How do we acquire moral obligations to others? The most straightforward cases are those where we acquire obligations as the result of particular actions which we voluntarily perform. If I promise you that I will trim your hedge, I face a moral Obligation to uphold my promise, and in the absence of some morally significant countervailing reason, I should indeed cut your hedge. Collective apologies on behalf of governments to historically mistreated minorities have become more common. It is unclear, however, how we should respond to these apologies and other practices that invoke collective responsibility for oppression (chapter 1). I review the current literature on collective responsibility to better understand the obstacles facing an account of collective responsibility for oppression (chapter 2). I then argue that we can make sense of these practices by holding powerful organized collectives (chapter 3) and privileged disorganized collectives (...) (chapter 4) responsible for oppression. These practices then can be what I call “morally legitimate” if they are confessions of self-blame, and this self-blame contains an element of collective-self protest (chapter 5). (shrink)

Ateistlerin teizmi reddetme gerekçeleri, genellikle kötülük sorununun teizme karşı en güçlü argüman olduğunu iddia etmelerinde yatmaktadır. Nitekim ateizme göre teizm, bu soruna başarılı bir şekilde cevap verememektedir. Bununla birlikte kötülük sorununun sadece teistler için bir problem olmadığı iddia edilebilir. Bizde bu makale içerisinde bu savdan yola çıkarak, yakın dönemde Yujin Nagasawa’nın geliştirdiği “sistematik kötülüğün varoluşsal sorunu” açısından bu iddiayı ele almaya çalıştık. Bu sorun, başlangıçta, yalnızca dünyadaki belirli olayların veya belirli olay türlerinin kötü olduğunu değil, aynı zamanda insan varoluşunun dayandığı (...) tüm biyolojik sistemlerin kötü olduğunu göstererek, teizm için bir meydan okuma yaratmaktadır. Ancak hem teistlerin hem de ateistlerin tipik olarak dünyanın genel olarak iyi olduğunu ve içinde yaşamaktan mutlu ve minnettar olmamız gerektiğini onaylayan varoluşsal iyimserliği benimsedikleri düşünüldüğünde, kötülüğün bu versiyonu, teizm için olduğu kadar, ateizm içinde bir problem olmaktadır. Makale içerisinde sorunun bu versiyonuna yanıt verirken ateizmin teizme kıyasla önemli bir dezavantajla karşı karşıya kalması nedeniyle, bunun ateizme karşı güçlü bir argüman olabileceğini iddia ediyoruz. Nagasawa has argued that the suffering associated with evolution presents a greater challenge to atheism than to theism because that evil is incompatible with ‘existential optimism’ about the world – with seeing the world as an overall good place, and being thankful that we exist. I argue that even if atheism was incompatible with existential optimism in this way, this presents no threat to atheism. Moreover, it is unclear how the suffering associated with evolution could on its own undermine existential (...) optimism. Links between Nagasawa's argument and the current debate about the axiology of theism are also explored. (shrink)

Recent decades have seen a considerable and progressive increase in historical claims. Within the context of colonialism criticism, but also outside this sphere, numerous politicians, collectives and intellectuals have emerged to denounce certain acts of the past, demanding recognition and repentance that would compensate for these past affronts. In this article we will analyze one of these cases: the demand for an apology from Spain and the Vatican by the President of Mexico, López Obrador. Taking as a guide the debate (...) around the ethical problem of non-identity, we will see what ethical and metaphysical assumptions serve as the basis for these claims. We will also assess whether the claims of the so-called «historical victims» are consistent and ethically acceptable. (shrink)

Abstract: We live in the age of apology, particularly the age of collective apology. Here, I focus specifically on collective state apologies. In these apologies, political leaders apologize on behalf of an entire collective to another collective, often a racial or ethnic minority. Cynicism and skepticism arise on whether these apologies are morally legitimate. Here, moral legitimacy entails that an apology deserves to be given the authority, seriousness, and consideration that interpersonal apologies usually demand. In this paper, I respond to (...) two groups that doubt the moral legitimacy of such apologies, namely political-realists and moral-individualists. Ultimately, I argue that collective state apologies can be morally legitimate. Political-realists are wrong to think that sincerity is necessary or sufficient for moral legitimacy. Moral-individualists overmoralize the role of the individual to the point of “hyperindividualism.” I end by proposing that at least democratically elected leaders have standing to apologize on behalf of their constituents. We can morally compare possible alternative states of affairs, judging that various actual historical occurrences were bad, overall—the Holocaust, World War I, and slavery, for example. We should prefer that such events had not occurred, and regret that they had occurred. But the vast majority of people who now exist would not have existed had it not been for those historical events. A ‘package deal’ is involved here: those events, together with oneself; or, the absence of the historical calamity, and (...) the absence of oneself. So, all considered, ought one to prefer never to have existed, and to regret that one exists? Not in itself, of course, but as part of the conjunction? There seems to be a strong case for saying that morally one must wish and prefer that certain historical events had not occurred, even if that would have meant that one would never have existed. One ought to regret, all considered, that the aggregate state of affairs that includes one's existence is the one that materialized. After setting out this idea, I explore arguments against it, and attempt to reach a conclusion. (shrink)

Usually, apologies are made by using non-conditional utterances: “I apologize for ruining your evening!” Very little, if any, attention has been given so far to conditional apologies which typically use utterances such as “If I have ruined your evening, I apologize!” This paper argues that such conditional utterances can constitute genuine apologies and play important moral roles in situations of uncertainty. It also proposes a closer analysis of such conditional apologies and contrasts them with unconditional apologies.

Our attitude to official apologies is paradoxical. Despite widespread critique of most apologies issued by heads of state, government, and NGOs, public demand for such apologies continues to arise with predictable regularity—we demand even as we condemn.I argue that the role of apologies in securing public trust in a democratic context can explain this paradoxical attitude. By contrasting private and public apologies, I demonstrate that the latter have emerged as a performative (rather than legal or structural)model for accountability, and thus (...) for reinspired public trust. Are there wrongs for which states cannot apologise? In this chapter, I argue that the answer is 'Yes'. I begin with the simple observation that reasoning as a state official requires a conception of what officials do, and so a conception of what is - and is not - properly undertaken on behalf of the state. To act as an official, then, requires a theory of what happens in a well functioning state: it requires a 'normative theory of the state. (...) What officials believe to be necessary for a state to be a good example of its kind will affect what they recognise as outside the bounds of what a state official ought to do. This limit on what can be recognised as something prior officials ought not to have done is illustrated by Canada's official apology for imposing residential schools on indigenous peoples. Canada's official apology left out a crucial feature of the schools policy in part because of the influence of integrationist theories of the state. An integrationist view of good statehood has limited officials' ability to see the project of restructuring indigenous communities and inculcating attachment to an overarching identity as a wrong in itself, and distorted officials' diagnosis of what went wrong in previous policy. One effect has been to allow contemporary officials to offer a sincere and comprehensive apology for past officials' human rights violations in indigenous communities while themselves pursuing policies in these communities that violate human rights. The lesson of the Canadian apology is that how state officials theorise the state can undermine their capacity to recognise human rights violations for what they are and distort their judgements of what must be done in remedy. In the ethical debate on genetic modification, it is common to encounter the claim that some anti-GM argument would also apply an established, ethically accepted technology, and that the anti-GM argument is therefore unsuccessful. The paper discusses whether this argumentative strategy, the Similarity Argument, is sound. It presents a logically valid, generic form of the Similarity Argument and then shows that it is subject to three types of objection: It does not respect the difference between pro tanto reasons and all-things-considered (...) judgments; it relies on the unproblematic transferability of reasons from one case to another; and it runs the risk of equivocations, especially in cases where the anti-genetic-modification argument relies on gradable features. The paper then shows how these issues play out in three specific Similarity Arguments that can be found in the literature. Finally, the paper discusses what conclusions we can draw from the fact that genetic modification and established technologies are similar for the ethical status of genetic modification. (shrink)

Unlike other kinds of theories of justice, reparatory justice can only be negatively defined, in non-ideal contexts in which initial wrongs had already been committed. For one, what counts and what does not count as wrongdoing or as an unjust state of affairs resulted from that wrongdoing depends on the normative framework upon which a theorist relies. Furthermore, the measures undertaken for alleviating historical injustices can be assessed only from the vantage point of other, independent normative considerations. In the present (...) paper I argue that this lack of substance is a feature that, far from being problematic, is what makes reparatory justice attractive. The specific example that I put forward is that of a reparatory justice account which seeks to instantiate the desiderata of a sufficientarian theory of justice. At first, distributive justice fills the content of reparatory justice, specifying up to what level reparations in-kind or compensatory measure should go. Afterwards, reparatory justice clarifies and provides epistemic inputs for distributive justice. Reparatory justice thus becomes an epistemic source for distributive justice, in that it provides the means for assessing whether someone’s level of well-being can be traced to her choice or to a wider, historically-sensitive operationalization of her “circumstances”. Janna Thompson has outlined ‘the apology paradox’, which arises whenever people apologize for an action or event upon which their existence is causally dependent. She argues that a sincere apology seems to entail a wish that the action or event had not occurred, but that we cannot sincerely wish that events upon which our existence depends had not occurred. I argue that Thompson’s paradox is a backward-looking version of Parfit’s (forward-looking) ‘non-identity problem’, where backward- and forward-looking refer to the perspective (...) of an agent apologizing for or contemplating an action. The temporal perspective of the agent gives us the tools with which to dissolve the air of paradox which surrounds these problems. Each is best grasped from one temporal perspective, but the para- doxes arise when we attempt to examine it simultaneously from another. The evaluations appropriate to the apology paradox and the non-identity problem are therefore time-indexed. (shrink)

As much as we can be squeamish and angry over what was being done in these studies, they force us to consider how we tell these stories and the policy we make now, as so much of our research is global and the risks and benefits of experimentation always in need of recalibration.Susan M. ReverbyA growing distrust exists among Latin American populations as past abuses in medical research have rightly been publicized, and as researchers continue to intentionally and unintentionally circumvent (...) the systems of regulation and oversight. Beyond the cultural gaps between researcher and subject, the Latin American people have their own perspectives about responsible conduct of research formed by sociopolitical thought and familial and community identity, which may be overlooked or ignored by the U.S. and other foreign nations. Just as the Havasupai Tribe in Arizona have challenged us to think about the role of culture and the need for improved regulations and practices in conducting research within the United States, through past abuses in human experimentation and the emergence of discourse between our Latin American neighbors, similar challenges confront us.
