Los autores hacen en este ensayo un análisis crítico del texto original de John Stuart Mill [1861/1863] titulado “El utilitarismo”, en el que el autor inglés busca hacer compatibles dos doctrinas: la doctrina del mayor bien para el mayor número de personas y, la doctrina del ius naturalismo que considera que existe un canon moral a priori que introduce conceptos absolutos como el bien intrínseco o el mal en sí como criterios para la toma de decisiones. En este trabajo, se (...) subraya la influencia que el pragmatismo clásico ejerció, y ejerce, como teoría de pensamiento jurídico y, sobre todo, para la acción y la decisión. El utilitarismo, interpreta al mundo desde diversos enfoques epistemológicos, especialmente desde el derecho, la economía y la política. Los autores concluyen que el utilitarismo queda justificado como precepto válido para la aplicación del derecho positivo, en el que debe juzgarse la acción no por su intencionalidad, sino por sus consecuencias evidentes. If ethics of care deals with the nature of relationships, attentiveness, and understanding particular others, narrativity ought to play a central part. Sometimes, caring simply amounts to working with narratives. In the article I claim that narrativity can even be said to be native to an ethics of care. Through an example, I demonstrate how a narrative ethics of care can discern and grasp some moral problems better than the standard theoretical outlooks.

Professional work is currently based on explicit knowledge and evidence to a greater degree than in the past. Standardising professional services in this way requires repetitive scenarios and might be seen as a challenge to professional autonomy. In the context of policing, officers perform a range of familiar tasks, but they may also encounter novel challenges at any moment. Moreover, police tasks are not well-defined. Therefore, many missions require police officers to rely on common sense, tacit knowledge or gut feeling. (...) The purpose of this research paper is to do reflection on the importance of the preservation of the justice in the peace talks in Colombia for that serve the construction a better country and a better society of the post-conflict. To achieve it is necessary to revise the justice concepts of redress of Adam Smith and associate it with the concept of utilitarianism of John Stuart Mill as search for the general happiness. The investigation go to do a traceability exhaustive (...) of the Peace Accords in Colombia to compare them with those achieved by other societies of the post-conflict in two countries in Europe and one from Latin America. The research conclude in the need of a peace agreement respectful of the right victims and territories affected by the armed conflict. An agreement to reduce as far as possible the not social satisfactions about Colombian political and justice institutions in the future. (shrink)
