In this article, we present an analysis of defeasible generalizations -- generalizations which are essentially exception-laden, yet genuinely explanatory -- in terms of various notions of privileged conditions. We argue that any plausible epistemology must make essential use of defeasible generalizations so understood. We also consider the epistemic significance of the sort of understanding of context that is required for understanding of explanatory defeasible generalizations on any topic.

Modifying a contrast introduced by Dixon, Stephen Mumford distinguishes between ‘partisan’ and ‘purist’ ways of watching sport. Recognising that the extreme partisan and extreme purist positions do not explain the nature of sports spectatorship, Mumford follows Dixon in adopting the idea of moderate partisanship. He outlines three theories of spectatorship designed to address the issue of the relationship between the partisan and the purist ways of viewing sport. The true perception theory regards the moderate fan as able to see the (...) event as it really is, rather than concentrating on an aspect. The mixture theory is the view that ‘the moderate partisan has both partisan and purist perceptions of sport in some mixed way’. The oscillation theory, which Mumford favours, holds that the moderate sports fan switches or oscillates between competitive and aesthetic ways of watching sport... (shrink)

Beginning from an earlier claim of mine that there was really no such area of study as the philosophy of sport, Part One of the paper reconsiders the place previously given to David Best’s distinction between purposive sports and aesthetic sports. In light of a famous cricketing event in the 1977 contest between England and Australia (‘The Ashes’), in which Derek Randall turned a cartwheel after taking the winning catch, the paper clarifies that not all aesthetically-pleasing events taking place in (...) sporting competitions can be understood as the aesthetic in sport. Then, in Part Two, the force of the claim that philosophy is one subject is explored. The conclusion is that a focus just on the philosophy of sport is necessarily inappropriate, since it will present the student with only cases from sport to then apply to sport. Rather, one’s understanding must be informed by (much of) the breadth of philosophy. Charles Travis’s view of occasion-sensitivity provides a clear example of appropriately contextual appeal. Part Three of the paper returns to the need for an institutional account of sport, one recognizing that there is no one occasion on which a particular sport is played; and hence no single set of conditions which can uniquely identify that sport. Thus, soccer played with one’s children typically differs from elite soccer: but both are (genuinely) soccer. When one turns to the appreciation of sport (in the light of Stephen Mumford’s excellent Watching Sport: Aesthetics, Ethics and Emotion [2012a]), one recognizes that, in order to genuinely appreciate sport, one cannot detach oneself from the outcome as completely as Mumford’s extreme purist seems to. But reflection on that case may also return us to contextualism by moving us away from attachments to the complete or the exceptionless in our accounts of spectating as of sport: maybe there is no one thing that occurs in all the relevant cases. This paper explores the view that, on Mumford’s account of the purist, to the degree that the purist adopts an aesthetic perspective, he or she doesn’t watch the sport in question, and to the degree that he or she does watch the sport, there is a loss of aesthetic appreciation. The idea that spectators oscillate between partisanship and purism means that the purist is unable to avoid either the Scylla of not actually watching the sport, or the Charybdis of loss (...) of aesthetic appreciation at any given point. Ultimately there seems to be both a sport-shaped hole and an aesthetic-shaped hole in Mumford’s account of the purist. It is argued that oscillation is incapable of dealing with the problem precisely because it is disjunctive in nature and entails the spectator either watching sport from an aesthetic perspective or from a partisan perspective at any given time. An alternative conception of the aesthetic is considered that offers one way of dissolving the purist’s dilemma. (shrink)

This article is concerned with the role of moral principles, specifically the Fundamental Principles of Olympism, in the judgements of the International Olympic Committee (IOC) on matters of performance enhancement. The article begins with two pairs of distinctions, that between moral judgements and morally-laden judgements, and that between the moral judgement of cases and the ethical environment of a society. The article is concerned with working through the implications of those distinctions in the context of the IOC's judgements on performance (...) enhancement. The article favours a particularist account of the moral judgement of cases, while preserving a place for meaningful general moral statements as contributions to the ethical environment of a society, but not as general action-guiding statements or principles that can be applied to judgements in specific cases. The article illustrates the implications of this conclusion in the context of the decision-making of the IOC on performance enhancement (the case of Alain Baxter is considered). It is argued that there is a danger of the decision-making of the IOC suffering deep confusion over the difference between general and particular statements, the nature of reasons and the logic of what it is to apply a general action-guiding statement. Although football is often referred to as ‘the beautiful game’, to take that idea very seriously — by aestheticizing the target of spectating — is to misunderstand a purposive sport such as football. Yet such a view seems required by Stephen Mumford’s endorsement of the purist spectator, in contrast to the partisan, as attending to ‘… only aesthetic aspects of sport’. But, first, not all non-purposive appreciation is thereby aesthetic appreciation, as Mumford assumes. And, second, while a technical understanding of (...) the aesthetic includes both positive and negative aesthetic concerns, an everyday version addresses only positive aesthetic value. Now, there are concepts of grace, line and so on, applicable to football: that is, concepts suitable to aesthetic appreciation. And sometimes, for instance, in TV’s ‘Goal of the Month’ competition, such appreciation sets aside the purposive dimension of such sports. Yet that dimension is fund.. (shrink)

Stephen Mumford argues that positive aesthetic value is a by-product of both sport and art, and that the principal aim of the artist and the player or athlete could not be to produce positive aesthetic value. Three features of Mumford’s by-product argument are considered. It is argued that problems arise as a result of failure to appreciate Best’s distinction between the evaluative and conceptual uses of ‘aesthetic’, the nature of the descriptions Mumford gives of the intention of the artist in (...) making art and the necessary implicit premises in the argument. There is, therefore, reason to think that Mumford has not established that sport and art are in the same position in the ways in which their aims relate to aesthetic values, nor that the by-product argument can form part of a counter to Best’s position. The paper highlights the centrality of some concepts from philosophy of sport for philosophical aesthetics. Once Best conclusively answered negatively the fundamental question, ‘Can any sport-form be an artform?’, what further issues remained at the intersection of these parts of philosophy? Recent work revitalizing this interface, especially Mumford’s Watching Sport, contested Best’s fundamental distinction between purposive and aesthetic sports, and insisted that purist viewers are taking an aesthetic interest in sporting events. Here, we defend Best’s conception against considerations Mumford hoped (...) would bring the aesthetics of art and sport closer together, thereby elaborating the aesthetics of sport. But, against Mumford’s resolutely psychological conception of an aim, we follow Best to defend the centrality, for purposive sports, of the means/ends contrast even when taking an aesthetic interest in such sports. This paper builds on a previous discussion of Stephen Mumford’s rejection of what he takes to be David Best’s argument for a distinction between purposive and aesthetic sports. That discussion concluded that Mumford’s argument misses its target, but closed by introducing a possible alternative argument, not made by Mumford, that might be thought to have the potential to secure Mumford’s conclusion. This paper considers that alternative argument, namely, the thought that the ascription of psychological predicates conceived of in terms of (...) defeasible criteria that constitute logically good evidence could preserve Best’s claim to be making a logical point while allowing a place for intention in relation to aims and purposes in sport. It is argued that the relationship between rules and intention is such that this alternative argument cannot secure Mumford’s conclusion. (shrink)
