The paper presents H. L. A. Hart as a leading exponent of the analytic orientation in legal philosophy. Hart showed that the principles and methods of analytic philosophy yield fruitful implications to law, where they may foster fresh ideas and innovative solutions. The text emphasizes the linguistic aspect of Hart’s works; his achievements in legal theory are discussed in the context of the principles of ordinary language philosophy.

Christianity and other religions claim that their books and creeds contain truths revealed by God. How can we know whether they do? Revelation investigates the claim of the Christian religion to have such revealed truths; and so considers which parts of the Bible are to be regarded as literal history, and which as metaphorical truth. This entirely rewritten second edition contains a long new chapter examining whether traditional Christian claims about personal morality can be regarded as revealed truths.

This unique anthology of new, contributed essays offers a range of perspectives on various aspects of ontic vagueness. It seeks to answer core questions pertaining to onticism, the view that vagueness exists in the world itself. The questions to be addressed include whether vague objects must have vague identity, and whether ontic vagueness has a distinctive logic, one that is not shared by semantic or epistemic vagueness. The essays in this volume explain the motivations behind onticism, such as the plausibility (...) of mereological vagueness and indeterminacy in quantum mechanics and they offer various arguments both for and against ontic vagueness; onticism is also compared with other, competing theories of vagueness such as semanticism, the view that vagueness exists only in our linguistic representation of the world. Gareth Evans’s influential paper of 1978, “Can There Be Vague Objects?” gave a simple but cogent argument against the coherence of ontic vagueness. Onticism was subsequently dismissed by many. However, in recent years, researchers have become aware of the logical gaps in Evans’s argument and this has triggered a new wave of interest in onticism. Onticism is now widely regarded as at least a coherent view. Reflecting this growing consensus, the present anthology for the first time puts together essays that are focused on onticism and its various facets and it fills in the lacuna in the literature on vagueness, a much-discussed subject in contemporary philosophy. This volume analyzes and studies how vagueness occurs and matters as a specific problem in the context of theories that are primarily about something else.

This dissertation examines aspects of the interplay between computing and scientific practice. The appropriate foundational framework for such an endeavour is rather real computability than the classical computability theory. This is so because physical sciences, engineering, and applied mathematics mostly employ functions defined in continuous domains. But, contrary to the case of computation over natural numbers, there is no universally accepted framework for real computation; rather, there are two incompatible approaches --computable analysis and BSS model--, both claiming to formalise algorithmic (...) computation and to offer foundations for scientific computing. The dissertation consists of three parts. In the first part, we examine what notion of 'algorithmic computation' underlies each approach and how it is respectively formalised. It is argued that the very existence of the two rival frameworks indicates that 'algorithm' is not one unique concept in mathematics, but it is used in more than one way. We test this hypothesis for consistency with mathematical practice as well as with key foundational works that aim to define the term. As a result, new connections between certain subfields of mathematics and computer science are drawn, and a distinction between 'algorithms' and 'effective procedures' is proposed. In the second part, we focus on the second goal of the two rival approaches to real computation; namely, to provide foundations for scientific computing. We examine both frameworks in detail, what idealisations they employ, and how they relate to floating-point arithmetic systems used in real computers. We explore limitations and advantages of both frameworks, and answer questions about which one is preferable for computational modelling and which one for addressing general computability issues. In the third part, analog computing and its relation to analogue (physical) modelling in science are investigated. Based on some paradigmatic cases of the former, a certain view about the nature of computation is defended, and the indispensable role of representation in it is emphasized and accounted for. We also propose a novel account of the distinction between analog and digital computation and, based on it, we compare analog computational modelling to physical modelling. It is concluded that the two practices, despite their apparent similarities, are orthogonal. (shrink)

This paper explores Dear’s interpretation with regard to the construction of Galileo’s science of motion, by analyzing the celebrated inclined plane experiment described in the Discorsi as well as one of Galileo's manuscripts and concludes that Dear’s interpretation makes very difficult the characterization of Galileo’s practice. This thesis focuses on models of conceptual change in science and philosophy. In particular, I developed a new bootstrapping methodology for studying conceptual change, centered around the formalization of several popular models of conceptual change and the collective assessment of their improved formal versions via nine evaluative dimensions. Among the models of conceptual change treated in the thesis are Carnap’s explication, Lakatos’ concept-stretching, Toulmin’s conceptual populations, Waismann’s open texture, Mark Wilson’s patches and facades, Sneed’s structuralism, and Paul Thagard’s conceptual revolutions. (...) -/- In order to analyze and compare the conception of conceptual change provided by these different models, I rely on several historical reconstructions of episodes of scientific conceptual change. The historical episodes of scientific change that figure in this work include the emergence of the morphological concept of fish in biological taxonomies, the development of scientific conceptions of temperature, the Church-Turing thesis and related axiomatizations of effective calculability, the history of the concept of polyhedron in 17th and 18th century mathematics, Hamilton’s invention of the quaternions, the history of the pre-abstract group concepts in 18th and 19th century mathematics, the expansion of Newtonian mechanics to viscous fluids forces phenomena, and the chemical revolution. I will also present five different formal and informal improvements of four specific models of conceptual change. I will first present two different improvements of Carnapian explication, a formal and an informal one. My informal improvement of Carnapian explication will consist of a more fine-grained version of the procedure that adds an intermediate, third step to the two steps of Carnapian explication. I will show how this novel three-step version of explication is more suitable than its traditional two-step relative to handle complex cases of explications. My second, formal improvement of Carnapian explication will be a full explication of the concept of explication itself within the theory of conceptual spaces. By virtue of this formal improvement, the whole procedure of explication together with its application procedures and its pragmatic desiderata will be reconceptualized as a precise procedure involving topological and geometrical constraints inside the theory of conceptual spaces. My third improved model of conceptual change will consist of a formal explication of Darwinian models of conceptual change that will make vast use of Godfrey-Smith’s population-based Darwinism for targeting explicitly mathematical conceptual change. My fourth improvement will be dedicated instead to Wilson’s indeterminate model of conceptual change. I will show how Wilson’s very informal framework can be explicated within a modified version of the structuralist model-theoretic reconstructions of scientific theories. Finally, the fifth improved model of conceptual change will be a belief-revision-like logical framework that reconstructs Thagard’s model of conceptual revolution as specific revision and contraction operations that work on conceptual structures. -/- At the end of this work, a general conception of conceptual change in science and philosophy emerges, thanks to the combined action of the three layers of my methodology. This conception takes conceptual change to be a multi-faceted phenomenon centered around the dynamics of groups of concepts. According to this conception, concepts are best reconstructed as plastic and inter-subjective entities equipped with a non-trivial internal structure and subject to a certain degree of localized holism. Furthermore, conceptual dynamics can be judged from a weakly normative perspective, bound to be dependent on shared values and goals. Conceptual change is then best understood, according to this conception, as a ubiquitous phenomenon underlying all of our intellectual activities, from science to ordinary linguistic practices. As such, conceptual change does not pose any particular problem to value-laden notions of scientific progress, objectivity, and realism. At the same time, this conception prompts all our concept-driven intellectual activities, including philosophical and metaphilosophical reflections, to take into serious consideration the phenomenon of conceptual change. An important consequence of this conception, and of the analysis that generated it, is in fact that an adequate understanding of the dynamics of philosophical concepts is a prerequisite for analytic philosophy to develop a realistic and non-idealized depiction of itself and its activities. The extensions of vague predicates like ‘is bald’, ‘is tall’, and ‘is a heap’ apparently lack sharp boundaries, and this makes such predicates susceptible to soritical reasoning, i.e. reasoning that leads to some version of the notorious sorites paradox. This essay is concerned with a certain kind of theory of vagueness, according to which the symptoms and puzzles of vagueness should be accounted for in terms of a particular species of context sensitivity exhibited by vague expressions. The basic idea is (...) that the extensions of vague predicates vary with certain contextual factors, and that this fact can explain why they appear to lack sharp boundaries. This kind of view is referred to as contextualism about vagueness. A detailed characterisation of contextualism about vagueness is given in chapter two and three. In chapter two, a generic version of contextualism about vagueness is developed, and some alternative forms of context sensitivity are introduced. In chapter three, the specific contextual factors appealed to by different contextualists are discussed. In chapter four, different contextualist diagnoses of the sorites paradox are considered, and found to be problematic in various ways. It is argued that contrary to what some of its proponents have claimed, contextualism about vagueness is not superior to other comparable theories of vagueness when it comes to explaining the appeal of soritical reasoning. In chapter five, a certain version of the sorites paradox, known as the forced march sorites, is discussed. It is argued that “data” about how speakers would behave in the forced march cannot lend any firm support to contextualism about vagueness. In chapter six, some problems concerning the instability of the contextual factors are considered. One problem is that contextualist diagnoses of the sorites which locate a fallacy of equivocation in the reasoning seem to render non-soritical reasoning fallacious as well. A model for treating this problem is suggested, but on closer consideration, it turns out to be problematic. Moreover, this model is of no help in solving the more general problem that even if classical logic remains valid for vague language on some contextualist views, the instability of the extensions of vague predicates makes it difficult to know when a certain piece of reasoning instantiates a valid argument form. Other difficulties arise with respect to speech reports and belief contents. Chapter seven concludes with a summary and some methodological remarks. (shrink)

Ordinary Language Philosophy has largely fallen out of favour, and with it the belief in the primary importance of analyses of ordinary language for philosophical purposes. Still, in their various endeavours, philosophers not only from analytic but also from other backgrounds refer to the use and meaning of terms of interest in ordinary parlance. In doing so, they most commonly appeal to their own linguistic intuitions. Often, the appeal to individual intuitions is supplemented by reference to dictionaries. In recent times, (...) Internet search engine queries for expressions of interest have become quite popular. Apparently, philosophers attempt to surpass the limits of their own linguistic intuitions by appealing to experts or to factual uses of language. I argue that this attempt is commendable but that its execution is wanting. Instead of appealing to dictionaries or Internet queries, philosophers should employ computer-based linguistic corpora in order to confirm or falsify hypotheses about the factual use of language. This approach also has some advantages over methods employed by experimental philosophers. If the importance of ordinary language is stressed, the use of linguistic corpora is hardly avoidable. In this dissertation, I present a novel account of the components that have a peculiar epistemic role in our scientific inquiries, since they contribute to establishing a form of coordination. The issue of coordination is a classic epistemic problem concerning how we justify our use of abstract conceptual tools to represent concrete phenomena. For instance, how could we get to represent universal gravitation as a mathematical formula or temperature by means of a numerical scale? This problem is particularly pressing when (...) justification for using these abstract tools comes, in part or entirely, from knowledge which is not independent from them, thus leading to threats of circularity. Achieving coordination between some abstract conceptual tools and the concrete phenomena that they are supposed to represent is usually a complex process, which involves several epistemic components. Some of these components eventually provide stable conditions for applying those abstract representations to concrete phenomena. It is in this sense of providing certain conditions of applicability that different philosophical traditions, as well as some contemporary reappraisals, view these components as constitutive or a priori. In this work, I present a new gradualist, contextualist, and relational approach to understand these constitutive components of scientific inquiry. It is gradualist inasmuch as the degree to which some component is constitutive depends on three quantifiable features: quasi-axiomaticity, generative potential, and empirical shielding. Since the quantification of these three features impinges on the history and practice of using these components in a scientific context, my approach is a contextualist one. Finally, my approach is relational in a double sense: first, it identifies ordinal relationships among epistemic components with respect to their constitutive character; second, these relationships are relative to a scientific framework of inquiry. After introducing my account and a classic example of constitutively a priori principles, i.e., Friedman’s (2001) analysis of Newtonian mechanics, I turn to my own case studies to demonstrate the advantages of my approach. Firstly, I discuss Okasha’s (2018) view of endogenization as a pervasive theoretical strategy in evolutionary biology and suggest that the constitutive character of the core Darwinian principles progressively increases with endogenization. Secondly, I apply a conceptual distinction between two varieties or scopes of coordination – general coordination and coordination in measurement – to Ohm’s work on electrical conductivity. This distinction allows me to pinpoint to what extent components along different dimensions (e.g., instrumentation, measurement, theorising, etc.) were constitutive of the forms of coordination which Ohm relied on. Thirdly, I discuss the epistemic function of the Hardy-Weinberg principle in the history and practice of population genetics. I assess this principle in terms of my account and identify approximation and stability as two components that are highly constitutive, in that they contribute to justifying its use in population genetics. Finally, applying my account to these case studies enables me to identify at least three qualitatively different types of constitutive components: domain-specific theoretical principles, material components, and domain-independent assumptions underlying reasoning abilities. In the light of my results, I draw some general conclusions on epistemic justification and scientific knowledge. (shrink)

John Austin (1911-1960) è stato uno dei filosofi britannici più influenti del suo tempo, per il rigore del pensiero, la personalità straordinaria e il metodo filosofico innovativo. A parere di John Searle Austin era molto amato e molto odiato dai contemporanei – disorientati da un pensiero che sembrava distruggere più che costruire, sfidare l'ortodossia della filosofia tradizionale ma anche dell'allora imperante empirismo logico, senza sostituirvi nessuna confortante nuova ortodossia. L'opera di Austin è tuttavia oggi poco conosciuta e gli elementi di (...) novità della sua riflessione non sufficientemente apprezzati. Costituiscono un'eccezione due risultati, universalmente riconosciuti e celebrati: da un lato la tecnica di analisi filosofica – quella versione della "filosofia linguistica" praticata da Austin con la pazienza, il rigore e il talento di un entomologo; dall'altro la teoria degli atti linguistici. Austin viene ricordato soprattutto per aver evidenziato la dimensione performativa che permea ogni nostro proferimento: con uno slogan diventato famoso, ogni dire è anche un fare. Una tesi con ripercussioni in aree di ricerca molto diverse, dalla filosofia del linguaggio all'etica, dalla filosofia politica al diritto, dalla linguistica alla filosofia femminista. Ci concentreremo qui sui contributi di Austin alla filosofia del linguaggio, ma faremo cenni anche estesi ai suoi contributi in epistemologia e teoria dell'azione, nonché al vivace dibattito che a partire dalla teoria degli atti linguistici si è sviluppato negli anni '60 e '70. Un dibattito che è tornato ad accendersi in tempi recentissimi nelle discussioni su libertà di espressione e censura. (shrink)

Putnam is known for having demonstated the existence of a new form of context-dependence, namely that which characterizes natural kind terms. Terms like ‘tiger' and ‘water' are indexical, Putnam says, since their conditions of application varies with the context of use — in a suitably broad sense of ‘context'. In this talk I focus on the relation between Putnam's semantics and a body of views I call ‘contextualism'. Contextualism generalizes context-sensitivity : it claims that sentences carry contents only in the (...) context of a speech act. This view was put forward by ordinary language philosophers in the mid-twentieth century, and it has re-surfaced in recent times in the works of philosophers like John Searle, Charles Travis, and myself. In the talk I argue that Putnam's semantics has strong affinities with contextualism. (shrink)

This thesis explores possibilities that arise from regarding theodicy as the activity of descriptive understanding of Christian belief and practice as found in the classical theistic framework. First, any theodicy as an activity is analysed in terms of the role of philosophy, the place of epistemology, the basis of theology, and the taking of an apologetic stance. It is then argued that traditional approaches to theodicy suffer from methodological weaknesses which derive from formulating theodicy in terms of unbelief, and from (...) strictly theoretical analysis. The superiority of philosophical description is argued as better suited to understanding religious belief as held in the community of believers, with especial reference to relationships that hold between language and reality. A critical exploration follows of the approach to theodicy of a proponent of philosophical description, D.Z. Phillips, and consideration is given to the status of evaluations made by believers. In the light of this critique, two attempts are made to describe the shape of Christian theodicy using the interperson model of theological language. The first attempt, based on a description of actual interpersonal relationships, is found eventually to be open to serious objections. A second attempt is then made, based not only on interpersonal language, but using a distinction between "surface" and "depth" in religious language, and by arguing for the presence of an epistemological "direction" in religious belief. On this basis, a Theodicy of Dependence is developed as best describing the shape of Christian belief held in a world which is frequently hostile. (shrink)

In this contribution I will examine Cotnoir’s (2013) solution to the problems that alethic pluralism faces when it comes to logical paradoxes. I will argue that his proposal fails to be a viable option and I will put forward an alternative approach, more Tarskian in spirit, but with the same “pluralist” trait of Cotnoir’s solution. Such an alternative approach is based on the idea that each truth predicate can be associated with an index that fully describes its relation with other (...) truth predicates.I will show how such indexes must be constrained in order to avoid logical paradoxes. This thesis comprises three main chapters—each comprising one relatively standalone paper. The unifying theme is fragmentalism about truth, which is the view that the predicate “true” either expresses distinct concepts or expresses distinct properties. -/- In Chapter 1, I provide a formal development of alethic pluralism. Pluralism is the view that there are distinct truth properties associated with distinct domains of subject matter, where a truth property satisfies certain truth-characterizing principles. On behalf of pluralists, I propose an account of logic (...) and semantics that shows how they can answer central conceptual and logical challenges for their view. -/- In Chapter 2, I motivate and develop a modal account of propositions on the basis of an iterative conception of propositions, where the modality is logico-mathematical. The modal account of propositions takes the conception to motivate an inherently potential hierarchy of propositions. I show that the account helps provide satisfying solutions to the intensional paradoxes of Russell-Myhill, Kaplan, and Prior. -/- In Chapter 3, I propose that “true” is polysemous. I suggest that “true” is initially polysemous between correspondence truth and disquotational truth, and further polysemous between the meanings corresponding to the subconcepts of the concept truth generated by the indefinite extensibility of that concept. I show that the proposal provides satisfying solutions to the semantic paradoxes. (shrink)

En este trabajo se analizan los conceptos de laguna axiológica y de derrotabilidad desde el punto de vista de una teoría "realista" de interpretación. En base a algunos ejemplos se intenta mostrar que ambos conceptos aparecen como resultado de la interpretación de los textos jurídicos. Tanto las lagunas axiológicas, como la derrotabilidad no son propiedades objetivas de sistemas jurídicos, porque dependen de las valoraciones de los intérpretes y la acción de interpretar no es conocer el derecho, sino contribuir a hacerlo. The analysis of the concepts of axiological gaps and of defeasibility from the point of view of a "realistic" theory of interpretation shows -by means of several examples- that both concepts are the result of interpretation of legal texts. Axiological gaps and defeasibility are not objective properties of legal systems, because they depend essentially on valuations of the interpreters and interpretation is not cognition of law, but participation in making law. Abstrakt. Když se řekne Ludwig Wittgenstein, vybaví se člověku, který to jméno už někdy slyšel, nejspíše termín jazyková hra. Tento termín si Wittgenstein vybral, aby se v rámci své pozdní filosofie distancoval od určitého druhu názorů na jazyk (druhu, kterého byly i jeho vlastní ranější filosofické názory). Chtěl jeho pomocí zdůraznit různorodost lidských aktivit, které se opírají o jazyk. Avšak ač to Wittgenstein úplně explicitně neříká, zdá se mi že je tu něco podstatného, co je podle něj pro jazykové hry (...) charakteristické, a to je role pravidel v rámci jejich konstituce. Tomu napovídá rozsah pozornosti, kterou Wittgenstein věnuje fenoménu pravidla ve Filosofických zkoumáních. Podle mne tedy můžeme říci, že jazyková hra je v typickém případě hrou - více či méně - 'řízenou' pravidly. Způsob, jakým se jazyková hra 'řídí' pravidly, se však v některých zásadních ohledech liší od způsobu, jakým se pravidly řídí hry, ke kterým občas naše jazykové hry přirovnáváme (šachy, fotbal ap.) Pravidla jazykových her jsou implicitní, vágní a do jisté míry otevřená. Přitom pravidla hry nám obvykle otevírají nějaký nový prostor - a v případě jazykových her je to prostor, kterému se dá říkat prostor smysluplnosti. Myslím ovšem, že skutečnou roli pravidel v rámci jazykových her Wittgenstein v rámci Filosofických zkoumání trochu zamlžuje; a cílem tohoto textu bude ji vyjasnit. (shrink)
