Isaiah Berlin's distinction between "negative" and "positive" concepts of liberty has recently been defended on new and interesting grounds. Proponents of this dichotomy used to equate positive liberty with "self-mastery "-the rule of our rational nature over ourpassions and impulses. However, Berlin's critics have made the case that this account does not employ a separate "concept" of liberty: although the constraints it envisions are internal, rather than external, forces, the freedom in question remains "negative" (freedom is still seen as the (...) absence of such impediments). Responding to this development, Berlin's defenders have increasingly tended to identify positive liberty with "self-realization." The argument is that such an account of freedom is genuinely "nonnegative," in that it does not refer to the absence of constraints on action. This essay argues that the claims made on behalf of "freedom as self-realization" cannot withstand scrutiny, and that they fail to isolate a coherent view of liberty that is distinguishable from the absence of constraint. In recent decades, a ‘realist’ alternative to ideal theories of politics has slowly taken shape. Bringing together philosophers, political theorists, and political scientists, this countermovement seeks to reframe inquiry into politics and political norms. Among the hallmarks of this endeavor are a moral psychology that includes the passions and emotions; a robust conception of political possibility and rejection of utopian thinking; the belief that political conflict — of values as well as interests — is both fundamental and ineradicable; a focus (...) on institutions as the arenas within which conflict is mediated and contained; and a conception of politics as a sphere of activity that is distinct, autonomous, and subject to norms that cannot be derived from individual morality. For political realists, a ‘well-ordered society’ is rarely attainable; a modus vivendi without agreement on first principles is often the only practical possibility. Not only will ‘full compliance’ never be achieved, but also it is an assumption that yields misleading accounts of political norms. While realists offer a number of compelling criticisms of ideal theory, there are some lacunae in their stance. It is not yet clear whether realism constitutes a coherent affirmative alternative to idealism. Nor have realists clarified the extent of conflict that is consistent with political order as such. And because both sides accept ‘ought implies can’ as a constraint on the validity of political norms, much of the debate between realists and idealists revolves around deep empirical disagreements that are yet to be clarified. By freedom, classical liberals meant non-interference, independence from the state, the personal and proprietary liberty of the governed. It is negative freedom as the antithesis both to absolutism and anarchy. In the republican interpretations, the freedom of a free political community is made possible and guaranteed by the institutionalization of the liberty of the political community. Political liberty is the medium, stage and precondition for the freedom of its members. That, in turn, is conditional upon the readiness of its members (...) to protect the liberty of their community and themselves, i.e. upon the virtue of the free citizen. In this article I engage with four different interpretations of both kinds of liberty concepts in different discourses of the 20th-century UK and US and 20th—21st-century Hungary. (shrink)

The classical theory of government and citizenship was conceived in terms of virtue and civic equality. Against this, Hobbes derived his individualistic and liberal view of citizenship from the model of the social contract, an idea that still prevails in contemporary theories of justice as fairness. Recent contractarian thought has been concerned to oppose the view that assigns priority to the welfare of groups over the rights and liberties of citizens. The author wants to question, however, whether this thought is (...) justified in its assumption that the best way to secure liberty is to insist that the interference of social duties should be minimised and that this is the fundamental purpose of law. The classical republican tradition, centred upon the ideal of promoting civic virtue, commits citizens to engage themselves in the life of the State. The understanding of citizenship in active and participative terms presupposes public service. Freedom has to be produced, and not merely secured, by law, i.e. by giving shape to the general will of the community, acting as one body. Man, however, being irrational in civic laziness and selfish ambition, one of the goals of the law must be to prevent corruption by coercing the citizen into the performance of those civic duties upon which liberty depends.
