If “perfectionism” in ethics refers to those normative theories that treat the fulfillment or realization of human nature as central to an account of both goodness and moral obligation, in what sense is “human flourishing” a perfectionist notion? How much of what we take “human flourishing” to signify is the result of our understanding of human nature? Is the content of this concept simply read off an examination of our nature? Is there no place for diversity and individuality? Is the (...) belief that the content of such a normative concept can be determined by an appeal to human nature merely the result of epistemological naiveté? What is the exact character of the connection between human flourishing and human nature? These questions are the ultimate concern of this essay, but to appreciate the answers that will be offered it is necessary to understand what is meant by “human flourishing.” “Human flourishing” is a relatively recent term in ethics. It seems to have developed in the last two decades because the traditional translation of the Greek term eudaimonia as “happiness” failed to communicate clearly that eudaimonia was an objective good, not merely a subjective good. Přirozený zákon je jednou z nejvýznamnějších idejí, která stojí v základech evropského filosofického, etického a právního myšlení. Předložený článek podává stručnou expozici vývoje ideje přirozeného zákona ve filosofickém myšlení s důrazem na jeho klíčové momenty a vyjádření nosných tezí, které předurčily rozumění tomuto pojmu v následujících obdobích. Jeho cílem není detailní probádání některé z jednotlivých etap či některého z autorů, ale naopak podat souhrnný a přehledný obraz vývoje této ideje. Východiskem je zde stručné načrtnutí hlavních zdrojů ideje přirozeného zákona v (...) antice, počínaje předsokratiky, následně u Platóna a Aristotela a představením hlavních rysů stoické koncepce. Další část je věnovaná scholastickému uchopení problematiky přirozeného zákona u T. Akvinského a Suaréze. Následuje přiblížení novověkých úvah u Grotia, Pufendorfa a Hobbese. Tito teoretici jsou následně kontrastováni s průřezovým přehledem myšlení positivně právního u Benthama, Austina a jejich pokračovatelů, neboť i vývoj positivistického myšlení výrazně přispěl k zformování moderní teorie přirozeného zákona, které stojí explicitně v opozici k němu. Alasdair MacIntyre asks, if all individuals are in fact potential authorities of natural law and agree on its fundamentals, how can we explain manifest moral disagreement? Contemporary Thomistic natural law theorists have not attempted to address this particular issue to a significant degree. MacIntyre, taking this large-scale rejection seriously, focuses on the communal factors that allow individuals to recognize their need for and commitment to Thomistic natural law. By doing so, he attempts to give reasons for why we should expect (...) natural law to be widely denied in contemporary society. In this paper, I argue that MacIntyre’s approach to natural law is capable of accounting for the seemingly paradoxical claim that these per se nota first principles of natural law might suffer apparent widespread rejection. Moreover, I will argue that MacIntyre’s account is also capable of explaining why we should actually expect such rejection to occur. (shrink)
