Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the (...) social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." In this book, Bryan W. Van Norden examines early Confucianism as a form of virtue ethics and Mohism, an anti-Confucian movement, as a version of consequentialism. The philosophical methodology is analytic, in that the emphasis is on clear exegesis of the texts and a critical examination of the philosophical arguments proposed by each side. Contrary to what several prominent scholars contend, a number of important early Confucians ground their ethical claims by appealing to the authority of tian, Heaven, insisting that Heaven endows human beings with a distinctive ethical nature and at times acts in the world. This essay describes the nature of such appeals in two early Confucian texts: the Lunyu (Analects) and Mengzi (Mencius). In support of the thesis that virtue ethics allows for a more comprehensive and consistent interpretation of the "Analects" than other possible models, the author uses a structural outline of a virtue ethic (derived from Alasdair MacIntyre's account of the Aristotelian tradition) to organize a discussion of the text. The resulting interpretation focuses attention on the religious aspects of Confucianism and accounts for aspects of the text that are otherwise difficult to explain. In addition, the author argues that the structural (...) similarities between the Aristotelian and Confucian conceptions of self-cultivation indicate a dimension of commensurability between the two traditions, despite very real variations in specific content. Scholars of early Chinese philosophy frequently point to the nontranscendent, organismic conception of the cosmos in early China as the source of China's unique perspective and distinctive values. One would expect recent works in Confucian ethics to capitalize on this idea. Reviewing recent works in Confucian ethics by P. J. Ivanhoe, David Nivison, R. P. Peerenboom, Henry Rosemont, and Tu Wei-Ming, the author analyzes these new studies in terms of the extent to which their representation of Confucian ethics reflects and (...) is consistent with the view that in early China the cosmos was conceived to be organismic, nontranscendent, and nondualistic. Several scholars have recently proposed that Confucianism should be regarded as a form of virtue ethics. This view offers new approaches to understanding not only Confucian thinkers, but also their critics within the Chinese tradition. For if Confucianism is a form of virtue ethics, we can then ask to what extent Chinese criticisms of it parallel criticisms launched against contemporary virtue ethics, and what lessons for virtue ethics in general might be gleaned from the challenges to Confucianism in particular. This (...) paper undertakes such an exercise in examining Han Feizi, an early critic of Confucianism. The essay offers a careful interpretation of the debate between Han Feizi and the Confucians and suggests that thinking through Han Feizi's criticisms and the possible Confucian responses to them has a broader philosophical payoff, namely by highlighting a problem for current defenders of virtue ethics that has not been widely noticed, but deserves attention. This paper argues that a comparative study of the idea of a sense of justice in the work of John Rawls and the early Chinese philosopher Kongzi is mutually beneficial to our understanding of the thought of both figures. It also aims to provide an example of the relevance of moral psychology for basic questions in political philosophy. The paper offers an analysis of Rawls’s account of a sense of justice and its place within his theory of justice, focusing on (...) the features of this capacity and how it develops. It then provides an account of the sense of justice in Kongzi’s thought as it is seen in the Analects. Finally, it shows how examining the similarities and differences between the two accounts can deepen our understanding of both views, as well as our appreciation for the importance of understanding how a sense of justice develops. This dissertation examines the philosophy of the early Chinese Confucian thinker Xunzi . With his focus on good traits of character such as "benevolence," and on moral paragons such as the "sage, " there is a strong similarity between Xunzi's thought and the contemporary Western philosophical movement known as "virtue ethics." In this work, I investigate the extent to which Xunzi can be understood as espousing a form of virtue ethics, as a way of applying to his writings revealing new (...) interpretive tools, and as a way of showing how he may have something to contribute to current philosophical debates. To do so, I first articulate an interpretation of virtue ethics based on the work of John McDowell, R. Jay Wallace, and Jonathan Dancy. The three most significant features of this model are the ideas that proper moral judgment is not codifiable, that such judgment is instead best understood as analogous to the cultivated expertise of a connoisseur, and that the sort of reasoning in which the moral connoisseur engages is a kind of constitutive or specificationist reasoning. I then argue that Xunzi shares these three views in relation to the highest moral standard in his ethical system, the Dao, and that therefore he can be regarded as presenting a form of virtue ethics. Next, using the topic of the unity of virtue as an organizing theme, I analyze Xunzi's conception of virtue in order to highlight the distinctively Confucian features of his version of virtue ethics. Finally, I argue that the way Xunzi combines a belief in the uncodiliability of proper moral judgment with a strong emphasis on ritual can provide contemporary virtue theorists with a helpful example for thinking about problems of social co-ordination and moral education, as well as how to effect an accommodation between their conviction, on the one hand, that right action is not reducible to a set of principles and people's need for specific practical guidance, on the other. In his A Theory of Justice, John Rawls suggests that a society's notion of justice informs its distribution of rights, obligations, and goods. For him, "justice as fairness" ensures that the principles dictating this distribution be agreed upon fairly. I will argue that there is no exact parallel in the Chinese tradition to what Rawls is calling "justice as fairness." Instead, we see serving a similar purpose an emphasis on the regulation of harmonious processes within the body of society. This (...) can be seen in the use of the Chinese word zhi (ÖÎ) to refer both to governing and to healing. In this sense, Chinese ideas about justice seem to come closer to Plato than to Rawls. This dissertation examines ethical theory and its relationship to tradition in the philosophical writings of Xunzi, a Chinese philosopher of the fourth century B. C. We begin by placing Xunzi's writings in the context of the ethical debates occurring in the early Chinese philosophical tradition. Within this tradition, Xunzi's writings constitute the last and most sophisticated defense of Confucian moral cultivation against various challenges, both internal and external to Confucianism. After explaining the context in which Xunzi writes, we develop an (...) interpretation of Xunzi's ethical theory. Xunzi's ethical theory includes a conception of human nature, a theory of moral psychology, and an understanding of moral cultivation. When woven together, these elements create a theory that explains not only the synchronic aspects of moral agency, but also the diachronic aspects as well. Further exploring the diachronic aspects of moral agency, the last section of the dissertation examines Xunzi's use of craft metaphors to describe the relationship between tradition and ethics in his theory. Tradition and the mechanisms for transmitting ethical knowledge from generation to generation are an integral and necessary component of Xunzi's ethical theory. Without understanding the interrelationship of these various elements of Xunzi's philosophy we fail to fully appreciate his ethical theory. (shrink)
