In his essay ‘Critique of Violence’, Walter Benjamin subjects violence to a critique in order to establish the criterion for violence itself as a principle. His starting point is the distinction between law-positing and law-preserving violence. However, these are for him inseparable and subjected to the law of historical change: the history of the law is nothing but the dialectical rising and falling of legal orders. Benjamin’s analysis of legal violence and his criticism of parliamentary democracies, this article advances, should (...) be related to the critical analysis of the possibilities for alternative politics in contemporary democratic rule of law states, as those advanced by Bernard Noël, Philippe Lacoue-Labarthe, Jean-Luc Nancy and Jacques Rancière. For Benjamin, it is only law-destroying divine violence, whose principle is justice, not power, that is able to break this circle and open up a new era. Divine violence is, however, not only a provocative but also an extremely problematic, even dangerous, concept, as Jacques Derrida, among others, has claimed. This article considers, therefore, whether the concept of divine violence has any real political relevance in the contemporary era. (shrink)

The claim of this article is that the perpetrators of violence are “liminal” figures, being inside and yet outside of the world in which they act. It is this liminality, this existing on the border, that makes their violence senseless. Because of it, their actions can be understood in terms neither of the actual reality of their victims nor of the imagined reality that the perpetrators placed them in. Sense, here, fails, for the lack of a common frame. Liminality exists (...) in a number of forms: economic, religious, and political—each with its potential for violence. What distinguishes political liminality is the scale of its violence. As Carl Schmitt shows, the liminal sovereign or ruler is both inside and outside the state, employing its means for violence even as he is unconstrained by its laws. I contend that this sovereign exists in a continuum with the practitioners of terrorist violence, who are also liminal figures. To analyze this liminality, I explore the intertwining between the self and the world that sets up the common frame that gives sense to actions. I then examine the causes of its breakdown. (shrink)

Postcolonial discourse is incredibly diverse and postcolonial art in Australia has numerous critical modes. This paper describes an approach in Contemporary Indigenous art that attempts a critique of the law from within the law rather than outside of it. It takes a radical form of over-proximity, rather than avant-garde distance, and finds the gap and failure in law’s attempt at creating legal subjects of us all. In the work of Gordon Bennett, Danie Mellor and the duo Adam Geczy and Adam (...) Hill, there is a working through the political and legal ramifications of the Indigenous subject in contemporary Australia. The focus on processes of initiation and subjectivization, or what Althusser called “interpellation” and show the effects of this interpellation in the Indigenous subject and offer modes of resistance. The artists are informed by Lacanian notions of subjectivization and utilise this approach to semiotics and power as the starting point for their critique. (shrink)

Notwithstanding his own spiritual inadequacies, Wittgenstein has a profound respect for those capable of living a genuinely religious life; namely, those whose “passionate,” “loving” faith demands unconditional existential commitment. In contrast, he disapproves of those who see religious belief as hypothetical, reasonable, or dependent on empirical evidence. Drawing primarily on Culture and Value, “Lectures on Religious Belief,” and On Certainty, in this essay I defend two claims: (1) that there is an unresolved tension between Wittgenstein's later descriptive-therapeutic approach and the (...) implicit normativity of his conception of genuine/passionate religious belief; and (2) that the demarcation between the latter and its pseudo-religious counterpart is itself problematic. To illustrate these claims I argue that apocalyptic Christian fundamentalism presents a significant challenge to Wittgenstein's taxonomy. Despite these shortcomings, however, I conclude by suggesting that his characterization of religious belief as a “passion” or “love” remains valuable. (shrink)

This essay focuses on Judith Butler’s configuration in Parting Ways: Jewishness and the Critique of Zionism of sacred life from the mystical motifs that traverse Walter Benjamin’s writings as the pivot of an anti-identitarian ethics committed to non-violent resistance. To gain critical leverage on Butler’s post-secular stance, my analysis turns to Talal Asad’s ‘Redeeming the “Human” Through Human Rights’ chapter from Formations of the Secular, where he enunciates a disparity between a ‘pre-civil state of nature’ and the notion of ‘inalienable (...) rights’ that informs the subject’s rights under secular law. In underscoring the secular state’s inability or refusal to ascribe sacredness to ‘real living persons’ over and against ‘“the human” conceptualized abstractly, or imagined in a state of nature’ as presumed by natural law, Asad indirectly articulates what is at stake in Butler’s explication in Parting Ways of Benjamin’s ‘Critique of Violence’. In this context, Butler unpacks Benjamin’s remarks about the sixth commandment’s non-coercive disposition and the inner struggle its provisional applicability prompts. A conception of ‘sacred life’ crystallizes through Butler’s emphasis on the open-endedness of this struggle, which encourages us to abandon a solipsistic investment in our own suffering in the process of acknowledging its eternally transient rhythm. I argue that Butler supplements this motif by drawing upon Hannah Arendt’s grounding of the political in cohabitation. My contention is that while ‘sacred life’ forms the backbone of Butler’s affirmation of civil disobedience, Arendt empowers Butler’s ethics to transcend Benjamin’s Jewish-messianic melancholy by radicalizing the passivity that refracts it. ABSTRACT In this article I venture the hypothesis that music confronts education with the possibility to think violence in ways that are both inherently educational and radically affirmative. Beginning with a reflection on a poem by Elizabeth Barrett Browning, which emphatically evokes the violence within the genesis of music, I then move in a different direction in the second section, which surveys how extant (music-) educational has thematized violence so far. Concluding that this thematization, notwithstanding many nuances, invariably implies a (...) negative validation of violence, I devote the third section to a search for more affirmative concepts of educational violence. Eventually, this culminates in a return to the issue of a possibly intrinsic, positive relation between violence and music education. I first discuss this possibility more generally, connecting the discussed affirmative concepts of violence to the antipodal music-educational ideas of Plato and Nietzsche. Finally, in the last section, returning to Browning’s poem, I specify it by reclaiming the particular violence of music’s instrumental aspects for music education. (shrink)

Schmitt insists that the sovereign decision is unavoidable, that even an anarchist is caught in the trap of sovereignty when he tries to ‘decide against decision’. This article begins to think about a critical legal vocabulary that might suspend the necessity of the will to constitute, while emphasising the creativity of the constituent moment. The terms inoperativity, dis-enclosure and dissensus are developed and deployed in order to think about certain aspects of the Tunisian revolution. Speaking about the state of the Hollywood film industry at the 2008 Academy Awards, the Oscars’ host – comedian Jon Stewart – made the following wry assessment: ‘Not all films did as well as Juno obviously. The films that were made about the Iraq War, let’s face it, did not do as well. But I’m telling you, if we stay the course and keep these movies in the theatres we can turn this around. I don’t care if it takes 100 (...) years. Withdrawing the Iraq movies would only embolden the audience. We cannot let the audience win.’ The films he is referring to include Home of the Brave (2006), In the Valley of Elah (2007) and Stop-Loss (2008) – all of which focus on the personal cost to American soldiers on their return to civilian life, as well as exposing the failure of the US invasion of Iraq at home and abroad. Despite their topical subject matter, these movies were, for the most part, commercial failures. This article seeks to investigate audience indifference (Jean Baudrillard claims a certain indifference is a fundamental consequence of the Western globalising ideology) to mainstream cinematic depictions of the post September 11 invasion of Iraq, via a consideration of the trauma and abjection depicted in these films. Baudrillard’s hypotheses on terrorism – as a symbolic challenge put forth by terrorism (embodied by the attack on the Twin Towers) – and the West’s incapacity to respond to it, forms the basis for our investigation of the limits of these films to incite and engage viewers. His writings offer a lens through which to consider how ‘terrorism’ operates symbolically, and fundamentally, the dilemmas this raises for a Western psyche grappling with how the ‘terrorist threat’ might be answered, engaged with, responded to. ENGLISH ABSTRACT: This thesis is a philosophical exposition of violence informed by two theoretical positions which confront complexity as a phenomenon. These positions are complexity theory and deconstruction. Both develop systemsbased understandings of complex phenomena in which relations of difference are constitutive of the meaning of those phenomena. There has been no focused investigation of the implications of complexity for the conceptualisation of violence thus far. In response to this theoretical gap, this thesis begins by distinguishing complexity theory as a (...) general, trans-disciplinary field of study from critical complexity theory. The latter is used to develop a critique and criticism of epistemological foundationalism, emphasising the limits to knowledge and the normative and ethical dimension of knowledge and understanding. The epistemological break implied by this critique reiterates the epistemological shift permeating the work of, among others, Friedrich Nietzsche and Jacques Derrida. In this context, critical complexity theory begins to articulate the idea of violence on two levels: first, as an empirical, ethical problem in the system; and, secondly, as asymmetry and antagonism. Violence in this second sense is implicated in the dynamic relations of difference through which structure and meaning are generated in complex organisation. The sensitivity to difference and violence shared by critical complexity theory and deconstruction allows for the parallel reading of these philosophical perspectives; and for the supplementation and opening of critical complexity theory by deconstruction within the architecture of this thesis. This supplementation seeks to preserve the singularity of each perspective, while exploring the potential of their points of affinity and tension in the production of a coherent philosophical analysis of violence. Deconstruction offers a more developed understanding of violence and a wealth of related motifs: différance, framing, law, singularity, aesthetics and others. These motifs necessitate the inclusion of other philosophical voices, notably, that of Nietzsche, Arendt, Kant, Levinas, and Benjamin. In conversation with these authors, this thesis links violence to meaning, to its possibility, to its production and to the process by which meaning comes to change. Given these links, violence is conceptualised in relation to the notion of difference on three distinct levels. The first is the difference between elements in a complex system of meaning; the second is the notion of difference between systems or texts around which boundaries or frames can be drawn; and the third is the notion of difference between meaning and the absence of meaning. This discussion examines the relationship between this violence implicated in the constitution of meaning and the more colloquial understanding of violence as atrocity, as rape, murder and other socially, politically and ethically problematic expressions thereof. It is to empirical violence, following Derrida and Levinas, that we are called to respond and to intervene in the suffering of the other. The ethical and political necessity of response anchors this discussion of violence. And, it is towards the possibility of an adequate response – the possibility of an ethics sensitive to its own violence and a politics that is directed at the eradication of empirical violence – which this discussion navigates. This article accounts for Heidegger’s phenomenological concept of violence from the period of Being and Time. Violence is relevant for Heidegger in two different contexts: (i) methodological, where we speak of hermeneutic violence, and (ii) thematic, where we should speak of existential violence. The former is grounded in the latter. In the first part of the article, I analyze hermeneutic violence, showing that this concept is ambiguous, and one has to distinguish between two different meanings of it. In the second (...) part of the article, I show that at the core of the original sense lies the existential violence of bursting out of senselessness. In the final part, I contextualize Heidegger’s concept in light of the contemporary phenomenological developments of the phenomenon of violence, showing that existential violence is constitutive and has the peculiar character of being at the same time sense-destroying and sense-making. This article explores the work of the influential poststructuralist and postcolonial anthropologist Saba Mahmood. Mahmood’s work in anthropology adopts an Asadian and Butlerian approach, particularly in the seminal Politics of Piety: The Islamic Revival and the Feminist Subject. In this work, Mahmood critically interpellates the categories of ‘Western’ secular feminism through an exploration of the lives of pious Muslim women of Salafi orientations in Cairo in Egypt. Mahmood’s work constitutes an important intervention at a point in time when secular feminist (...) discourses are increasingly instrumentalized across the political spectrum in anti-Muslim discourses in the ‘Western’ world and in Europe. I argue, however, that in wanting to use the understandings and practices of pious Muslim women in Egypt in order to critique Western secular feminism, Mahmood fails to pose critical questions about the historicity of these practices and understandings, and lends her analysis to a form of cultural relativism which offers few prospects for a way forward for feminism. In this paper I argue that we need to analyze ‘religious violence’ in the ‘post-secular context’ in a twofold way: rather than simply viewing it in terms of mere irrationality, senselessness, atavism, or monstrosity – terms which, as we witness today on an immense scale, are strongly endorsed by the contemporary theater of cruelty committed in the name of religion – we also need to understand it in terms of an ‘originary supplement’ of ‘disengaged reason’. In order to confront its (...) specificity beyond traditional explanations of violence, I propose an integrated phenomenological account of religion that traces the phenomenality of religion in terms of a correlation between the originary givenness of transcendence and capable man’s creative capacities to respond to it. Following Ricœur, I discuss ‘religious violence’ in terms of a monopolizing appropriation of the originary source of givenness that conflates man’s freedom to poetically respond to the appeal of the foundational with the surreptitiously claimed sovereignty to make it happen in a practical transfiguration of the everyday. Drawing on the work of Walter Benjamin, Harold Bloom, and Theodor Adorno this article proposes the re-imageination of international law as a ‘pure means’ of representation rather than a means of exercising control over the world.

This article investigates links between the final scene—the milkshake scene—of P. T. Anderson’s film, ‘There Will Be Blood’, and a commercial advertisement for the sale of oil, which relies on a milkshake drinking analogy. The comparison probes a tension between the aspiration for capitalist economic growth and the self-regulation of corporate social responsibility. Business figures committed to the practice of CSR struggle with the possibility that deeper, systemic forms of violence inherent in market competition supersede their attempts at installing more (...) responsible cycles of economic exchange. A risk remains, all the while, that social and environmental concern of the kind expressed in CSR is only able to acquire ‘value’ in the market, a relational or ‘dialectical’ system of exchange, where it meets contrasting cycles or events in the market: the value of alternatives is predicated on pre-existing products or earlier cycles of marketisation. The article discusses difficulties that CSR creates in terms of making interventions and raising conflict with corporate actors, and a tendency for the system to leave inert, exposed or abandoned, those that try. The capacity of CSR to eradicate the more vicious shadow of capitalist markets is challenged in the article. There is no release, the author argues, in a concept that is so essentially dependent on market mechanisms and on competitively motivated change. (shrink)

Crises have become a new normality. This normality is turned into grounds for the politics of fear. The hegemonic principle of the politics of fear is security. This politics, which invents objects of fear, is intimately linked to the nationalist identity politics shaped by a particular nationalist essence. Racism is an elemental part of the nationalist identity politics. In the text, racism is considered in relation to, on the one hand, fear and anxiety and, on the other hand, the imaginary (...) and symbolic orders and the structure of fantasy. This analysis shows how xenophobic images, nationalist signifiers and racist fantasies create the vicious circles of fear and hate that gives justification for the nationalist identity politics that raises security as the hegemonic organizing principle. To counter the nationalist identity politics, the nationalist and racist fantasy must be traversed. Therefore, an anti-racist politics cannot be based on any pre-given identity. It takes place only as emancipatory events that confront the racists and nationalist fantasy. (shrink)

Many scholars in recent years have focused their efforts on revealing the connection of philosophy and authority. Basically, from Nietzsche onwards, philosophyhas witnessed ongoing efforts for “will to power” by some philosophers and of course this motivated many philosophers to take part in politics. Nonetheless, thismoot point engendered a serious risk and not only contrasted with the Socratic contributions, but also paved the way for the advent of a new way of making politics where philosophy and scientific prestige are being (...) manipulated following certain interests. By comparing the US and Argentinian climates, this paper explores to what extent philosophy can and must remain independent of politics. Even though one might think of Heidegger as a clear example of this relationship, there are many other philosophers who were interested in politics and committed to political parties. One of the aspects that characterizes this new way of politics is the theatrification of reality, and philosophers are part of this process. To some extent, the prestige given to scholars for their contribution to society is being conferred to some privileged groups to gain more legitimacy, precisely in a world where the classical institutions are gradually declining. The politics of precarity have emerged on the contemporary scene of critical theory with great social force in recent years. This paper looks at the risks and obstacles of positing precariousness and vulnerability as the basis of a universal ethics while also arguing for the socially transformative potential of such a model. More broadly, it considers the crucial question of what stands in the way of human relation and ethical life in an age of neoliberalism and biopolitics, and posits an (...) ethics of resemblance grounded in the commonality of flesh and in the at once singular and universal experience of loss. Following Freud’s suggestion that we are able to recognize in the others some parts of our unconscious life that we are not keen to admit as our owns, this paper draws a theory of empathy understood as a double intention affecting the self and the other, each of them being connected indirectly to an unconscious phantasm sustaining the social relations. The subjectivation is to be described as a process driving the self from what is seen in the other towards some (...) parts of his unconscious that remain unknown. Violence and freedom in the social field are to be examined in relation to this difficult self-knowledge that we may access when the other is not only a limit, but also an indicating sign of what we are, without knowing it.
