We all have beliefs, even strong convictions, about what is just and fair in our social arrangements. How should these beliefs and the theories of justice that incorporate them guide our thinking about practical matters of justice? In his book A Theory of Justice, John Rawls introduces and employs the concept of “reflective equilibrium” as a method of testing which of rival moral theories is to be preferred. The introduction of this concept is plainly a significant event for moral philosophy. The criterion by which we decide to reject, say, utilitarianism in favour of a contractual theory of justice is, if anything, even more fundamental than the choice of theory itself, since our choice of moral theory may (...) well be determined by the criterion we use. We all have moral beliefs. But what if one beleif conflicts with another? DePaul argues that we have to make our beliefs cohere, but that the current coherence methods are seriously flawed. It is not just the arguments that need to be considered in moral enquiry. DePaul asserts that the ability to make sensitive moral judgements is vital to any philosophical inquiry into morality. The field of bioethics has deployed different models of justification for particular moral judgments. The best known models are those of deductivism, casuistry, and principlism (under one, rather limited interpretation). Each of these models, however, has significant difficulties that are explored in this essay. An alternative model, suggested by the work of Henry Richardson, is presented. It is argued that specified principlism is the most promising model of justification in bioethics. This chapter begins with a weak understanding of intuitions as beliefs that do not result from more familiar sources, but that the person currently holds simply because the proposition believed seems true to the person upon due consideration. Nearly all moral inquiry makes significant use of moral intuitions. Reflective equilibrium is perhaps the most sophisticated intuitionistic approach to moral inquiry. It modifies the usual understanding of reflective equilibrium by arguing that inquirers must not merely mold their moral intuitions into a (...) coherent system via a process of mutual adjustment, but must also strive to enhance their competence at making moral judgments. It then considers and rejects an argument for the reliability of moral intuitions that takes them to provide evidence regarding our own moral concepts. Finally, it defends reflective equilibrium by arguing that there is no sensible alternative to accepting the intuitions we have after full reflection, which is, in essence, what reflective equilibrium does. Over the last twenty years, John Rawls has developed an approach to political philosophy which appeals to the notion of reflective equilibrium. This notion has proven suggestive to those attracted to coherence approaches to justification, in ethics and in other domains as well. In this paper, I explore the question whether Rawls’s approach provides a model for a coherentist account of justification, concluding that although the discussion of reflective equilibrium has provided helpful insights it has not produced a coherentist model (...) of justification. In a well-known series of articles, Norman Daniels has drawn a contrast between wide reflective equilibrium and a more traditional method of theory acceptance in ethics that would be employed by a sophisticated moral intuitionist. The more traditional method is geared towards achieving a narrow equilibrium, or ‘an ordered pair of a set of considered moral judgments acceptable to a given person P at a given time, and a set of moral principles that economically systematizes.’ Although we might achieve narrow (...) reflective equilibrium by deducing particular moral judgments from self-evident moral principles, the more plausible approach is to start from our particular moral judgments. Here we begin by screening our intial moral judgments to eliminate those in which we have little confidence and those made under circumstances conducive to error. We then search for general moral principles that best account for the remaining ‘considered’ moral judgments. (shrink)

In this commentary, I critically discuss the respective views of Gert and Beauchamp–Childress on the nature of so-called common morality and its promise for enriching ethical reflection within the field of bioethics. Although I endorse Beauchamp and Childress’ shift from an emphasis on ethical theory as the source of moral norms to an emphasis on common morality, I question whether rouging up common morality to make it look like some sort of ultimate and universal foundation for morality, untouched by the (...) dialectics of time and reflective equilibrium, was an equally good move. As for Gert’s magisterial conception of common morality, I conclude that certain elements of his system are controversial at best and woefully inadequate at worst. He has a tendency to find in common morality what he himself put there, and his highly restricted conception of duties of assistance strikes this reader as ad hoc, inadequately defended, and unworthy of a project whose goal is to lessen the amount of misery in the world. The chapter discusses the various ways in which ethical theory and moral practice relate to one another. Various proposals are discussed and evaluated, such as that the relation is a deductive one, that the relation is one of norm-specification, or that the theory provides multiple moral principles that must be balanced against one another.
