In 1905 the Supreme Court of Georgia became the first state high court to recognize a freestanding “right to privacy” tort in the common law. The landmark case was Pavesich v. New England Life Insurance Co. Must it be a cause for deep jurisprudential concern that the common law right to privacy in wide currency today originated in Pavesich’s explicit judicial interpretation of the requirements of natural law? Must it be an additional worry that the court which originated the common (...) law privacy right asserted that a free white man whose photograph is published without his consent in a city newspaper is like a slave in bondage? I argue that the jurisprudence of Pavesich need not be troubling. Pavesich’s natural law argument was supplemented by several positive law arguments. The positive law arguments were a strong enough basis for finding a right to privacy in the common law, as indeed Samuel Warren and Louis Brandeis had previously argued. The observation that the Pavesich court’s natural law argument ran alongside positivistic arguments suggests that the arresting, high-toned natural law and slavery appeals in Pavesich are inessential rhetorical throwaways. But I maintain that the natural law argument and slavery analogy features of Judge Andrew Jackson Cobb’s opinion extolling the “liberty of privacy” are (1) of critical importance to a full contextual understanding of the decision and (2) illuminate the contemporary case for recognizing invasions of privacy as civil injuries to freedom and self-determination. One can poke holes in the logic of Thomas Aquinas and John Locke as scholars have done for centuries. But one can as easily choose to celebrate the spirit of the natural law tradition. The natural law tradition represents efforts rhetorically, rationally, and intuitively to derive principles of justice and goodness from basic facts about human characteristics, needs, and desires, where otherwise binding sovereign law may fall short. Sikap kritis terhadap krisis ekologi yang berdampak buruk pada perempuan telah dimulai oleh Francoise d’Eaubonne dalam bukunya La Feminsme au la Mort (1974). Inilah awal terminologi ekofeminisme diperkenalkan. d’Eaubonne mengungkapkan adanya keterkaitan yang erat antara penindasan terhadap perempuan dan penindasan terhadap alam yang berakar pada kultur patriarki. Dalam sistem ini, perempuan menempati konstruksi posisi yang sama dengan alam yaitu sebagai objek, bukan subjek. Ekofeminisme kemudian lahir untuk memecahkan masalah kehidupan manusia dengan alam yang berangkat dari pengalaman perempuan dan menjadikannya sebagai (...) salah satu sumber belajar dalam pengelolaan dan pelestarian alam. Dalam artikel ini, saya akan mencoba melakukan kritik terhadap beberapa gagasan ekofeminisme. Kritik dalam gagasan ekofeminisme yang akan dilayangkan adalah terkait: relasi antara perempuan dan alam, sifat ideal perempuan, etika kepedulian, gagasan “Ibu Bumi”, dan gagasan menyembuhkan Bumi. Dengan metode studi pustaka, saya akan membedah gagasan dan solusi yang ditawarkan oleh ekofeminisme dalam menghadapi alam saat ini dan melihat apakah ekofeminisme masih relevan dalam epos Antroposen. This chapter concerns the role accorded to animals in the theories of the English-speaking philosophers who created the field of environmental ethics in the latter half of the twentieth century. The value of animals differs widely depending upon whether one adopts some version of Holism (value resides in ecosystems) or some version of Animal Individualism (value resides in human and nonhuman animals). I examine this debate and, along the way, highlight better and worse ways to conduct ethical arguments. I explain (...) that two kinds of appeals (which I call intuition and reductio) are questionable foundations for environmental ethics and that representatives of both schools occasionally appeal unhelpfully to intuition or caricature the commitments of the other side. I review two stronger arguments for Ecoholism (inference and eco-organisms) and show that they have performed a useful function in environmental ethics. Ultimately, however, both arguments fail because their proponents are unable to answer four critical objections: weakness of will, no eco-organisms, no teleology, and is/ought. I then show that Animal Individualism operates on more secure footing when it comes to philosophical and scientific assumptions. I also propose that Animal Individualism is more likely to prove effective in establishing progressive environmental policies insofar as it builds on existing legal concepts, especially the concept of moral rights, and political institutions, such as democratic states. I note that wild animals are not inherently more valuable than domestic animals and, finally, offer a brief outline of an animal rights environmental ethic. (shrink)

It has been accepted for some time within Communication Theory that there are identifiable differences in how men and women communicate. This acceptance obtains both within the academic world and even more so within the realm of folk Communication Theory. I argue that the gender-identified differences run along distinct poles. The first major pole concerns the objectives meant to be achieved by argument: is it deciding who is right? Or, what the issue really is? Or, how a disagreement can or (...) should be resolved? The second major aspect concerns the communi­cative tools used in settling differences and understanding positions. If the genders have different rules of communi­cation, which rules will be followed? What sorts of arguments and evidence will be allowed? If classically mascu­line criteria are applied, then how can classically feminine voices be heard? It is argued that these issues do not loom nearly so large when gender is not confused with sex. The Millennium Development Goals (MDG) set time-bound targets that are powerful shapers of how and for whom health is pursued. In this paper we examine some ramifications of both the temporal limitation, and maternal-child health targeting of MDG 4 and 5. The 2015 end date may encourage increasing the number of mass campaigns to meet the specific MDG objectives, potentially to the detriment of a more comprehensive approach to health. We discuss some ethical, political, and pragmatic ramifications of this tendency, (...) and show that these are not unique to the MDGs but rather have a long history in health policy debates. We also examine attempts to counter a narrow focus on vertical interventions in campaigns through integrated health system delivery platforms. We argue that the way forward is not to assume that evidence is value free, but rather to make explicit the political and ethical decisions in the design of metrics and evaluation research. We propose an index of five factors that should be included in research designed to inform decision making about providing interventions as part of routine services or periodic campaigns, toward serving more members of the population, and long-term strengthening of the health system via integrated health interventions. Neste artigo defendo a tese de que o direito de não saber é independente do direito à privacidade. Há duas diferenças fundamentais entre esses dois direitos que os tornam independentes: (1) a direção da informação do direito de não saber é oposta a do direito à privacidade e (2) o âmbito do direito de não saber é maior do que o do direito à privacidade. Pretendo clarificar essas diferenças e fazer algumas qualificações sobre o direito de não saber, tal como (...) os requisitos para o seu exercício e os limites desse direito. Apesar de o foco da análise não ser sobre um direito jurídico de não saber, ela traz implicações relevantes para o tratamento jurídico tanto do direito de não saber, quanto para o direito à privacidade.
