Adolf Reinach was one of the leading figures of the Munich and Göttingen circles of phenomenology, and Husserl's first real co-worker. Although his writings are highly original and remarkably clear, Reinach's tragic death in the First World War prevented him from formulating a definitive statement of his phenomenology, leaving his name virtually unknown to all but a small circle. In his ground-breaking study, Judgment and Sachverhalt, DuBois shows how Reinach succeeds in developing a realist ontology and epistemology based on rigorous (...) argumentation and phenomenological elucidation. Drawing from numerous texts and the developments of Reinach's students and colleagues - Roman Ingarden, Alexander Pfänder and Dietrich von Hildebrand above all - DuBois presents, refines and defends Reinach's `phenomenological realism'. Confrontations of Reinach's theories of states of affairs, concepts and speech acts with the work of contemporary authors like Chisholm and Searle allow readers to evaluate Reinach's philosophy, not only in the light of the later developments of Husserl, but also in the light of certain Anglo-American developments. Summary In this article the ethical systems of Risieri Frondizi and Maurice Mandelbaum, both decisively influenced by Wolfgang Köhler, are investigated for the first time. Each writer took different things from Köhler, Frondizi the idea of value as a Gestalt quality and Mandelbaum the idea of value as a felt demand. Their positions are highly complementary and Frondizi’s axiological approach enlightens the ontology of value whereas Mandelbaum’s phenomenological approach clarifies the nature of “requiredness” (Köhler) or “fittingness.”.

This paper discusses the thesis defended by Edith Stein that certain acts can be attributed to the State. According to Stein, the State is a social structure characterized by sovereignty. As such, it is responsible for the production, interpretation, and application of law. These tasks require the performance of acts, most of which are what Stein calls “social acts” like enactments and orders. For Stein, the acts in question are made by the organs of the State, but in the name (...) of the State, and are thus attributed to the State via a relation of representation. In the first section, the paper presents Stein’s thesis that the sovereignty of the State entails a series of legal prerogatives, which in turn result in various social acts being ascribed to the State through its representatives. In the second section, the paper critically discusses Stein’s views, notably her theory of representation, and her account of the nature of the State, while emphasizing its most interesting aspects, namely, its fine-grained analyses of the various acts that are attributed to the State. Emotion Review, Volume 14, Issue 4, Page 264-269, October 2022. Müller's position-taking view of emotions takes issue with the widely endorsed philosophical notion that emotional feelings are a form of consciousness in which we become acquainted with the evaluative properties of objects and events. Müller rejects this perceptual theory of emotions and casts doubt on the idea that it is through emotional feeling that we develop an awareness of value. In so doing, his proposal amounts to a denial of any (...) epistemic function of emotional feeling. Challenging such a radical move, in my commentary, I discuss several affective phenomena in which feelings do seem to serve an epistemic function. These cases pose problems for Müller's version of the position-taking view of emotion, at least in its current form. (shrink)

It is a popular thought that emotions play an important epistemic role. Thus, a considerable number of philosophers find it compelling to suppose that emotions apprehend the value of objects and events in our surroundings. I refer to this view as the Epistemic View of emotion. In this paper, my concern is with a rivaling picture of emotion, which has so far received much less attention. On this account, emotions do not constitute a form of epistemic access to specific axiological (...) aspects of their objects. Instead it proposes that they are ways of taking a stand or position on the world. I refer to this as the Position-Taking View of emotion. Whilst some authors seem sympathetic to this view, this it has so far not been systematically motivated and elaborated. In this paper, I fill this gap and propose a more adequate account of our emotional engagement with the world than the predominant epistemic paradigm. I start by highlighting the specific way in which emotions are directed at something, which I contrast with the intentionality of perception and other forms of apprehension. I then go on to offer a specific account of the valence of emotion and show how this account and the directedness of emotions makes them intelligible as a way of taking a position on something. According to much recent work in metaethics, we have a perceptual access to normative properties and relations. On a common approach, this access has a presentational character. Here, ‘presentational’ specifies a characteristic feature of the way aspects of the environment are apprehended in sensory experience. While many authors have argued that we enjoy presentations of value properties, thus far comparatively less effort has been invested into developing a presentational view of the apprehension of normative reasons. Since it appears that this (...) view would offer much the same theoretical benefits as presentational views of the apprehension of value, it seems worthwhile redressing this imbalance. My paper aims at doing so, focusing on concern-dependent practical reasons. After clarifying the central commitment of this view, I assess a recent proposal by Dancy :787-812, 2014) which provides a detailed characterization of the relevant type of cognition. I argue that Dancy ignores one of the central features of a presentational access to normative reasons and therefore misidentifies which actual psychological phenomena are apt to play this role. In this context, I also assess and reject further candidates that might seem fitting for this purpose. In the remainder of the paper, I then offer a more adequate account which specifies an actual form of presentational access to concern-dependent practical reasons and provide the contours of a more substantive account of its nature. Many metaethicists endorse a cognitive constraint which links the reasons for which we act or hold attitudes (motivating reasons) to normative reasons (reasons that speak in favour of an action or attitude). As traditionally formulated, this constraint (known as the Taking Condition) requires that an agent’s motivating reasons are mentally represented by her as corresponding normative reasons. In response to the charge that the Taking Condition is overly demanding, Errol Lord and Kurt Sylvan have proposed a reformulation which eschews the (...) need for normative representation (Lord and Sylvan 2019 [“Prime Time (for the Basing Relation).” In Well-Founded Belief, edited by J. Adam Carter, and Patrick Bondy, 141–173. London and New York: Routledge]). As they argue, agents must treat their motivating reasons as normative reasons, where this notion picks out a specific set of dispositions rather than a representational state. I argue that this proposal seriously distorts our understanding of the relation between an action or attitude and the reasons for which we perform or hold it. On the plausible assumption that an account of motivating reasons should not stray too far from this understanding, this response to the over-demandingness charge thus fails. I also provide some directions on how friends of the Taking Condition should instead respond this charge. (shrink)

Evaluative theories of emotions purport to shed light on the nature of emotions by appealing to values. Three kinds of evaluative theories of emotions dominate the recent literature: the judgment theory equates emotions with value judgments; the perceptual theory equates emotions with perceptions of values, and the attitudinal theory equates emotions with evaluative attitudes. This paper defends a fourth kind of evaluative theory of emotions, mostly neglected so far: the reactive theory. Following a brief summation of the phenomenological method, the paper considers three metaethical positions adopted by phenomenologists and the implications of those positions for a normative ethics. The metaethical positions combine epistemological and ontological viewpoints. They are non-intellectualism and strong value realism as represented by the axiological views of phenomenologists such as Scheler, Meinong, Reinach, Stein, Hartmann, von Hildebrand, and Steinbock; non-intellectualism and anti-realism as represented by the freedom-centered phenomenologies of Sartre, Beauvoir, and Merleau-Ponty; and weak intellectualism and weak value (...) realism as represented by Husserl and Drummond. The paper argues that only the third metaethical view can support a normative ethics that is consistent with the essential features of the phenomenological method, that allows for freedom in an agent’s choosing from a multiplicity of first-order goods, including vocational goods, practical identities, and life plans, available in the agent’s factical circumstances, and that provides norms governing the correctness of our actions and our obligations to others. The normative dimension is introduced, first, by the requirement that the fulfillment of first-order evaluations and choices be truthful, that is, that the evaluations be appropriate and the actions right. Second, transcendental considerations revealed in the phenomenological analysis of intentional experience disclose a notion of second-order goods of agency that universally bind agents in their exercise of freedom and their dealings with others. Ever since its appearance in 1913, Reinach's work on a The A Priori Foundations of the Civil Law has served as the principal representative of phenomenological, aprioristic and ontological/realist approaches to the philosophy of law. This annotated bibliography provides an overview of the reception of Reinach's thinking, which has been of influence also in the realm of speech act theory.

This dissertation engages in a critical analysis of the work of Adolf Reinach in the theory of knowledge and legal philosophy. Reinach had trained as a lawyer and brought that perspective and experience to bear in his phenomenological work on problems in evidence and legal philosophy. His contributions to phenomenology in the early 20th century provide a window into the earliest phases of the development of the phenomenological movement, prior to World War I. This dissertation locates this work in the (...) European intellectual context of the era and finds analogies with key philosophical dilemmas and developments in England during the same period, arguably ones with shared intellectual roots. Valued for his talent as an inspiring university lecturer, Reinach was a central figure in the circle of young scholars who practiced phenomenology in the spirit of the "early" "pre-Ideen" phase of phenomenology. The dissertation Appendices include translations of selected excerpts from the Nachlass. My translation of the obituary Edmund Husserl wrote and published following Adolf Reinach's death in WWI is published separately. Professor Raymond Klibansky was my supervisor and mentor throughout.
