This article examines the view of forgiveness expounded in the classical Jewish sources. It is shown that traditional rabbinic authorities regarded the duty of one individual to forgive another as conditional upon the repentance of the offender, who has a prior duty to seek forgiveness from the person harmed. These same authorities appear to have extended the duty to forgive, in theory at least, to all offenses regardless of their severity. The religious underpinnings of this view are explored and contrasted (...) with the model of forgiveness presented in Paul Lauritzen's paper. The author concludes that the Judaic view of forgiveness as a moral imperative has been shaped decisively by the beliefs in a compassionate God whom we have a duty to emulate and in the special cove- nantal relationship established between this God and Israel. To forgive a person for a wrong he has done has often been valued as morally good and as indicative of a benevolent and merciful character. But while forgiveness has been recognized as valuable its nature as a moral response has largely been ignored by modern moral philosophers who work outside the confines of a religious context. 1 Where it has been discussed, forgiveness has been thought particularly difficult to define, and some have thought the forgiving response paradoxical or even (...) impossible. I shall discuss some of these difficulties and suggest firstly that the value of forgiveness lies in the fact that it essentially requires a recognition of the wrongdoer's responsibility for his action, and secondly that forgiveness typically involves an effort on the part of the one wronged: a conscious attempt to improve oneself in relation to the wrongdoer. A theory of punishment should give some account of mercy and yet it is true to say that very little has been said about it at all. It is commonly regarded as a praiseworthy element in moral behaviour—something to be practised occasionally both for the good of the one who punishes and the one who is punished. The suffering that punishment involves is unpleasant for all concerned, and if it is possible to avoid it or lessen it without moral injustice, (...) then it is desirable to do so. We condemn as hard and unbending the judge who never shows mercy and the suggestion is that the poor unfortunates whose lot it is to be judged by him are poor unfortunates indeed. This is reflected in the fact that the opposite of merciful—merciless—means cruel. Presumably there are occasions when it is appropriate to show mercy to an offender, and other occasions when it is not. What are the conditions for the appropriate exercising of mercy, how do we decide how much mercy is appropriate, and when is a judge morally obliged to be merciful, if ever? (shrink)

Good reasons to forgive typically divorce act from agent so that there is nothing in the agent to be forgiven. Forgiving on the basis of good reasons that show the wrongdoer deserves forgiveness is thus minimalist because nonelective. Genuine, or aspirational, forgiveness requires forgiving agents for unexcused, unjustified, and unrepented wrongdoing. The primary obstacle to aspirational forgiveness is that we cannot make sense of persons choosing evil. Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition. This reissue makes the first edition once again available for scholars and serious students of Rawls's work.

Since it appeared in 1971, John Rawls's A Theory of Justice has become a classic. The author has now revised the original edition to clear up a number of difficulties he and others have found in the original book. Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the (...) social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." Advancing the ideas of Rousseau, Kant, Emerson, and Lincoln, Rawls's theory is as powerful today as it was when first published. (shrink)

According to a long theological tradition that stretches back at least as far as St Augustine, God's justice and mercy are distinct, and in many ways quite different, character traits. In his great epic poem, Paradise Lost, for example, John Milton goes so far as to suggest a conflict, perhaps even a contradiction, in the very being of God; he thus describes Christ's offer of himself as an atonement this way.

This book focuses on the degree to which certain moral and legal doctrines are rooted in specific passions that are then institutionalised in the form of criminal law. A philosophical analysis is developed of the following questions: when, if ever, should hatred be overcome by sympathy or compassion? What are forgiveness and mercy and to what degree do they require - both conceptually and morally - the overcoming of certain passions and the motivation by other passions? If forgiveness and mercy (...) indeed are moral virtues, what role, if any, should they play in the law? (shrink)

There appear to be a number of general things which can be said about forgiveness. If these are left sufficiently vague they seem to be applicable to all the situations in which the term is used.First, there can be no question of forgiveness unless an injury has been inflicted on somebody by a moral agent. There must be something to forgive; and the injury that is to be forgiven must be one for which a moral agent can be held responsible. (...) One cannot forgive a rock for falling on one's foot or a cougar for attacking one's child—even though a child might kick the rock and a father might shoot the cougar. (shrink)

I have no comment to make on the aesthetic merits of these verses. I have put them at the head of my discussion because they happen to introduce a cluster of concepts connected with forgiveness: pride, love, hate, God, friendship, goodwill, eternity, offence, condemnation, resentment, blame. We may think that some, but not all, of these have essential connections with the concept in which we are interested. And we may, of course, think that the list is incomplete. Other obvious candidates (...) spring to mind: pity, for example, repentance, compassion, punishment and pardoning. (shrink)
