In this article, I summarise the ontological theory of informational privacy (an approach based on information ethics) and then discuss four types of interesting challenges confronting any theory of informational privacy: (1) parochial ontologies and non-Western approaches to informational privacy; (2) individualism and the anthropology of informational privacy; (3) the scope and limits of informational privacy; and (4) public, passive and active informational privacy. I argue that the ontological theory of informational privacy can cope with such challenges fairly successfully. In (...) the conclusion, I discuss some of the work that lies ahead. (shrink)

It is sometimes suggested thatthere is no conception of privacy in Japan orthat, if there is, it is completely differentfrom Western conceptions of privacy. If thiswere so, finding common ground between Japanand the West on which to establish privacypolicies for the internet would be extremelydifficult if not impossible. In this paper wedelineate some of the distinctive differencesin privacy practices in Japan, but we maintainthat these differences do not prevent theestablishment of sound, shared, ethicalinformation privacy policies. We distinguishbetween a minimal conception (...) of privacy that webelieve is shared by Japan and other societiesand richer conceptions of privacy that oftenreflect patterns of behavior distinctive ofparticular cultures. Although Japan and othersocieties share at least a minimal sense ofprivacy, a base on which to build, robustprivacy protection will not exist on theinternet until an internationally accepted richsense of privacy is developed. This paper deals with intercultural aspects of privacy, particularly with regard to important differences between Japanese and the Western views. This paper is based on our discussions with Rafael Capurro – a dialogue now represented by two separate but closely interrelated articles. The companion paper is broadly focused on the cultural and historical backgrounds of the concepts of privacy and individualism in “Western” worlds; our main theme focuses on different concepts of privacy in Japan and their sources in related aspects (...) of Japanese culture. The interrelationship between our two papers is apparent in our taking up identical or similar topics in each paper. Reading our two papers in conjunction with each other will bring about deeper and broader insights into the diverse values and worldviews of Japan and Western cultures that underlie concepts of privacy that at a surface level appear to be similar. PurposeThe purpose of this paper is to analyse incidents of personal information leakage in Japan based on Japanese socio‐cultural characteristics of information privacy and to consider how best to develop an effective personal information protection policy that conforms to Japanese situations as well as to the global requirement of personal information protection.Design/methodology/approachAfter describing recent incidents of personal information leakage in Japan, the paper examines the defects of the Act on Protection of Personal Information that permit these incidents to continue. Subsequently, (...) these incidents and the responses of the Japanese people in a manner that reflects the unique Japanese socio‐cultural characteristics of information privacy are analysed. Finally, the paper proposes a revision of APPI that conforms to these Japanese socio‐cultural characteristics as well as to the global requirement for personal information protection.FindingsPersonal information leakage cases and social responses in Japan reflect three Japanese socio‐cultural characteristics: Uchi/Soto awareness, insular collectivism and Hon'ne/Tatemae tradition. An effective law protecting personal information in Japan's cultural environment cannot be made simply by copying the privacy protection laws in western nations. Instead, legal protection of personal information should be drafted that reflects and takes into account these socio‐cultural characteristics.Originality/valueThis paper conducts analysis of incidents of personal information leakage in Japan based on Japanese socio‐cultural characteristics. A revision of APPI is proposed on the basis of the analysis. The paper's analysis and proposal would provide a good clue to develop effective measures to protect personal information and the right to information privacy in the global, multicultural information society. For more than thirty years an extensive and significant philosophical debate about the notion of privacy has been going on. Therefore it seems puzzling that most current authors on information technology and privacy assume that all individuals intuitively know why privacy is important. This assumption allows privacy to be seen as a liberal “nice to have” value: something that can easily be discarded in the face of other really important matters like national security, the doing of justice and the effective (...) administration of the state and the corporation. In this paper I want to argue that there is something fundamental in the notion of privacy and that due to the profoundness of the notion it merits extraordinary measures of protection and overt support. I will also argue that the notion of transparency (as advocated by Wasserstrom) is a useless concept without privacy and that accountability and transparency can only be meaningful if encapsulated in the context of privacy. From philosophical and legal literature I will discuss and argue the value of privacy as the essential context and foundation of human autonomy in social relationships. In the conclusion of the paper I will discuss implications of this notion of privacy for the information society in general, and for the discipline of information systems in particular. (shrink)
