According to second‐personal approaches to moral obligation, the distinctive normative features of moral obligation can only be explained in terms of second‐personal relations, i.e. the distinctive way persons relate to each other as persons. But there are important disagreements between different groups of second‐personal approaches. Most notably, they disagree about the nature of second‐personal relations, which has consequences for the nature of the obligations that they purport to explain. This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though they (...) can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)

The Problem of Obligation is the problem of how to explain the features of moral obligations that distinguish them from other normative phenomena. Two recent accounts, the Second-Personal Account and the Relational Account, propose superficially similar solutions to this problem. Both regard obligations as based on the claims or legitimate demands that persons as such have on one another. However, unlike the Second-Personal Account, the Relational Account does not regard these claims as based in persons’ authority to address them. Advocates (...) of the Relational Account accuse the Second-Personal Account of falling prey to the Problem of Antecedence. According to this objection, the Second-Personal Account is committed to the implausible claim that we have an obligation to φ only if, and because, others demand that we φ. Since the Relational Account’s proposed solution to the Problem of Obligation does not face the Problem of Antecedence, its advocates argue that it is dialectically superior to the Second-Personal Account. In this paper, I defend the Second-Personal Account by arguing that, first, the Relational Account does not actually solve the Problem of Obligation and, second, the Second-Personal Account does not fall prey to the Problem of Antecedence. Do aesthetic reasons have normative authority over us? Could there be anything like an aesthetic ‘ought’ or an aesthetic obligation? I argue that there are no aesthetic obligations. We have reasons to act certain ways regarding various aesthetic objects – most notably, reasons to attend to and appreciate those objects. But, I argue, these reasons never amount to duties. What is it for a duty or obligation to be directed? Thinking about paradigmatic cases such as the obligations generated by promises will take us only so far in answering this question. This paper starts by surveying several approaches for understanding directed duties, as well as the challenges they face. It turns out that shared agency features something similar to the directedness of duties. This suggests an account of directedness in terms of shared agency – specifically, in terms of the (...) so-called practical intimacy that holds between individuals when they act together. The final section addresses a challenge to the shared agency approach posed by legal wronging in tort law. (shrink)

Are there aesthetic obligations, and what would account for their binding force if so? I first develop a general, domain‐neutral notion of obligation, then critically discuss six arguments offered for and against the existence of aesthetic obligations. The most serious challenge is that all aesthetic obligations are ultimately grounded in moral norms, and I survey the prospects for this challenge alongside three non‐moral views about the source of aesthetic obligations: individual practical identity, social practices, and aesthetic value primitivism. In this article I propose an original view of the nature of shared intention. In contrast to psychological views (Bratman, Searle, Tuomela) and normative views (Gilbert), I argue that both functional roles played by attitudes of individual participants and interpersonal obligations are factors of central and independent significance for explaining what shared intention is. It is widely agreed that shared intention (I) normally motivates participants to act, and (II) normally creates obligations between them. I argue that the view I propose (...) can explain why it is not a mere accident that both (I) and (II) are true of shared intention, while psychological and normative views cannot. The basic idea is that shared intention involves a structure of attitudes of individuals –including, most importantly, attitudes of reliance – which normally plays the relevant motivating roles and creates the relevant obligations. A defence of the idea that there are sui generis duties of love: duties, that is, that we owe to people in virtue of standing in loving relationships with them. I contrast this non-reductionist position with the widespread reductionist view that our duties to those we love all derive from more generic moral principles. The paper mounts a cumulative argument in favour of the non-reductionist position, adducing a variety of considerations that together speak strongly in favour of adopting it. Introduction Non-consequentialists often attempt to capture a familiar, if slightly elusive, sense of moral wrongness. In particular, many non-consequentialists give a central role to the idea that there is a distinction to be made between acting wrongly and wronging someone. To explain, consider the difference between my duty not to trample sunflowers and my duty not to trample you. In the case of sunflowers, I might act wrongly in trampling them without good reason, but it does not seem that I (...) can wrong them by doing so. In juxtaposition, if I trample you it does not seem that I have merely acted wrongly, but that I have wronged you in particular because I owe it to you not to do so. We defend a fitting-attitude theory of the funny against a set of potential objections. Ultimately, we endorse a version of FA theory that treats reasons for amusement as non-compelling, metaphysically non-conditional, and alterable by social features of the joke telling context. We find that this version of FA theory is well-suited to accommodate our ordinary practices of telling and being amused by jokes, and helpfully bears on the related faultless disagreement dispute.

In this paper, I argue that accounts of the normative basis of morality face the following puzzle, drawing on a case found in Susan Wolf’s influential discussion of conflicts between the moral and personal points of view. On the one hand, morality appears to constitute an independent point of view that can intelligibly conflict with, and can conceivably be overruled by, the verdicts of other points of view. On the other hand, moral demands appear to carry a distinctive sort of (...) authority; moral reasons normally seem to take priority over other kinds of considerations, and the verdicts of morality seem to possess a distinctive place in our deliberations, in that they appear to represent standards that we are open to legitimate complaint for failing to honor. After clarifying the nature of the problem, I argue that a contractualist theory of morality can resolve the puzzle by offering a compelling vindication of the independence of the moral perspective, the normal priority of moral reasons, and the deliberative significance of moral verdicts, within a unified theoretical framework. Furthermore, I claim that this contractualist analysis can help account for the sense of deep conflict that is characteristic of the sort of troubling moral choices that Wolf calls to our attention. Deontic, as opposed to evaluative buck-passing theories seem to be easier to accept, since there appears to be an intimate connection between deontic properties, such as ‘ought’, ‘requirement’, and ‘permission’ on the one hand, and normative reasons on the other. However, it is far from obvious what, precisely, the connection consists in, and this topic has suffered from a paucity of discussion. This paper seeks to address that paucity by providing a novel deontic buck-passing view, one that avoids the pitfalls (...) both of the most straightforward view on the matter (what I call the “standard view”) as well as a recently articulated view, due to Matt Bedke. It does so by appealing first to the distinction between a reason for, and a reason against, and uses this distinction to clarify what are taken to be two fundamental, but distinct, deontic properties—ought and requirement. The resulting view allows us to capture these properties, the structural relations between them, and does so in a way that avoids making supererogation impossible. (shrink)

Barry Maguire has recently argued that the nature of normative support for affective attitudes like fear and admiration differs fundamentally from that of reasons. These arguments appear to raise new and serious challenges for the popular ‘reasons-first’ view according to which normative support of any kind comes from reasons. In this paper, I show how proponents of the reasons-first view can meet these challenges. They can do so, I argue, if they can successfully meet some other well-known challenges to their (...) view: distinguishing between right and wrong kinds of reasons, distinguishing between reasons, enablers, and defeaters, and providing an account of the relation between reasons and rationality. Whether proponents of the reasons-first view can meet these other challenges remains controversial. I do not try to settle these questions here, but rather show that the debate about the nature of normative support for affective attitudes is not going to be settled in isolation from them. (shrink)

The normative power of consent plays a central role in enabling individuals to permissibly interact with one another. However, in the philosophical literature, the relationship between consent and permissible action is not always well understood. In this article I outline an account of the normative effect of valid consent, in order to clarify this relationship. I first argue that consent’s primary moral significance lies in its effect upon our interpersonal moral relationships. Specifically, I argue that valid consent serves to cancel (...) a directed duty owed to the consenter. Other things being equal, this equips the consentee with a directed permission: they will no longer wrong the consenter by acting in the consented to manner. However, this account does not yet explain how consent impacts upon the all things considered permissibility of an action. On the assumption that all things considered permissibility is a function of an agent’s reasons for action, we require an account of consent’s effect on those reasons. I consider, and then reject, Michelle Dempsey’s recent suggestion that consent affects a consentee’s reasons for action by granting them an exclusionary permission. I propose that we should instead understand consent to function as a cancelling permission. (shrink)

It is therefore sometimes objected that contractualist moral theories cannot give a satisfactory account of such obligations, as there is little to motivate a contract with persons who can offer us almost nothing in return. I will argue that more recent “relational” forms of contractualism escape these objections. These forms of contractualism do, however, remain vulnerable to Derek (...) Parfit’s non-identity problem. Recent attempts to resolve this problem have looked to the role “generic reasons” and “standpoints” play in contractualist theories. I argue that these views provide an important line of response in cases where the deliberating agent has limited information about the identities of those their actions will affect, but that the non-identity problem is not such a case. Sometimes individuals act together, and sometimes each acts on his or her own. It's a distinction that often matters to us. Undertaking a difficult task collectively can be comforting, even if only for the solidarity it may engender. Or, to take a very different case, the realization (or delusion) that the many bits of rudeness one has been suffering of late are part of a concerted effort can be of significance in identifying what one is up against: the accumulation of (...) grievances (no doubt well catalogued) is seen, not as an unfortunate coincidence of affronts stemming from various quarters, but as itself a product of a unified exercise of agency. A paranoid conspiracy theorist is not usually to be taken seriously. But he does get right that it certainly would be awful, for example, if everyone were out to get him and were working together to do so. After all, the stability and impact of agency that's shared can be expected to be more serious than the effects of a mere collection of individual acts.[1.. (shrink)

This thesis is about what a normative reason is and how reasons relate to oughts. I argue that normative reasons are to be understood as relational properties of favouring or disfavouring. I then examine the question: What is the relation between reasons, so understood, and what we ought to do, believe, or feel? I argue that the relation is an explanatory one. We should explain what we ought to do in terms of reasons, and not the other way around. This (...) view faces a number of difficulties, in particular in accounting for supererogatory acts and the distinction between an action being required and an action being recommended. The analysis that I provide explains how we can solve these problems. In providing such an analysis, this thesis aims to be a contribution to the discussion of how we might elucidate the structure of what is sometimes called normativity. (shrink)

Morality is a source of reasons for action, what philosophers call practical reasons. Kantians say that it ‘gives’ reasons to everyone. We can even think of moral requirements as amounting to particularly strong or stringent reasons, in an effort to demystify deontological views like Kant’s, with its insistence on inescapable or ‘binding’ moral requirements or ‘oughts.’¹ When we say that someone morally ought not to harm others, perhaps all we are saying is that he has a certain kind of reason (...) not to, one that wins out against any opposing reasons such as those touting benefits to him of ignoring others’ concerns. This work is an investigation into philosophical method and rational argument in moral philosophy. It makes an original contribution to human understanding, by taking some of the tools and techniques that Gordon Baker identifies in the later work of Wittgenstein, and using them as a way of fending for oneself in an area of philosophy that neither Baker, nor Wittgenstein, wrote on. More specifically, a discussion of some different aspects of the contemporary literature on Dancy’s moral particularism is used as (...) a vehicle for illustrating how Baker’s therapeutic conception of philosophy offers alternative possibilities for how we can do philosophy, and what counts as rational argument in moral philosophy. I maintain that, by considering some indicative ways in which Baker’s therapeutic approach to philosophy can dissolve, rather than solve, the kinds of perplexities found in the existing literature on Dancy’s moral particularism, we can liberate ourselves from the traditional/theoretical view of how we ought to do philosophy, and an understanding of rational argument in moral philosophy, to which we need not be committed.
