Using a sample of 12,061 firm-year observations from the Chinese stock market for the period of 2001–2011 and geographic-proximity-based Confucianism variables, this study provides strong evidence that Confucianism is significantly negatively associated with minority shareholder expropriation, implying that Confucianism does mitigate agency conflicts between the controlling shareholder and minority shareholders. This finding suggests that Confucianism has important influence on business ethics, and thus can serve as an important ethical philosophy or social norm to mitigate the controlling shareholder’s unethical expropriation behavior. Moreover, my findings reveal that the nature of the ultimate owner attenuates the negative association between Confucianism and minority shareholder expropriation, suggesting that Confucianism’s negative impact on minority shareholder expropriation is less pronounced for state-owned enterprises than for non-state-owned enterprises. The above results are robust to a variety of sensitivity tests and my findings are valid after controlling for the potential endogeneity between Confucianism and minority shareholder expropriation. This comparative study of the ethics of care and the Confucian concept of jen argue against two assumptions made by Chenyang Li in his own study of these two traditions. Against him, I argue that a "feminine" morality is not adequate to address human equality, and that care-orientated theories like jen and care seem incompatible with the feminist commitment to oppose the subjection of women.

This paper examines whether the modern bioethical principles of respect for autonomy, beneficence, non-maleficence, and justice proposed by Beauchamp and Childress are existent in, compatible with, or acceptable to the leading Chinese moral philosophy—the ethics of Confucius. The author concludes that the moral values which the four prima facie principles uphold are expressly identifiable in Confucius’ teachings. However, Confucius’ emphasis on the filial piety, family values, the “love of gradation”, altruism of people, and the “role specified relation oriented ethics” will (...) inevitably influence the “specification” and application of these bioethical principles and hence tend to grant “beneficence” a favourable position that diminishes the respect for individual rights and autonomy. In contrast, the centrality of respect for autonomy and its stance of “first among equals” are more and more stressed in Western liberal viewpoints. Nevertheless, if the Confucian “doctrine of Mean” and a balanced “two dimensional personhood” approach are properly employed, this will require both theorists and clinicians, who are facing medical ethical dilemmas, of searching to attain due mean out of competing moral principles thus preventing “giving beneficence a priority” or “asserting autonomy must triumph”. This article explains how li 禮 or ‘ritual propriety’ is the ‘body language’ of ren 仁 or the authentic expression of our humanity. Li and ren are interdependent aspects of a larger creative human way (rendao 仁道) that can be conceptually distinguished as follows: li refers to the ritualized social form of appropriate conduct and ren to the more general, authentically human spirit this expresses. Li is the social instrument for self-cultivation and the vehicle of harmonious human interaction. More, li (...) must mean something that is effectively communicated to others for an authentic, human (ren) interaction to occur. Li is the body language of ren in being the ritual vehicle for its’ expression; however, li is underdetermined by ren and so must be distinguished from it in on further grounds: authentic human activity must not just be equivocated with social convention because conclusively establishing whether a particular action is li (or is a truly ren action) is impossible. As a result, li is often confused with social power and privilege that is easier to empirically identify than ren conduct is, but this is a mistake since li has to express ren or it is not li at all. The inescapable ambiguity of li – an ambiguity that attaches to any language – can be critiqued by the Western view that sees something ‘essential’ to the ‘self,’ and that makes one a ‘self’ in and of oneself and not in a way that depends on others. I show that such Western individualism – while resting on a fundamentally different way of thinking of being a person and living a good life – does not reduce Confucian ritual to being an instrument for social discrimination and subordination. My argument is indebted to twentieth-century philosophy of language in the West that offered the idea that some words are actions. (shrink)

The deep structure of Confucianism is identified through structuralist analysis in order to provide a conceptual framework for conducting social psychological research in Chinese society. Through understanding and imitating the Way of Heaven (tiendao), Confucians constructed the Way of Humanity (rendao), which consists of two aspects; ethics for ordinary people and ethics for scholars. Ethics for ordinary people adopts the principle of Respecting the Superior for procedural justice and the principle of Favouring the Intimate for distributive justice; the person who (...) occupies the superior position should play the role of decision-maker and should allocate resources by favouring intimate relationships. Because Confucian cosmology suggests that the Way of Humanity corresponds to the Way of Heaven, Confucians required individuals to cultivate themselves with the Way of Humanity. Ethics for scholars further endows Confucian disciples with the mission of benefiting the whole society with the Way of Humanity. (shrink)

My basic contention in this essay is that the proper characterization of Confucian ethics is not role-based ethics, rule-based ethics, or virtue ethics, but an ethics of the self or a self-based ethics. In essence, Confucian ethics is about how to realize a self in line with inner sagehood and outer kinghood ; it is about how to realize a self as fully self-conscious being-for-itself of definite character, substance, and personality. Confucian ethics does not start with the assumption that there (...) is a given self that should be made virtuous, rule-abiding, or dutiful, but starts from the assumption that a self needs to be created, developed, and realized in the ethical life while the potentiality of building a self is given. This Philosophy Compass article continues the comparison between Confucian and mainstream Western views of personhood and their connection with ethics begun in Confucianism and Ethics in the Western Philosophical Tradition I: Fundamental Concepts , by focusing on the Western self conceived as an independent agent with moral and political rights. More specifically, the present article briefly accounts for how the more strictly and explicitly individualistic notion of self dominating Western philosophy has developed, leading up to a recent debate in modern (...) Western rights theory between Herbert Fingarette and Henry Rosemont, Jr., two contemporary Western philosophers who are both steeped in Confucian thought as well as moral and political philosophy. This discussion elucidates how Confucianism can be compared to, and even contrasted with some basic principles of modern Western rights theory and the more individualistic view of self they entail. In the end, a new view of personhood and "free will"? is offered that synthesizes insights from the Confucian treatment of persons as being essentially interdependent with the Western treatment of persons as being essentially independent. Nyansa nye sika na w'akyekyere asie. One critical factor that has contributed to the spread of the virus COVID-19 and resulting illnesses and deaths is both the conceptual and the ethical confusion between the prioritization of individual rights over social duties. The adherence to the belief in the priority of rights over duties has motivated some individuals to refrain from social distancing and, as a result, has placed themselves and other individuals at serious risk to health and life. My argument (...) is that the ethical enjoinder of social duty possesses priority over the ethical value of individual rights especially in times of global crisis. I demonstrate this point by arguing that the concept of individual right is derivative from the concept of social duty and through the argument that the concept of social duty is more efficacious in addressing global threats to human life than is the concept of individual rights. What is needed is an in-depth revision of the moral ordering of rights and duties and a vision of the human being as inherently other directed with duties toward others. I shall examine two specific ethical systems, that of Confucian and African, Akan moral philosophy that exemplify such a revision of the moral order. (shrink)

In Confucianism, the subject of learning is one of the most important concerns. For centuries, Confucian thinkers have been devoted to seeking answers to questions such as, how to be a morally noble and decent human being?, how to be a true and moral human being—a noble man? and how to learn to be a junzi? A ‘junzi’ can be described as ‘an ideal person’. For Confucian thinkers, the concept of learning is not only an epistemological problem but also, or (...) perhaps more importantly, an ethical one. Confucian learning can be defined as a particular process of obtaining a certain knowledge in order to become a junzi. The aim of this article is to first introduce the Confucian hierarchy of learning and knowledge. Next, the typology of Confucian knowledge and learners is considered. The author makes a critical enquiry into the Confucian epistemology, and by doing so, attempts to reveal implied limitations and weaknesses. In the final section, the author argues that the Confucian classical text Li Ji revises, in part, the Confucius’ hierarchical view of learner and knowledge. (shrink)

This paper explores the Confucian value of authenticity. Taking as the starting point of the Confucian concept of becoming authentic persons of bo, da, jing, and shen, the paper first demonstrates that a high–far–firm zhixiang, creativity, an examined life, and sincerity are four necessary conditions for a self to be an authentic one of bo, da, jing, and shen. It then demonstrates that Confucian ethics operates with a metaphysical concept of a substantive self and Confucian self-cultivation implies authenticating such a (...) substantive self. Finally, it demonstrates that in Confucian ethics, cultivating a person’s self and cultivating the person’s humanity are not separable and entail one another. (shrink)

From the ‘DuPont factory’ case in China, one can see that contemporary ecology is faced with two underlying problems: A lack of responsibility toward the environment beyond being economically profitable, and a lack of care for what is outside of one’s immediate environment. For the purpose of confronting these two problems, I suggest two Confucian concepts: 1. zhengming 正名 and 2. datong 大同 . These two concepts can be used to develop an environmental ethics and thus play a crucial role (...) in solving the two above-mentioned problems. Zhengming is originally a political concept that was put forward by Confucius. According to this concept, everyone should fulfill their duty to the utmost in accordance with their individual roles. Datong is Confucius’ political ideal and emphasizes gong 公 as a spirit for caring for tian xia 天下 . Countering the general reading of Confucian ethics as a form of virtue ethics or humanistic ethics, this essay reads Confucian ethics as a form of ethical personalism. Doing so, it examines the ethical orientations in the Confucian classics, The Analects, Da Xue, and others, pointing out that the touchstone concept of Confucian ethics taught in these classics is the person, recalling the Confucian motto of ethical cultivation, ?inner sagehood and outer kinghood?. It demonstrates that only the name of personalism describes (...) well the substance of Confucian ethics and captures its essence. It indicates that Confucian personalism is characterized by its starting not from the concept of the person or personhood as a divinely or naturally given, something akin to the Hindu Atman, but from the concept of the person or personhood that must be substantialized in ethical cultivation, e.g., cultivating a personhood after the image of the sage. The most constructive response to the crisis in moral theory has been the revival of virtue ethics, an ethics that has the advantages of being personal, contextual, and, as this paper will argue, normative as well. The first section offers a general comparative analysis of Confucian and Whiteheadian philosophies, showing their common process orientation and their views of a somatic self united in reason and passion. The second section contrasts rational with aesthetic order, demonstrating a parallel with analytic and synthetic (...) reason, and showing that rule-based ethics comes under the former and virtue ethics under the latter. The third and final section discusses a Confucian-Whiteheadian aesthetics of virtue, focusing on love as the comprehensive virtue. The principal goal of the paper is to propose that an appropriation of Confucian virtue ethics will enhance the otherwise slow development of a Euro-American process ethics. (shrink)

This article discusses New Confucian views on individuality and related philosophical problems. Special emphasis is given to the position of Tu Wei-Ming, a foremost living New Confucian thinker. It is pointed out that many New Confucian philosophers share a vision of a Confucian 'ideal' individuality or selfhood based on social integration - as opposed to a Western type of individuality sometimes portrayed as an individuality by isolation. These patterns of individuality are further examined on the basis of Niklas Luhmann's historical (...) analysis of the semantics of individuality and his categories of 'individuality by inclusion' and 'individuality by exclusion'. Finally, some parallels and differences between Confucian and the Luhmannian viewpoints are pointed out, and a suggestion on how a Luhmannian perspective might contribute to reformulations of New Confucian thought is attempted. A cross-cultural work which reinvigorates the consideration of enlightenment.

Since the publication of his book on Zhongyong, Tu Weiming has worked for more than 30 years on an anthropocosmic reconstruction of the Confucian universe, in which self-transformation is defined both as the starting point and as the necessary vehicle for one’s spiritual journey. This article is primarily intended to examine Tu’s attempts to reconstruct Confucian spirituality but further to take a step forward to argue that in the spiritual world as construed by Confucius and Mencius, the experiential functions as (...) transcendental by which the self initiates and empowers the transformative process. Through exploring the spiritual significance of Confucian experiences, this essay will conclude that although “transcendental experience” is only one of many dimensions in other religious or intellectual traditions, it is the most important path for Confucians by which the self is enabled to become fully integrated with ultimate reality. It demonstrates that essential to Confucianism is the concept of three contracts: the contract of mind with oneself, the cultural contract with society and community; and the moral contract with humanity and the universe at large. Confucianism may not be labelled as contractualism. Nonetheless one would not have an adequate understanding of Confucianism without a view of the contractual dimension of Confucianism. Confucianism may not be labelled as realism. Human embryonic stem cell research can bring about major biomedical breakthroughs and thus contribute enormously to human welfare, yet it raises serious moral problems because it involves using human embryos for experiment. The “moral status of the human embryo” remains the core of such debates. Three different positions regarding the moral status of the human embryo can be categorised: the “all” position, the “none” position, and the “gradualist” position.The author proposes that the “gradualist” position is more plausible than the other (...) two positions. Confucius’s moral principle of jen, which proposes a unique theory of “love of gradation”, and the principle of yi, which advocates “due treatment for persons”, are then explored. The author then argues that our moral obligations to do good to other living organisms, persons, and our families are different.Putting together the “gradualist” position on the human embryo, and Confucius’s theories of “love of gradation” and “due treatment for persons”, the author concludes that the early embryo has less ethical significance than the later fetus and adult human. The moral obligation we have toward persons is clearer and stronger than that which we have toward human embryos. Embryo research is justifiable if it brings enormous welfare to human persons that cannot be otherwise achieved. The “love of gradation” requires us, however, to extend love and respect towards other entities according to their different status. We should therefore be very cautious in using human embryos for research, acknowledging the gradualist nature of their moral status. (shrink)

As an advocate of ‘comparative political theory,’ Fred Dallmayr has long engaged with Confucianism with a new vision for democracy suitable in East Asia but little attention has been paid to his idea of Confucian democracy, which he presents as a specific mode of ethical or relational democracy. This paper investigates Dallmayr’s ethical vision of Confucian democracy, first, by articulating his postmodern reconceptualization of democracy in terms of post-humanism and, second, by examining his post-humanist reevaluation of Confucian virtue ethics as (...) a critical resource for ethical democracy. It argues that the ethical vision of Confucian democracy, though morally appealing, should not dismiss the important instrumental value of democracy as a political system and, rather, find a way to integrate democracy’s instrumental and intrinsic values in a way that can enhance the qualitative relationality between people, political agents, and the common good. ABSTRACTI suggest that Kierkegaard proves a helpful interlocutor in the debate about Analects 13.18 and the meaning of yin 隱. After surveying the contemporary debate, I argue that Kierkegaard and the Confucians agree on three important points. First, they both present relational selves. Second, both believe certain relationships are integral for moral knowledge. Third, both present a differentiated account of love where our obligations are highest to those with whom we are closest. Moreover, Kierkegaard’s ‘covering’ in the deliberation ‘Love covers (...) a multitude of sins’ in Works of Love of ‘covering’ suggests innovative meanings for yin 隱 that are compatible with Confucian philosophy. Finally, I argue that sagely discretion in covering on the Confucian account is like the teleological suspension of the ethical. (shrink)

This article argues that, as far as the problem of Confucian religiosity is concerned, there is an interpretative turn from Mou Zongsan’s moral metaphysics to Tu Weiming’s religious hermeneutics. Some concluding remarks are made: First, Tu’s hermeneutics is rooted in the ontology of self as interrelatedness, which is completely different from Mou’s theory of true self as transcendental subjectivity. Second, Tu’s hermeneutics of self can be better illuminated with the help of Heidegger’s notion of Dasein as Being-with (Mitsein). For Tu (...) and Heidegger, self cannot be seen as something separate from community. This article also points out that the paradigmatic shift is evidenced in another similarity between the four categories of self, community, nature, and the transcendent in Tu’s hermeneutics on the one hand, and the four symbols of earth, sky, divinities, and mortals employed by Heidegger to interpret the meaning of dwelling, on the other. In such a primordial situation of dwelling, gods are not supposed to be intellectually known; they are rather to be neighbors in community. (shrink)

Through a comparative analysis of the stories of Abraham and Guo, this article tries to argue that some particularistic claims of Christianity and Confucianism, which regard faith in God or filial piety to parents respectively as the sole ultimate principle of human life, may constitute the spiritual mainstay of such serious evils as murdering the innocent in certain in-depth paradoxes. Only by assigning a supreme position to their universal ideas of loving all humans through their self-transformations could the two ethico-religious (...) traditions prevent those morally unacceptable evils motivated by their particularistic claims and overcome their in-depth paradoxes. If the current trend is any guide, it looks like we are heading towards a future in which relationships are determined and regulated by rights. In addition to the ?universal human rights? declared soon after the Second World War, other ?universal rights? have been declared and added to the list of rights, such as the rights of the child, the rights of indigenous peoples and so on. A question arises as to whether a world in which our relationships are governed (...) entirely on the basis of rights is an appealing one. I want to suggest that if our common future is regulated entirely by rights then we are moving in the wrong direction. By contrast, Tu Wei-ming believes that if Confucianism flourishes, we will move towards a society based on trust rather than rights, or what he calls a ?fiduciary society?. I will argue that while Tu's Confucian fiduciary society is perhaps an impractical ideal, a move towards it will provide a necessary counter-balance to the relentless march towards a rights-based society. This article suggests how Mengzian ideas of the way [dao], rightness [yi] and rites [li], as related to the presupposition that human nature is moral, respond to rigid notions of “truth” and “law,” which tolerate a banalization of evil. It further suggests that the Mengzian attitude is both rooted in human empathy and draws clear limits to it. This is demonstrated by responding to arguments raised by the protagonist Max Aue in Jonathan Little’s book The Kindly Ones.

In this article, we argue that, in order for white racial consciousness and practice to shift toward an antiracist praxis, a relational understanding of racism, the "self, "and society is necessary We find that such understanding arises from a confluence of propositional, affective, and tacit forms of knowledge about racism and one's own situatedness within it. We consider the claims sociologists have made about transformations in racial consciousness, bringing sociological theories of racism into dialogue with research on whiteness and antiracism. (...) We assert that sociological research on white racism and "whiteness" tends to privilege propositional and tacit/common sense knowledge, respectively, as critical to shifting white racial consciousness. Research on antiracism privileges affective knowledge as the source of antiracist change. We examine some of Perry's recent ethnographic research with white people who attended either multiracial or majority white high schools to argue that the confluence of these three types of knowledge is necessary to transform white racial praxis because it produces a relational understanding of self and "other, "and, by extension, race, racism, and antiracist practice. By focusing on the Confucian ideal of forming one body with Heaven, Earth, and myriad things, I argue that the distinctive feature of Chinese cosmology is not the absence of cosmogonist concerns, but faith in the interconnectedness of all modalities of being as the result of the continuous creativity of the cosmic process.
