulnerable to ideological and wishful thinking because they do not connect the demands of legitimacy with the interests of rulers. Realist theories, however, generally do manage to make this connection. This is because satisfying the usual realist criteria for legitimacy – the creation of a stable political order that transcends brute coercion – is usually necessary for (...) rulers to preserve their rule. In this paper, we argue that solutions to normative challenges associated with autonomous driving, such as real-world trolley cases or distributions of risk in mundane driving situations, face the problem of reasonable pluralism: Reasonable pluralism refers to the fact that there exists a plurality of reasonable yet incompatible comprehensive moral doctrines within liberal democracies. The corresponding problem is that a politically acceptable solution cannot refer to only one of these comprehensive doctrines. Yet a politically adequate solution to the normative challenges (...) of autonomous driving need not come at the expense of an ethical solution, if it is based on moral beliefs that are (1) shared in an overlapping consensus and (2) systematized through public reason. Therefore, we argue that a Rawlsian justificatory framework is able to adequately address the normative challenges of autonomous driving and elaborate on how such a framework might be employed for this purpose. Starting from the ‘Dewey Lectures’, Rawls presents his conception of justice within a contextualist framework, as an elaboration of the basic ideas embedded in the political culture of liberal-democratic societies. But how are these basic ideas to be justified? In this article, I reconstruct and criticize Rawls’s strategy to answer this question. I explore an alternative strategy, consisting of a genealogical argument of a pragmatic kind – the kind of argument provided by authors like Bernard Williams, Edward Craig and Miranda (...) Fricker. I outline this genealogical argument drawing on Rawls’s reconstruction of the origins of liberalism. Then, I clarify the conditions under which this kind of argument maintains vindicatory power. I claim that the argument satisfies these conditions and that pragmatic genealogy can thus partially vindicate the basic ideas of liberal-democratic societies. (shrink)

The article challenges the notion that political realism necessarily requires a distinctively political normativity. Drawing on the works of Weber and Nietzsche, it offers an alternative reading of political realism. The article uncovers in Williams’ scholarship a dual-layered legitimacy framework, displaying three inherent demands (namely, discursive, intelligibility, and reflective vindication demand) in his idea of legitimacy. In so doing, the article demonstrates how political realism employs its own prescriptive resources to critically scrutinize politics, while highlighting the crucial distinction between political (...) realism and applied ethics. The article finally contends that political realism can, through immanent critique, maintain its evaluative standards and critical potency without necessarily engaging with political normativity. Is it a requirement of justice to democratize private companies? This question has received renewed attention in the wake of the financial crisis, as part of a larger debate about the role of companies in society. In this article, we discuss three principled arguments for workplace democracy and show that these arguments fail to establish that all workplaces ought to be democratized. We do, however, argue that republican-minded workers must have a fair opportunity to work in a democratic company. The political psychologists Hatemi, Crabtree and Smith accuse orthodox moral foundations theory of predicting what is already intrinsic to the theory, namely that moral beliefs influence political decision-making. The authors argue that, first, political psychology must start from a position which treats political and moral beliefs as equals so as to avoid self-justificatory theorising, and second, that such an analysis provides stronger evidence for political attitudes predicting moral attitudes than vice versa. I take this empirical result as a starting point (...) to intervene in a debate in contemporary normative political theory which has, to my mind, become largely unwieldy: the political realism controversy. I advise the realists to ‘downplay’ the (thus far) inconclusive debate over realism’s metanormative standing in favour of a non-metanormative inquiry. Hatemi, Crabtree and Smith’s study makes for an excellent backdrop. It affirms the realist hypothesis that politics is in some relevant sense – a causal, psychological sense – prior to morality. Realist political theory is often confronted with the objection that it is biased towards the status quo. Although this criticism overlooks the fact that realist political theories contain various resources for critique, a realist approach that is strong in status quo critique and contributes, constructively, to the theorising of alternatives to the status quo is a desideratum. The article argues that contextual realism, which sources its normativity from particular contexts, harbours an underexploited potential to establish such a form of political (...) theorising. By drawing on ideas and principles that have guided critical engagements with social and political forms in a particular context, and on widely shared views of need for reform, realists can identify deficits of the status quo and contribute to a debate on how these deficits might be addressed. This article describes and illustrates the idea of a transformative contextual realism, and defends it against some potential objections. (shrink)

Most realist theories of legitimacy are internalist theories, meaning that they regard legitimacy as a function of how subjects view their own rulers. However, some realists seek to qualify their internalism by holding that legitimacy is not simply a matter of whether subjects accept their rulers’ exercise of power. According to one such view, legitimacy requires that rulers’ power be ‘acceptable’ to subjects, in the sense that it can be justified on the basis of values that they accept. Call this (...) acceptability internalism. In this article, I argue that realists should reject acceptability internalism. I first argue that acceptability internalism has the disadvantage of separating the concept of legitimacy from the interests of rulers. I then consider two arguments in favour of acceptability internalism, and argue that both should be rejected. (shrink)

However, given Hall’s expertise in Williams’ thought, it might be surprising that the chapters about Hampshire seem (...) the most interesting and most convincing parts of the book because they address some of the most fundamental issues of realism in an especially concise and well-written form. Realist thinkers in political philosophy often criticize ideal theorists for neglecting or eliminating the fact of politics in their work. This is supposed to be problematic because we should never expect to overcome politics. Any theory that attempts to do so is said to be unrealistic, naïve, and impractical. Although much has been said in the dispute between realists and ideal theorists in recent years, this particular line of criticism, which should be distinguished from other criticisms of ideal theory, has (...) not been clearly or explicitly addressed by ideal theorists in the literature. I deal with this issue by examining the ideal theory of John Rawls, which has been a prominent target of realist criticisms. My aim is to see where politics exists, or might exist, in Rawls’s theory, and whether this politics satisfactorily answers to the various aspects of the realist’s critique. My analysis suggests that there may be no inherent or necessary conflict between ideal theory and real politics, after all. (shrink)

For political realists, legitimacy is a central requirement for the desirability of political institutions. Their detractors contend that it is either descriptive, and thus devoid of critical potential, or it relies on some moralist value that realists reject. We defend a functionalist reading of realist legitimacy: descriptive legitimacy, that is, the capacity of a political institution to generate beliefs in its right to rule as opposed to commanding through coercion alone, is desirable in virtue of its functional role. First, descriptive (...) legitimacy plays an evaluative role: Institutions can fail to convince citizens that they have a right to rule and can be ranked by how well they do so. Second, descriptive legitimacy plays a normative role, because if an institution fails to convince subjects of its right to rule, this gives them a reason not to comply with its directives, even if it satisfies philosophers’ standards for possessing such right. Political theories of modus vivendi start from an assumption of deep and permanent disagreement about conceptions of the good and conceptions of justice. In response to this disagreement, modus vivendi provides an account of legitimacy as a result of a minimally restricted bargaining process. This account of legitimacy faces three major criticisms. Firstly, that the political arrangement will be unstable, secondly that a modus vivendi will institutionalise injustice, and thirdly, that it will institutionalise the status quo. I concede the objection (...) that a modus vivendi is unstable in order to address the more serious objections that it institutionalises injustice or the status quo. Through its acceptance of instability, modus vivendi theory is no more likely than liberal theory to institutionalise injustice. Far from the conservatism it is often associated with, modus vivendi permits radical political doctrines and radical political action in a way that is precluded by mainstream liberal theory. ABSTRACTDid Kant believe we need a world government? It has been a matter of controversy in Kant scholarship whether Kant endorsed the creation of a world state or merely a voluntary federation of states with no coercive power. I argue that Kant's main concern was with a global juridical condition, which he regarded as a rational requirement given the equal freedom and equality of individuals. However, he recognized that implementing this rational ideal requires sensitivity to contingent aspects of world politics. (...) I will argue that Kant offers an ideal theory not disentangled from realist considerations and that he adopts what I will call methodological realism: the attempt to realize the requirements of Right in a world governed by its own laws and mechanisms. I will illustrate this interpretation with Kant's discussion of the right of nations. The confusion in regard to Kant's actual position on the matter, I will argue, is a direct consequence of Kant's methodological realism. The... (shrink)

From Plato to the present day, political theorists have used models of idealistic societies to think about politics. How can these idealistic models inform our thinking about political life in our non-ideal world? Not, as many political theorists have hoped, by providing normative guidance -- by showing us how things should be or where we should go. Even still, we can use these models to interpret the concepts we depend on to explain and evaluate political behavior and institutions, thereby sharpening (...) our explanations of how things work and our estimations of how to make things better. Seeing idealistic models in this light reveals a promising route to a form of political inquiry that integrates our explanatory aims and our normative aspirations. -/- (Updated: October 2024. La tesis central de este trabajo es que la tradicional tensión entre substancia y procedimiento socava las estabilidad de la justificación de la concepción liberal más extendida de la legitimidad (la Democracia Deliberativa). Dicha concepciones enfrentan problemas serios a la hora de articular de manera consistente dos dimensiones que parecen ir naturalmente asociadas a la idea de legitimidad: la dimensión procedimental, vinculada a la equidad del procedimiento, y la dimensión epistémica, asociada a la corrección de los resultados.
