The book concerns what I take to be the least controversial normative principle concerning action: you ought to perform your best option—best, that is, in terms of whatever ultimately matters. The book sets aside the question of what ultimately matters so as to focus on more basic issues, such as: What are our options? Do I have the option of typing out the cure for cancer if that’s what I would in fact do if I had the right intentions at (...) the right times (e.g., the intention to type the letter T at t1, the intention to type the letter H at t2, the intention to type the letter E at t3, etc.)? If I can’t form intentions voluntarily, does that mean that I don’t have the option of forming the intention that I ought to form? Which options do we assess directly in terms of their own goodness and which do we assess in terms of their relations to the goodness of other options? What do we hold fixed when assessing how good an option is? Do we, for instance, hold fixed the agent’s future beliefs, desires, and intentions? And do we hold fixed the agent’s predictable future misbehavior? Lastly, how do the things that ultimately matter determine the goodness of an option? If one of the things that ultimately matters in determining the goodness of an option is that the option doesn’t involve violating anyone’s rights, do we evaluate the option itself in terms of whether it involves violating anyone’s rights or do we evaluate the option’s prospect in terms of this and then the option in terms of its prospect? And what if there is indeterminacy or uncertainty with regards to whether an option would involve violating someone’s rights? (shrink)

Those who want to deny the ‘ought implies can’ principle often turn to weakened views to explain ‘ought implies can’ phenomena. The two most common versions of such views are that ‘ought’ presupposes ‘can’, and that ‘ought’ conversationally implicates ‘can’. This paper will reject both views, and in doing so, present a case against any pragmatic view of ‘ought implies can’. Unlike much of the literature, I won't rely on counterexamples, but instead will argue that each of these views fails (...) on its own terms. ‘Ought’ and ‘can’ do not obey the negation test for presupposition, and they do not obey the calculability or the cancelability tests for conversational implicature. I diagnose these failures as partly a result of the importance of the contrapositive of ‘ought implies can’. I end with a final argument emphasizing the role the principle plays in moral thinking, and the fact that no pragmatic account can do it justice. (shrink)

We here address the question of how, for a theory of justice, a concern for the promotion of equality can be combined with a concern for making people as well off as possible. Leximin, which requires making the worst off position as well off as possible, is one way of combining a concern for making people’s lives go well with a special concern for those who are especially poorly off. Many egalitarians, however, reject its near-monomaniacal focus on the worst off (...) position (to the exclusion of other poorly off persons). In this paper, we explore the possibility of combining a weak kind of egalitarianism with a weak kind of efficiency requirement in a way that avoids leximin’s obsession with the worst off position. For example, one may consider solving all cases where efficiency is not at issue by choosing the alternative that is most equal according to the Gini-coefficient or some other well-established inequality measure. All standard inequality measures sometimes judge an alternative as more equal than another alternative even though the latter maximizes the benefits of the worst off. Thus it may seem like a promising way of avoiding the leximin approach within an egalitarian framework. Surprisingly, given certain generally accepted assumptions, this turns out to be impossible. The only possible way of combining weak egalitarianism with weak efficiency requires, we shall show, the rejection of a widely accepted—but perhaps dubious—contraction consistency condition on justice or the acceptance of some version of the leximin principle. We shall focus on moral theories that are solely concerned with promoting the benefits (e.g., wellbeing) of individuals and explore the possibility of such theories ascribing some priority to benefits to those who are worse off—without this priority being absolute. Utilitarianism (which evaluates alternatives on the basis of total or average benefits) ascribes no priority to the worse off, and leximin (which evaluates alternatives by giving lexical priority to the worst off, and then the second worst off, and so on) (...) ascribes absolute priority to the worse off (i.e., favors even a very small benefit to a worse off person over very large benefits to large numbers of better off people). Neither extreme view, we assume, is plausible. (shrink)

According to Act Consequentialism, an act is right if and only if its outcome is not worse than the outcome of any alternative to that act. This view, however, leads to deontic paradoxes if the alternatives to an act are all other acts that can be done in the situation. A typical response is to only apply this rightness criterion to maximally specific acts and to take the alternatives to a maximally specific act to be the other maximally specific acts (...) that can be done in the situation. (This view can then be supplanted by a separate account for the rightness of acts that are not maximally specific.) This paper defends a rival view, Binary Act Consequentialism, where, for any voluntary act, that act is right if and only if its outcome is not worse than the outcome of not doing that act. Binary Act Consequentialism, which dates back to Jeremy Bentham, has few supporters. A number of seemingly powerful objections have been considered fatal. In this paper, I rebut these objections and put forward a positive argument for the view. (shrink)

In this paper, using Mark Schroeder’s (2008a) expressivist semantic framework for normative language as a case study, I will identify difficulties that even an expressivist semantic theory capable of addressing the Frege-Geach problem will encounter in handling the logical possibility of moral dilemmas. To this end, I will draw on a classical puzzle formulated by McConnell (1978) that the logical possibility of moral dilemmas conflicts with some of the prima facie plausible axioms of the standard deontic logic, which include obligation (...) implies permission. On the tentative assumption that proponents of ethical expressivism should be generally committed to securing the logical possibility of moral dilemmas in their semantic theories, I will explore whether and how expressivists can successfully invalidate obligation implies permission within the framework developed by Schroeder. The case study eventually reveals that this can indeed be a hard task for expressivists. Generalizing from the case study, I will suggest that the source of the difficulty ultimately lies in the mentalist assumption of the expressivist semantic project that the logico-semantic relations exhibited by normative sentences should be modeled in terms of the psychological attitudes that speakers express by uttering them. My final goal will be to show that the difficulty expressivists face in dealing with the logical possibility of moral dilemmas is a reflection of the more general problem that their commitment to the mentalist assumption prevents them from flexibly adopting or dropping axioms in their semantic theories to get the right technical results. According to a popular account, rationality is a kind of coherence of an agent’s mental states and, more specifically, a matter of fulfilling norms of coherence. For example, in order to be rational, an agent is required to intend to do what they judge they ought to and can do. This norm has been called ‘Enkrasia’. Another norm requires that, ceteris paribus, an agent retain their intention over time. This has been called ‘Persistence of Intention’. This paper argues that thus (...) understood norms of rationality may at times conflict. More specifically, Enkrasia and Persistence of Intention may place demands on the agent that are impossible to fulfil. In these cases, the framework of requirements does not provide us with norms that make us rational. A rival account, according to which rationality is a kind of responsiveness to one’s available reasons, can overcome the problem. (shrink)

According to moral encroachment facts about epistemic justification can vary with moral factors that are unrelated to the truth of the belief. Most of the literature on this topic has focused on how beliefs can wrong, and whether the data that moral encroachers offer in support of their view can be explained within a purist framework. A largely neglected question has been what kind of consequences moral encroachment would have for epistemic justification if the thesis were true. It has been argued, in other words, that the epistemic is logically prior to other normative (e.g., ethical, prudential, pecuniary) considerations in human decision-making, that these other normative considerations figure in decision-making only after (logically and temporally) (...) relevant ignorance has constrained the decision-maker’s menu of options. If this is right, then a person’s moral judgments in some set of circumstances should vary with their knowledge and ignorance of these circumstances. In this study, we test the hypothesis of the logical priority of the epistemic. We describe two experiments in which subjects’ knowledge and ignorance of relevant consequences were manipulated. In the second experiment, we also compared the effect of ignorance on moral judgments with that of personal force, a factor previously shown to influence moral judgments. This paper shows that our popular account of weakness of will is inconsistent with dilemmas. In dilemmas, agents judge that they ought to do one thing, that they ought to do something else, and that they cannot do both. They must act against either of their two judgments. But such action is commonly understood as weakness of will. An agent is weak-willed in doing something if she judges that she ought to and could do something else instead. Thus, it seems (...) that, in a dilemma, the agent is weak-willed by definition. But this is puzzling: clearly, the two are different phenomena. The puzzle may support scepticism about weakness of will or dilemmas. Here, I argue that the two are consistent on a revised understanding of weakness of will. To do so, I further distinguish the mental states of an agent in a dilemma from those of a weak-willed person. (shrink)

Moral obligation and permissibility are usually thought to be interdefinable. Following the pattern of the duality definitions of necessity and possibility, we have that something’s being permissible could be defined as its not being obligatory to not do it. And that something’s being obligatory could be defined as its not being permissible to not do it. In this paper, I argue that neither direction of this alleged interdefinability works. Roughly, the problem is that a claim that some act is obligatory (...) or permissible entails that there is a moral law, whereas a negative claim that some act is not obligatory or not permissible does not. Nevertheless, one direction of the interdefinability can potentially be salvaged. I argue that, if we do not require the conceptual possibility of moral dilemmas, then there is a way to plausibly define obligation in terms of permissibility. I conclude that permissibility is the only feasible deontic primitive. (shrink)

This essay begins by describing T.M. Scanlon’s contractualism according to which an action is right when it is authorised by the moral principles no one could reasonably reject. This view has argued to have implausible consequences with regards to how different-sized groups, non-human animals, and cognitively limited human beings should be treated. It has also been accused of being theoretically redundant and unable to vindicate the so-called deontic distinctions. I then distinguish between the general contractualist framework and Scanlon’s version of (...) contractualism. I explain how the general framework enables us to formulate many other versions of contractualism some of which can already be found in the literature. Understanding contractualism in this new way enables us both to understand the structural similarities and differences between different versions of contractualism and also to see the different objections to contractualism as internal debates about which version of contractualism is correct. A compelling requirement on normative theories is that they should be satisfiable, that is, in every possible choice situation with a finite number of alternatives, there should be at least one performable act such that, if one were to perform that act, one would comply with the theory. In this paper, I argue that, given some standard assumptions about free will and counterfactuals, Objective Act Consequentialism violates this requirement.

To consequentialize a deontological moral theory is to give a theory which issues the same moral verdicts, but explains those verdicts in terms of maximizing or satisficing value. There are many motivations for consequentializing: to reconcile plausible ideas behind deontology with plausible ideas behind consequentialism, to help us better understand deontological theories, or to extend deontological theories beyond what intuitions alone tell us. It has proven difficult to consequentialize theories that allow for moral dilemmas or that deny that “ought” implies (...) “can.” This article argues that the problem is best solved by allowing impossible actions as inputs into consequentializations. It shows that all other approaches that have been advocated are inadequate. It also argues that progress in consequentialization, and in formal ethics more generally, requires thinking about more than just wrongness and permissibility; we should think about contrary-to-duty obligations and degrees of wrongness as well. This essay argues against the commonly held view that "ought" implies "can" in the domain of morality. More specifically, I contest the notion that nobody should ever be held morally responsible for failing to avoid the infliction of any harm that he or she has not been able to avoid through all reasonably feasible precautions in the carrying out of some worthwhile activity. The article explicates the concept of a moral right in order to show why violations of moral rights (...) can occur even when no one has acted wrongfully in any fashion. In so doing, it will effectively be maintaining that strict liability (i.e., liability irrespective of the presence or absence of culpability) exists in morality as well as in law. When we take account of the distinction between exoneration and extenuation, we can see that scrupulously thorough precautions are never sufficient to constitute an excuse in morality. Having made that point with some extended examples, the article goes on to consider a number of possible objections - objections that lead into discussions of some basic distinctions within moral philosophy and some central principles within deontic logic. This paper concerns one of the undecided disputes of modern moral philosophy: the possibility of moral dilemmas. Whereas proponents of the possibility of moral dilemmas often appeal to moral experience, many opponents refer to ethical theory and deontic logic. My aim in this paper is to clarify some of the tension between moral experience and ethical theory with respect to moral dilemmas. In Part One I try to show that a number of logical arguments against the possibility of moral dilemmas, (...) though apparently very different, turn out to be basically the same, as they are all based on the following concept of ought: if A ought to be done, doing B is impermissible and doing A itself is permissible. In Part Two I present an overview of several definitions of moral dilemmas that have been given by proponents of moral dilemmas: definitions that define moral dilemmas in terms of oughts and definitions that define them in terms of reasons. I conclude that, while reason is to weak, ought is too strong a concept to define moral dilemmas with. In this way, the arguments from Part One create a logical problem for proponents of the possibility of moral dilemmas to define moral dilemmas. (shrink)

A growing trend of thought has it that any plausible nonconsequentialist theory can be consequentialized, which is to say that it can be given a consequentialist representation. In this essay, I explore both whether this claim is true and what its implications are. I also explain the procedure for consequentializing a nonconsequentialist theory and give an account of the motivation for doing so.

Is it permissible to kill an innocent person against her will in order to prevent several other innocent persons from being killed against their will? The answer to which this essay comes after extensive discussion is – under certain conditions and limitations – affirmative. On the way to this answer, the book offers a comprehensive in-depth discussion of so-called deontic restrictions – that is, the idea of an action’s being prohibited in circumstances in which performing it once would be the (...) only way to prevent its being performed multiple times. The book’s leading question is whether there is a plausible rationale for deontic restrictions. To this effect, a taxonomy and critical discussions of the most important approaches to justify deontic restrictions are provided – where many of these approaches undergo a deeper examination for the first time ever. In addition, the book clarifies some adjoining questions, such as why deontic restrictions are often perceived as being problematic or how the concept of agent-relativity should best be understood and formalized. Put into broader perspective, the conclusions offered should have a bearing on a number of debates in normative ethics, not least on the debate between deontologists and consequentialist. (shrink)

It has been argued by Clayton Littlejohn that cases of insufficient evidence provide an argument against evidentialism. He distinguishes between evidential reasons and norm-reasons, but this distinction can be accepted by evidentialists, as we argue. Furthermore, evidentialists can acknowledge the existence of norm-reasons stemming from an epistemic norm, like the norm that one should not believe a proposition if one has only insufficient evidence for it. An alternative interpretation of evidentialism according to which it rejects the existence of norm-reasons is (...) also presented. Therefore, no reason to reject evidentialism arises in this context. (shrink)
