This paper concerns non-causal normative explanations such as ‘This act is wrong because/in virtue of__’. The familiar intuition that normative facts aren't brute or ungrounded but anchored in non- normative facts seems to be in tension with the equally familiar idea that no normative fact can be fully explained in purely non- normative terms. I ask whether the tension could be resolved by treating the explanatory relation in normative explanations as the sort of ‘grounding’ relation that receives extensive discussion in (...) recent metaphysics. I argue that this would help only under controversial assumptions about the nature of normative facts, and perhaps not even then. I won't try to resolve the tension, but draw a distinction between two different sorts of normative explanations which helps to identify constraints on a resolution. One distinctive constraint on normative explanations in particular might be that they should be able to play a role in normative justification. (shrink)

What if your peers tell you that you should disregard your perceptions? Worse, what if your peers tell you to disregard the testimony of your peers? How should we respond if we get evidence that seems to undermine our epistemic rules? Several philosophers have argued that some epistemic rules are indefeasible. I will argue that all epistemic rules are defeasible. The result is a kind of epistemic particularism, according to which there are no simple rules connecting descriptive and normative facts. (...) I will argue that this type of particularism is more plausible in epistemology than in ethics. The result is an unwieldy and possibly infinitely long epistemic rule — an Uber-rule. I will argue that the Uber-rule applies to all agents, but is still defeasible — one may get misleading evidence against it and rationally lower one’s credence in it. (shrink)

This paper is a survey of the generalism-particularism debate and related issues concerning the relationship between normative reasons and moral principles.

I argue that moral principles involve the same sort of generalization as ordinary yet elusive generic generalizations in natural language such as ‘Tigers are striped’ or ‘Peppers are spicy’. A notable advantage of the generic view is that it simultaneously allows for pessimism and optimism about the role and status of moral principles in our lives. It provides a new perspective on the nature of moral principles on which principles are not apt for determining the moral status of particular actions (...) while they may be apt, and even fundamental, to our acquisition of moral knowledge. A natural consequence of the view is variation among moral principles, with some regularly warranting exceptions and some appearing arguably exceptionless. I will also argue that this generic conception of moral principles has significant advantages, as a normative model of moral reasoning, over the view of moral principles as defaults advanced in recent years. This chapter examines the ethical case that can be mounted for veganism. Because there has been comparatively little discussion in ethics focused directly on veganism, the central aim of this chapter is threefold: to orient readers to (some of) the most important philosophical literature relevant to the topic, to provide a clear explanation of the current state of the ethical case for veganism, and to focus attention on the most important outstanding or underexplored questions in this domain. The chapter examines (...) the range of positions that deserve to be called ethical veganism, and some of the types of reasons that philosophers can potentially appeal to in arguing for veganism. It then spells out the core of the most promising case for veganism, which argues directly for the wrongness of making animals suffer and die. The chapter then considers three ways of arguing from this conclusion to an ethical defense of the vegan lifestyle, which appeal respectively to the ethical significance of the effects of individual use of animal products, of group efficacy, and of complicity with wrongdoing. The chapter concludes by examining several neglected complications facing the ethical case for veganism. (shrink)

Moral philosophers are, among other things, in the business of constructing moral theories. And moral theories are, among other things, supposed to explain moral phenomena. Consequently, one’s views about the nature of moral explanation will influence the kinds of moral theories one is willing to countenance. Many moral philosophers are (explicitly or implicitly) committed to a deductive model of explanation. As I see it, this commitment lies at the heart of the current debate between moral particularists and moral generalists. In (...) this paper I argue that we have good reasons to give up this commitment. In fact, I show that an examination of the literature on scientific explanation reveals that we are used to, and comfortable with, non-deductive explanations in almost all areas of inquiry. As a result, I argue that we have reason to believe that moral explanations need not be grounded in exceptionless moral principles. (shrink)

With recent advancements in systems engineering and artificial intelligence, autonomous agents are increasingly being called upon to execute tasks that have normative relevance. These are tasks that directly—and potentially adversely—affect human well-being and demand of the agent a degree of normative-sensitivity and -compliance. Such norms and normative principles are typically of a social, legal, ethical, empathetic, or cultural nature. Whereas norms of this type are often framed in the abstract, or as high-level principles, addressing normative concerns in concrete applications of (...) autonomous agents requires the refinement of normative principles into explicitly formulated practical rules. This paper develops a process for deriving specification rules from a set of high-level norms, thereby bridging the gap between normative principles and operational practice. This enables autonomous agents to select and execute the most normatively favourable action in the intended context premised on a range of underlying relevant normative principles. In the translation and reduction of normative principles to SLEEC rules, we present an iterative process that uncovers normative principles, addresses SLEEC concerns, identifies and resolves SLEEC conflicts, and generates both preliminary and complex normatively-relevant rules, thereby guiding the development of autonomous agents and better positioning them as normatively SLEEC-sensitive or SLEEC-compliant. In this essay I offer a new particularist reading of Aristotle’s Nicomachean Ethics. I argue that the interpretation I present not only helps us to resolve some puzzles about Aristotle’s goals and methods, but it also gives rise to a novel account of morality—an account that is both interesting and plausible in its own right. The goal of this paper is, in part, exegetical—that is, to figure out how to best understand the text of the Nicomachean Ethics. But this paper (...) also aims to contribute to the current exciting and controversial debate over particularism. By taking the first steps towards a comprehensive particularist reading of Aristotle’s Ethics I hope to demonstrate that some of the mistrust of particularism is misplaces and that what is, perhaps, the most influential moral theory in the history of philosophy is, arguably, a particularist moral theory. It is natural to think that law ought not to be vague. After all, law is supposed to guide conduct, and vague law seems poorly suited to do that. Contrary to this common impression, however, a number of authors have argued that vagueness in the law is sometimes a good thing, because it is a means to achieving certain valuable legislative ends. In this article, I argue that many authors—including Timothy Endicott and Jeremy Waldron—wrongly associate vagueness with instrumental roles that (...) are really played by a closely related semantic phenomenon. Normative explanations, which specify why things have the normative features they do, are ubiquitous in normative theory and ordinary thought. But there is much less work on normative explanation than on scientific or metaphysical explanation. Skow (2016) argues that a complete answer to the question why some fact Q occurs consists in all of the reasons why Q occurs. This paper explores this theory as a case study of a general theory that promises to offer us a grip on normative (...) explanation which is independent of particular normative theories. I first argue that the theory doesn’t give an adequate account of certain enablers of reasons which are important in normative explanation. I then formulate and reject three responses on behalf of the theory. But I suggest that since theories of this general sort have the right kind of resources to illuminate how normative explanation might be similar to and different from explanations in other domains, they nonetheless merit further exploration by normative theorists. According to a Type-B theorist there are no facts of the kind required for there to be morality instricto sensu, but there can be irreducible ‘normative’ properties which she deems, strictly speaking, to be morally irrelevant. She accepts that there areinstrumentalall things considered oughts, andcategoricalpro tanto oughts (both of which she deems morally irrelevant), but denies that there arecategoricalall things considered oughts on pain of (...) requiring ‘queer’ facts to obtain. I detail the most central motivation of this version of the theory against its more traditional rival, according to which there are no irreducible normative properties at all. What are moral principles? In particular, what are moral principles of the sort that (if they exist) ground moral obligations or—at the very least—particular moral truths? I argue that we can fruitfully conceive of such principles as real, irreducibly dispositional properties of individual persons (agents and patients) that are responsible for and thereby explain the moral properties of (e.g.) agents and actions. Such moral dispositions (or moral powers) are apt to be the metaphysical grounds of moral obligations and of particular (...) truths about what is morally permissible, impermissible, etc. Moreover, they can do other things that moral principles are supposed to do: explain the phenomena “falling within their scope,” support counterfactuals, and ground moral necessities, “necessary connections” between obligating reasons and obligations. And they are apt to be the truthmakers for moral laws, or “lawlike” moral generalizations. (shrink)

This essay situates some recent empirical research on the origin, nature, role, and reliability of moral intuitions against the background of nineteenth-century debates between ethical naturalism and rational intuitionism. The legitimate heir to Millian naturalism is the contemporary method of reflective equilibrium and its defeasible reliance on moral intuitions. Recent doubts about moral intuitions—worries that they reflect the operation of imperfect cognitive heuristics, are resistant to undermining evidence, are subject to framing effects, and are variable—are best addressed by ethical naturalism (...) as part of a broad dialectical equilibrium. This paper makes the non-monotonicity of a wide range of moral reasoning the basis of a case for particularism. Non-monotonicity threatens practical decision with an overwhelming informational complexity to which a form of ethical generalism seems the best response. It is argued that this impression is wholly misleading: the fact of non-monotonicity is best accommodated by the defence of four related theses in any theory of justification. First, the explanation of and defence of a default/challenge model of justification. Secondly, the (...) development of a theory of epistemic status and an explanation of those unearned entitlements that accrue to such status. Thirdly, an explanation of the basis of epistemic virtues. Finally, an account must be given of the executive capacity of rational decision itself as a ‘contentless ability’. This overall set of views can accommodate a limited role for generalizations about categories of evidence, but not such as to rescue a principled generalism. In particular, the version of particularism defended here explains why one ought not to accept the principled holism that has proved to be a problem for Dancy’s form of particularism. Ethics certainly involves hedged principles. However, principles cannot be self-hedging: there cannot be a that’s it operator in a principle as Richard Holton has claimed that there can be. Practical reasoning is concluded by the categorical detachment of the action-as-conclusion itself. (shrink)

I defend a form of generalism in ethics and aesthetics. Generalism about a domain D is the view that there are principles that play an explanatory role in the metaphysics of D and can be used in reasoning when thinking about D. I argue that in both aesthetics and ethics, there are generic generalizations that are principles. I do this by (i) explaining the nature of a particularly important kind of generic, (ii) argue that generics of this kind play a (...) explanatory role, and (iii) argue that we licitly use these truths in reasoning about ethics and aesthetics. This paper examines the nature of the specific grasp involved in moral understanding. After discussing Hills's ability account of that central component of moral understanding in light of problematic cases, I argue that moral grasp is best conceived of as a type of knowledge that is grounded in a subject's moral appreciation. I then show how and why the relevant notion of moral appreciation is connected to moral virtues and to one's affective and motivational engagement with moral reasons. Finally, I (...) discuss the connection between moral appreciation and a subject's ability to offer moral explanations in relation to the debate between pessimists and optimists about moral understanding's testimonial transmission. This paper deals with the question of the conflict of constitutional rights with regard to basic rights. Two extreme accounts are outlined: the subsumptive approach and the particularistic approach, that embody two main conceptions of practical rationality. Between the two approaches there is room for a range of options, two of which are examined: the proportionalist approach, which conserves the scope of rights restricting their stringency, and the specificationist approach, which preserves the stringency of rights restricting their scope. W. D. Ross is commonly considered to be a generalist about prima facie duty but a particularist about absolute duty. That is, many philosophers hold that Ross accepts that there are true moral principles involving prima facie duty but denies that there are any true moral principles involving absolute duty. I agree with the former claim: Ross surely accepts prima facie moral principles. However, in this paper, I challenge the latter claim. Ross, I argue, is no more a particularist about (...) absolute duty than a utilitarian or a Kantian is. While this conclusion is interesting in its own right, it is also important, I argue, because it prevents us from overlooking Ross's criterion of moral obligation and because it may have implications on the broader debate between particularists and generalists. Moral theories often issue general principles that explain our moral judgments in terms of underlying moral considerations. But it is unclear whether the general principles have an explanatory role beyond the underlying moral considerations. In order to avoid the redundancy of their principles, two-level theories issue principles that appear to generalize beyond the considerations that ground them. In doing so, the principles appear to overgeneralize. The problem is conspicuous in the case of contractualism, which proposes that moral principles are grounded (...) in generic reasons that operate in only a subset of the cases covered by the relevant principle. Arguments that motivate the use of generic reasons on the basis of guidance, institutional necessity, or fairness are unsatisfactory. But the generality of moral principles can be justified in terms of the idea of a generic interest, which is an interest that all occupants of a standpoint have in virtue of what occupants of the standpoint as such typically take an interest in. The notion of a generic interest therefore acknowledges a distinction between having and taking an interest, and its use in moral theory is a way of giving expression to the significance of autonomy. This is reminiscent of the idea of a normative power; but the idea of a generic interest is less expensive and makes better sense of the way in which autonomy features in our moral lives. (shrink)

Critics often accuse Kant and Kantians of rigorism: of advocating highly general exceptionless principles of duty that strictly prohibit action kinds like lying or breaking promises. In this article, I draw on arguments from the generalism-particularism debate to show that the way in which Kantians usually understand universality prevents them from solving this problem and leaves them stuck in a trilemma. I then argue that they should abandon this common conception—the “strict conception,” on which universal principles don’t permit any exceptions—in (...) favor of a “relaxed conception,” on which universal principles do permit certain exceptions, namely principled exceptions. I take the debate between the particularists and the principlists to be centered on the issue of whether there are true moral principles. One argument the principlists often appeal to in support of their claim that there are true moral principles is the argument from supervenience. Roughly, the argument is made up of the following three statements: (P1) If the thesis of moral supervenience holds, then there are true moral principles. (P2) The thesis of moral supervenience holds. (C) There are (...) true moral principles, and hence particularism is false. In this paper, I argue that the above argument is not sound by attacking (P1). I hold that no general supervenient/resultance base has a robust enough configuration of contextual features as to ground the existence of true moral principles. If I am right about this, I think it would be indicative of a reason to be less confident about the truth of principlism and more confident about the truth of particularism. (shrink)

I summarize a conception of morality as containing a set of rules which hold ceteris paribus and which impose pro-tanto obligations. I explain two ways in which moral rules are ceteris-paribus, according to whether an exception is duty-voiding or duty-overriding. I defend the claim that moral rules are ceteris-paribus against two qualms suggested by Luke Robinson’s discussion of moral rules and against the worry that such rules are uninformative. I show that Robinson’s argument that moral rules cannot ground pro-tanto obligations (...) is unsound, because it confuses an absolute reason for an obligation with a reason for an absolute obligation, and because it overlooks the possibility that priority rules may be rules for ordering pro-tanto obligations rather than rules for eliminating contenders for the status of absolute obligation. Moral particularism, as recently defended, charges that traditional moral theorizing unduly privileges moral principles. Moral generalism defends a prominent place for moral principles. Because moral principles are often asked to play multiple roles, moral particularism aims at multiple targets. We distinguish two leading roles for moral principles, the role of standard and the role of guide. We critically survey some of the leading arguments both for and against principles so conceived.

This paper situates the problem of defeaters in a larger debate about the source of normative authority. It argues in favour of a constructivist account of defeasibility, which appeals to the justificatory role of normative principles. The argument builds upon the critique of two recent attempts to deal with defeasibility: first, a particularist account, which disposes of moral principles on the ground that reasons are holistic; and second, a proceduralist view, which addresses the problem of defeaters by distinguishing between provisional (...) and strictly universal principles. The particularist view fails to establish that moral principles have no epistemological import, but it raises important questions about their role in practical reasoning. The proceduralist view fails to distinguish between reasoning by default and reasoning by principles, but it shows that normative principles have a structural justificatory role. The constructivist view recognizes that the moral valence of normative claims vary across contexts, but denies that this is because of holism about reasons. Rather, it defends defeasibility within a constructivist account of reasoning where universality serves as the matrix of judgment. The constructivist view vindicates the justificatory role of universal normative principles, and makes room for some ordinary sources of defeasibility, which are left unaccounted by competing views, and which depend on the agent’s own progress. I address a question in moral metaphysics: How are conflicts between moral obligations possible? I begin by explaining why we cannot give a satisfactory answer to this question simply by positing that such conflicts are conflicts between rules, principles, or reasons. I then develop and defend the “Dispositional Account,” which posits that conflicts between moral obligations are conflicts between the manifestations of obligating dispositions (obligating powers, capacities, etc.), just as conflicts between physical forces are conflicts between the manifestations of (certain) (...) causal dispositions (causal powers, capacities, etc.). This account combines the so-called “moral forces” interpretation of prima facie obligations with a dispositional moral metaphysic according to which the metaphysical grounds of moral obligations are not rules or laws, but rather real, irreducibly dispositional properties (or powers) of moral agents and patients. My principal aims are to offer a theoretically attractive and suitably metaphysical account of conflicts of obligation, and to show that the dispositional moral metaphysic that grounds the Dispositional Account can explain and accommodate plausible normative views that rule- and law-based alternatives cannot, as well as to answer objections that have been pressed against other accounts of moral conflict (especially Ross’s) that appeal to moral dispositions or forces. Pragmatist views inspired by Peirce characterize the content of claims in terms of their practical consequences. The content of a claim is, on these views, determined by what actions are rationally recommended or supported by that claim. In this paper I examine the defeasibility of these relations of rational support. I will argue that such defeasibility introduces a particularist, occasion-sensitive dimension in pragmatist theories of content. More precisely, my conclusion will be that, in the sort of framework naturally derived from (...) Peirce’s pragmatist maxim, grasping conceptual contents is not merely a question of mastering general rules or principles codifying the practical import of claims, but decisively involves being sensitive to surrounding features of the particular situation at hand. In a series of papers, Stephen Kearns and Daniel Star defend the following general account of reasons: R: Necessarily, a fact F is a reason for an agent A to Φ iff F is evidence that an agent ought to Φ.In this paper, I argue that the reasons as evidence view will run afoul of a motivational constraint on moral reasons, and that this is a powerful reason to reject the reasons as evidence view. The motivational constraint is as follows: (...) M: For some consideration C to be a moral reason for an agent to Φ it must be possible for C to figure as part of the agent’s motivation for Φing without thereby undercutting (either partially or wholly) the positive moral evaluation of the agent in acting as she does.M presents a problem for Kearns and Star’s view because there will be cases where some consideration is evidence that an agent ought to Φ, but where if an agent was motivated by that consideration the agent’s action would thereby be worse from a moral perspective for that very reason. Further, I argue that this problem will likely arise on any moral theory that evaluates the motivation of an agent as a component of assessing the moral status of acts. (shrink)

Frank Jackson, Michael Smith, and Philip Pettit contend in their 2000 paper that an argument from supervenience deals a fatal blow to shapeless moral particularism, the view that the moral is shapeless with respect to the natural. A decade has passed since the Canberrans advanced their highly influential supervenience argument. Yet, there has not been any compelling counter-argument against it, as far as I can see. My aim in this paper is to fill in this void and defend SMP against (...) the Canberrans’ supervenience argument. Such being the case, I will firstly re-construct the Canberrans’ supervenience argument in detail and push it as far as it can go. In fact, I will defend it against a number of existing objections respectively from Garfield, Dancy, and McDowell. Next, I will argue, however, that the supervenience argument, despite its initial plausibility, has one major pitfall: it hinges on an overly permissive conception of ‘shape’ such that it does not generate the right kind of moral principles the shapeless moral particularists are concerned to refute. I thus conclude that the seemingly scathing supervenience argument turns out to be toothless against SMP. Although this would not prove SMP to be right, for it might attract criticisms from other fronts, yet, until they come up, SMP, contrary to prevalent conceptions, remains alive and kicking. (shrink)

This work is an investigation into philosophical method and rational argument in moral philosophy. It makes an original contribution to human understanding, by taking some of the tools and techniques that Gordon Baker identifies in the later work of Wittgenstein, and using them as a way of fending for oneself in an area of philosophy that neither Baker, nor Wittgenstein, wrote on. More specifically, a discussion of some different aspects of the contemporary literature on Dancy’s moral particularism is used as (...) a vehicle for illustrating how Baker’s therapeutic conception of philosophy offers alternative possibilities for how we can do philosophy, and what counts as rational argument in moral philosophy. I maintain that, by considering some indicative ways in which Baker’s therapeutic approach to philosophy can dissolve, rather than solve, the kinds of perplexities found in the existing literature on Dancy’s moral particularism, we can liberate ourselves from the traditional/theoretical view of how we ought to do philosophy, and an understanding of rational argument in moral philosophy, to which we need not be committed.
