Many prominent theories of moral responsibility rely on the notion of “tracing,” the idea that responsibility for an outcome can be located in (i.e., “traced back to”) some prior moment of control, perhaps significantly antecedent to the proximate sources of a considered action. In this article, I show how there is a problem for theories that rely on tracing. The problem is connected to the knowledge condition on moral responsibility. Many prima facie good candidate cases for tracing analyses appear to (...) violate the knowledge condition on moral responsibility. So, either we need to dispense with tracing approaches or we must refine our understanding of the knowledge condition or we are responsible less frequently than we suppose. (shrink)

In this article I propose a resolution to the history issue for responsible agency, given a moderate revisionist approach to responsibility. Roughly, moderate revisionism is the view that a plausible and normatively adequate theory of responsibility will require principled departures from commonsense thinking. The history issue is whether morally responsible agency – that is, whether an agent is an apt target of our responsibility-characteristic practices and attitudes – is an essentially historical notion. Some have maintained that responsible agents must have (...) particular sorts of histories, others have argued that no such history is required. Resolution of this contentious issue is connected to a wide range of concerns, including the significance and culpability of different forms of manipulation, the plausibility of important incompatibilist criticisms of compatibilism, and of course, a satisfactory account of moral responsibility. As it turns out, history matters sometimes, but less frequently than we might think. (shrink)

I examine the extent to which Dennett’s account in Freedom Evolves might be construed as revisionist about free will or should instead be understood as a more traditional kind of compatibilism. I also consider Dennett’s views about philosophical work on free agency and its relationship to scientific inquiry, and I argue that extant philosophical work is more relevant to scientific inquiry than Dennett’s remarks may suggest.

Constitutive instrumentalism is the view that responsibility practices arise from and are justified by our being prosocial creatures who need responsibility practices to secure specific kinds of social goods. In particular, responsibility practices shape agency in ways that disposes adherence to norms that enable goods of shared cooperative life. The mechanics of everyday responsibility practices operate, in part, via costly signaling about the suitability of agents for coordination and cooperation under conditions of shared cooperative life. So, there are a range (...) of identifiable conditions where the ordinary operation of responsibility practices—and thus, the usual normative force of the practices—is disrupted. Even so, these conditions are not so widespread as to favor a more thoroughgoing abandonment of responsibility practices. (shrink)

The principal argument suggested here is that we are all morally embedded selves: We have no control over the abilities that make us moral agents nor can we control the degree to which we have these abilities; in other words, we are not responsible for our good or bad qualities as moral agents. This, I believe, calls for the adoption of embedded compatibilism (EC). According to EC, people have control over their conduct; this control, however, is embedded within prerequisites, which (...) they cannot control and hence are not responsible for having or lacking. On the one hand, EC enables us to explain why a lack of control at the ultimate level does not eliminate moral judgment altogether. However on the other hand, EC ought to change our understanding of moral responsibility; interalia, it supports a hybrid notion of punishment, indicates the incomplete nature of guilt and reintroduces the problem of moral luck. The debate between compatibilists and incompatibilists depends in large part on what ordinary people mean by ‘free will’, a matter on which previous experimental philosophy studies have yielded conflicting results. In Nahmias, Morris, Nadelhoffer, and Turner (2005, 2006), most participants judged that agents in deterministic scenarios could have free will and be morally responsible. Nichols and Knobe (2007), though, suggest that these apparent compatibilist responses are performance errors produced by using concrete scenarios, and that their abstract scenarios reveal the folk (...) theory of free will for what it actually is—incompatibilist. Here, we argue that the results of two new studies suggest just the opposite. Most participants only give apparent incompatibilist judgments when they mistakenly interpret determinism to imply that agents’ mental states are bypassed in the causal chains that lead to their behavior. Determinism does not entail bypassing, so these responses do not reflect genuine incompatibilist intuitions. When participants understand what determinism does mean, the vast majority take it to be compatible with free will. Further results indicate that most people’s concepts of choice and the ability to do otherwise do not commit them to incompatibilism, either, putting pressure on incompatibilist arguments that rely on transfer principles, such as the Consequence Argument. We discuss the implications of these findings for philosophical debates about free will, and suggest that incompatibilism appears to be either false, or else a thesis about something other than what most people mean by ‘free will’. Peter Strawson defends the thesis that determinism is irrelevant to the justifiability of responsibility-attributions. In this paper, I want to examine various arguments advanced by Strawson in support of this thesis. These arguments all draw on the thought that the practice of responsibility is inescapable. My main focus is not so much the metaphysical details of Strawsonian compatibilism, but rather the more fundamental idea that x being inescapable may be reason for us to regard x as justified. I divide Strawsonian (...) inescapability arguments into two basic types. According to arguments of the first type we cannot give up the practice. According to arguments of the second type we should not give up the practice. My reasons for revisiting these Strawsonian inescapability arguments are, first, to establish that these are different and to some extent conflicting arguments. Second, I hope to show that none of Strawson’s inescapability arguments are convincing. Third, I discuss the possibility that the practice of responsibility is inescapable in a different, more pessimistic sense than envisaged by Strawson. What may be inescapable under conceivable scenarios is the conflict of theoretical and practical considerations in the justification of the practice. (shrink)

The present chapter is concerned with revisionism about free will. It begins by offering a new characterization of revisionist accounts and the way such accounts fit (or do not) in the familiar framework of compatibilism and incompatibilism. It then traces some of the recent history of the development of revisionist accounts, and concludes by remarking on some challenges for them.

Our aim in this paper is to put the concept of moral responsibility under a microscope. At the lowest level of magnification, it appears unified. But Gary Watson has taught us that if we zoom in, we will find that moral responsibility has two faces: attributability and accountability. Or, to describe the two faces in different terms, there is a difference between being responsible and holding responsible. It is one thing to talk about the connection the agent has with her (...) action; it is quite another to talk about the potential interaction the agent might have with her moral community. It turns out, though, that the faces of moral responsibility can themselves be viewed under an even higher level of magnification. If moral responsibility has two faces, then our aim in this paper is to examine their features. To do so reveals subtle distinctions in our concept of moral responsibility and its interaction with surrounding issues that, we argue, can help illuminate various debates in the literature. In his Responsibility and the moral sentiments , Wallace develops the idea that we should think of what it is to be morally responsible for an act in terms of norms for holding someone responsible for that act. Smith has recently claimed that Wallace's approach and those like it are 'fundamentally misguided'. She says that such approaches make the mistake of incorporating conditions for 'actively blaming' others into the basic conditions for being responsible, when in fact the conditions for active (...) blame 'go beyond' the basic conditions. In this essay, I argue that Smith's otherwise illuminating discussion of these 'Normativist' approaches does not undermine them. Specifically, I maintain that being actively blamable by certain persons with the relevant standing is actually constitutive of being responsible for at least some acts. By distinguishing between persons with different sorts of standing, a Normativist approach can avoid Smith's challenge. My larger aim is thus to clarify and defend the Normativist approach. (shrink)

Moral psychology investigates human functioning in moral contexts, and asks how these results may impact debate in ethical theory. This work is necessarily interdisciplinary, drawing on both the empirical resources of the human sciences and the conceptual resources of philosophical ethics. The present article discusses several topics that illustrate this type of inquiry: thought experiments, responsibility, character, egoism v . altruism, and moral disagreement.

The philosophical debate about free will and responsibility has been of great importance throughout the history of philosophy. In modern times this debate has received an enormous resurgence of interest and the contribution in 1962 by P.F. From the first time I encountered the problem of free will in college, it struck me that a clear-eyed view of free will and moral responsibility demanded some form of nihilism. Libertarianism seemed delusional, and compatibilism seemed in bad faith. Hence I threw my lot in with philosophers like Paul d’Holbach, Galen Strawson, and Derk Pereboom who conclude that no one is truly moral responsible. How do the fact that an agent is morally responsible for a certain morally objectionable action and the fact that she is an appropriate target of blame for it relate to each other? Many authors inspired by Peter Strawson say that they necessarily co‐occur. Standard answers to the question of why they co‐occur say that the occurrence of one of the facts explains that the other obtains. This article presents a third option: that they are one and the same fact. (...) There is no difference between the fact that a person is an appropriate target of blame for an objectionable action and the fact that she is morally responsible for it. This view has the advantage of being metaphysically more parsimonious and of answering, in an elegant and plausible way, an interesting question about which many standard theories of responsibility keep silent: what is it to be morally responsible simpliciter? When confronted with the question of why it is appropriate to morally blame a person for some bad action, it may seem plausible to reply that she is morally responsible for it. Some authors, inspired by Peter Strawson's "Freedom and Resentment," argue, however, that thinking this way is backwards. Does it make sense for people to hold one another responsible for what they do, as happens in countless social interactions every day? One of the most unsettling lessons from recent psychological research is that people are routinely mistaken about the origins of their behavior. Yet philosophical orthodoxy holds that the exercise of morally responsible agency typically requires accurate self-awareness. If the orthodoxy is right, and the psychology is to be believed, people characteristically fail to meet the standards of morally (...) responsible agency, and we are faced with the possibility of skepticism about agency. Unlike many philosophers, I accept the unsettling lesson from psychology. I insist, however, that we are not driven to skepticism. Instead, we should reject the requirement of accurate self-awareness for morally responsible agency. It is often assumed that we are only blameworthy for that over which we have control. In recent years, however, several philosophers have argued that we can be blameworthy for occurrences that appear to be outside our control, such as attitudes, beliefs and omissions. This has prompted the question of why control should be a condition on blameworthiness. This paper aims at defending the control condition by developing a new conception of blameworthiness: To be blameworthy, I argue, is most fundamentally (...) to deserve to feel guilty. Being blamed by someone else is not necessarily harmful to the wrongdoer. The blame might not be expressed, or the wrongdoer might not care. But to blame oneself necessarily involves suffering. This conception of blameworthiness explains why the control condition should obtain: We are morally blameworthy for A only if A was under our control because to be blameworthy is to deserve to feel guilty, to feel guilty is to suffer, and one deserves to suffer for A only if A was under one’s control. I’ve been told that in the good old days of the 1970s, when Quine’s desert landscapes were regarded as ideal real estate and David Lewis and John Rawls had not yet left a legion of influential students rewriting the terrain of metaphysics and ethics respectively, compatibilism was still compatibilism about free will. And, of course, incompatibilism was still incompatibilism about free will. That is, compatibilism was the view that free will was compatible with determinism. Incompatibilism was the view that free (...) will was incompatible with determinism.1 What philosophers argued about was whether free will was compatible with determinism. Mostly, this was an argument about how to understand claims that one could do otherwise. You needn’t have bothered to talk about moral responsibility, because it was just obvious that you couldn’t have moral responsibility without free will. The literature was a temple of clarity. Then, somehow, things began to go horribly wrong. To be sure, there had been some activity in the 1960s that would have struck some observers as ominous. Still, it was not until the 1980s that those initial warning signs gave way to real trouble. The meanings of terms twisted. (shrink)

In his 1962 paper “Freedom and Resentment," Peter Strawson attempts to reconcile incompatibilism and compatibilism about moral responsibility and determinism. First, I present the error committed by the proponents of both these traditional views, which Strawson diagnoses as the source of their standoff, and the remedy Strawson offers to avoid the conflict. Second, I reconstruct the two arguments Strawson offers for a theory of moral responsibility that is based on his proposed remedy. Third, I present and respond to two proposed (...) problems for the Strawsonian theory: moral luck and revisionism. I conclude with a summary of my defense of Strawsonian “expressivism” about moral responsibility, and offer suggestions for further research. (shrink)

In terms of my own first-personal narrative, the most obvious proximal cause of my theorizing about agency was a graduate seminar on free will taught by Peter van Inwagen. It was my first semester of graduate school, and van Inwagen’s forceful presentation of incompatibilism made a big impression on me. I left that course thinking incompatibilism was both obvious and irrefutable. The only problem was that I didn’t stay at Notre Dame. I transferred to Stanford in the following year, where (...) I discovered the truth of a remark John Fischer once made: Indiana is for Incompatibilists and California is for Compatibilists. Some of the folks there who most influenced me, especially Michael Bratman and Ken Taylor, are thoroughgoing compatibilists. I was really struck by the fact that both of these smart, thoughtful guys seemed genuinely puzzled by the impulse to incompatibilism. I wasn’t entirely ready to give up on my incompatibilism (which was by then shifting from libertarianism to hard incompatibilism), but I felt a need to be able to find some way to reconcile it with an appreciation for the appeal that compatibilism clearly seemed to have for some otherwise compelling philosophers. And, so my interest in thinking about free agency and free action began to take root. So, that’s the intellectualized part of the story. But there is also the fact of my local conditions when all of this was going on. For good or ill, I kept taking seminars where the problem of free will would crop up in the course of things. Out of sheer laziness (or, as I like to think about it, out of a dimly sensed need to conserve my energies for later), I kept seizing on the topic as a subject matter for seminar papers, whether the course was on Hume, Aristotle, Nietzsche, philosophy of mind, or philosophy action. Thus, when it came time to write a dissertation, free will seemed like an obvious choice.. (shrink)
