This article addresses the relationship between ontology and politics in Jean-Luc Nancy’s theory of democracy by probing the implications of his latest ontological innovation, the concept of struction. We argue that Nancy’s democracy is a mode of politics that makes the radical pluralism of struction legitimate, opening and guarding a political space for the coexistence of the incommensurable. From this perspective, and despite Nancy’s own skepticism about the concept of biopolitics, the notion of struction opens a pathway for theorizing democracy (...) in a biopolitical key as the regime of coexistence of radically incommensurable forms of life in the absence of any coordinating principle. We nonetheless take issue with Nancy’s prescription for democracy to remain devoid of any political affirmation of its own. One way to characterise the difference between analytic and Continental political philosophy concerns the different roles played by normative and descriptive analysis in each case. This article argues that, even though Michel Foucault’s genealogy of liberal and neoliberal governmentality and John Rawls’s political liberalism involve different articulations of normative and descriptive concerns, they are complementary rather than antithetical to one another. The argument is developed in three stages: first, by suggesting that Foucault offers a way to conceive of public reason (...) as a historical phenomenon. Second, it is suggested that both Rawls and Foucault allow us to consider rights as historical and particular rather than a-historical and universal. Third, it is argued that Foucault’s genealogy of modern liberal government illuminates some of the tensions and some of the alternatives within the liberal tradition in relation to the concept of political legitimacy. This essay argues that whereas ‘analytic’ political philosophy is focussed on generating reasons that are oriented to the issue of articulating norms of justice, legitimacy and so on, that guide political judgements about institutions and/or forms of conduct; ‘Continental’ political philosophy is oriented to critically assessing the practices of reasoning that characterise our social and political institutions and forms of conduct as well as our first-order normative reflection on them. Setting out from the work of Jean-Luc Nancy, this article engages with post-Heideggerian thought on community, seeking to bring out and to enhance its political thrust for contemporary democracies. It shows how Jean-Luc Nancy, Roberto Esposito and Giorgio Agamben, ‘common the political’, that is, how they reconsider politics in light of a fundamental sense of co-existence which clears the ground for social openness, solidarity, plurality and autonomy. It then responds to a series of pertinent objections by further politicizing the post-Heideggerian (...) vision of the common. I set out to translate the ontologies of the common into more concrete political logics by relating them to actual political practices and by joining them to the political theory of hegemony and antagonism set out by Ernesto Laclau and Chantal Mouffe. Their conjunction of the ‘common’ with the antagonistic politics of hegemony is tension-ridden, as they draw from conflicting understandings of ‘the political’, pitting plurality and horizontal relations against division and uneven power. To mitigate that conflict, these two approaches should be situated at different sites of political action, and the hegemonic framework should be recast so as to bring it more into line with horizontalist ‘common’ politics. Immigration restrictions violate the prima facie right of potential immigrants not to be subject to harmful coercion. This prima facie right is not neutralized or outweighed by the economic, fiscal, or cultural effects of immigration, nor by the state’s special duties to its own citizens, or to its poorest citizens. Nor does the state have a right to control citizenship conditions in the same way that private clubs may control their membership conditions.

What today divides analytical from Continental philosophy? This paper argues that the present divide is not what it once was. Today, the divide concerns the styles in which philosophers deal with intellectual problems: solving them, pressing them, resolving them, or dissolving them. Using ‘the boundary problem’, or ‘the democratic paradox’, as an example, we argue for two theses. First, the difference between most analytical and most Continental philosophers today is that Continental philosophers find intelligible two styles of dealing with problems (...) that most analytical philosophers find unintelligible: pressing them and resolving them. Second, when it comes to a genuine divide in which not understanding the other side’s basic philosophical purposes combines with disagreement on fundamental questions of doctrine, the only such divide today is that between those analytical philosophers who tend to solve problems and those Continental philosophers who tend to press problems. It is among these subgroups that there is a real philosophical divide today. So the analytical–Continental divide is more a matter of style than of substance; but as we try to show, differences in style shape differences over substance. (shrink)
