This paper builds a nine-step method for determining whether a straw man fallacy has been committed in a given case or not, by starting with some relatively easy textbook cases and moving to more realistic and harder cases. The paper shows how the type of argument associated with the fallacy can be proved to be a fallacy in a normative argumentation model, and then moves on to the practical task of building a hands-on method for applying the model to real (...) examples of argumentation. Insights from linguistic pragmatics are used to distinguish the different pragmatic processes involved in reconstructing what is said and what is meant by an utterance, and to differentiate strong and weak commitments. In particular, the process of interpretation is analyzed in terms of an abductive pattern of reasoning, based on co-textual and contextual information, and assessable through the instruments of argumentation theory. En el presente artículo utilizamos el concepto de filosofía formalizada de Hansson, así como las categorías de idealización simplificada y perfeccionista que se le asocian, con el fin de proponer un metaanálisis de tres enfoques teóricos de la argumentación, a saber, la pragmadialéctica de van Eemeren y Grootendorst, los esquemas argumentativos de Walton y el enfoque conversacional de Jacobs y Jackson, en relación con el tratamiento de las falacias como un tipo de trasgresión de reglas pragmáticas. Concluimos que mientras las (...) dos primeras están ancladas en una concepción centralizada de lo falaz, la tercera abandona toda posibilidad de normatividad. (shrink)

Populism is on the rise, especially in Western Europe. While it is often assumed that populist actors have a tendency for fallacious reasoning, this has not been systematically investigated. We analyze the use of informal fallacies by right-wing populist politicians and their representation in the media during election campaigns. We conduct a quantitative content analysis of press releases of right-wing populist parties and news articles in print media during the most recent elections in the United Kingdom and Switzerland in 2015. (...) The results show that fallacies are used in more than a third of all analyzed texts and overwhelmingly co-occur with populist key messages. Moreover, fallacies occur more often in populist parties’ press releases than in news articles and are more common in Switzerland compared to the United Kingdom. This study confirms the argument that populist actors use fallacies in combination with populist claims. (shrink)

What role, if any, does dialectic play in Aristotle’s epistemology in the Topics? In this paper I argue that it does play a role, but a role that is independent of endoxa. In the first section, I sketch the case for thinking that dialectic plays a distinctively epistemological role—not just a methodological role, or a merely instrumental role in getting episteme. In the second section, I consider three ways it could play that role, on two of which endoxa play at (...) least a co-starring role. But in the third section, I argue that endoxa don’t play that co-starring role, by arguing for a deflationary account of what endoxa are. For that reason, the third view emerges as the most plausible; but the third view is, I’ll suggest, Platonic. (shrink)

This tribute to the breadth and influence of Trudy Govier’s philosophical work begins with her early scholarship in argumentation theory, paying special attention to its pedagogical expression. Most people first encounter Trudy Govier’s work and many people only encounter it through her textbooks, especially A Practical Study of Argument, published in many editions. In addition to the work on argumentation that has continued throughout her career, much of Govier’s later work addresses social philosophy and the problems of trust and response (...) to moral wrongs. The introduction by Catherine Hundleby situates Govier’s research along the path of her unusual academic life. While following the timeline of Govier’s research publication, in this collection the authors build on her work and suggest certain new connections between her argumentation theory and social philosophy. A Practical Study of Argument, first published in 1985, situates Govier among a distinct segment of informal logicians whose concerns about teaching reasoning to post-secondary students orient their research, Takuzo Konishi argues. Moira Kloster evaluates Govier’s progress in the challenge of providing critical thinking education to diverse and changing social contexts. Shifting gears to social philosophy but still addressing education, Laura Elizabeth Pinto explores the significance of Govier’s work on trust for explaining the problem of “audit culture” for teaching. At the centre of this volume, social philosophy receives an abstract meta-ethical defense from Linda Radzik. Moving solidly into the domain of normative social philosophy, Alice MacLachlan reconsiders Govier’s condemnation of revenge by viewing it as a form of moral address, but she notes how revenge as an act of communication contrasts with argumentation in lacking the respect that Govier maintains is intrinsic to argumentation. MacLachlan ultimately agrees that revenge is morally indefensible. The practical challenges of addressing others in the aftermath of wrongdoing, especially in public contexts, can make it difficult to distinguish between victims and combatants or wrongdoers, Alistair Little and Wilhelm Verwoerd explain, and Kathryn Norlock argues that forgiveness is psychologically vexed too. People may recognize transformation to be in principle possible for all people, Norlock argues, and yet we may find the evidence regarding some particular evildoer sufficient to count that person as an exception. This paper uses argumentation tools such as argument diagrams and argumentation schemes to analyze four examples of argument from analogy, and argues that to proceed from there to evaluating these arguments, features of the context of dialogue need to be taken into account. The evidence drawn from these examples is taken to support a pragmatic approach to studying argument from analogy, meaning that identifying the logical form of the argument by building an argument diagram of the premises and conclusion is (...) not by itself sufficient for argument evaluation. To get further, it is argued, the argument evaluator needs to take into account how this particular argument was used in context to support a conversational goal.Cet article utilise des outils d'argumentation tels que des diagrammes d'argument et des schèmes d'argumentation pour analyser trois exemples d'argument par analogie, et soutient que pour évaluer ces arguments de manière adéquate, il est nécessaire de tenir compte du contexte d'utilisation de l'argument. Ces exemples suggèrent que l’étude des arguments par analogie à partir de seulement l’identification de leur forme logique n'est pas adéquate. Dialogical egalitarianism is the thesis that any proposition asserted in dialogue, if questioned, must be supported or else retracted. Dialogical foundationalism is the thesis that some propositions are privileged over this burden of proof, standing in no need of support unless and until support for their negation is provided. I first discuss existing arguments for either thesis, dismissing each one of them. Absent a successful principled argument, I then examine which thesis it is pragmatically more advantageous to adopt in analytic (...) philosophical dialogue. This requires identifying the goal of such dialogue, to the attainment of which the thesis would be so advantageous. To identify this goal, I draw on Douglas Walton’s typology of dialogues for an analysis of the types of dialogue of 110 representatively selected journal articles in current analytic philosophy. 95% of articles are found to instantiate persuasion dialogue. In light of the thus prevalent goal of persuading one’s opponent, I argue that the adoption of dialogical egalitarianism in analytic philosophical dialogue is pragmatically inescapable. (shrink)

Douglas Walton, perhaps the most prolific author in Argumentation theory, has been of a great influence in the fields of Informal logic, Artificial intelligence, and Law. His contributions in the field of educational research, in particular in the field of argumentation and education, are less known. This review paper aims at shedding light on those aspects of Walton’s theory that have received educational researchers’ attention thus far, as well identifying existing lacks of consideration and open paths for future research.

In this paper I focus on the fallacy known as Complex Question or Many Questions. After a brief introduction, in Sect. 2 I highlight its pragmatic dimension, and in Sect. 3 its dialectical dimension. In Sect. 4 I present two accounts of this fallacy developed in argumentation theory, Douglas Walton’s and the Pragma-Dialectics’, which have resources to capture both its pragmatic and its dialectical nature. However, these accounts are unsatisfactory for various reasons. In Sect. 5 I focus on the pragmatic (...) dimension of the fallacy and I suggest amendments to the accounts mentioned drawing on the study of the phenomenon of presupposition in theoretical pragmatics. I argue that the central notion in the definition of the fallacy is that of an informative presupposition. In Sect. 6 I focus on the dialectical dimension of the fallacy. This dimension needs to be explicitly acknowledged in the definition of the fallacy in order to distinguish it from a different, non-dialectical, fallacious argumentative move involving presuppositions. That bootstrapping and Moorean reasoning fail to instantiate persuasive argumentation is an often informally presented but not systematically developed view. In this paper, I will argue that this unpersuasiveness is not determined by principles of justification transmission but by two straightforward principles of rationality, understood as a concept of internal coherence. First, it is rational for S to believe the conclusion of an argument because of the argument, only if S believes sufficiently many premises of the argument. Second, if S (...) doubts that a source O is reliable and believes that information i is delivered by O, then S rationally suspends judgment about the truth of i. This paper aims to accomplish two tasks. First, it provides a thorough analysis of why bootstrapping argumentation is not an instance of rational persuasion. According to a widely shared generic conception of inferential justification—‘the standard conception’—an agent is inferentially justified in believing that p only if she has antecedently justified beliefs in all the non-redundant premises of a good argument for p. This conception tends to serve as the starting-point in contemporary debates about the nature and scope of inferential justification: as neutral common ground between various competing, more specific, conceptions. But it’s a deeply problematic starting-point. This paper explores three questions that haven’t been (...) given the attention they deserve, that complicate the application of the standard conception to cases, and that reveal it to be underspecified at the core—in ways that aren’t resolved but inherited by more specific (extant) versions of it. The goal isn’t to answer the questions, but to articulate them, explain what turns on them, and invite a critical re-examination of the standard conception. (shrink)

The paper relates two different fields of research: the historiography of generative linguistics and argumentation theory, a central topic of which is the investigation of fallacies. Relating the two fields is a challenge: Since fallacies seem to be at the heart of the historiography of generative linguistics, any thorough evaluation of its present state of the art also involves accounting for fallacies. The paper applies Kertész and Rákosi’s p-model of plausible argumentation to a case study on heated discussions in the (...) historiography of generative linguistics. As a result, basic properties of fallacious argumentation are revealed and delimited from plausible argumentation in linguistic historiography. In addition, the paper also draws generalizable conclusions that may affect the historiography of other human sciences as well. (shrink)

Harry Frankfurt characterised bullshit as assertions that are made without a concern for truth. Assertions, however, are not the only type of speech act that can be bullshit. Here, I propose the concept of argumentative bullshit and show how a speech acts account of bullshit assertions can be generalised to bullshit arguments. Argumentative bullshit, on this account, would be the production of an argument without a concern for the supporting relation between reasons and claim.

According to the Bayesian paradigm in the psychology of reasoning, the norms by which everyday human cognition is best evaluated are probabilistic rather than logical in character. Recently, the Bayesian paradigm has been applied to the domain of argumentation, where the fundamental norms are traditionally assumed to be logical. Here, we present a major generalisation of extant Bayesian approaches to argumentation that utilizes a new class of Bayesian learning methods that are better suited to modelling dynamic and conditional inferences than (...) standard Bayesian conditionalization, is able to characterise the special value of logically valid argument schemes in uncertain reasoning contexts, greatly extends the range of inferences and argumentative phenomena that can be adequately described in a Bayesian framework, and undermines some influential theoretical motivations for dual function models of human cognition. We conclude that the probabilistic norms given by the Bayesian approach to rationality are not necessarily at odds with the norms given by classical logic. Rather, the Bayesian theory of argumentation can be seen as justifying and enriching the argumentative norms of classical logic. (shrink)

Douglas Walton’s multitudinous contributions to the study of argumentation seldom, if ever, directly engage with argumentation in mathematics. Nonetheless, several of the innovations with which he is most closely associated lend themselves to improving our understanding of mathematical arguments. I concentrate on two such innovations: dialogue types (§1) and argumentation schemes (§2). I argue that both devices are much more applicable to mathematical reasoning than may be commonly supposed.

This essay addresses the collapse/incoherence problem for normative frameworks that contain both fundamental values and rules for promoting those values. The problem is that in some cases, we would bring about more of the fundamental value by violating the framework’s rules than by following them. In such cases, if the framework requires us to follow the rules anyway, then it appears to be incoherent; but if it allows us to make exceptions to the rules, then the framework “collapses” into one (...) that doesn’t make use of rules in the first place. The chapter begins with an examination of happiness and truth as fundamental values in Mill’s work, which lead into parallel versions of the collapse/incoherence problem in ethics and epistemology. It then sets out the collapse problem for rule-consequentialist approaches in ethics, truth-directed accounts of justification in epistemology, and epistemological approaches to argument cogency. The chapter closes with discussion of two potential solutions to the problem. (shrink)

This thesis justifies the need for and develops a new integrated model of practical reasoning and argumentation. After framing the work in terms of what is reasonable rather than what is rational (chapter 1), I apply the model for practical argumentation analysis and evaluation provided by Fairclough and Fairclough (2012) to a paradigm case of unreasonable individual practical argumentation provided by mass murderer Anders Behring Breivik (chapter 2). The application shows that by following the model, Breivik is relatively easily able (...) to conclude that his reasoning to mass murder is reasonable – which is understood to be an unacceptable result. Causes for the model to allow such a conclusion are identified as conceptual confusions ingrained in the model, a tension in how values function within the model, and a lack of creativity from Breivik. Distinguishing between dialectical and dialogical, reasoning and argumentation, for individual and multiple participants, chapter 3 addresses these conceptual confusions and helps lay the foundation for the design of a new integrated model for practical reasoning and argumentation (chapter 4). After laying out the theoretical aspects of the new model, it is then used to re-test Breivik’s reasoning in light of a developed discussion regarding the motivation for the new place and role of moral considerations (chapter 5). The application of the new model shows ways that Breivik could have been able to conclude that his practical argumentation was unreasonable and is thus argued to have improved upon the Fairclough and Fairclough model. It is acknowledged, however, that since the model cannot guarantee a reasonable conclusion, improving the critical creative capacity of the individual using it is also of paramount importance (chapter 6). The thesis concludes by discussing the contemporary importance of improving practical reasoning and by pointing to areas for further research (chapter 7). (shrink)

Se asume decididamente la hipótesis de la intencionalidad colectiva y la cooperación como rasgos estructurales que permiten entender la argumentación como un fenómeno normativo. Se concluye que la argumentación fue producto de una presión selectiva para la multiplicación de representaciones alternativas provenientes de una mayor cantidad de agentes de un mismo o diferente grupo. La presión evolutiva seleccionó la comunicación de buenas razones a través (...) del conflicto verbal y permitió, al agente individual, generar reputación, lo que va en su directo beneficio reproductivo.
