Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the (...) social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." In his book A Theory of Justice, John Rawls introduces and employs the concept of “reflective equilibrium” as a method of testing which of rival moral theories is to be preferred. The introduction of this concept is plainly a significant event for moral philosophy. The criterion by which we decide to reject, say, utilitarianism in favour of a contractual theory of justice is, if anything, even more fundamental than the choice of theory itself, since our choice of moral theory may (...) well be determined by the criterion we use. In this masterful work, both an illumination of Kant's thought and an important contribution to contemporary legal and political theory, Arthur Ripstein gives a comprehensive yet accessible account of Kant's political philosophy. In addition to providing a clear and coherent statement of the most misunderstood of Kant's ideas, Ripstein also shows that Kant's views remain conceptually powerful and morally appealing today.

Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition. This reissue makes the first edition once again available for scholars and serious students of Rawls's work.

Ever since the introduction of reflective equilibrium in ethics, it has been argued that reflective equilibrium either leads to moral relativism, or that it turns out to be a form of intuitionism in disguise. Despite these criticisms, reflective equilibrium remains the most dominant method of moral justification in ethics. In this paper, I therefore critically examine the most recent attempts to defend the method of reflective equilibrium against these objections. Defenders of reflective equilibrium typically respond to the objections by saying (...) that either reflective equilibrium can in fact safeguard moral objectivity or alternatively, even if it cannot, that there simply are no reasonable alternatives. In this paper, I take issue with both responses. First, I argue that given the non-foundationalist aspirations of reflective equilibrium, moral objectivity cannot be maintained. Second, I argue that reflective equilibrium is not the only game in town once intuitionism has been discarded. I argue that given their own normative ambitions, combined with their rejection of intuitionism, proponents of reflective equilibrium have reason to take alternative methods of moral justification, and more specifically transcendental arguments, more seriously than they have done so far. I end by sketching the outlines of what this alternative methodology might look like. (shrink)

Der Aufsatz behandelt den Zusammenhang zwischen Recht, Ethik und Moral in der MdS. Ausgangspunkt ist der Befund, daß Kants System der Pflichten in der MdS weder konsistent noch vollständig ist, weil Rechts- und Tugendpflichten, entgegen Kants Annahme, den Bereich der moralischen Pflichten nicht erschöpfen . Kants System der Pflichten beruht auf den Unterscheidungen zwischen Recht und Ethik und zwischen Legalität und Moralität. Letztere konzipiert Kant in der MdS anders als in früheren Werken, indem er sie nun auf die beiden Arten (...) der "Gesetzgebung" in Recht und Ethik und die daraus entspringenden Gesetze zurückführt . Im Zusammenhang mit der "ethischen" Gesetzgebung ergibt sich das Problem, wie es ethisch geboten sein kann, aus Pflicht zu handeln . Analog dazu stellt sich mit Blick auf die "juridische" Gesetzgebung die Frage, warum man befugt ist, andere zu rechtlichem Handeln zu zwingen. Handelt es sich um eine moralische oder eine spezifisch rechtliche Befugnis? Es zeigt sich, daß Kant zwei unvereinbare Auffassung miteinander verbindet: Aus seiner "offiziellen" Auffassung, wonach das Recht ein Teil der Moral ist, würde folgen, daß die Zwangsbefugnis im Recht moralisch gerechtfertigt werden kann. Tatsächlich ist eine solche Rechtfertigung aber nicht möglich, die "offizielle" Auffassung also unzureichend. Kant greift in der MdS aber auch mehrfach auf eine "alternative" Auffassung zurück, der zufolge das Recht als eine eigenständige Form autonomer Gesetzgebung neben der Moral steht . Dieser alternativen Auffassung zufolge, die der "offiziellen" insgesamt überlegen ist, würde die "Rechtslehre" also gar nicht in die Metaphysik der Sitten gehören. (shrink)

Recent years have seen a rekindling of interest in the method of reflective equilibrium. Most of this attention has been suspicious, however. Critics have alleged that the method is nothing more than a high-minded brand of navel-gazing, that it suffers from all the classic problems of inward-looking coherence theories, and that it overestimates the usefulness of self-scrutiny. In this paper I argue that these criticisms miss their mark because they labor under crucial misconceptions about the method of reflective equilibrium. In (...) defending reflective equilibrium I put forward a handful of theses about the nature of inquiry (or, more generally, norm-governed enterprises) that form the backdrop to the method. The critics’ objections fall short, I argue, because they do not recognize reflective equilibrium’s embrace of these theses. Confronting these objections and understanding why they fail brings us to a better understanding what, exactly, the method of reflective equilibrium is. The answer I come to in the final section of the paper is that the method of reflective equilibrium is not, exactly, anything. It is a mistake to try to give a positive characterization of the view, to identify it with a concern with a particular species of data, particular procedures and methods, or even a particular conception of normative success. Instead, it should be understood as the denial of essentialism about just these matters—as a form of anti-essentialism about our epistemic inputs, methods, and goals. (shrink)

Constitutivism aims to justify substantial normative standards as constitutive of practical reason. In this way, it can defend the constructivist commitment to avoiding realism and anti-realism in normative disciplines. This metaphysical debate is the perspective from which the nature of the constitutivist justification is usually discussed. In this paper, I focus on a related, but distinct, debate. My concern will not be whether the substantial normative claims asserted by the constructivist have some elements, which are not constructed, but real, given (...) independently from us; instead, my concern will be more narrowly epistemic – whether those claims can be derived from premises, which are normatively less substantial than the normative conclusions themselves. I focus on Korsgaard’s transcendental articulation of the constitutivist argument. I conclude that more work would need to be done, in order for this argument to function as intended. (shrink)
