Durante algún tiempo el problema de la fundamentación de lo moral atrajo la atención de los éticos. Hoy en día, el «giro aplicado » sufrido por la filosofía afecta en primer término a la ética y le pide orientaciones, aunque mediatas como es propio de la filosofía, para organizar la vida en las distintas esferas de la vida social. Este cambio exige ante todo aclarar cuál debe ser el proceder de la ética aplicada , si existen principios comunes a sus (...) distintos ámbitos o constituyen reinos de taifas, cuáles son los principios, hábitos y valores que cada esfera exige para moralizarse, en el sentido de Ortega, qué métodos son adecuados para la toma de decisiones.Estas exigencias están ya en la calle y piden interdisciplinariedad. No intentar responder a ellas es reconocer, frente a la pretensión originaria, que a la filosofía no le importa la vida, no le importa sí los seres humanos viven bien. (shrink)

El presente artículo constituye una reflexión sobre el concepto de sociedad civil, centrado en el debate sobre la idoneidad de integrar los mercados en dicha concepción. Se presenta un total de once tesis, siguiendo el esquema literario, que no político, de las tesis de Marx sobre Feuerbach, con el propósito de fomentar discusiones originales entre losdetractores y defensores de la sociedad civil. A lo largo de estas once tesis se explora el papel que históricamente se le ha atribuido al mercado (...) en la sociedad civil, y se analizanlos motivos por los cuales las visiones actuales de la sociedad civil se basan por lo general en concepciones puristas que excluyen al mercado de dicha esfera. A partir de ahí se argumenta contra estas visiones de sociedad civil que se consideran erróneas por motivos tanto conceptuales como por errores de carácter estratégico. Finalmente, se defiende la necesidad de interpretar el mundo de un nuevo modo y formular nuevas propuestas de cómo los mercados pueden hoy en día ser re-incrustados en la sociedad civil con tal de fomentar la libertad y la igualdad entendidos en términos complejos.This article reflects on the concept of civil society with a focus on the debate over the appropriateness of incorporating markets into its conceptualisation. Eleven theses are presented following the literary, not political, style of Marx’s theses on Feuerbach, aimed to trigger original discussions between the critics and defenders of civil society. Through these eleven theses, the article explores the role historically attributed to the market in civil society, and analyses the reasons why current visions of civil society are generally based on purist conceptions that exclude the market from this sphere. From this point, arguments are made against these visions of civil society, considered to be mistaken for both conceptual motives and strategic-type errors. Finally, the paper defends the need to find a new way of interpreting the world and to formulate new proposals about how markets can be re-embedded in civil society so as to promote the freedom and equality understood in complex terms. El presente artículo aborda lo que se considera que son algunas de las deficiencias de la teoría contemporánea de la sociedad civil. Para ello pasa brevemente revista a la evolución histórica del concepto, y se presenta una selección de sus definiciones contemporáneas. Todas ellas manifiestan una cierta imposibilidad para contemplar la política si no es desde una polarización dualista Estado-Sociedad, que trata de superarse abriéndose el concepto de sociedad civil a una mayor interrelación entre estos dos polos. Asimismo, se afirma (...) que el recurso a la «sociedad civil» sirve para recomponer en el ámbito de la teoría y resolver de un solo golpe dos de las grandes deficiencias que asolan a las relaciones entre sistema político y sociedad: la ausencia de un sujeto unitario claramente delimitado y el déficit de integración normativa. Accounts of international or global justice often focus primarily on the rights or goods to be enjoyed by all human beings, rather than on the obligations that will realise and secure those rights and goods, or on the agents and agencies for whose action obligations of justice are to be prescriptive. In the background of these approaches to international or global justice there are often implicit assumptions that the primary agents of justice are states, and that all other agents and (...) agencies are secondary agents of justice, whose main contribution to justice will be achieved by conforming to the just requirements of states. This background picture runs into difficulties when states are either unjust or weak. The problems posed by unjust states have been widely noted, but the distinctive problems weak states create are less commonly discussed. In this paper I shall consider some reasons for and against viewing states as primary agents of justice, and will focus in particular on the importance of recognising the contribution to justice that other agents and agencies can make when states are weak. Global democratization cannot be achieved by simply replicating familiar democratic institutions on a global scale. We must explore alternative institutional means for establishing democratic institutions at the global level within the present pluralist structure of global power.

In this paper I examine Habermas’ conception of the market in The Theory of Communicative Action (TCA). Habermas’ characterization of the market as norm-free has been controversial and I discuss three objections to it: the claims that it (1) conflates of action types, types of action coordination and spheres of action, (2) cannot account for the normative structure of the social organization of labour, and (3) that it makes impossible to make moral judgments about behaviour in the market. I conclude (...) that while some of these objections are unfounded, we have reason to revise Habermas’ substantive claims about the market. I also stress the importance of distinguishing between the TCA’s methodology and its time-diagnostic thrust. Next, I assess the colonization thesis through a case study of the commodification of higher education. I conclude that this thesis remains plausible, but that it needs to be supplemented with a theory of ideology. (shrink)

If deliberative democracy is to be more than a critique of current practice and achieve the normative goals ascribed to it, its norms must be approximated in practice and combine its two elements, popular deliberation with democratic decision-making. In combining these, we come across a Weberian dilemma between legitimacy and effectiveness. One of the most popular methods for institutionalizing deliberative democracy, which has been suggested, is citizen associations in civil society. However, there has been a lack of precise and detailed (...) discussion about how such a system could link macro deliberations in public spheres with micro and formal decision-making arenas. This paper aims to amend this and offers a dualist model, which ensures that deliberation and decision-making are linked, and an effective balance between the Weberian dilemma is achieved, through the same secondary associations fulfilling both roles. The first part of this strategy focuses on the informal public sphere and its networks and their potential to foster deliberative communication between secondary associations and between these associations and the state that helps transform preferences and set the agenda for decision-making. The second part is mediating forums, organized by quangos, with devolved powers, where representatives from secondary associations assemble to make decisions based upon the norms of deliberative democracy. If deliberative democracy can be approximated in practice then it becomes a more persuasive theory as it means the normative goals attributed to it could actually be achieved, which is why the dualist method is significant. Democratic theorists often place deliberative innovations such as citizen's panels, consensus conferences, planning cells, and deliberative polls at the center of their hopes for deliberative democratization. In light of experience to date, the authors chart the ways in which such mini-publics may have an impact in the “macro” world of politics. Impact may come in the form of actually making policy, being taken up in the policy process, informing public debates, market-testing of proposals, legitimation of public policies, building confidence and (...) constituencies for policies, popular oversight, and resisting co-option. Contending discourses underlie many of the worlds most intractable conflicts, producing misery and violence. This is especially true in the post-9/11 world. However, contending discourses can also open the way to greater dialogue in global civil society and across states and international organizations. L’articolo esamina le qualità della democrazia deliberativa a partire dal ri­ferimento a espressioni storiche di questa: nelle istituzioni ateniesi del quin­to-quarto secolo a. C., nella Convenzione Federale statunitense del 1788, negli Stati Generali della Rivoluzione francese, in varie esperienze lo­cali odierne. Stabiliti tre modelli di democrazia e tre criteri per la deliberazione , la questione da affrontare è se la forma deliberativa di democrazia sia un buon sistema politico. La risposta è sì, purché si verifichino tre con­dizioni: intensità della motivazione (...) nei partecipanti, orientamento al bene pubblico della motivazione stessa, corretta informazione dei partecipanti. Ma si tratta di una conclusione ipotetica, che tiene conto della complessità e molteplicità dei fattori in gioco, e dunque del fatto che nessuna proprietà dei processi decisionali collettivi è desiderabile incondizionatamente.The article reflects upon strengths of deliberative democracy from an historical point of view: beginning with Athens’ institutions , pas­sing through States-General during French Revolution and U. S. Federal Con­vention , finally reaching today’s experience. Having established three different models of democracy and three criteria for the deliberative process , the issue is whether deliberative democracy works well as a po­litical system. We can surely say it does, although under some con­ditions: level of participants’ motivation, actions directed towards well-being and good information. Nevertheless, this is only a hypothetical con­clu­sion: there’s no perfect deliberative process, because of the complexity and plurality of the factors at play. (shrink)
