The volume consists of two parts, of which the former describes the two central elements of Locke’s account. First, Sreenivasan explains how he understands Locke’s attempt to show that common ownership of natural resources is consistent with the existence of a procedure whereby private ownership rights can be acquired without universal agreement. Solving this consent problem, Locke construes common ownership as involving merely a right to those conditions necessary for self-preservation. He then argues that where non-appropriators are left with enough (...) to achieve subsistence, unilateral appropriation does not violate such a right. Locke’s sufficiency condition ensures this by requiring that the able-bodied must have access to the relevant production or employment opportunities, while the disabled must be capable of subsisting through charity. John Locke's political theory has been the subject of many detailed treatments by philosophers and political scientists. But The Lockean Theory of Rights is the first systematic, full-length study of Locke's theory of rights and of its potential for making genuine contributions to contemporary debates about rights and their place in political philosophy. Given that the rights of persons are the central moral concept at work in Locke's and Lockean political philosophy, such a study is long overdue.

For all contract theorists, including Kant, political legitimacy is based upon the consent of the governed. The differences amongst them begin to emerge when we inquire into the motivations and considerations which lead up to the agreement. For Kant, consent to the social contract is not based upon considerations of rational self-interest or prudence, nor upon a natural right to self-preservation and the guarantee of absolute property rights, but upon a moral obligation to institutionalize and make peremptory in a social (...) contract property rights that in the state of nature have only a provisional character. Whether this approach ultimately makes the idea of a voluntary agreement superfluous is a question I will address below. First I would like to consider the unique status Kant assigns to property rights in his theory of the social contract. This status has for the most part not been observed in the secondary literature, and Kant has even been accused of falling behind the achievements of Locke and Rousseau by grounding property rights on an element of brute force. However, since Kant himself espoused a labor theory of property rights in his earlier writings, it is important to consider carefully the basis for its subsequent rejection in the Rechtslehre. Further, since Kant’s theory of property rights constitutes an alternative to Locke, it may be possible to find within the contract tradition an alternative to the view of property rights found in some of its contemporary versions. This book discusses Locke's theory of property from both a critical and an interpretative standpoint. The author first develops a comprehensive interpretation of Locke's argument for the legitimacy of private property, and then examines the extent to which the argument is really serviceable in defense of that institution. He contends that a purified version of Locke's argument--one that adheres consistently to the logic of Locke's text while excluding considerations extraneous to his logic--actually does establish the legitimacy of a form of (...) private property. This version, which is both defensible in contemporary, secular terms and is, essentially, egalitarian, should provoke a reassessment of the nature of Locke's relevance to contemporary discussions of distributive justice. The indispensability of the ‘postulate of practical reason with regard to Right’ to Kant's property argument in the Rechtslehre is now widely recognized. However, most commentators continue to focus their attention on the relation between the postulate and the deduction of the concept of intelligible possession. The nature of this relation remains a matter of dispute in part because the precise position of the postulate within chapter one of the Rechtslehre remains undecided. Given this, it is perhaps not surprising that (...) the related question has been neglected, as to why Kant should characterize the postulate of Right as a postulate of practical reason. Yet the fact that he does so is of some significance – especially if one recalls the definition in the Critique of Practical Reason of postulates of practical reason as practically necessary but theoretically indemonstrable propositions. What is of interest about this definition is not just the fact that it designates postulates as practically necessary and as theoretically indemonstrable at the same time – even more intriguing is the intimated relation between practical necessity and theoretical indemonstrability. Kant does not think the postulates' theoretical indemonstrability morally insignificant. To the contrary, their moral significance for us appears to be a function, in part, of their theoretical indemonstrability. (shrink)
