Despite tendencies to compete for a prime place in moral theory, neither virtue ethics nor the four principles approach should claim to be superior to, or logically prior to, the other. Together they provide a more adequate account of the moral life than either can offer on its own. The virtues of principlism are clarity, simplicity and (to some extent) universality. These are well illustrated by Ranaan Gillon’s masterly analysis of the cases he has provided. But the vices of this (...) approach are the converse of its virtues: neglect of emotional and personal factors, oversimplification of the issues, and excessive claims to universality. Virtue ethics offers a complementary approach, providing insights into moral character, offering a blend of reason and emotion, and paying attention to the context of decisions. The cases provided can be more adequately understood if we combine the approaches. Both should foster the virtues of humility and magnanimity. (shrink)

Despite its authors’ intentions, the four principles approach to medical ethics can become crudely algorithmic in practice. The first section sets out the bare bones of the four principles approach drawing out those aspects of Beauchamp and Childress’s Principles of biomedical ethics that encourage this misreading. The second section argues that if the emphasis on the guidance of moral judgement is augmented by a particularist account of what disciplines it, then the danger can be reduced. En el inacabable debate sobre el positivismo jurídico, hay quien ha propuesto un retorno a los orígenes del positivismo anglosajón, es decir, a Hobbes, Bentham y Austin. Para quienes defienden esto, las tesis positivistas no pretenden ser conceptuales ni descriptivas sino normativas o prescriptivas, es decir que formulan cómo deberían ser los sistemas jurídicos. Tal carácter prescriptivo no se fundamenta en los beneficios que dicho modelo produce a la ciencia jurídica o en que se logre una descripción mejor de la (...) realidad jurídica, sino en razones morales y políticas. De ahí la denominación de ‘positivismo ético’. Se expone la teoría de la interpretación del positivismo ético , desde la obra del iusfilósofo australiano Tom Campbell, quien ha defendido con más empeño la vuelta a un positivismo de este género. El reconocimiento, en tanto que constitutivo de la subjetividad, es una necesidad básica tanto de las personas como de los Estados. Los términos de relación internacional impuestos por buena parte de los organismos internacionales de crédito y comercio niegan y socavan este reconocimiento a través de políticas que generan exclusión y pobreza en los países más pobres. La ruptura de esta lógica se presenta como un camino que posibilita el surgimiento de condiciones de justicia global basadas en términos de reconocimiento (...) recíproco. Un argumento prudencial oficia como primer paso en este proceso, el beneficio a medio y largo plazo sería la motivación racional para que los organismos internacionales generasen una apertura que permitiese asegurar el reconocimiento recíproco. Sin embargo, este argumento no es suficiente y el objetivo de una inclusión radical que afecte a todas las regiones del planeta requiere un argumento moral basado en la idea de igual dignidad inherente a toda persona. La justicia global y su contraparte de justicia local solamente serán posibles a través de una conjunción de estos dos argumentos que habilitarían la instalación de una lógica de reconocimiento recíproco como posibilitante de la justicia. It is always great good fortune for an author to have his writings meet with a receptive circle of readers who take them up in their own work and clarify them further. Indeed, it may even be the secret of all theoretical productivity that one reaches an opportune point in one's own creative process when others' queries, suggestions, and criticisms give one no peace, until one has been forced to come up with new answers and solutions. The four essays collected (...) here, in any event, jointly represent an ideal form of such a challenge: I am now compelled to make further theoretical developments and clarifications that lead me to a whole new stage of my own endeavours, well beyond what I initially had in mind in The Struggle for Recognition . For this reason, I will not concentrate here on interpretative issues regarding my earlier work but will instead take up the problems and challenges that have occasioned several revisions on my part. For this reason, it makes sense to begin (in section I) with the points that Carl-Göran Heidegren makes, in terms of a history of social theory, regarding my proposed theory of recognition. The issues that still motivate me today can best be expressed via an engagement with the conscientious interpretations he offers. The core of this rejoinder is based on Heikki Ikäheimo's and Arto Laitinen's suggestions and corrections, which they have used to develop my initial approach further, to the point where the theoretical outlines of a precise and general concept of recognition come into view. It is primarily these two contributions that helped me develop a productive elaboration of my originally vague intuitions (section II). By way of conclusion (in section III), I take up the penetrating questions raised by Antti Kauppinen regarding the use of the concept of recognition in the broader context of social criticism; he has compelled me to take on several extremely helpful clarifications, and they give me the opportunity, in conclusion, to summarize my overarching intentions. El presente artículo se ocupa del problema de si existen formas de reconocimiento moral y social caracterizables como ideológicas, analizando qué propiedades de tales modos de reconocimiento justifican tal calificación. Pretende, además, articular un criterio que permita dirimir normativamente entre formas ideológicas y no ideológicas de reconocimiento. Este criterio será puesto a prueba en el análisis crítico de discursos actuales que reivindican el carácter de reconocimiento social para recientes transformaciones del mercado laboral en el mundo desarrollado.

In the course of the last 30 years, feminist theories of gender have shifted from quasi-Marxist, labor-centered conceptions to putatively ‘post-Marxist’ culture-and identity-based conceptions. Reflecting a broader political move from redistribution to recognition, this shift has been double edged. On the one hand, it has broadened feminist politics to encompass legitimate issues of representation, identity and difference. Yet, in the context of an ascendant neoliberalism, feminist struggles for recognition may be serving less to enrich struggles for redistribution than to displace (...) the latter. Thus, instead of arriving at a broader, richer paradigm that could encompass both redistribution and recognition, feminists appear to have traded one truncated paradigm for another – a truncated economism for a truncated culturalism. This article aims to resist that trend. I propose an anaysis of gender that is broad enough to house the full range of feminist concerns, those central to the old socialist-feminism as well as those rooted in the cultural turn. I also propose a correspondingly broad conception of justice, capable of encompassing both distribution and recognition, and a non-identitarian account of recognition, capable of synergizing with redistribution. I conclude by examining some practical problems that arise when we try to envision institutional reforms that could redress gender maldistribution and gender misrecognition simultaneously. (shrink)
