Is there any reason to discriminate among the rival claims self-proclaimed conservatives make for being truly conservative? This article argues that at least some of these claims can legitimately be dismissed by an independent third. Drawing on and critically interrogating the theories of conservatism provided by Huntington, Oakeshott, as well as Brennan and Hamlin, this article argues that many characterizations of conservatism mistake contingent circumstances explaining why people historically were or conceivably might be reluctant to promote social change for a (...) fully-formed conservative ideology. Not least, risk- and uncertainty-centred accounts, which have gained in popularity as of recently, constitute no viable basis for plausible claims to being truly conservative. Rather than specifying what it takes to be a true conservative, these accounts provide a formalized description of one kind of contingent circumstances that may lead a principled non-conservative to adopt conservative political attitudes. In his recent book Against Liberalism, philosopher John Kekes argued that liberalism as a political system is doomed to failure by its internal inconsistencies. In this companion volume, he makes a compelling case for conservatism as the best alternative. His is the first systematic description and defense of the basic assumptions underlying conservative thought. Conservatism, Kekes maintains, is concerned with the political arrangements that enable members of a society to live good lives. These political arrangements are based on skepticism about (...) ideologies, pluralism about values, traditionalism about institutions, and pessimism about human perfectibility. The political morality of conservatism requires the protection of universal conditions of all good lives, social conditions that vary with societies, and individual conditions that reflect differences in character and circumstance. Good lives, according to Kekes, depend equally on pursuing possibilities that these conditions establish and on setting limits to their violations. Attempts to make political arrangements reflect these basic tenets of conservatism are unavoidably imperfect. Prospect theory is an alternative theory of choice under conditions of risk, and deviates from expected utility theory by positing that people evaluate choices with respect to gains and losses from a reference point. They tend to overweight losses with respect to comparable gains and engage in risk-averse behavior with respect to gains and risk-acceptant behavior with respect to losses. They also respond to probabilities in a non-linear manner. I begin with an overview of prospect theory and some of the (...) evidence upon which it is based, and then consider some of the implications of the theory for American politics, international relations, and the law.
