Christine Korsgaard has become one of the leading interpreters of Kant's moral philosophy. She is identified with a small group of philosophers who are intent on producing a version of Kant's moral philosophy that is at once sensitive to its historical roots while revealing its particular relevance to contemporary problems. She rejects the traditional picture of Kant's ethics as a cold vision of the moral life which emphasises duty at the expense of love and value. Rather, Kant's work is seen (...) as providing a resource for addressing not only the metaphysics of morals, but also for tackling practical questions about personal relations, politics, and everyday human interaction. This book follows hard upon Korsgaard's The Sources of Normativity. Both present the author's influential version of a Kantian theory of normative ethics and metaethics. Whereas The Sources of Normativity was a systematic investigation of "normativity" written as a single unit, the present volume is a collection of previously published papers, some of them already well known and much discussed, dating between 1983 and 1993. By the nature of the case, one might expect less thematic unity in this book than (...) in the other one, but the present book is a deeper and more wide ranging presentation of the author's views. Korsgaard's historical focus in The Sources of Normativity is less on Kant and more on the British moralists. Creating the Kingdom of Ends deals quite explicitly with the interpretation of Kant's moral philosophy. The papers in this book contain, in my judgment, the heart of Korsgaard's work: a variety of fresh and illuminating insights into Kant's moral theory and its relation to contemporary ethical theory which have helped to reshape the image of Kant's ethics and to refocus the issues dealt with in current moral philosophy. Or to make claims less grand but of more immediate relevance to this review, there is no question that some of the papers in this book have helped to reshape both the present writer's image of Kant's ethics and his conception of the way questions of ethical theory should be addressed. I hope below to say something both about where I think Korsgaard has gotten these matters right, and where I find her position either unclear or dubious. (shrink)

Der Aufsatz behandelt den Zusammenhang zwischen Recht, Ethik und Moral in der MdS. Ausgangspunkt ist der Befund, daß Kants System der Pflichten in der MdS weder konsistent noch vollständig ist, weil Rechts- und Tugendpflichten, entgegen Kants Annahme, den Bereich der moralischen Pflichten nicht erschöpfen . Kants System der Pflichten beruht auf den Unterscheidungen zwischen Recht und Ethik und zwischen Legalität und Moralität. Letztere konzipiert Kant in der MdS anders als in früheren Werken, indem er sie nun auf die beiden Arten (...) der "Gesetzgebung" in Recht und Ethik und die daraus entspringenden Gesetze zurückführt . Im Zusammenhang mit der "ethischen" Gesetzgebung ergibt sich das Problem, wie es ethisch geboten sein kann, aus Pflicht zu handeln . Analog dazu stellt sich mit Blick auf die "juridische" Gesetzgebung die Frage, warum man befugt ist, andere zu rechtlichem Handeln zu zwingen. Handelt es sich um eine moralische oder eine spezifisch rechtliche Befugnis? Es zeigt sich, daß Kant zwei unvereinbare Auffassung miteinander verbindet: Aus seiner "offiziellen" Auffassung, wonach das Recht ein Teil der Moral ist, würde folgen, daß die Zwangsbefugnis im Recht moralisch gerechtfertigt werden kann. Tatsächlich ist eine solche Rechtfertigung aber nicht möglich, die "offizielle" Auffassung also unzureichend. Kant greift in der MdS aber auch mehrfach auf eine "alternative" Auffassung zurück, der zufolge das Recht als eine eigenständige Form autonomer Gesetzgebung neben der Moral steht . Dieser alternativen Auffassung zufolge, die der "offiziellen" insgesamt überlegen ist, würde die "Rechtslehre" also gar nicht in die Metaphysik der Sitten gehören. (shrink)

As such the book offers insights to a wider audience than that of sinologists or Chinese historians. The important distinction made by the author is between image makers and eyewitnesses. Whole categories of powerful image makers, both Chinese and foreign, never saw anything of the Boxer War but were responsible for (...) disseminating images of that war to millions of people in China and throughout the world. Such not merely historical interest it can only have for those of us who still regard metaphysics as a viable enterprise. Thus some discussion of the past and future of the metaphysical enterprise may provide a useful background for the studies of Leibniz’s thought in the other contributions to this issue of The Monist. Kants Metaphysische Anfangsgründe der Rechtslehre galten seit ihrem Erscheinen 1797 als mehr oder weniger verunglücktes Alterswerk. Bernd Ludwigs Untersuchung beansprucht dagegen, in ihrem ersten Teil den Nachweis zu führen, daß der problematische Zustand der Schrift nicht etwa den nachlassen den Geisteskräften des Autors zuzuschreiben ist, sondern sich vielmehr einer verunglücken Drucklegung verdankt: Zum Druck gelangte ein Manuskript, in dem nicht nur einzelne Textpassagen falsch angeordnet waren, sondern das auch Vorarbeiten enthielt, die für den Druck gar nicht vorgesehen waren. Anhand von (...) philologischen Indikatoren läßt sich eine Version rekonstruieren, die der von Kant intendierten Textgestalt weitgehend entspricht, ihr zumindest aber wesentlich näher kommt als der Druck von 1797. Im zweiten Teil wird in Gestalt eines analytischen Kommentars feingliedrig die Kantische Argumentation rekonstruiert und auf diesem Wege aufgezeigt, daß das wiederhergestellte Werk tatsächlich die über dreißig Jahre währende Arbeit Kants an seiner Rechtsphilosophie erfolgreich zum Abschluß gebracht hat. Spuren nachlassender Geisteskräfte sind dabei nicht auszumachen. Vielmehr erweist sich Kant als Autor, der traditionelle Lehrstücke des Naturrechts souverän an seine kritische Grundlegung der praktischen Philosophie anschließt. (shrink)
